  1. Hi all. I've received a Notice of Enforcement from Marstons for a recent CCJ for my unpaid water bill. I was out of work for a while, recently back in full time work and trying to pull my head out of the sand. The notice states that if I don't pay or make a payment arrangement by 23rd June an officer will call. I tried calling the water company (United Utilities) first, and they referred me straight to Marstons. I called Marstons, made an offer to pay, first instalment on the 25th when I get paid and they have advised that an officer will still need to visit "to make sure that I can't pay the full amount". I asked the woman on the phone if this was necessary, as the letter stated I had to make a payment or an arrangement by the 23rd, which I have tried to do, and she said that it's just part of the process. I don't want someone to visit as it adds an extra £200 plus onto the debt. Does anyone know where I stand with this? I have every intention of repaying the debt, but could really do without them adding to it. Thanks in advance.
  2. hi i had a visit this morning from two women bailiffs from marston they tried to force their way in my property while my young children were screaming for a debt that isn't even mine when i shown id thy wasn't bothered they said we can still force entry i refused and stood behind door so they couldn't get in my daughter was late for school because i couldn't get her out in time because of them after 35 mins they finally took their feet out my door which i slammed shut they then said they will be back with a locksmith to gain entry and remove goods even though i have proved this is my property im worried that they will come back and just force entry

Hi, im sorry this is a rather long story but i really need some legal advice... my husband had a tenancy in his ltd co name with a pub company. when he passed away 2 years ago the pub co regional manager asked if i would continue with the pubs, he had another one at the time with them. Both pubs were struggling and i told them i wasnt sure. They assured me of financial and business support. Obviously they didnt want two closed pubs on their hands and i felt a responsibility to my husband to keep them. i struggled to manage both pubs without my husband and trade suffered due to various different factors. The rent support never happened and they often held me to ransom refusing to release orders without full rent payments. At the time the rents were over £1000 per week on each pub and we were trading at just over £2,000 a week so not hard to work out why struggling. I ended up putting around 50k of my own money in as each week unless i paid the rent on both, i couldnt have any beer and if bought from somewhere else they would fine me then refuse the next weeks order until that was paid!!! They never so much as kncocked a penny off anything, i paid full cost on rent for both pubs for the 15 months it took them to transfer in to my name despite having my name on nothing. they lied to me about what rent deal they would do on the new lease and also refused to give me proper credit terms etc. as a result and having at their insistance put a brand new deposit down on what was already my pub my cash flow took a battering and im now on the brink of closing altogether. various people i have spoken to have told me that they should not have let me trade for the 15 months it took to transfer then pub into my name as the tenancy was in my husbands ltd company name which legally shouldnt have traded after he died since he was the sole director And my name was not on anything. Is this true and if so can i do anything about it now? thanks...S
  4. I paid a fine with the court for £145, albeit a few days late. For a speeding fine. My partner has his car clamped by the HCEO for an outstanding amount of £310. How can it be so high? He has to prove he is the owner for them to remove the clamp but say they will do so today. The car isn't mine but has been clamped because of the fact I owe £310. What can I do?
  5. Hi, my brother in law came home yesterday to find that a 'Removal Notice' had been posted through his door from Marstons. He is certain that it stems from some unpaid court fines from some time ago, which he admits having not paid. Long story short he was going through a very rough time then, with lots of issues but is now beginning to get himself sorted. Since the fines were issued originally he has been moving all over the country and has consequently never received any notice of intended action or chasing of this debt until this letter received yesterday. He understands that the fines need to be settled but cannot tell how much of this £1500 odd is actual debt and how much is Marstons fees. He is renting a room in a privately owned house, with virtually no countable posessions to speak of. I'd like some help with advice on the following points: Do Marstons have a right of entry given that nothing in the house belongs to him? If they turn up should he try to prevent their entry or 'welcome' them in on the basis that there is nothing in the house that he owns apart from a small crt television and a portable stereo? The owners of the house are being very supportive through this and although not in a position to pay the debt for him will not throw him out because of it. If Marstons turn up and he is not there what should they do? Is there a way for him to get this back to the courts so that he can make a voluntary arrangement to pay by installments, possibly avoiding what we think are substantial fees and charges added by Marstons? And anything else which you think he should be doing to get this resolved. I'm sorry for all the questions, but after years of worry about him it's good to see him getting back on his feet and it would be a real heartache if this sent him back. Thanks in advance.   6. Marstons turned up on my door step yesterday, regarding a magistrates fine for not returning the log book slip, after selling a car. My 16 year old daughter was in at the time, she didn't open the door, but said that the 'officer' had threatened to force the door open. .which obviously scared her. I called the 'officer' today to see what my options were for repayment. He said that because it was a magistrates fine he could not agree any payment arrangement. He said that he would give me till tomorrow to pay it. But if it had been a county court, then it would have been a different case. Does this sound right?
  7. Marstons, acting with a High Court writ, have amassed over £500 of additional costs on top of the bill for £1,300 (water I never used, faulty meter no doubt but I can't prove it). I have simply been unable to pay - about 8 eviction attempts over the last few years from hideous rip off mortgage lenders and since all my money went to clear those arrears, now an Attachment of Earnings for Council Tax as they want their money now. I have absolutely nothing of any value and I have emailed Marstons to tell them that. No car, 14" TV that I bought secondhand for £25, no iphone, no sound system, no jewellery. Nothing. They have been once (neighbour says a guy knocked on the door) and that cost me £295 more. Should I just let them in to see that I have nothing? Otherwise every time they come back it will presumably be another £300. I am happy to pay a little, but simply cannot afford more. AW refuse to take the debt back. So they are giving money to Marstons which they could have had. Makes absolutely no sense whatsoever to me. And as a woman alone the whole process is terrifying.
  8. I have today been visited by Marstons bailifffs in connection with an unpaid fine. The dilemma I have is that I had a fine which was paid in December 2014 for £70 and upon speaking to the bailiff I was told the original amount was £70. However they say it must be for a different fine. I have proof that I paid £70 in December of last year but I cannot find a matching reference from my online banking that relates to the visit from Marstons. They are now claiming £380 from an original £70 fine which I beleive are one and the same the question I have is how do go about finiding the information I need to stop this. I have 48 hours grace from Marstons before they say they will enter my home with locksmiths if neccessary to remove goods. Can anyone help?

Hello I need some help please I worked for a company selling insurances back in 2011 in august 2014 i received a county court letter saying certain people had cancelled there insurance meaning they were clawing back the payment already made to me this was the first i knew about it, a cci was obtained in september 2014 and they have now issued me with a Notice of enforcement thru marstons the enforcement is claiming the money i owe plus £90.00 for compliance stage it also say about enforcement details high court writ of control based upon judgement obtained against you by ****** in september Do they have the power to force there way into my home and remove goods now?
  10. I use my sons car occasionally and managed to get a parking ticket, actually had a couple and got them quashed, and am paying one off at £1 per week to the City Council. Where I parked has a reputation for tickets to go missing, and thats what happened. At the end of the financial year the council in their wisdom send them to northampton and i didn't receive paperwork or son didn't or he misplaced it so it went to Marstons. I acknowledged it was mine and sent them the letter from my son to allow them to talk with me and a copy of my benefit letter, and they have taken no notice of my benefit letter at all. We've been playing email ping-pong Now they're not taking any notice that it mine and going after him again when I sent them an email stating my payment offer of £1 week as the other I am doing. How should I proceed. I feel like doing a full blown complaint
  11. Hello, I'm looking for some help regarding a notice of enforcement I've received this morning for my ex partner. It is for a court summons for tv licensing which I received to my address after we split up, when I received it I phoned the court to inform them he wasn't at this address but stupidly didn't say he was my ex as I don't have a clue where he is and thought at the time it was better to just say I was a new tenant (I know,very stupid) they told me to return the summons and I thought that was the end of it but this morning I've received an enforcement notice from Marstons. I phoned them up and stuck to the same story that it must have been a previous tenant as I thought I can't change it now in case they find out I've lied...they told me I have to send in evidence that I'm not the person named and they will do some checks to confirm that the evidence I provide is legit. My fear is what will happen when I send it off? What checks can they do? I'm going to send my tax credit award notice which has my own and my new partners names on but will they check anything with HMRC? Please help I don't know what to do and I'm frightened if getting into trouble Thanks in advance for any advice
  12. Just had a visit from a bailiff from marstons to my mums address who proceeded to explain everything to a 17 yearold who answered the door!! All this on her camera apparently. She told him that she was entiltled to come in and remove goods from my room for a court fine I had failed to pay which I did try to sett up a payment plan but they refused. I have been on benefits as was unable to work. This is a high court distress warrant and she says she is coming back on friday or saturday to remove the goods. I called her to see if I could set up a payment plan she saidf no she also said that she will be removing goods from the whole of the house as the warrent is on the whole house not just me. All the time my disabled mother and brother were getting agitated and distressed over all that was being said. Please help I need some advice what do I do?? What are my rights?? Many thanks in advance.
  13. My daughter moved into a council property last year, since then she has been inundated with Debt Collectors letters and door stoppers regarding a previous tenant. It has now gotten serious as a Marstons Baliff with a Court order to her house saying that he intended to take away goods to sell at auction (that would be funny as she has nothing of any value). She told them that she has been fighting off people about this guy ever since she moved in, also, she has shown them a copy of her tenancy agreement, she thought that she had seen the last of them, but, at about 7 am this morning they came again with another letter stating that they will attend to seize goods soon. This is absolutely preposterous, she has shown them her tenancy agreement. I have told her to ring both numbers on the letter and to tell them AGAIN that she is not the person that they are looking for, I have also told her to tell them that this is now harassment and she can do now more to prove that this bloke no longer lives there, I have also told her to ring her tenancy adviser at the council to see if they can do anything to help. Is there anything else that I can do to help her? Thanks for your help in advance.
  14. Please bare with me on this as its a little long winded. As Marstons are now involved I thought it best it should be in here, if not then I am happy for it to be moved. Last year before my son moved he had 2 PCN's issued, how ever this was through no fault of his own. He lived in a residential permit area and the council had not issued him with the permit which he applied for in plenty of time. As the one he was using at the time was close to running out he called the perking services and told them that he still hadnt received his permit, he was told by the parking people that he should place a note on his car explaining this until they sent out another. So this is what he did, still no permit arrived and he called again and was told to do the same thing. Well unfortunately he had two PCNs, which he did not see as he was in the middle of moving at the time and PCNs dont stay on cars for very long in that area due to stupi idiots taking them off and placing them on their own cars to stop them getting any PCNs for parking where they shouldnt. Anyway because my son had moved he didnt receive the NTOs to both PCNs, we only found out when a bailiff visited the present occupiers to his old address where the NTOs went to, they unfortunately didnt open the letters and just sent them back, however she got a visit from said bailiff from Marstons, Have to say at this point, bailiff was extremely rude to the lady now living there and scared the life out of her. Even though she showed her CT benefit forms which also proved she was there with just her and her baby, he threatened to return if he hadnt heard anything with regards to the my son not being there. How he was going to do this is beyond me. It was only by chance that I found out about the bailiff visit, so I contacted PS and marstons to find out what the problem was. I explained the situation to the parking people and they remembered my son calling and told me the that the bailiffs have been placed on hold, they admitted it was their fault, however I needed to fill in 2 sets of TE7 & TE9, which I emailed to the TEC, After many many weeks I called the PS again as I had not heard anything, neither had they, so I contacted the TEC via email and a few days later received a letter to say one had been excepted but they had lost part of the other and I needed to re issue it, which i did. I called the parking people and asked if they had received any correspondence from the TEC and they hadnt, but said to make a representation and that they would cancel that PCN. I havnt heard anything from them since then, in fact I havnt heard anything from the TEC either and that was weeks ago in fact at least 8 weeks. They have received the forms via email as I had a conformation email stating that they have them, but I have heard nothing. Today my son gets a letter from Marstons stating that they are going to turn up in a few days time. As far as I am concerned the bailiffs were placed on hold until the TEC had return their verdict, so to speak, which I was fully confident would be the same result as both were identically written. But as I have said I have heard nothing from them. My son is disabled and on benefits and at the moment he is quite poorly, hence why I am dealing with this. Ive written to both the parking people and Marstons explaining this situation and placed a formal complaint with the councils parking people stating that this is not good enough, the time span on this is ridiculous and there has been so many cock ups on their part. I need to stop Marstons from going to my sons house, because this would put him back healthwise and he isnt a very patient person at the moment and I would hate to think what he would do if Marstons did turn up at this stage. Especially when this isnt really his fault in the first place. Is it worth emailing the TEC and asking what they are doing and why they havnt been in touch as it seems from the bailiffs paperwork its the TEC who have involved the bailiffs. As its Saturday I cant phone anyone as no one is open. Looks like I will be making a few calls on Monday to get this sorted ... AGAIN I feel I cant do anymore, but has anyone got anymore suggestions.. Cheers guys
  15. After struggling for years to get my credit/debt all nice and in order, I've had a bit of a bombshell today.. I now own a busy off-licence, and have three staff working for me. just before Xmas last year, I was taken ill and went into hosp for a few weeks, during this time the girls ran the shop, with one of them doing the ordering/banking etc. one of the cash & carry's I use regularly, deliver to the shop every Wednesday and are paid by cheque, as I was not going to be there, I spoke to the manager who agreed to deliver that week and wait for the cheque in the post, I signed one and my OH put it in the post, all sorted. The following week, as I was still hospitalised, I had arranged for the chequebook to be dropped off at the shop, containing two signed cheques, made out to the C&C, but waiting for the amount to be filled in. This went on for a couple of weeks all fine and dandy, until I returned to work. Upon doing so, I opened a statement from the C&C which showed an overdue amount in the sum of just over £3,500, I rang them immediately and asked what had happened. They told me that one cheque hadn't been picked up by the driver the week or two before, and that's why it was outstanding, but that it wasn't a problem, and I could pay it when I wanted. I immediately paid £1500 via my personal debit card over the phone and told them that I'd pay the balance along with the payment for the next delivery the following week. The next day, I was back in hospital, and warned that I should not have returned to work... for the next four months, all went fine, the girls started using another cash & carry that I frequent, as it was near to the home of the girl in charge, and - as she was using the van, it made sense for her to pick up stock and pay cash for it from the takings with the surplus after wages etc being banked. around three weeks ago, the girl informed me that she was leaving, and asked for a reference etc, as she was going back to the NHS, I took this as my leave to return to the shop full time. We parted ways on good terms. In the last couple of weeks however, I have noticed a couple of financial transactions that aren't quite right, and some (small amount) of stock being down (which may be due to an inputting error on the EPOS) Now, to the point (sorry for the rambling) Today, whilst I was in the shop, I received a call on the landline, a male asking for me by name, and telling me he was from "Marstons Group" he then went on to tell me that he was seeking to recover just over £2000 after a CCJ was registered against me on the 7th May 2014, in favour of the C&C. I replied that I had no knowledge of this whatsoever, and that as far as I was aware the outstanding invoice had been paid months ago - He reckons it had not, and that I needed to take it up with either the C&C's solicitor or the court, but as it was almost 7pm neither are open. I am really worried about this now, apart from the fact that I can see a cheque for the amount was cashed months ago, I am more worried (for now) about bailiffs turning up at my home or shop.   16. Hello, I am wondering if anyone can help me, we are in a big bit of bother with Marstons Bailiffs. A very rude and arrogant officer came to our door yesterday looking for my brother for a parking fine last year in London which we knew nothing about saying that unless he pays the £512 before 6pm today then he compounding the car which is a motorbility car. I explained that even when he is home he will not be able to speak to him as he is severely disabled. He has a tracheotomy tube in his throat and cannot speak! He did not seem bothered and replied ''well he can drive'' Which I told him that he could not as he does not have a license, and he could check with DVLA if he wanted. He was tryign to find out who drives that car.. . I didn't know what to say, or if I should tell him so I didn't! The car is driven by his carer, not him. He said that it did not matter if it is a Motorbility car, they can over ride that. . Which I am almost sure is incorrect, but he also said that he will be taking goods and forcing entry in to the property if need be. I explained that my 34 year old brother is disabled over and over, but he did not seem to care, told me that I could pay!!! I do not have £512 out of the blue like that!! My brother only receives his ESA and his Higher rate motorbility and care payments have been stopped while the switch to PIP claim goes through, so he doesn't even have the funds to pay this extreme rate! Obviously we are very concerned, he is very distressed and I am worried that they could force entry and take goods from the home. My brother is very self conscious of his disability and the way he looks and this would cause more upset than I want to imagine. The Bailiff said that he had sent letters here before that have been ignored, I know nothing about these but he did say that he has a Distress Warrant. This Bailiff is going to be at our doorstep at 6pm tonight and I do not know what to do!!!! As it is my brother sleeps in the front room, he does not have a bedroom. He cannot lay flat to sleep so has to sleep in a recliner chair. Are they going to go round my little brother and sisters rooms and remove things, and from the front room? My Mother is also disabled and I really don't want to put the stress on her, as it could be detrimental to her already ill health , so I am trying to deal with this myself.... Only I don't know how to. ANY help would be greatly appreciated, because I really do not know what I'm doing with this! Thank you so much xx
  17. Hi all I wonder if you can help me. I did something stupid and ended up in Magistrates Court and got fined and told to pay costs and it came to over £1k.. I’ paid some off then got into money troubles so stopped paying. They (Cheltenham Magistrates Court) ended up handing fine over to Marstons bailiff was quite friendly and we made an agreement for me to pay, but then I got into trouble again and ended up being sent to prison for 18 weeks by Walsall Magistrates Court….to serve 9 weeks. Left me owing £900 to Cheltenham Magistrates. I got out to find a text from the bailiff asking what was going on and why hadn’t I paid and a letter from him through my door, with the fine now at £1220. He then arrived at my door and left me a note after talking to me and me explaining where I was and told me to make arrangements. I then went for a few job interviews came back to find he’d been again and it was the note saying he will come and take stuff. I really can’t afford to pay the £900 in one go and am currently on benefits until I find a job. I did write to Cheltenham Magistrates whilst I was inside asking them to consider that my prison term be classed as time served but they have apparently refused as I was put in prison by a different court than them. What can I do to get him off my back if I can’t pay him? I really don’t want him taking my stuff? CAn I get the court to take money off my benefits or is that too late? Iv'e had a visit from a debt collector from Marstons at 6.30 this morning claiming I owed an outstanding fine to the court for no insurance on a car, (the car in question was parked on my drive with tax, with a blown head gasket and a SORN had been sent to the DVLA as advised by my insurance company). The debt collector claimed the court hadn't received the £330 and asked how and when I paid, I said a couple of months ago online, he then miraculously found the paperwork in front of him confirming this, he then tried a different angle and said it was paid late and I know owed Marstons £320 and he was recording this conversation, I then told him to go away as he was trespassing, he then put a letter through my door: I ATTENDED YOUR ADDRESS TODAY AT 6.40 TO ARRANGE PAYMENT UNDER THE TERMS OF A WARRANT ISSUED ON BEHALF OF THE ABOVE CLIENT. (Cambridge Court) DESPITE PREVIOUS VISITS (This was the first) AND NOTICES THIS MATTER HAS NOT BEEN SETTLED, AND I THEREFORE URGE YOU TO CONTACT ME ON THE NUMBER BELOW IMMEDIATELY. It then goes on to say £320 is due and if not paid immediately another call to take goods. Any ideas how to deal with this?
  19. hi just looking for a bit of advice plzzz:???: (sorry very long post) my partner has a court fine for not having a tv license (he honestly thought he had one ( i no you hear this all the time)). he pleaded guilty by post and got fined ££240 (or there a bouts) (been researching all day and head hurts) he spoke to the courts fines officer and was told to send income & expenditure form which he did. he then received a letter from the court regarding non payment so he called and made a payment of £42 as they had requested. the man on the phone took all his bank details and said it would continue to come out of his account till it was clear. he thought no more of it and happily plodded along.] he moved in with me a month ago and on the 30th April we received a knock on the door (hammering on the door) at 7.30am i ignored the door as wasn't expecting any one, he then posted a letter threw the door it said it was a removal notice and had visited to make a payment arrangement. and £518 was now due. Then on the 1st May we received another notice threw the door (no one was home) saying final notice and he would be back to remove goods either one evening this week one morning this week after 7pm today or this weekend. it also stated there will be no further warnings. we called the company (marstons) direct and was told we had to call watford court as they wore the only people to reclaim the debt for a payment arrangement. so we called watford court who told us it was bedford court but also marstons had to hand the debt back. so we called bedford who said they had no recollection of the calls my partner had made etc and to speak to the bailiff. i call the baliff on my partners behalf and he said he would ask the court if they would except a payment plan, after speaking to the court i was told they shut at 4:30pm this was at 4;15. he said the court had addded a £320 admin fee. and he would call back i then received a text message from the bailiff @ 4:30pm stating important message fao Mr XXXXX your case given that it has been outstanding since 5/4/13 is high priority i have been instructed to collect immediate and full payment off £518. there will be an enforcement team arrive with in 96hours to take control of goods for sale at public auction.my advice would be that you consider asking close family for assistance. i then rang him and it went straight to voicemail, i said could he call me back and explain what the court had said. and also i had been advised by his company and the court that he can not gain access to my property as i am sole tenant and my partner is not currently registered as living here (the man from marstons on the phone said as long as i had my tenancy agreement this is fine) today 8/5/14 at 7:16am i receive a text from the bailiff saying important and urgent message for Mr xxxxxxx from Mr xxxx full payment of £518 is to be made before 12:00 fri 9th may 2014. to make payment call blah blah quoting ref no xxxxxxxxxxxxxxxx you will receive a 6 digit authorization code text or caall me with this code immediately to cease full enforcement action at (my address) this weekend. i replied mr xxxx you have been told you are not authorized to attend my property if you do attend i will call the police this is not mr xxxxxx (my partners)contact number you are texting the wrong person. Mr xxxxxxx has said to tell you he does not wish to deal with marstons. just to recap do not attend my property it has nothing to do with Mr xxxxxx. many thanks the sole tenant. he then replied please understand there exists the power under schedule 4A magistrates court act 1980 (inserted by schedule 4 of the domestic violence crime and victims act 2004) to enable entry into the property BY FORCE using locksmiths where required to execute a magistrates warrant against Mr xxxxx at the address xxxxxxx. call the police non emergency no 101 to confirm what i am telling you is lawfully correct. So please can someone help us on what we can do? the court has said its not an admin charge its the enforcement charges. we are more than willing to pay in installments just we cannot do it in full. any help and advice gratefully received kind regards Kim & Jay
  20. Hi all, My partner had a run in with a Basiliff from Marstons just over a month ago regarding an unpaid Court fine issued to her in 2011. She had moved away and unfortunately forgot about the fines existance until the Bailiff showed up, Bringing the original £120 fine up to £420. As My partner lives with me and the majority of the goods in the house belong to me our baby and older children, the Bailiff couldnt seize the goods and we are in no financial position to pay the bailiff in full, he said he was referring this back to court. From what I understand the Court can issue an arrest warrant for my partner, and she is under the assumption that she need do nothing until a new date is set for court. Surely she can just ring the Court and pay this outstanding £120 in full to avoid any further action??? Is there anyone out there willing to fill me in on the process please? as i do not fancy her getting arrested and possibly end up in the chokey for a month or 6. Hi all A private person applied to Northampton to get a CCJ against me for a fictitious amount, I knew nothing about it as the paperwork was all sent to a previous address, the first I knew of it was when a rather stubborn and single minded gentleman from Marstons turned up with a high court writ, I refused to let him in or fully confirm my details, he took details of two cars in the road outside my home and said they were now levied, and I would have to prove they didn't belong to me... I asked to see the writ or proof, he said he didn't have it, I asked what address was on the writ , he refused to answer only saying the address is not important. I phoned Marstons and requested to see the writ and asked them to send an I and E , the said that as they could not reproduce the seal they would not supply me with it, I must go to their office in Birmingham to see it ( some 280 miles away) Is it normal and standard not to be allowed to see the writ? He also said that if he returned and no cars were there he could break into my garage ( integral to my home) and take it . I am in the process of gathering evidence to prove the claimant lied in her application and no monies are in fact owed , she didn't support her claim with any kind of signed proof as there is none . Any advice on the concerns I have would be greatly appreciated
  22. Hi I'd love some advice if anyone can help. I gather there's a lot of mis-information floating around various forums and this seems to be the place with people that actually know what they're talking about. On Monday my wife received a letter from Marstons with 7 days to pay a magistrates court fine in excess of £1000 (which we don't have) for an offence dated 2008! She has moved house twice since then, and her surname has also changed since. The letter is addressed to her current name but her name in 2008 when the offence was alleged was different (just due to marriage btw). This is the first we have heard about the alleged offence. Had nothing from any court asking to attend. It's a 'fail to give information' so I assume it is vehicle related and that she didn't change her DVLA details in time (but they are up to date now). There is an HM Courts & Tribunal ref number on the Marstons letter if that helps. what should be my first course of action taking into account that payment in full is just not an option at the moment? I read that she can send a staturory declaration the court - is this the way to go? I'm loathe to belief anything I read on the internet now after reading some of tomtubby's myth debunkings! I know all the usual stuff about not letting them in etc but I know it's not going to go away. I can afford monthly payments but I don't expect to get any joy from Marstons in that respect. Any advice most welcome. Thanks in advance.
  23. Can someone help, please? We received a notice of seizure some time ago, after my partner let the HCEO into the house. He took a list of goods, set up a payment plan and left. We moved house in August of last year, and informed them immediately. HCEO turned up today (partner let him in again- argh!) and issued us with a new notice of seizure. Apparently, because we moved house, it shows that we had money? So he said he came to check that we didn't have the means to pay off the debt. So, basically, he can turn up when he likes to see if have new goodies? Is that right? I thought, if we had a payment plan, and didn't miss payments, that we'd just be left to it. Apparently not! Is there anything I can do? Thanks

Here I am again, thankfully for someone I know not me, couldn't go through all that again, and wouldn't have got through it last time without Wonkeydonkey! we have a single mum, moved into the area to escape domestic violence (must have been pretty nasty as she has specialist safety equipment installed in the house) The lady got fined for having no TV license, been paying fine up until Xmas, then missed payments, outstanding balance £280, this has now jumped up to £1,000! The poor lady was on the verge of taking out a loan with a dodgy lender in order to pay Marstons, I said I would see if I can get any advise from you guys. Obviously due to her previous problems, she is terrified and so are the children, 3 x all school age. could anyone advise me how I can help her please, she's beside herself with fear.   25. Hello, For the past nine years we have had trouble with different baliffs collecting on behalf of train and tram companies. It started with a baliff collecting for many unpaid tram fines in my husbands name in 2007. My husband did NOT accumulate these fines and had no idea where they came from. We had no correspondence of the orginal paperwork. Just what the baliff had in his hand. He suggested my husband do a stat dec on them and was very understanding. A few were actually referred back to court. My husband attended court and once the description of the person fined was read out it was quickly dismissed. The description however was the exact match to his brother His brother admitted using my husbands name and address on many occasions. We thought it was all over. We moved address and didnt think anymore of it. But Its been years and these baliffs kept coming. Some we paid as they didnt give enough time to complete a stat dec others gave us time to complete it. Its been nine long years of just wondering when the next door knock will come. This morning a baliff arrived stating he wanted £825 for avoidance of fares relating to 2005 and 2007. He has given us 24hours and if we do not pay hell be back with the police and a locksmith. We are at our wits end. Again its another day off for my husband and another day of ringing around courts. Is there anything we can do to stop this baliff and the locksmiths as we really do not have the money this time to stop them and not enough time to complete a stat dec. (Although my husband is trying) thank you
