  1. I bought a sofa for £199 and other items for another £50 from a second hand store and paid cash over 2 months ago. They delivered the sofa 6 weeks ago and said the other items would follow. I have not received them yet. I have tried to contact the seller via their mobile phone contact number and cannot get a reply, I have left messages and get no call back. This morning I left a message saying that I wanted my money back and would be visiting the shop to obtain it. I still have my receipts. Am I within my rights to do this?
  2. Hi Can someone please help me? I have home appliance cover with a large company and when I called them out to look at my American fridge freezer, they informed me that they could not repair it but offered me 30% of its value against a replacement. I found a product which was the same size as mine and the product replacement asked me to pay the balance which I did (on my debit card). They said they would order the product for me and that I would receive delivery details from the "supplier". Delivery was due last Wednesday so I had to take unpaid time off work. Delivery men arrived (3rd party national home delivery company) and my new fridge freezer was tail-lifted down off the vehicle. To cut a long story short(ish), one of the delivery men was used to these types of delivery and one wasn't. They unpacked my new fridge/freezer in the road and then attempted to carry it to my house. They dropped it more than twice. They damaged my laminate flooring and internal architrave. One man badly cut his hand in the process and the blood splattered through my hall and on walls. The fridge freezer was damaged (incl dents on front door). I have video/audio footage of the event. As soon as they left, I called the home appliance company which I have a contract with to inform them of the above. They said they would inform the "supplier" and that I would hear back from them within an hour. I didn't. I telephoned again on Friday and was told the same thing and I still haven't heard from the "supplier". Can someone please tell me where I stand? What should I do? Which of the 3 companies 'in the chain' is responsible for the damage to my house and new appliance? I can ill-afford to take more unpaid time from work - can I add this to a claim?   3. So, I chose a very large and nice painting for our new flat, and it formed part of the way we designed it. We got the painting in the sale in early April for £125, lead time of 7-8 weeks. 8 weeks later I get an e-mail saying it has been delayed 21 weeks! (just under 6 months!). I have the right to cancel, but finding a substitue is going to be very hard and more importantly a lot more expensive. I want Dwell to pick up the difference for a subsitute product as they have failed to perform their contract. I purchased the item in store and was not presented with terms and conditions until the confirmation e-mail came through. For the purposes of discussions I believe their terms and conditions to not apply as they were terms introduced after the contract was formed. I've never been in a situation or seen one where products are not easily subsituted (normally if someone lets you down it is easy to find a replacement at a very similar cost), however a similar painting could cost £100-£200 more, especially when not on sale.... consumer law/contract law does enable you to do this, but has anyone done it with a retailer?

Hi I have had a new caravan on order since October 2012 order direct for manufacturer we asked for delivery early April this year as we use it for specific sporting events, after chasing them we were told 16 April that came and went then told beginning of May that has passed now told late June but no firm date, my issue is that we have now paid out for 3 hotels for 3 events booked a site at £135 for the next race in 2 weeks but will not have the van, we were due in Europe this week that has been canceled, ferry's are booked for Europe for Mid June but we still do not expect to have the van, none of the above is refundable, I have now asked for a full refund of the deposit so I can buy elsewhere but they have refused stating clause 7 on the contract, during this processes I have been the one chasing dates at no time have they been upfront with providing dates. Delay In Delivery The seller will use reasonable endeavors to secure delivery of the caravan and the accessories on the delivery date specified in schedule b but shall be under no liability whatsoever for loss occasioned by delay in delivery. dates for delivery specified in schedule b are estimates only and time for delivery is not of the essence of the contract

I have ordered a couch 13 Jan it is now 8 April which is the 12 weeks from when it was ordered and i was told by the rep i would receive it within 12 weeks, I am now told it will be in May, I am extremely unhappy but have been advised by the store manager that they say approx yet I was told by the rep "WITHIN 12 WEEKS". All I am asking that due to the delay my order should be cancelled and I should be refunded (Which in my opinion is fair as I have waited long enough). Also I think it is extremely bad customer service not to advise me of the delay.................................... I gave a £150 cash deposit (I know should have given CC). would really apreciate some advise
  6. Hi all, I'm having a problem with a company that have put an incorrect address on a parcel for me and hence its been sent and signed for at the wrong address. Unfortunately when I first paid for the item I mistakenly submitted an incorrect delivery address on my paypal account. However I quickly realised this and called the company to inform them of the correct address and emailed to which I receievd a reply confirming that the address had been corrected at their end. A few weeks later they dispatched I contacted asking them about the status and they replied that I should have received the parcel. On checking it turns out it has gone to the original (incorrect) address even though it was dispatched weeks after I informed them of the mistake. I am attempting now to get a refund as it was a gift which has now expired its pupose because they have taken so long to send and now have sent to wrong address. However they say they wont refund until they've got the item back. Does anyone know where I stand on this should they have problems retrieving the goods? (it's just that there customer service is shocking they seem to be dragging their heels in sorting it out). I can foresee it getting problematic.
  7. We have used Asda as our main shopping store since what seems like fore ever. The past couple of years we have used the on line store to get the bulky and heavy thing and generally spend in excess of £100 each time. I have noticed over the past few shops that the quality of the goods has dropped in that they are disposing of their goods that have very limited Sell By Date left. For instance, the last shop had a pork pie with only 14 hours left before the Best Before expired. I have complained and they have changed the goods, I have complained to the CEO and all they did was offer me the cost of those items back. I don't want money, I want fresh goods, how the hell am I supposed to consume all of these fresh/chilled goods within 24 hours? A couple of months ago, the oranges arrived rotten, not just a spot, this was over at least half of the orange so in no way could have been missed by the packer, it had to have been done on purpose. I didn't even get an apology, just a man in a van with 3 oranges to replace the rotten ones. Maybe this is only the Plymouth store that does it. I was assured that this wasn't company policy, so tell the stores then and stop sending out stuff you will have to ditch the next day. I think I've given them enough chances, and it's time to try someone else. It won't be Tesco though, the quality of their food is disgusting, made as cheap as possible and not fit for rats, so Sainsburys it is.
  8. Hi there, My rent is due the 21st of every month, following my previous forum posts I have been issued an S21(4)(a) now on the 18/9/2012 and it ends next month on the 18/11/2012. I have just read that the dates can only be for one day before the rent or is this not true? And is the time frame correct by the landlord? I owed three months rent and a fourth month on the 21st which will all be paid and correct on the 21st of this month (the previous months are all paid off) and I wish to continue staying on the property. I will keep paying my rent as per usual and once the notice runs out he can then get a court warrant but if I am all paid up-to-date what will happen, will I still be requested to leave the property as I doubt he will have a sensible conversation with me to continue rental agreement. I understand he has 12 months to get the warrant also or have I read wrong? (the contract is periodic that the one?). Thanks.
  9. Hi. Can anyone help here. I ordered some flooring from a company. I ordered a solid floor and the company sent an engineered floor by mistake.. I received and signed for the flooring on the 25th Jan and it was fitted on the 4th feb. I did not tell the fitter what he was fitting and he carried on and fitted half the floor. We stopped him doing this when we realised it was the wrong floor. We informed the supplier who said they would have immediately exchanged the floor if the fitter had not fitted it. they offered us £500.00 pounds compensation and said they would change the unused boxes but would not change the boxes that the fitter had already fitted. Can someone tell me where i stand Many Thanks
  10. We ordered a sofa from Harveys on Boxing Day. My wife has rung several times about it and the last couple of times they "suggested" we pay the balance for the sofa in advance as this would speed delivery up considerably. My wife rang again just now and was told they will not ship the sofa from England to Northern Ireland until the balance is paid. Is this proper? Surely once they have our money they can make us wait as long as they want before delivering (we had the same thing happen with MFI many, many moons ago and this has tainted our faith in furniture companies).

Hi I hope someone can help yesterday a parcel was delivered to my place of work but the company name was wrong and I refused to sign for it at which point the driver became abusive and pushed me. There were 4 other witnesses and I have contacted the delivery company and emailed them what has happened but they have not acknowledged the complaint and my employer is also doing nothing. I would like to take this further but no idea how to, the company outsourced the delivery to a franchisee and have given them my full details:jaw:
  13. Hi everyone, I've read a few posts on here with similar situations to mine, but didn't really see any outcomes, so I'm hoping someone here will be able to help me out! I ordered a PS3 from a private seller on ebay, and paid through Paypal, and was given a parcel tracking ID for parcelforce. On the night of the 5th of Jan, I tracked the parcel and was very pleased to see that its status was "Loaded to vehicle for delivery". I assumed this meant it would be with me the next day, (the 6th) and spent all day waiting for the package to arrive, anxiously keeping an eye out for the van to stop or go past the window. It got to about 16:00 when I started to give up hope that my PS3 would arrive that day. I checked the tracker one more time to see if the status had changed, and to my amazement it said it had been delivered! I noticed that there was a new option for me to 'see proof of deliery' so I clicked the link, to find that the parcel had apparently been delivered at 14:06 to M Cooper, followed by a signature stating 'M Cooper'. The strange thing is, M Cooper is me! But it was definately not my signature, and the parcelforce man had definately not rang my doorbell! I've read that, although they are not supposed to, the delivery men will sometimes sign on your behalf, and leave the parcel somewhere outside, but it's nowhere to be seen, and there was no card through my letterbox! I thought maybe a neighbour would bring the parcel round that they had taken delivery for by mistake... but then, why would they sign for it in my name?! I'm so annoyed, not only that the delivery man would hand the parcel over to someone at the wrong address, with no proof that they are the owner of the parcel, but also that someone would do that! I've e-mailed parcelforce, but have so far just recieved an automated reply saying that they aim to get back to me within 12 hours, which will be Monday now. Just wondered if anyone else has experienced anything like this, what they did, and what was the outcome? Many thanks, Mitch (the real one! )
  14. hi all, i purchased a washing machine on line from curry's on 26th december 2012. my wife and i are pensioners the reason we chose to purchase from curry's was, they offered free delivery and collection of our old machine, and the new machine had a five year warranty, the first paragraph of the conformation of order e-mail states, we will contact you to confirm a date for delivery. at 17.15 hours 3rd january 2013 while my wife was alone at home, they called to deliver the new machine, we had not received an e-mail or telephone call to confirm a delivery date, even though we have an online account registration with our e-mail and phone numbers, the old machine was still plumbed in when they called, we were still waiting for a delivery date so my son could disconnect the old machine ready for them, my wife age 65 tried to refuse delivery, they cajoled my wife to except delivery browbeating her with threats she would not get another delivery for 4 to 6 weeks, they carried the machine into our small kitchen and left it there with all the packaging still on the machine for my wife to remove, when I arrived home half an hour later i was incensed at the delivery driver, and angry at my wife for not refusing delivery. (who is recovering from removal of kidney and later womb through cancer) fortunately my son lives near and came and plumbed in the new machine, but we still have the old machine in the kitchen it is far to heavy and awkward for my wife and i to move down a narrow hallway, I know we will be held at fault because my wife accepted delivery, and that curry's don't give a toss now they have been paid, i feel impotent against them and the way we have been treated.

As title, now it could just be a coincidence but twice now I have sent mail to Barclays with regards to different PPI claims with the two occasions being months apart, both of the letters being sent by recorded delivery thus requiring a signature. Of course neither of these letters made it to their destination and on another occasion a third letter regarding PPI was actually signed for but somehow then became lost internally! As far as Royal Mail are concerned once the letter has been posted it can't be tracked during delivery, only upon delivery when a signature is obtained can they then update the 'track and trace' section of their website. Anyone else had similar problems sending mail to Barclays or is it just me that has this run of bad luck?
  16. Hi everyone, Over the course of the last six weeks I have sent 3 letters to Aqua customer services (which is in Halifax). All letters by recorded delivery. Non of the letters have been delivered, the Royal Mail website says they are all being proceesed through their system for delivery. I can understand if they lost one letter, but three?, or am I being paranoid? Any suggestions on my next move?
  17. Hi All So long story short, I renewed my contract with Vodafone part of the deal was that I would get my new phone Saturday just gone and not pay for the delivery. That never happened, called up about it and complained and got informed that a Saturday delivery actually takes 5 working days to process no one told me that originally. They are offering a poxy £30 as compensation. How do I get more out of them. I don't want to go elsewhere because my deal would be in excess of £40 and I'm paying nowhere near that. But I need to make sure I make the most out of this whole situation because they have made a mistake and I personally think I should get more than £30.
  18. I ordered a shower screen from homebase online, paying for home delivery as unable to fit item in my car. I took a day off work to take delivery of item (as 8am-8pm was the only timescale they could give). A dining room table from Argos was left outside my front door (they didn't even knock). They won't send another shower screen and they won't refund me as I used my husband's credit card - although of course they were quick enough to take the money. Very upsetting dealign with customer services as each time have to wait 24 hours for email response or phone calls take an hour each time. What can I do and what are my legal rights?
  19. Hi, i am writing on behalf of 2 friends who purchased things from Brighthouse. They have paid £7.50 as fees, when asked what the £7.50 was for, Brighthouse response was that it is a delivery fee. Delivery fee is £30.00 and this is split up into 4 payments of £7.50 Has anyone else paid this delivery fee? Is it normal?

  21. Royal Mail has been given the green light to start delivering parcels to neighbours, where recipients are not at home to receive them. The service will now begin from the beginning of October. UK postal regulator Ofcom gave its approval today to the “Delivery to Neighbour” programme, which has already been trialled with 748,000 addresses in six areas of the country. Ofcom stated its belief that the new scheme would reduce the need for consumers to pick up their parcels from Royal Mail depots or post offices, and that it would bring Royal Mail in line with rival delivery firms, who can already leave items with neighbours. “The ‘Delivery to Neighbour’ scheme should help meet increasing consumer need for easier ways to receive certain items requiring a signature and parcels, if the person is not at home when the postman tries to deliver,” the regulators said in a statement. Consumers will be able to opt out of the scheme – either having their items delivered to neighbours, or receiving items for their neighbours – by displaying a free opt-out sticker near their letterbox, Ofcom said. Royal Mail postmen will be allowed to follow other private delivery firms who leave packages with neighbours and then post a slip through the letter box explaining which house has the item. The scheme was given the go-ahead by government watchdog Ofcom today after a consultation on how it would work and a three month trial that was welcomed by 90 per cent of customers due to its convenience. The initiative will be rolled out on October 1, making it easier for people who are out and about to receive their post. The change will also save hundreds of man-hours as fewer Post Office staff will be required to man collection points. Households will be able to opt out of the scheme by putting a sticker, which will be available from the Post Office, near their letter box. And Royal Mail will still be responsible for the mail if it goes missing. Anything sent by Special Delivery, from abroad, or high-value parcels will be excluded from the scheme. Post sent by a Government department under the ‘Do Not Redirect’ (DNR) scheme, such as pension information or passports, will also be excluded. DNR means the item can only be delivered to the address it bears.   22. I have a quick question and wondered if anyone can help. If a debt collection agency writes a letter to you, do they need to have some form of proof of delivery in order to demonstrate to a judge that the letter was delivered? I can see a situation where a firm cannot prove delivery of correspondence and therefore could be judged to have not communicated in an appropriate manner before a final demand. This is all theoretical - I don't actually have any debts.
  23. Hi. I placed an order with asda this week. It didn't arrive so I called customer services only to be told that the order had been cancelled because they couldn't take payment from my debit card. I could see quite clearly that they payment had left my bank account. I told them this and they said they'd look into it and call me back. They didn't call back so I called them. They told me the same thing again and said I should check with my bank. I called my bank and they confirmed what I already knew so I called asda again. This time I was told that they did have the payment. I asked why I was previously told that they didn't. They said they didn't know why I had been 'lied' to and didn't know why my order was cancelled. I demanded a refund which I was told could take up to 10 days. They have left me in real trouble. I have no food in the house and no money in my bank. The only money I have is sitting in asdas bank waiting to be returned. I'll be in this situation for almost a week.
  24. I am sure someone on here will know the answer to this! I bought something online and on the website it stated there was an option for 1st class recorded delivery. I paid a bit extra for this. Now, after weeks of non-communication from the company and requests by me for a refund (which were ignored) half my order has finally turned up. The jiffy bag has a '"2nd class large' stamp on it with the post mark over it. The postman didn't knock, just put through letter box. So does this mean it was definitely not sent recorded? I mean if it was sent recorded would you be able to tell by the packaging?
  25. We've been waiting for Argos to deliver one of their Scandinavia 4 door 6 drawer wardrobes, which was order online on 23rd Jan. Originally, we were told it would be delivered within 35 days and somebody would contact us to sort out delivery. Had a phone call today to day the order had been delayed by 4 weeks, and the estimated time for home delivery, if ordered now, is 42 days unless you live in Birmingham - they only have to wait 10 days!! I've checked over a dozen postcodes (sadly enough) and if you are within a 5 mile radius of the city you get preference Argos have had our money for a month with no goods. Already had a check for £14.00 due to the reduction in price for a bookcase that's delayed too. Is there any way I would be able to speed up delivery or am I stuck with a pile of clothes on the floor and a deficit on my credit card balance? Thx
