  1. Hi, David here, and I am new to the site and looking for advice. I had a £11,000 debt with Barclaycard and through advice from CCCS, set up a £1 token payment agreement, as I am on Pension Credit and completely broke !! This has been in place for 12 months, but has been taken over by Link Financial, and today I have received a letter from IDR Finance telling me that they have been assigned my account. The letter is not threatening as such, but I now wonder what the next step will be ?? If anyone has had a similar situation, I would be grateful of advice. Thanks...................
  2. Hi all Just had a letter from Lowell on behalf of barclaycard. It says its a statement of my account dating back from 01/10/2008. To be honest i had completely forgotten about this. The balance is £931.72. Ive not paid a penny on this since 2008. And they have even spelt my first name incorrect. Its not even a threatening letter just a statement. What can I do about this?   3. Hi Eveyone, Has anyone successfully reclaimed Barclaycard FAP (Family Accident Plan)? I was pressured into buying the cover, even though I lived with my parents at the time and had no dependants. I gave in after about half an hour and agreed to have the free trial. The lady gave it the "you can cancel it in two months" line, and being young and weak, I agreed to it, really just to get her off the phone. I remember being asked "how would your family cope paying off your debts if you died?" The only debt I had was my Barclaycard, and that only had a limit of £300. And my parents were pretty secure financially anyway so I'm sure could have paid for my funeral. I cannot think of any one else that would have needed financial assistance had I died. In addition to this, I also believe that I received some cover through work anyway at the time. Admittedly it was about 10 years ago, but I don't remember beng asked about any existing medical conditions, or if I had any other cover through work etc. I do remember it being a very pushy persistant phone call. It was also a real nightmare to cancel the policy. Even though it showed on my Barclaycard statements as Barclaycard FAP, they would not let me close my account until I had cancelled the policy directly through the insurer. It would be great to know if anyone else has reclaimed this cover successfully.
  4. Hi Everyone, I'm desperate for some advice. I have sent a SAR well in truth I have sent about 5 letters over the past year and made numerous calls to Barclaycard about a card that I help from 2000 until 2005. I have finally received statements from 2004 until 2008 (even though I closed the account in 20005 and never received any further statements), which included some charges. Generally anyone in Customer Services couldn't find my card details, even when I advised them that they would only fin the information on their Pre-Qual system, I have been sent a print out of this previously. They have also told me previously that between 2000 and 2001 I had PPI cover. I am wanting to claim back charges from 2000 - 2005 and have read previously that the older statements are likely to be on microfiche, is this correct? If the account was kept open until 2008, presumably all records should be kept for at least 6 years? If they dont have the statement information, how would they be able to calculate the PPI that was in place? Please can you let me know what I should do now? Many thanks, Dan
  5. Hi Everyone, I'm hoping for some advice, I have been chasing Barclaycard for what seems forever to try and reclaim PPI and Charges on an old Egg card. I took the card out in October 2004 and it went into default about a year later. Eventually I received the SAR information and had £60 worth of charges, and a couple of hundred pounds of PPI premiums. In addition to this, there was a two page list of tranactions relating to the November 2004 transactions, if I add up all of the transactions and add them to the opening balance, there is a £611.40 difference between my total and the closing balance. It may be that the transactions have fallen of the bottom of the page, but I would obviously like to know the details in case there are any charges of PPI premiums in there. I sent in three seperate letters in the same envelope, requestinging the refunding of the PPI, the Charges with interest, and the details of the missing £611.40 and that if they cannot provide me with this information then that element of the debt should be removed. Yesterday, I received a leter from Barclaycard advising that they could not establish if the CRP policy on my account had been mis-sold so they would like to return me to my original position. They offered the following: - Refund of Premiums: - £278.01 Refund of Interest charged on CRP Premiums : - £12.31 8% Simple interest per annum: -£174.19 As I am still in debt to them, they have said that the Refunds will be deducted from my debt, but that I will receive the Simple interest. This seems fair, however, I also received a second SAR information pack from Barclays yesterday, relating to an old Barclaycard. This included details of a the Egg card, with a balance of £0.00. When I went back further, I found a statement for the 1st December 2011, which had the following entries: - Closing balance of last statement £1,708.87 CHRGOFF PRCH PRIN BALM, 04 NOV £1,708.87 TOTAL OF NEW TRANSACTIONS £1708.87CR The present balance is shown as £0.00. I am currently paying approximately £20.00 per month to CapQuest, and the account says on some of the card holder account details print out that the account became delinquent at the end of 2011. Please can anyone clarify if I still owe Barclaycard money, or if it has been sold on to CapQuest? If the debt has been sold on, can Barclays withold the refund of premiums agains the det??? I have also spoken to Barclaycard requesting that they refund the cost of my numerous calls and letters and have been told that I will receive a call back within 48 hours to discuss this. Dan

After too many years of running to stand still I am writing to Barclaycard to tell them I will be making a token payment of between £1 and £5 per month in future as I am too hard up to pay the true minimum payment of around £50. I have recently skipped paying a couple of months so the phonecalls and letters have started. I will also be sending off a SAR because I have recently noticed that because my credit history recently is not too good they have reduced my available credit to £0 and are charging me £12 pcm for the privilege! Type of Debt: Collecting: Moorcroft ('Acting on behalf of' Barclaycard) Status: Default (18/07/12) Balance: £7075.00 (as per credit report) Last Payment: Token payment on June 2012 06/01/13 Request for CCA & 25% F&F offer sent to Moorcroft. 09/01/13: Acknowledgement letter received from Moorcroft. 02/02/13: Counter F&F offer of 90% of balance due, valid for 10 days. - I did not respond to this letter. 12/02/13 Received a letter from Barclaycard showing: a) Statement of my account (balance and current status). b) Reconstituted copy of my credit agreement.( Online agreement so no signature but also no "tick box"?) c) General terms and conditions. Is this all ok? Where do you think I should go from here? All help is appreciated.
  8. HI Caggers! I need your help with this! November last year, I had received my initial FOS assessment in my favour about PPI complaint registered against Barclays. On 18th of February 2013, I received another letter from FOS informing me that Barclays contested the decision for the reasons below: please find letter sent by Barclays to FOS. i never had anyone either on phone or face to face who explained to me anything about the PPI policy. it came through the post & i signed it off to them. Dear Sirs We refer to your assessment in relation to Mr xxxx complaint concerning the sale of payment protection insurance (PPI). Please accept our apologies for the the length of time it has taken to respond to your letter. My understand of your assessment is that you believe the complaint should be upheld because you feel that reviewing the Payment Protection Insurance (PPI) policy element of their Barclaycard is not clear from the evidence available that the policy was optional. We have reviewed the complaint relating to the purchase of their PPI policy and have identified that their application form was completed over the telephone with one of our advisors. We believe that our evidence suggest that the optional nature of the policy was made clear to the customer. We have set out below our reason for this, using both our generic evidence and where applicable customer specific evidence. Sales Process Evidence We note that the Payment Protection Insurance was sold 2003 over the telephone. Attached is a copy of our telephone sales script and attach this in appendix 1. We note the following from this script which indicates the optional nature of the policy: · The customer was required to give positive or negative response when asked if they would like to take out PPL policy; · Following positive selection, we in addition make the customer aware of their right to cancel within the first 30 days without obligation; · Even following a positive response the customer is requested to reconfirm their decision;4 · We also note that at no point customer is informed that the policy is obligatory in order to take a Barclaycard. Following positive selection for PPL, a pre-populated Application Form will be sent to the customer following the conversation. We attach in Appendix 2, 3 copies of Application Forms use during this period. We will have sent our original submission a copy of the application form if we hold on file, howeverdue to age of sale, we may not retain copies. The Application Forms are per-populated for convince the customer’s decision. Sections required, then there was further opportunity for it to declined at this stage. In this instance, acceptance was confirmed by signing and returning this documentation to Barclays. The customer would then the application form to the insurer’s, who would review it and if the application was accepted would forward a certificate of insurance to the customer. The certificate of insurance confirms the full terms and conditions of the cover, including all exclusions and highlighting the right to cancel cover within the first 30 days without obligations. As a result of the sales script used, the process following the initial sales call, and the fact that the customer’s recollection of the complaint does not indicate his script was not used, we believe this is sufficient evidence to demonstrate the optionality of cover. Customer Specific Evidence in addition, we note from our investigation, that the customer has not provided any evidence or any testimony that indicates the customer was unaware optionality of the policy. Conclusion In summary, given the above, we do not agree with your assessment of this complaint and would ask that the point raised is considered. We await response In due course. Hi Cage, not sure which forum this belongs to but here is my issue in brief: Northampton CCBC Claimant MKDP LLP not Barclaycard Particulars of claim states account assigned to MKDP LLP - NO DATE ? looked on credit ref files and info stated on Experian acoount ended in XXXX X but that is not the account number for the card ? particulars of claim number is correct though. Experian 1st entry May 2012 as a straight default without any communication from them ? Equifax & Noddle 1st entry Jan 2012 as a straight default again without any comms?? Last full account payment to Barclays was Oct 2011 when we an agreement was requested as considering a debt consolidation company, did not do this , so wrote to Barclays, SAR, with a view to reduce the balance as much as poss with the payment recieved, no response, non SAR letter sent 3 months after still no response, another non SAR letter sent June 2012 still as of today no response now this. No default from MKDP, I suppose they will make some letters up and send upon request ? Please any help would be gratefully received, panicking and worried to death AG
  10. It's quite a long story so I apologise now for that. Maybe it will help someone else out there though. I found that I had PPI on my account in 2006 and cancelled it. I didn't know I had it before that time as I was an idiot back then and didn't open my statements for years because I was scared of my balance. I just kept paying the minimum amount and kept my head buried in the sand. In 2006 a good friend told me some home truths about my debts and made me sort myself out. So I cancelled the PPI when I opened my statements and found it. then I went into an arrangement with Barclaycard where I would pay just 1% interest. This was then restored to normal interest in January this year as my balance is now £650 and I am no longer in difficulty. Anyway when all the PPI thing blew up the the media it struck a chord with me because I couldn't remember that I had applied for it or discussed it with anyone. So I wrote to Barclaycard asking for a copy of my original application. They sent me a copy of the form I signed in 1991 when I opened the account. There was no mention of PPI anywhere on it. I then filled in the PPI questionnaire and sent off my complaint in January last year. By the end of July last year I received a rejection letter from Barclaycard claiming that I had ticked the box on the postal application form. This did not concur with the copy that they had sent me. My Card was upgraded from a standard card to a Gold card some time around 1998 give or take a year. They asked me and at the time I thought it was a good idea so I accepted. I still have no recollection of PPI being discussed or applied for but I wonder if it was at this point that it was added. After the rejection I sent a complaint to the FOS in August last year. In November they called me and said that Barclaycard would make a goodwill offer of a full refund of all PPI payments plus 8% simple interest. I was very pleased with this outcome. In January this year I received a letter from the FOS confirming what they had said to me on the phone in November. Then I heard nothing until this morning (7th March) when the letter arrived from Barclaycard with the offer. Sadly two years ago my Girlfriend made me get rid of a load of stuff I was hoarding when we moved in together. This included shreading all the Barclaycard statements I had saved over the years. In hindsight a very bad move. I remember the last PPI payment I made in 2006 was around £25. My card was always maxed out and they kept increasing my limit. Sadly I cant prove anything now! Today's offer was as follows: Refund of PPI Payments: £1217.28 Refund of interest charged on premiums: £237.63 8% simple interest: £863.49 Total: £2318.40 I'm sure I'm due more than this but due to the big shred-fest I haven't a leg to stand on so I guess I should be grateful for that! Lessons learned: Keep your records because you never know! Open your statements and study them! Don't be afraid of your debts, free help is available, do it now! Read everything (even the small print) before you sign it!
  11. Hello Had a very nice conversation with a young man from Barclaycard this evening because he informed me that my old Barclaycard had PPI and was mis-sold. He mentioned that the offer letter had been sent to my old address, and now he will send the letter to my correct address. The only problem is, he states a figure of about £600-onwards in PPI payments and totals to about £1500 with interest. I know its absolute rubbish offer as I have too many statements with PPI £25 approx Exceeded Limit £20 Late Payment Charge £20 My question is should I be contesting two of the above charges with this with my PPI claim, or is court claim, Note SAR sent awaiting all details before anyone mentions.   12. Hello, having read a lot of the posts on here I thought I would begin my own so I can keep you up to speed but also get some ideas from other people in the same boat. Brief history as follows: November 2012: SAR sent to BC in with covering payment. Letter sent recorded delivery. Janaury 2013: Log complaint that no SAR recieved, Customer Relations Manager manages to send me statements through post. Still deny ever receiving SAR and payment, told to cancel cheque. February 2013: Statements arrive, not a complete set, and no other SAR information as promised. £10 credit onto card for cost of calls. February 2013: Cheque cashed 82 days after sending it! February 2013: Complaint now passed to higher level. Paperwork is now being "rushed" thorugh due to "delays" March 2013: Letter states that SAR and payment were "not processed by BC correctly" Paperwork will be completed and sent in "2 weeks". £50 credited to my card, even though balance is £0.00!! So thats where I'm at right now, clock is ticking and follow up paperwork already written in anticipation that I wont receive correct and complete paperwork. I have entered the data from the statements I have already received onto the spreadsheet, but without them all, its not really a true estimate of what I can claim for.
  13. Hi , I had a morgan stanley credit card from 2003 that had ppi, it then got moved to goldfish to barclaycard with ppi still in place. who should i ask for the ppi to be returned, barclaycard or the individual companies?

I have paid off a debt firstly with Barclaycard and then a few years later Lowells got in touch and said there was an outstanding amount still, I (stupidly) agreed to pay this off as well, I did this over three months last year. If only I had known what I know now having read these forums I would have put up more of a fight. The account is satisfied, as per a letter from Lowells received today after I queried it, but is still showing as defaulting they say that as it has a defaulted history they cannot mark it as satisfied...is this true? If so why are some of my old overdraft debts marked as satisfied, with a date of default also on it as well. This is all on Experian which is the one that Lowells say they use. Also can I reclaim charges added to this account even though I have settled it? I don't mind if I can't put will attempt it if I can!! Thanks to all you beautiful CAGGERS! x
  15. Hello, wondering if anybody can help me out here. I have been chasing Barclaycard (was Egg credit card) since November 2012 for my SAR, they denied ever receiving my request and since January my ongoing complaint with Barclaycard has been escalated to a Level 2 compliant. During one of my many phone calls I was told to cancel the cheque I enclosed for payment of the SAR. Then on the 14th February 2013 the cheque is cashed, 82 days after posting it. I was on the phone for over an hour attempting to explain my issue with the call centre staff and was finally put through to the complaints department who advised me that I would receive a call this evening by 4pm. That call did not arrive. I have previously requested all copies of phone calls between myself and Barclaycard so I can present it to the FOS and ICO but Barclaycard have told me I am not entitled to them. Is this the case? I recall a few years ago a work colleague was able to get a CD containing phone calls between himself and an insurance company. Does anybody know how I can go about getting these conversations as it will prove my case that I have been lied to at least 10 times since I began my complaint with Barclaycard. I keep written notes of all conversations and have begun to record them myself, but its the older ones I need. Thanks.

  17. Hi I have been in a DMP with StepChange for about 4 months now and it seems to be going fine - the threats/chasing letters are drying up. Most of my debts were defaulted in 2011/12 and have been passed to DCAs. My account with Barclaycard was initially passed to Mercers (who I believe are part of Barclays) and I received a default notice in December 2011. The debt was then assigned to IDR Finance and is run by Link Financial. When I check my equifax report (yet to do experian), the account does not show as a default - rather a series of status '6' since April 2012 (it is showing as Link Financial, not Barclaycard). I know this isn't a good situation and need to get it changed to a default (at least then the clock is ticking towards the 6 years). Surely if a default has been issued it should be reported? What is the best way to get this rectified? Do I write to Barclaycard, Mercers, Link or Equifax or all 4? Are there any templates or is it a straightforward letter describing what has happened and requesting the status be changed to default with a date of Dec. 11? I have seen a number of other threads re: defaults and CRAs but they do not quite address my questions... Thanks
  18. I previously had an Egg card which was taken over by Barclaycard with new card etc issued. The account is completely online and is paid off fully by direct debit. Statements are intermittent and not always notified by email. I have been hit by overlimit charges on several occasions - something which Egg also did whereas other card companies do not authorise transaction. I know that Egg managed to justify such a charge with the FOS by some means so there is little point in making a complaint there. £12 seems an excessive charge for what is an automated process Has anyone any experience of these charges and any challenges to them? Any success in small claims court?
  19. Had an LPF Credit card which i disputed strongly the amount owed, which was been dealt with by Loewlls so i asked them for a CCA Request. Now because they couldnt supply it they closed the account, and this morning got a reconstituted agreement from Barclaycard saying i still owe it and although they can't enforce it they can still ask third parties to demand payment. What should i do next please. Thanks in advance.
  20. Hi I am new to this site although to date my friend who is a member has beenhelping me. Due to circumstances, my friend is no longer able to help so I amnow going alone. I have an outstanding debt with Barclaycard and i stopped paying lastAugust. I wrote asking for a copy of my agreement in September and received aletter from Barclaycard saying they would answer me shortly. However to date I have not had a reply, only letters from Mercers and manyphone calls from Barclaycard which i have ignored. Today, I received a Formal Demand for Payment letter giving me until friday8/2 to pay the dept in full or reach an agreement with them, or else they maypass my account on to a specialist collections company and a localrepresentative may call on me. I moved in with my mum 2 years ago when my dad died and i really do not wantanyone coming to the house. Please can you suggest what action I can now take. I have read that I could request a full history of my account for £10 buti'm not sure if it's too late to stop Barclaycard taking the action threatened. thank you for reading this and i look forward to any replies B
  21. Received a few hundred pounds off them today in compensation following my formal complaint regarding their treatment of me and refusal to only contact me in writing. I'll give them their dues though they swiftly responded to my formal complaint and admitted where they went wrong etc.

Hello Some advice please would be appreciated with regards to Credit Agreements and PPI I have a copy of my Old Egg Card Agreement dated 28/01/2001 - Amazed I kept it but its the only CC I currently have which is now with Barclaycard The first page of the Credit Agreement has a section on PPI ---------------------------------------------------- Limit x Interest and Credit Charges x Repayments x Your Repayment Protection premium is payable to the insurer at 69 pence per £100 of your monthly statement balance for the accident, sickness, unemploymen, life and serious illness cover you have choosen in accordance with the Egg Card Repayment Protection Policy document supplied to you The argument I am currently having with Barclaycard is they state that PPI was optional on the Credit Agreement, and I am stating the following No sign of the word optional against the PPI details on the first page of the Credit Agreement or maximum amount on the credit agreement I was made to feel that PPI was not optional once again after the on-line application with its pre-ticked box No where did it say interest would be added to the PPI I could only cancel the PPI policy if I took out a new credit agreement - this is now considered to be unfair by the FSA Are my arguments valid, I appreciate any comments and differing opinions, thanks in advance
  23. Hello Guys, I'm having real trouble with Barclaycard, who bought the credit cards of Egg sometime in the last few years. I'm presently in a DMP and paying back at a rate I can afford to, however every month Barclaycard continue to add more interest/fees to the account because they claim the funds I send through my DMP (PayPlan) don't arrive until after the due date. This means that my account which should be £58.98, instead sits at £104.43, not a massive difference but this continues to climb every month, despite conversations with them about what's going on, my forced home move (caused by a landlord divorce) and an assurance that fees/interest would be frozen to help this is still being added. I have attempted a SAR before but this was returned to me without any explanation as to why, and I imagine if it was successful it would clear the debt I presently have with Barclaycard freeing up the money to distribute among my other creditors. Does anyone have any advice on what to do here, PayPlan are suggesting I speak with Barclaycard directly but that feels like talking to a brick wall at times, more so with their outsourced call centres seemingly trained in high level sarcasm.
  24. Good Afternoon, In 2007 i started a dispute against barclaycard for misold PPi, and charges. This was at the time that everyone was chasing bank charges so it took them longer to reply to everything. Well eventually they wrote back stating they was putting all claims on hold until the big court hearing and that they would get back to me when the final outcome was known. I accepted this and awaited and never got no reply, in the meantime they passed on to a recoveries agency, i wrote to them and sent all documents etc i had sent to barclay card outlining the dispute, they actually appologised and sent the account back to barclays. At this point i wrote to barclays again, computer screen printouts sent to me recently from barclays confirm that despite the dispute being acknowledged by barclaycard, 3 days later they sold it to 1st credit. 1st credit hounded me so copy of dispute sent to them. They stopped hounding me but continue to mark on credit files every month for nearly 5 years as default, and every christmas send me a statement of account. Barclays meanwhile despite sending all documents, spreadsheets etc continue to ignore the dispute, saying they need statements etc to process, although they had been sent them over 6 times with the follow up letters etc, now Barclays admit they was in wrong, and agreed to pay 872.00 in PPi back which includes interest at rate charged and also 8% interest, ( although don't match with my interest added the amount is only 100 quid off ) they have also already agreed to pay back £8.00 for every £20.00 late payment charge etc. When i get that final amount in it is more than the £1125 debt they unlawfully sold. So although i am happy they have 6 years later finally nearly resolved my dispute, i still have a default every month for the last 5 1/2 years for the amount which i didn't owe. Is it best to refuse the ppi and charges offered and tke it to court so that i can get the defaults deleted from my records or accept the offers ( I'm not signing their acceptance forms, will write my own ) or accept the offers and then try get them removed afterwards, so far 1st credit have refused to pass the account back, refused to delete the default notices and refused to stop further recording of default notices etc. any suggestions would be appreciated
  25. Hello, Looking for some advice please as Barclaycard are ignoring my requests to provide me with all of my credit agreements for both Barclaycard and Egg Card -SAR sent. They have acknowledged that they are perfoming a SAR on my current Barclaycard that I have with them but have ignored the old Barclaycard that I had dating back in 2006-2009 and also stated that they did not obtain any dormant accounts from Egg. My 2 x Egg cards date back to 2007 and 2009. I have sent them all of my details including full name, d.o.b and previous addresses but they are saying that they cannot locate my details which I know is a fob off. What steps should I take next as this has already been going on for a couple of months. I have also provided them extracts from my current account showing DD payments to verify the period that I had these cards with them? Thanks for your assistance Jon
