Hi Could someone tell me what happens when one of two business partners dies? My friend's husband (I'll refer to him as K) died in May and he was in business with his sister, running a café. The partnership was not a formal one - ie no agreements were signed (I know - WHY?!) but K did pay a sum to his sister to "buy in" to the business. K died intestate (again WHY?!). As you might imagine, this is causing a whole host of problems for my friend and I'm trying to help her unpick the knots. My friend believes that her husband's 1/2 share of the business is part of his estate (which is in the hands of solicitors). My friend believes that the business should be valued and sold, with funds being split between the sister and K's estate. The business was put on the market before K died, but overpriced and has not sold. The sister refuses to bring down the asking price. The sister maintains that if a valuation is required, then the probate solicitors should arrange it and pay. The probate solicitors don't seem to be addressing this issue and are being extremely slow. My friend is concerned that the sister is continuing to run the business as though nothing's happened, and is taking all the profit. She could engineer the accounts to appear that it is making a loss and therefore of no value for the purposes of probate. The sister has continued to run the business, and obviously take all the profits. This strikes me as unfair and surely K's estate should have either 1/2 the business value or 1/2 the ongoing income. It could not be both, so the same should apply to the sister, surely? When a partner dies, is there a requirement to sell the business? Any advice would be massively appreciated Thanks

I hope someone can help. My daughters husband had a vasectomy 2 weeks ago today.. All went well on the day. He was fit as a fiddle. Two days ago he was complaining of stomach pain sickness and Diarrhea. also he hands and feet were numb and he was a strange purple colour. This was on the Wednesday at 11 am and my daughter phoned the gp who said it was a gastric flu...She said she wasn't happy and could he make a house call whereupon she was tod they don't do house calls. In the space of time it took to get her 3 year old from nursery and get back some 20 minutes her husband was dead ..She tried cpr and the paramedics tried but he was gone. There will be a post mortem but the coroner thought it was probably a massive bacterial infection from the vasectomy which turned into septis and it killed him in less than 4 hours.. The day before he had been fit and healthy at work.. we will know for sure on Monday My daughter has lost her best friend and is beyond grief they had 7 children and they have lost their dad. were are in complete shock don't know what to do next....will my daughter be able to sue and get some help for her and the children...They have lost the main breadwinner more importantly will we get answers thanks in advance for any advise give

Wondering if anybody can help, our house was bought in my wifes and her mothers names, it is fully paid off, (no mortgage etc) but my wifes mother recently passed away and we dont know how to change the ownership, we were told to just use land registry but cant find anything on there that fits the bill any help appreciated

Not quite sure where to put my question since I have been searching the net for an answer, but here goes:- I have a charging order (or a restriction since the house in joint owned), which was put upon by a landlord whose building i was leasing for business. So its a private individual who has put a charge on my house. Now my question is what happens to that charging order if the landlord dies? Do I still have to pay the debt to get the charging order off the land Registry? Does one of his family member get the ownership of the charging order? Any actual facts to my questions would be much appreciated, thanks.

hi, not sure if i am in the right place here, sorry if i am not. my dad does not have long left to live, he has approximately 55,000 in savings that he wants to split between his 3 kids, his wife passed away two years ago, as far as i am aware we are his only living next of kin, he has said he is going to write a letter stating that he is of sound mind and body and that in the event of his death he wants his money transferring from his account into my brothers account (who will then split it between the three of us) question is, how do we go about sorting this out once he has died, and will the letter be sufficient?? thank you for reading, any help will be very much appreciated, thank you

I hope I have posted this in the right place. I am involved with a partnership which owns a couple of houses on a buy to let basis and one of the partners has died. We are concerned that his estate could take over a year to sort out (it seems very complex) and have tried to contact his solicitor who seems to be pretty ineffective (and that's being polite) but got nowhere - he may even have frozen the partnership bank account. Before we contact our own solicitor are there any pragmatic steps we can take to protect our tenants (as students its getting close to lease end) and make sure that they, through no fault of their own, experience any hassle as a result of this and also to protect our own interests. Thanks in advance for any advice.

Actor Herbert Lom, best known for playing Charles Dreyfus in the Pink Panther films, has died aged 95. The Czech-born, London-based actor starred opposite Peter Sellers in several films as Inspector Clouseau's irritable boss. Lom appeared in more than 100 films during his 60-year acting career, including such classics as The Ladykillers, Spartacus and El Cid. His family said he died peacefully in his sleep on Thursday. Lom also portrayed Napoleon Bonaparte on two occasions. One of them came in the 1956 screen adaptation of Tolstoy's War And Peace, also starring Audrey Hepburn and Henry Fonda. He first appeared as police chief Dreyfus in 1964's A Shot In The Dark, a character who became increasingly mentally unstable as a result of Clouseau's incompetence as the films went on. Lom was born Herbert Charles Angelo Kuchacevich ze Schluderpacheru in Prague in 1917, where he grew up and attended the city's university. Link: http://www.bbc.co.uk/news/entertainment-arts-19745910
