  1. I have received a court summon from a debt collection agents for a debt they bought from HSBC bank. I like to contest the proceeding on the grounds: 1. The amount was a disputed amount and I wrote to HSBC many time to sort it out before I can pay them the amount, but instead they sold the debt to a collection agent. 2.I do not recognise them as a creditor and Collection agent has no right to this debt, as I never had any agreement with them. The agent's own stake in the debt. is probably 10% and they are claiming 100%. 3.HSBC has no right to sell my information/debt, to a company which is not regulated by a financial regulator. I have read in the cag sometime ago that these debt. collection agencies cannot claim debt. successfully in the courts, is it True? does any body have any information about this? Can someone please help me file a defense for this case, or direct me to a link. highly appreciate it. I have about 10 days left to file a defense. Thanks
  2. hi all just need a bit of advice being chased for a debt of 13k by mkrr for an old hsbc loan from 2006, no payment or acknowledgment has been made since jan 2007, there is no ccj against this debt and the default fell off my credit report jan this year am I right in thinking this debt is statute barred .
  3. Hello, I'm hoping that someone on this forum will be able to help with the situation i find myself in. I today received a court claim from MKDP LLP for 16,368.28 for an old loan and overdraft from the HSBC Claimant: MKDP LLP Issue Date 14 March 2014 Particulars of Claim The claimant claims the sum of 16,368.28 being monies due from the Defendant(s) to HSBC Bank plc under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the Claimant on 28/11/2013. The defendants account number was xxxxxx/xxxxxxxx. It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant(s) has failed to make payment as required by the statutory default notice served by HSBC Bank plc. The Claimant claims the sum of 16,368.28 and costs. The Claimant has complied, as far as is necessary, with Pre-Action Conduct Practice Direction I'm assuming that this claim is for both the overdraft and the personal loan. The overdraft was around £1500 and the loan was around £15000 all were taken out before 2007. As it was quite a while ago i can't remember when the loan was originally taken out but it I think it was 2006. The loan and overdraft were defaulted in November 2007. MCS were originally passed the debt after i defaulted. After the default i contacted the CCCS who helped me put a budget together which i sent off and was accepted at £5 per month. I continued to make payments until 2010 when i found that my earnings (I'm self-employed) dropped considerable and i had to cease making payments. Since then the debt has been passed to numerous different collection agencies.(I think it's been through 4 different ones). After the debt was passed on from MCS, of which i didn't get any notice, I wrote to each collection agency asking for a copy of my credit agreement and notice that the debt had been passed over. Requests were ignored, and after going back and forth asking for information the debt was then passed on to another collection agency and the whole process started again. Now it has landed with MKDP. I don't believe i received a Notice of Assignment from MKDP. I do think i received a Default Notice form the HSBC back in 2007 but i can't find a copy of it I have never received any Notice of Default sums, from anyone I found your forum and people in similar situations, so i hoping that someone will be able to help me moving forward. This court claim has come out of the blue and I'm quite anxious about it. There is no way i can afford to pay it back, and as I'm on a low income repayments would be very low. I've had a look at the CCA1974 request, and a CPR31.14 request - am i right in thinking i need to send these to MKDP and should i do this before responding to the court claim? Any advice as to my next course of action would be greatly appreciated. Andy
  4. Hi I'm not sure if this is the correct place to post this but I have received court paper through the post from MDK regarding a HSBC account for £645. I only had a basic current account with them with no overdraft so I can only conclude this figure is made up of charges. I was in the process of reclaiming charges several years ago (unsuccessfully ) I've never been in this situation before so I don't know what to do and am very worried - I work and my other half takes care of our young children but we normally have nothing left from my wages after bills and about to start a claim for housing benefit as our income has gone down again If anyone can offer me any advice I would really appreciate it, as the stress is making me so ill.   5. overdraft: Account opened: July 1997 Last payment: September 2010 Current balance: £2000 Status: Gone away credit card: Account opened: July 1997 Last payment: August 2010 Date defaulted: Feb 2011 Current balance: £6000 I have an overdraft and crdit card with HSBC, it was a young savers account and converted to student account and then joint account over the years. I think that opening date of 97 was the student account but Im pretty sure the same account number existed since the 80's. I lost my job and used the overdraft to make a mortgage payment, my credit cars which was high was also run up further while i looked for work, then when I did find work I found my monthly salary wasnt enough to get me back to £0 on the overdraft and things spiralled. I opened a new bank account and then wrote to HSBC explaining my difficult situation and basically have heard very little since, especially on the overdraft. I also have a credit card that I sent the CCA and SAR letters and did eventually get a large box from the SAR request, but they admitted that they held no agreements to satisfy the CCA request. They attempted to open a case in he bulk Northampton court but it was thrown out when they failed to provide the evidence required in time. I have had the usual letters from Metropolian and DG Solicitors but I am unsure of what to do if anything. I have been saving with the aim of making full and final settlements to all of my debts but I owe close to £40,000 in total and Im not sure how I should prioritise.
  6. I'll start at the beginning because this is a complicated one! 1. Opened up a joint account with husband at HSBC. 2. A few months later in July 2006, we applied for an overdraft, this was granted. 3. Autumn 2007, we opened up an account with LLoyds TSB & they transferred the O/D. 4. In the last 6 months I've started to get letters from Raven/MKDP asking me to pay back £1709.01. I sent letter back disputing this, even did a CCA request, which I now know was pointless. What I have had back is some historic statements dating back to 06/Nov/2007 with a balance of £1201 O/D. This account then has lots of fees/charges added to it until 09/Jan/2009 when the balance is now £1709.01. 5. Had notice this morning that a claim has been filed at Northampton County Court. 6. I called MKDP to ask if I could ask to make a SAR, was told I couldn't do this!! I don't know what to do for the best now, as far as I'm concerned the balance was transferd over to Lloyds TSB & the O/D was £1201. Any help would be much appreciated!
  7. Had a VERY upsetting afternoon. I suffer from Hypothyroidism and Hashimoto's Disease. Quite common but only been diagnosed a short time and still trying to get medication correct. I was a Carer for my mum for 10 years but I have now lost my home due to her having to go into a home. I am currently with friends and on benefits. I have many problems which I won't go into here. Because of this, last Jan or Feb, by luck I spoke to someone at HSBC about excessive charges which some got refunded and others didn't. He set a plan in place whereby, because of my long term situation, they were not to charge me overdraft charges. I had to phone every 3 months to reset the plan as they could only do it at 3 months at a time. This seemed to go well until one girl raked me over the coals asking me many questions about my expenditure and that she wanted me to cut out my spending. A few weeks later I got sent a new debit card. I knew nothing about the old one being lost, as I thought so phoned the bank. To cut a long story short she had, unbeknownst to me, cancelled my debit card which was contactless and sent me a non-contactless one and on further investigation had cut my spending limit per day from £100,000 to £10,000. Now I can't afford to spend either but the customer adviser told me to complain. I did and they apologised and gave me £50 compensation for the trouble. EDIT forgot to say here, I was "punished" for being poor by having the contactless thing taken away - I couldn't really care less but it's the principle. So, re-setting the plan with the bank worked well til today. It took 2 1/2 hours of them asking me very invasive questions about things I had purchased upon my account, wanting to know what was wrong with me and when I would be working again and making me feel like I was lying and probably a criminal. "You bought something from Amazon, what was that for?" Do I have to go through this discriminatory behaviour every time I renew this plan? They tell me I do because for some reason they don't want to look at incoming and outgoing and see my position hasn't changed. I am not a wimp but this has left me very upset and distressed. What can I do and who should I contact please?
  8. Hi All, I strongly believe I am a victim of fraud and I have been cheated, and HSBC is doing nothing to help me. Chrono of events: Jan 13 - Placed order for one (1) iPad Air – Space Grey 32GB WIFI & Cellular, Paid £406.91, via VISA Debit card on HSBC website. Jan 27 - Cancelled order due to non delivery of the Ipad. Jan 30 - Refund was to be issued within 24 hours. Feb 12- Still no refund. Company said refund being processed. Feb 18 - Received Email notification that Company has ceased to trade Feb 19, 20, 21, 24, 25, 27, 28 and Mar 3rd - Company has been informing me that funds have been released to them, my refund has been 'processed' and I should receive confirmation. Repeated empty promises after empty promises - but I have yet to receive anything until today. I called HSBC and they said because I had authorised the payment as a BILL PAYMENT on HSBC website, they will NOT issue a refund to me, and there is NOTHING they can do. I have complained to the FOS and lodged a complain with Action Fraud. I am running out of ideas. Please Help??? I really feel exasperated. I can't get a refund from this Company, and nor can I get a refund from my Bank. I am left empty pocket
  9. Hi there, first time forumite so please be gentle. I have an extremely long running case with HSBC over our credit card bill and I now find myself in a very specific situation and I'm not sure where to go for help. As a very brief summary; I tried over the phone to pay a sum from the outstanding balance that was over the minimum payment I was told I could only make the minimum payment over the phone and for anything greater than that, I'd need to go into the branch I went to the branch and the only way they'd let me pay was with cash, not card When I complained, I was told that this was in the T&Cs that I signed, 12 years ago when I opened the account I asked for a copy, under the relevant Civil Procedure Rules and they wouldn't provide me with them I've complained to the Ombudsmen, they've ruled in HSBCs favour My argument is that if they are imposing practices that they say that I agreed to when I signed the agreement, they should be able to demonstrate that I have indeed agreed to it. Without this evidence, their practices are unfair and they should have let me make a payment, for any amount I liked, via any channel available. I have experience of working in the Financial Services Industry and I know that Credit Card companies will (and do) make it as difficult as possible to clear down balances (ask your card company to explain residual interest for example, it's great fun listening to them try). But given that the FOS has ruled against me, I'm not sure where to go with this now. I've been fighting the good fight since January 2012, I don't want to give up.
  10. I have today received a CCJ claim from the Northampton County Court Bulk Centre, for a credit card that was held with HSBC a few years ago. The last statement I can find for the account is 2009, although the assignment to the DCA was later than that date. Having read through the forums for some advice (which is very handy and I'm very grateful for) I'm going to write to them tomorrow with a CPR31.14 requesting the agreement, default notice and the assignment. From people's past experiences, what are the chances of them providing this information? And do they have to provide the originals, or just legible copies of the originals? And am I correct in thinking the fee to enclose is £1? If they do provide the info as requested, and I have no other defence, I can't afford to pay them the amount they're requesting. I could offer to pay them a token amount every month or I could borrow a lump sum and make them an offer of a full and final settlement, although it would be much less than they're asking for. Either way would I still end up with a CCJ? Many thanks.
  11. Help with aggressive HSBC AND EVERSHEDS ! A family member incorporated a business in 2007 with a partner and 8 months later they were offered a loan of nearly £400,000 by HSBC (they had no trading record at that time) to buy a business. Both parties needed to secure the loan. The family member needed to guarantee their part of the loan but also needed to have a security guarantor as they had no assets or trading assets. The family member put sever emotional pressure on their parents who agreed to be guarantors using their house as security, joint and several. The family member then stopped all communications with parents and in 2010 went into liquidation leaving the 60+yr old parents high and dry. There has been much investigation done into this matter by parents and with the costly advice of a solicitor(which they cannot afford any more), and it turns out that the following has occurred-all supported with documentation -The bank and solicitors and business bought in 2007 all knew each other -the loan was irresponsible lending as the incorporated business had no trading assets and had only been running for 8 months -for the guarantors - no indépendant légal advice was given, no cooling off period was offered, no copy of credit agreement setting out payment terms and amount etc was given , no survey done on property or background check(i.e. age of guarantor) done -legal charge was signed in front of family member,and with all parties of the business present by the banks recommended solicitor -no yearly statements by the bank as to the payments made has ever been sent to guarantors. -guarantors had nothing to do with the business and knew nothing of how it was trading -no whitewash procedure was ever carried out over the business that was being bought -no financial gain was ever offered or received by guarantors -2010 family member sold part of the business and then went into liquidation-mislaid monies found in 2013 -HSBC AND Eversheds continue to avoid providing documents or breakdown of the debt. -issues have been raised over the legality of the legal charge paperwork and its registering -guarantors been threatened with legal action 4 times over the last 4 years. On the first notification that the debt was due in 2010 the guarantors independently sort the advice of a debt advisory service and completed a statement of means, and made some payments but were later advised to stop while further queries were made. -guarantors unsure if bank or solicitors have followed MARP or banking protocols, -guarantors now have completed statement of means again for Eversheds as advised by solicitors (they are no longer acting for us as they need to get paid even though they say we have a case). We desperately need help with this matter-both parents are ill one with cancer and have no funds. I am supporting them with all my wages(at the detriment of my own young family) and cannot begin to imagine how loosing their home would effect us all. It now seems inevitable that they will loose their home as we cannot afford to fight them off and they are determined to ignore any requests, lie and get away with it. Please can someone tell me that we have a case and what can we do about it. Having never been in this situation we don't know where to turn. Financial Ombusman was rubbish and didn't want to know. If it goes to court will a Judge at least listen to all the facts and do we stand a chance of having no possession order. And if they don't persue it through the courts (bearing in mind that it has been 4 ys) what can we do to stop this painful process. We are at our wits end and its heartbreaking to see your own parents cry. It has torn the family apart. Especially as the family member has a lovely new car and very very well paid job.
  12. Hi I received a call this morning from a company called MKRR asking about payment on an HSBC account. Never having had one suspicions were raised. I asked her what the debt was (credit card) how much (£1605.73) when it defaulted (14 January 2008) if that meant statute barred - no as payment of £30 was made in 2009 As I told her I had no knowledge of this debt I asked for proof of debt to be sent out - default notice and proof of last payment. She said the notice of assisgnment was proof of the debt but I wouldn't accept that as any company could send me a letter saying money is owed but that doesn't proove that said debt actually exists. She was also unable to give me proof of when/how last payment was made as it wasn't made to MKRR. The call ended with her saying statements will be posted out to me. Later on today the postman comes with a letter from MK Rapid Recoveries dated 11 February saying: "Further to our recent communication regarding transfer of ownership of your balance we have not received your offer of payment" Does this company just buy statute barred/near-barred debts? And am I right in believing that a notice of assignment is all the proof they need of a debt existing being a pile of poo?

Hi this is my first post on CAG.I have however scoured your pages many times and used the information you provide to good effect reclaiming many thousands in charges Alas the golden years are now behind us. I worked for TSB bank 1988 to 1999. I have started a letter to reclaim charges applied to my partners account from 2009 to 2013. Many appear straight forward eg returned dd or informal od charged when funds deposited on the same day or £25 charged for a £15 informal ovefdraft request. The next part is aclittle trickierand therefore I would invite opinions and comments with regard to bcobs, charges etc. In the explaination of hsbc charges it expliakns that items are not automatically returned but each time an item is presented for payment it is considered before a decision is made and when a decicion is made there may be a charge accordingly. In a recent communication online to hsbc re a formal overdraft Iivreceived a respose whichcstatedvthat a marker was put on the account in 2010 which precluded any form of lending and the marker would be reviewed on an annual basis. I have checked the statements and since the marker was put on the account no obe informail overdraft has be3n granted and any direct debit presented have been returned even when funds deposited on same day. It is my belief that this marker overides all decisiohs to pay items when presented and insufficient funds availiable and is in conflict with hsbc promise not to automatically return items and to consider items as they are prevented. But would this be considered unfair under bcobs.
  14. Hello All, (sorry I think I may have posted the first copy in wrong area...newbie lol) I hope someone can give me some advice on this matter as not sure where to go from here? In a nutshell, 6 months ago HSBC closed my credit card account after I alerted them to fact I hadn't received my new card at the same time as got my debit card as usual (I only noticed a few months later as I only use my card in particular times of year). They were in process of sending it out to me again when the account was closed with no notes and no one signing off on it, according the the advisor who had been helping me and was no longer able to. She said it was not the usual protocol and suggested writing a formal letter of complaint, which I did. I was told the account was closed because I no longer "met the criteria". I asked for a copy of said criteria. I not only couldn't get that, I couldn't even get any advisor to speak to me in a branch, they all said once it was closed there was nothing they could do in branch and couldn't help me. They would send the receptionist out to tell me there was nothing they could do and not even come out personally to speak to me. I then went to the Ombudsman. After 6 months of waiting/bothering (probably about 10 calls in total to HSBC, Ombudsman, formal letters to both, and about 4 trips to both the Bristol and Cwmbran Wales branch) they admitted fault through the Ombudsman but with no letter or information about what happened other than they admitted fault and offered to compensate me 100 GBP, and seem to only be willing to reinstate the card account when I accept this payment which makes me feel a bit blackmailed really or coerced as I feel 6 months of my time, I am self employed as a club promoter and dj (hence I use my card not all the time but for flightsicon, visas, hotels, etc) in this time I had to have other people cover costs for me (so technically I am not out of money per se) but it was a lot of hassle!! Some tours I didn't partake in because I couldn't front the international flight while invoicing my clients like I would usually do. I still do not know for sure if my credit rating is affected by this and how to triple check? (I am originally from the US so I don't know UK legal/credit system well - though I am a resident of UK). It's hard to calibrate how much this "cost" me, but I was definitely inconvenienced more than 100 GBP as I run my own business and depend on the cards, despite not using them that much..the times I use them are "club season" which is say Feb - May and Sept - Nov for me especially. So when I told HSBC in July that I hadn't noticed as I don't use the cards that much, I didn't mean never and that they weren't very necessary when I did use them. I just didn't do loads of personal shopping or holidaysicon or use it every week is what I meant. It is for special, business, purposes. I lodged another complaint at the time of this one...which was simply they charged me twice for my monthly debit for the card. I made a stink to prove how they can make a mistake, as this was still at the time they were denying their error in the credit card closure. That took 45 mins and talking to three different advisors to have them admit what I said from start of conversation, which was they obviously charged me twice, as the amount is exactly double (they hilariously tried to convince me that the interesticon could go up 100% from one month to the other with no notice or formal letter etc). For that trouble they compensated me 50 GBP. So I don't see how 6 months reflects only double compensation of 45 minutes on an in branch phone. My question is, if I am not happy with this offer, where do I go from here as feel the Ombudsman, who is meant to be in my favour, is also pushing for me to accept this, and I am not looking for loads of money or anything, but I feel it grossly under reflects my stress and life upheaval in this time and frankly takes the ****. I want to be clear that during this 6 months, I paid all the monthly fees and interest still I believe being incurred. I have never defaulted on any loan (or had any) overdraft, card payments. HSBC told me themselves a few months prior to the incident that I had stellar credit with them. Can I take it further or should I just let it go?

Is this because, No one is successful They impose a confidentiality agreement in the settlement Complainants give up They send the "Boys" round ?   17. Hi all I have been banking with HSBC for some years now. Last week I applied for a loan via on line banking. I was told my loan had been approved, but could not complete on line. They asked me to call to arrange a time for me to see the bank to sign for the loan. I called the number and was told I needed to take some ID with so I can sign the agreement. I did print out the screen telling me the loan had been approved. As it was Sunday and the banks closed, I went to pay £200 deposit for a car. When I went to the bank on the monday, they told me I had in fact been declined. Because of this I have lost my £200 deposit. Can this be done? Many Thanks
  18. Hi all In October 2009 I defaulted on an HSBC overdraft, £700 of which was charges, the other £700 ish the actual overdraft. They didn't get in touch until last year (I had previously looked in to a DRO but HSBC wouldnt confirm the details to me as it had been passed to a DCA, my circumstances then changed and I was able to negotiate the other debts I had at the time) The account was originally opened in 2005. I sent MKDP LLP a CCA request, they took a long time to respond and finally responded saying that the account was opened 'interpersonally' (whatever that means) and therefore no agreement was necessary? I've read elsewhere on the forum that pre-April 2007 CCA agreements are required or the debt is unenforcable, can anyone confirm? I now can't afford to pay this debt having exhausted my options previously; I'm begrudged to play ball with them / HSBC when there are so many charges on there and this could have been resolved years ago if they had given me the info I needed for a DRO!
  19. Hi Guys, Im a newbie here and would really need your help, I've been mis-sold PPI and would like to claim back. I have discovered that I had PPI from HSBC from a £1000 loan. Just found out that I have been paying some sort of PPI every month on my Burton Store Card, (I don't know how much I have paid, all i know Ive had that card for years!) And im not sure I had PPI on my Barclay credit card. Can someone please tell me how much will ill be able to get back. And also may layman terms explain to me in bullet points on how to go on about claiming them back. People please help me, I just want to clear out my debt and would really appreciate some angle here will get me through this.
  20. Hi All, I had an HSBC credit card. Defaulted in 2011 and was passed Metropolitan. Payment plan in place with standing order. I then got a couple of letters from 1st credit chasing the balance, then passed to Connaught collections about the money. I have ignored all of them as im still paying this Standing Order each month. I've now received a letter from Connaught saying its passed to their solicitors Judge & Priestly who want the balance in full in 16 days or their client "may" issues proceedings. Thing is the solicitors letter says.... "We are instructed by 1st Credit that you entered into a written agreement numbered XXXXXXXXX with PROGRESSIVE CREDIT LIMITED. That number does not tie up with the Metropolitan one. Have checked my credit file and its says Credit card from 1st Credit but scroll down and theres also credit card from HSBC. So, I guess i should CCA request but do i send to Judge & Priestly or Connaught Collections? And what about the payments Metropolitan have been taking all this time?
  21. Hi all, I am after some advice. I have a CC debt with HSBC I defaulted on in 2010. Since then they passed to MCS and I have been paying £80 a month. Balance is now £7800. obviously I have a default on my file. I am hoping to do a full and final settlement offer with MCS but need advice on how much to offer, what I need to make sure is done and will this improve my file at all? I have noticed on Experian that HSBC are still marking defaulted every month. From my understanding the default will fall off my file in 2016. is this correct? thanks for your help
  22. I have recieved a reply back from HSBC with reference to a claim I submitted 23.10.13 for mis-selling on 3 credit cards I had with what was Midland Bank, from 1993 to 1997. I received a reply back 28.10.13 to say they will be investigating the issue raised. Further letter to say they would come back to me by 24.12.13. Received letter dated 17.01.14 quoting 1 of the credit cards offering £2,029.61 redress for full and final settlement and would be using it to reduce the outstanding debt with Metropolitan Collection Services, the account they refer to was for a personal loan I had taken out with HSBC before I lost my job, which has an ongoing CCJ against it, it is not a problem doing that, it just feels they are taking my money and giving it to themselves. They say that as a result of their investigations they are prepared to uphold my complaint, as your complaint has been upheld I have not addressed the individual issues raised (not sure what that means) then proceed to give me an explanation of calculation. (dont know how to insert document into thread) but does say that this covers all credit cards, some cards may not be listed as they are no longer held on our records. I am really pleased with the offer as the sums concerned on the credit cards were relatively small and happy to sign the acceptance I just wanted to run it past you more knowledgable people first.

  24. Hi All, Having finally come to terms with the severity of my financial situation i am now about to start my first steps with the kind help of StepChange. Your help, advice and guidance will be greatly appreciated as i have no income and have to leave my privately rented flat within a month... My current account with HSBC has had an agreed overdraft limit of £2000 for about the past 5 years ( having had a reasonably paid job ). I also have a credit card with them with a limit of £12,000. My account has been incurring charges for about the last 5 months and recently i have has letters to state certain debts haven't been paid which the have had a knock on effect with other cards i have. My Credit card has gone over its agreed limit a few times and i have been able to pay the interest to bring it back to £12k but can't anymore so again is 300 over £12.3k limit. I have had the CC since 2003 and normally had balances of 3-6k. I have just noticed that i am not covered with Payment insurance they have always been charging me and did ask for or notice until i got my self into this mess. Annual review letter states : last year i paid £818.69 ppi. So now i incur over dawn and over limit fees for both my current and cc accounts. Is the a way i can get some advice and to put my mind at rest and have some glimmer of hope as to how much if any i could expect to receive? I asked HSBC and they told me to speak to Aviva? Basically don't want to know. I another two cards with barley card again both to the limit, but no ppi as i think i cancelled, can i still claim for that ? Many thanks all N
  25. Hi everyone, Just after a bit of advice. I received a letter a few weeks ago from one of my credit card providers (Barclaycard) telling me that they had identified that there is a chance I may have been mis-sold PPI on my card...which was news to me as I wasn't even aware I had it! So, I have logged a complaint with them and I'm waiting to hear back. The fact this was applied to my account without my approval made me wonder if any of the bank loans I took out in the past had it applied also, but if I'm honest I was fairly sure it wouldn't have been as I know I have never asked for any form of payment protection on any of my loans. I called HSBC and asked them to look into my old loans I'd had with them, and whether I had been paying PPI on any of them. They found minimal information (just loan reference numbers and the dates they were taken out), but they did confirm that I had, to my surprise, paid PPI on all three of them. The first loan was taken out back in 1999, the second was in 2002 and the final one was in 2004. I was told by several people in the course of several phone calls that they hold no further information on any of these loans - they couldn't tell me the amount of each loan, how much I'd paid in PPI, my monthly repayments - nothing. However, on one occasion I spoke to someone who miraculously DID find details of the last loan, showing the loan date, total amount of loan (£6616.65), and a breakdown of all my monthly repayments (£183.65 per month). This is despite being told several times that they had no information at all. I asked if they could send full details of this to me by post. So yesterday I received two letters from HSBC. The first one I opened echoed what everyone had told me - sorry, we don't have any information, bye! I then opened the next letter, which was a statement showing full details of the loan. So, I'm hoping that I should be able to claim at least for the last loan (which actually included some of the previous loan, i.e. I re-borrowed). I'm not holding out much hope with the other loans, as I have no paperwork whatsoever, and it seems they don't either, so I guess that's gone. So far I have registered a complaint via the FoS. I have received a letter from the FoS confirming that they have registered the complaint with HSBC and they now have 8 weeks to respond. So, does anyone have any advice regarding roughly what I should expect from them now (besides the obvious denial of any wrongdoing!), e.g. what kind of settlement is reasonable versus what they are likely to offer (if they offer at all) etc. Thanks in advance for any help/advice anyone can give!
