  1. I am in need of some advice. While I was married to my ex-husband, we had a joint bank account, and I was an additional credit card holder to his HSBC Gold account. ( I was not entitled to one on my own as I did not work and had no income). We seperated briefly and obtained seperate bank accounts, but the credit card remained joint. After permanently splitting up I had a debt on the credit card for over £4000, and as I was on Income Support as my only income, the credit card was cancelled by the bank and the debt was passed onto Rockwell/Tessera, who started collecting repayments, albeit at a very low rate due to my circumstances. Fast Forward 5 years and I have remarried. I only work 10 hours a week and I now pay £35 a month to tessera. At this rate my debt will still take 8 more years to clear. I dont dispute that the debt is mine and am not trying to pass the buck to my ex, but wondered if I could find out if there is anything I can do because I was only an additional cardholder? will I be able to reclaim any PPI etc? (I dont even know if there was any taken on the card accounts as my ex dealt with it all. I cant ask him as we are not in touch, and I have written to the bank for details of the account and sent a small cheque to cover for this but I have not had a response from them. Not sure what direction to go now. Can anyone help please?

Hi was wondering if anyone could offer some advice, I took a loan out with hsbc in 2005 just before i started work (was a student prior to this) and i already had an existing credit card with them. Over subsequent years i found it increasingly difficult to meet both repayments and coupled with up to £175 a month bank charges this soon hit crisis point. Anyway to cut a long story short i opened a new account and stopped paying hsbc. On my credit report it states i owe them £4500 on my credit card account and £8500 on my loan account. This debt has been passed to MKPD LLP who send letters occasionally which i am continuing to ignore so to my questions, i think i had ppi on both of these accounts but i don't have any of the original paperwork account numbers etc, can i try to reclaim it even though the account has not been settled and also are this new company likely to take me to court for repayment of the debt? Am i being silly to keep ignoring them in the hope this will all go away? Many thanks for any help you can give
  3. Hi I have received a Claim Form from Northampton county court regarding an overdraft of less than £3000, the account HSBC have closed. I have sent a letter to DG solicitors asking for CPR request last friday 20/7/2012 aslo I acknowledged AOS on time I phoned the court and they have received. But I could not postpone defence. The court says when I acknowledged I postponed to 30/7/2012. I do not think I will get reply from DG solicitors on time for court so I think I should better put in defence which would be for the enormous amount of charges put on the account in the last 10 to 15 years for which I am pretty sure are unlowful. I don't know how to write defence or what should I do.

Hi, I put a PPI claim in to the FOS on behalf of my husband October 2010,at the time he was still managing to pay his CC and loan, however it all went belly up in April this year and as I have heard nothing for months from the FOS I'm wondering where it will leave this claim when the HSBC take action against him which from the letters received yesterday could be soon Ro
  5. Hi I am having problems with HSBC Premier investment management service. HSBC have over contributed to my ISA within the PIMS by an automatic payment. I have been told that this error has occurred with many customers but I am having great difficulty in getting HSBC to correct their error. Has anyone else had problems with HSBC PIMS? It was very lucky that I spotted the error as although HSBC were aware of the problem they did not point it out to me. The PIMS statements are over 100 pages and the customer is expected to check for any errors! The Premier investment management service is a very complicated product and I am wondering if anyone else has had any problems with this service? Thank you
  6. Having cleared through some more draws at my mothers I have come across yet more paperwork for old loans at Midland / HSBC bank. The first loan was taken out in November 1996 over 42 months. Loan was for £5500 and had £750 PPI added to it. APR was charged at 9% and obviously front loaded The second loan was taken out in November 1998 over 60 months. Loan was for £9500 and had £1697 PPI added to it. APR was charged at 9.9% and again seems front loaded. As you can see the first loan roled into the second. Pretty sure I would have had a rebate but not sure if for the interest / PPI or both. I have no other paperwork showing any refunds etc, just the initial credit agreements As per each of my previous claims I had 6 months full and 6 months half pay through work at this time, so would have been covered. The fact each of these was front loaded also helps my claim If I had put in a SAR (I actually have done) on these loans, HSBC would (and have) said they no longer carry any information. However I'm pretty sure they will magically find info that may show any rebate against either of these loans if I put in a claim. Just want to check that I have all I need to put my claim in?     Confusion

    Hi, first post so please bear with me. My husband submitted his NDL Cashflow to the HSBC in April this year when he realised he could not meet his commitments, mostly in return he has had letters advising him to get help from a DC and of course the phone calls. The HSBC also denied that he had written to them so he sent them copies of the recorded delivery receipts and complained about the way he had been treated, he did receive a better response to this and an apology and a refund of charges for that month, he also pointed out that he would not deal with this matter on the telephone and would they please deal with it by letter, he also received a letter offering him a reduced full and final settlement which he replied to saying if he had any money he would be making his monthly payments, no reply yet. Frankly this is one of the more baffling elements of being in debt, you do what you think is the right thing and offer what you can and it gets ignored? I cannot see any merit in totally ignoring an offer,they can always say no (in writing of course). I think it is back to the drawing board Rohannah
  8. Hi, I have written to HSBC to ask they waive the charges due to be taken out of £160 due to hardship. I received a letter basically telling me no, be more careful with your finances. In the letter there is a line that says "only one fee will be applied per day, up to a maximum of £150.00 in any one monthly charging period". On several occasions I have been charged more than £150 in a month, including the charges due to come out of my account on the 14th of £160. Does anyone know if it has always been this limit per month, or if it is a new thing? Do you think I should complain? Thanks
  9. Hi guys, I took out a loan & Credit Card with HSBC years ago. More than 6 years ago, deffo. Now it appears HSBC have joined the two together into a single debt (£2,458.14) and appear to have sold the debt to "Clarity Credit Management", who are now sending me letters demanding I pay up. The funny thing is, the debt doesn't even show on my Credit Report on Experian. How on earth can they chase for a debt that's not even on my record anymore?! Can I fight this, or do I have to pay it? Cheers.
  10. Hi all, I'm new to CAG, and have been really impressed with the useful information on the threads read so far! I was hoping someone might be able to offer some advise with a court claim I received today, (trying not to panic!). The claimant is Robinson way (Hegarty LLP solicitors) for an HSBC overdraft (less than 2k) from back in 2007 (default date April 07). I got letters from RW over the last few years but haven't responded to any of their demands for payment because the overdraft itself was made up of so many penalty charges I really didn't think this was fair, I can't remember exactly how much. I've moved address a few times so not sure whether they have sent an NoA at any point, I haven't ever seen it. Around mid-June I received a final letter before action from IND which had pretty much no information about the debt apart from a account statement that looks like something they have put together themselves, I think they are making this out to be a NoA but I'm not sure (I've attached this but deleted some personal details)? The particulars of the claim state that the NoA was provided to the defendant which I'm guessing is the IND letter before action? It doesn't reference anything else. I was planning to defend the claim and send a CPR 31.14 request to Robinson Way/Hegarty LLP. I'm not sure whether this is the right thing to do? Should I also send a SAR to HSBC? If someone would be able to advise I would be really grateful. I've attached the claim form for reference (with personal details deleted alond with a couple of pages of the letter before action.   11. Hello all I am looking into making a claim against HSBC for mis-selling insurance when I took out my mortgage but am unsure if I have a case or how to start. I took out a 100% mortgage with HSBC in July 2006. When I went in to sign the paperwork I was told that their insurance plan which would offer payment if I was sick or injured and life assurance were a compulsory part of the mortgage and I needed to sign up for this too. In November 2010 whilst talking to a colleague in work I was told that this was a waste of money as my employer provides a death in service grant which would cover the mortgage and sickness cover for a year too! I promptly cancelled the cover deeming it unnecessary. I interestingly did not hear from the bank telling me the compulsory cover was no longer in place! My complaints are 1) the advisor made it clear it was compulsory when I now know that this is not the case. It was made clear at the time that the mortgage would not happen without the cover. 2) the advisor did not mention I could shop elsewhere for this cover. 3) the advisor did not check to see if the cover was necessary due to my employment. I do not have any of the original paper work (stupid I know) apart from the bank statements showing payment to HSBC LIFE UK for payments of approx £45 a month Could you offer your thoughts please of if I can / should claim and if so perhaps how I would go about this? If you have had a similar (and successful!) experience with this then any letters you have used would be great if you do not mind sharing! Thank you in advance. Naith
  12. Hi, I bought HSBC's Flexilife Income Payment Protection (individual) when I took out a business loan. It was mis-sold to me as I was led to believe it was compulsary and they wouldn't give me the loan without it but 3 years later when I was struggling, I was able to cancel it. I'm hoping this is the same as PPI? and I am able to reclaim. Would really appreciate it if anyone knows of this product to let me know.
  13. I had a debt of 20K resulting from the collapse of a company where I was a director and had provided a personal guarantee. The original debt was to HSBC, but they passed this on to Robinson Way. I have made regular payments up until may this year. I stopped making payments in May after 3 attempts to make a full & Final and reciving no response at all from RW. The balance is now Cirac 6.5K. Stopping payments was meant to focus their attention in getting a settlement. Since doing this, I have heard nothing from RW. Slightly strange as I got mothly letters when I was paying, reminding me payment was due. I was informed this week that Lowells had accessed my credit report and although they have not contacted me, I am wondering whether they are now involved. What advice do you have if indeed Lowells make contact. The debt will be 6 years old in October and is the last default showing on my credit report. Any advice greatly appreciated. John.
  14. Hi all, Just a quick one hopefully. I did a sec 78-79 request to HSBC, to which they returned some T&C's (apparently correct at time of my account) and an agreement that was usnsigned saying that after reasonable effort, they cannot provide a signed one at present. The signed agreement shows a box which should be ticked if PPI was taken and a signature to authorise it but with there being no signed agreement, this wouldn't have been shown. They also included a handful of printed statements which simply showed a balance, account number, credit limit and debit. No breakdown which would show if PPi was paid. Now I don't remember ever having PPI info on my statements but it just kind of feels like I may be being bluffed. Has anyone else come across this?
  15. Hello, this is my first post, as have made use of other material to get this far. However, I now need answers to a specific set of questions. I have a credit card account with HSBC, nothing paid on it since feb 2008. It has been passed through the usual subsidiary debt recovery agencies and has been the subject of two section 77(1) requests, one of which, july 2009 was passed back to HSBC, who then passed the account to another agency, who were sent a 77(1) request jan 2010, which was not even acknowledged, fee not returned. Suffice to say that nothing was ever sent to me to satisfy my requests. Earlier this year, HSBC sent letters informing me that the account has been sold to MKDP. It is my understanding that where a 77(1) request is unfulfilled, the account cannot be passed to another agency or sold to another firm under section 78(6) and as such is unenforceable. Is that correct? As this breach of CCA Regulations has occurred previously, the account now CANNOT be enforced. Is that correct? I received a letter from MKDP yesterday who require me to provide evidence that the account was in dispute with HSBC or will be referred back to their Collections Department. My inclination is to tell them to stuff it as they have already been informed that I do not recognise their having legal title to the account. Is this likely to be regarded very dimly by a judge in the future? How am I to square the fact that it seems to me that HSBC sold this account unlawfully? Should there have been a duty of care on MKDP as responsible holders of a Consumer Credit License to have satisfied themselves as to the legality of their purchase before the sale of the account? Am I even obliged to enter into communicative discourse with MKDP? Help would be very greatly appreciated. BD
  16. Hi IMS and others, Another query! My other half has received a letter from HSBC upholding his PPI complaint about a credit card and offering a refund of premiums but only from 2005 to 2007. He's certain he's had the card for longer but has no statements from before that time to prove this. They say that they are only required to retain information on the account for the last 6 years and that this is their final offer. They add that they will consider any claims for the period prior to their records but only if we are able to provide statements. What should we/he do? He's tried to ring the tel number given in the letter but no one replies and/or he's just cut off so they're obviously not making it possible for people to ring them. He's also been into the local branch of HSBC but they won't help either, just refer him back to the complaints dept of HSBC. They also say in the letter that the offer form needs to be returned to the bank withing 6 weeks of the date of the letter, so it does not give us time to request a SAR (we now have only 4 weeks left to reply.) Should we just accept the offer they've made or press on by eferring the complaint to the FOS? Any suggestions gratefully received. Thanks Peony
  17. Hi All need some hand holding on this as this has been a while since i have had to do this. right here we go......... Claim for received from Sigma Today claiming part monies from an an agreement, this is an old bank account I used to hold. the amount is like a 3rd of what I owed on the original Debt. its come from MCOL so the POC are vague. I have acknowledge it today and am sending the CPR request today!! I havent heard of these part claims before it seems its a new trick by Sigma! can anybody assist in what to do next??? thanks
  18. Hi, I had a HSBC credit card (which is now in the hands of DCA) Which I took out in 1994. I have sent them a SAR but have only received back data up to 2005. How do I get the data back to the opening of the account as I know I had PPI on this account when it was 1st opened but later cancelled it. Do I fail Sar them Again as I had to do this to get the data in the first place. Am I just unlucky or is this standard practice for HSBC to only provide 6 years

Hi Guys, This may be simpler and really I am looking for confirmation that I am going in the right direction but: In October 2002 I took out an £800 12 month loan with HSBC; with no bank account, HSBC opened a new account from which to take the funds. I finished paying the loan in October 2003 (just after I left for uni) and as far as I am concerned, this was the last time I used the account until October 2005 when I for some reason (not sure why), I deposited the amount of £37.52 - not sure as to the precise nature of the amount, but I do remember the purpose of the visit to the branch was to gain some mortgage literature. I also remember at this time changing my address to reflect my uni address (when I left for uni, I left my parents house permanently). Fast forward to February 2012, I was contacted by Lowells about an outstanding debt of £327.52 owed to HSBC - it seemed very random given that HSBC had not contacted me in the past regarding this so I advised Lowells that until Lowells / HSBC can prove the debt was mine, that I shall be disputing. Lowells informed me that they would go and request the statements from HSBC. I remained in regular contact with Lowells who informed me that they were still waiting on the statements. Finally, on the 9th June, the statements turned-up, the trouble is, HSBC had sent 60 pages of statement starting from statement page 034 dated 19 July 2005 which starts with an opening balance of £227.37 and nothing else. Lowells have written in their letter that "they see no reason why they are not entitled for me to pay the debt" so I called them and advised that a balance brought forward does constitute proof that I rang-up the debt providing them with a couple of scenarios one being that I could have decided to take-out student possessions insurance with them, then cancelled within the cooling-off period and that this debt could therefore be for a first payment that was never refunded but without the missing statements, we will not know what the debt is for; I should add at this point that I did receive a zero-balanced loan statement so I know it is not for this. Lowells advised that they did not expect HSBC to hold statements back any further than 6 years whereas I said that until HSBC can prove that the debt is mine the balance shall remain in dispute. Lowells did say whilst I was on the phone that the account was defaulted in 2009 and that HSBC would have been contacting me for some time before, yet the only address HSBC have ever held for me was my parents address, this seems odd to me since I changed the address in 2005, 2006 and 2007, also, I advised them that my parents sold their house in 2006 so should they have tried to send letters, it was likely that the mail would have been returned (hopefully). Unfortunately, due to a mistake of my own, the plot thickens. I know how this can look but, the previous evening 08/06/2012, I had received a letter from Lowells asking for the amount for which I contacted the and advised that I had not yet received the statements. I then entered into a dialogue with the girl during which point whilst I persistently disputed the debt, I asked about the default, now being on hold, and could it be removed until investigations had completed, she advised not but she also advised that one possible solution to cleaning my credit file would be to begin payments so that it would "look good on my file" and then to claim the amount back if the debt subsequently proves to not be mine. Being straight after a particularly long day and my mind not being in 'alert' mode, whilst I continued that the debt was in dispute and she too accepted this, I accepted this proposition which the following day Lowells sought to use against me as "my accepting the debt"; I have since cancelled my payment arrangement citing that HSBC need to prove that the debt is mine but Lowells are still seeking to rely on my acceptance of a payment plan as grounds that I accepted the debt. Even though during the course of the call (the second call once the statements had been received 09/06/2012), Lowells sought to control the call I maintained my position that I shall dispute the debt until it is proven and it is likely that this would also be a court's position should we go down the legal route. At this Lowells said that at least for now, if I am disputing the debt then collections activity shall commence though it is currently not in their interests to go legal - yet. I want to know where I stand with this and whether I am in the right or does a balance on an account with no supporting evidence that the debt is mine constitute a recoverable debt? I also want to know where I stand with the 'accepted' debt and also, what would be the best course of action regarding the forthcoming collections activity and finally, in the circumstances with HSBC unable / unwilling to provide any supporting evidence that I owe the debt, is it legally enforceable? -- I should add, that whilst the statements open on page 34 [19/05/2005] with an opening balance of £227.37D, with exception to the £32.57 I deposited in October 2005, the final balance of £327.52D is solely made-up of their interest over the next 4 years.
  20. Hi everyone. Quick background: mid-last year I learned I could reclaim PPI from my credit card, so I wrote HSBC a letter about it. This process was long and drawn-out, and I moved house during it. I moved in July 2011, and in September 2011 HSBC wrote me a letter with an offer of £650. My ex-landlord has been slow to forward my post so I received this offer just yesterday. In the letter, they offer the money within 6 weeks, which is obviously now long gone. My question is this: can I still get the money I'm entitled to? And if so, what should my next steps be? I have all the letters confirming the amount owed. Is there a phone number I should call HSBC at, or an email address I can use to contact them? Alternatively, can I simply fill in the acceptance form with my current account details as they request and return it, despite being past the deadline, and hope they pay it?   21. Hi, A couple of months ago I received a letter from Mortimer Clarke Solicitors acting on behalf of MCE Portfolio Limited. They asked me for just under £2000 but other than the usual threats there was no information as to what this was all about. I put this letter to one side and to be honest forgot all about it. Today I have received a claim form for the Northampton Bulk centre court. The claimant are MCE Portfolio limited and in the particular of claims they refer to a current account with HSBC from 1998. They have added on another £2000 in interest. This account is surely statute barred as I have had no contact with HSBC for over ten years. I am unsure of how to proceed. I feel like just writing in the defence section of the claim form " This debt is statute barred and unenforceable" but that will probably not suffice. Any suggestions on how I should proceed? Cheers.   22. Having heard a lot about PPI in the last few years, I was always tempted to find out some more information but never did so from believing I had not ever paid it. Back in April, I received a questionnaire from HSBC about PPI. This to me seemed like an admission of guilt in receiving the questionnaire alone. I duly filled it in and returned it. They said I would hear back in 8 weeks and i am due a response by Friday 15th June. I phoned them yesterday and no decision had been made yet, but that I would hear next week. Surely this is cutting it very fine. The more I think about it, the more annoyed I am about having paid this. Please could you tell me if the following factors make me a candidate for a claim: 1) I didn't know I paid any PPI 2) I have always been in a secure profession with a generous sick pay should it ever be required Then lo and behold, last week I had a different questionnaire from Santander! I'm really confused as to what's going on and if I'm in line for any refunds. Your help and advice would be greatly appreciated as this site was such a huge help when I reclaimed bank charges several years ago. Thank you!
  23. Hey I received an offer today from HSBC which i am happy with. The offer refers to 2 loans which were settled in 2005 and 2008. I however defaulted on a seperate loan in 2010 and the majority of the balance remains outstanding. They have stated the monies will be used to pay off some of the outstanding debt. Can they do this? After all the PPI reclaim relates to a closed account? The account still outstanding remains with HSBC though i have had a third party DCA write to me. Any advice is appreciated
  24. Hubby received a letter this morning - front cover with HSBC logo on it and back letter from Lowell. It basically states HSBC have sold Lowell a debt etc etc. I have been with hubby 3 years and have never heard of this debt (I open all the mail). I rang him at work and he doesnt remember anything relevant to the amount. The letter states the debt is to HSBC, but not what for (credit card, overdraft....) What do we do? Ignore it?
