    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Another one for Debt managers -(although I have told Lloyds that I am looking into a harassment case and will be jointly naming them if I take it on)

 

Letter giving me a date that they 'may' take legal action

monkey who tried to tell me that a judge would refuse any offer of payment hat they had refused - called him a liar straight

Letter threatening IMMEDIATE legal action - no use of the word MAY

Two weeks later a slip telling me that Mr something would be calling between certain hours but no date to say when it was sent or when he may be calling - ooo I got all panicky at that one :rolleyes:

Letter from Russell Aitken which interestingly had the exact same layout as Debt Managers

Letter form Parkgate Investigations AGAIN same layout as DM - they must have LOADS of different headed paper in their office

Second letter form Parkgate

Letter from Call Serve apparently acting on DMs behalf - now I have no contract with DM so I am thinking Data Protection has been violated here as I thought the DCAs were acting on behalf of the Banks not each other when they don't own the debt and until they own the det surely they don't have the right to process my info to a third party

Now its back with Lloyds

If you can keep you head when all of those around you are losing theirs try parking your helicopter somewhere else

on a payment plan with ..debt managers ..all of a sudden get a letter from call serve asking for full payment ..CCA on its way .also for debt manager to agreeing a payment plan just to pass it over to any Adam

 

LOWELLs for refusing to give bank details so OH can pay something..And ignoring every email/recorded letter sent

Its essential to keep the complaints going to TS and Consumer direct.....at the end of the day every one counts.

I have complained to TS about Phoenix recoverys, Wescot and Moorcroft. They weren't interested and did absolutely nothing. I am still being harassed by Wescot and Halifax phone my number up to 10 times per day even though they have been told in writing to send letters only. Fortunately the phone they are ringing is a virgin media line which we don't use as we have BT, its only there because they gave me it free as part of a deal to keep me as a customer. We cannot plug a phone into it. Once it stops ringing it starts again and when its answered it an automated voice checking sho you are to put you through to an adviser.:mad:

Maybe you will get more joy then to report the others to their home area TS.

I agree theres many trading standards departments who are simply not up to scratch with the laws and frankly cannot be bothered with the types of issues we have seen on the increase.I had this experience with my own-they wanted to send me to the CAB-the CAB wanted me to contact consumer direct.

Consumer direct wanted me to contact my local trading standards.

In the end I wrote a quite strong letter to the manager of my local TS spelling out what I expected them to do-and detailing my rights to have it sorted.

It did the trick-they sorted it in a week (I had been on it for over 2 years !!!)

So shows it can be done.

 

 

In the case of Halifax-are you getting 10 calls a day from them now ?

I would like to add Barclays Bank plc T/A Barclaycard,

- for pretending that I had a Barclaycard after taking on an old account from a failed CC firm they had bought out,

- for failing to take proper care of their vital business documents :rolleyes:

- for taking absolutely no proper notice whatsoever of the fact that they are in default

- for taking the view that the account is not in dispute when there was no letter of assignment and there is no CCA :rolleyes:

- for declaring that, despite the above, "Collection will continue!" (oo I am so scared of the stern lady quiver quake :rolleyes::p)

- for constantly telephoning me when they have no lawful reason so to do :(

- for stressing me with their pretense and so causing a past condition to re-appear : my immune system became ineffective once more which totally spoils my life : HOW FVC

- for Mercers

 

Actually, I take that last one back, Mercers are a source of amusement because they give every impression of being a dormant company with no real address - their letters carry a PO Box in Liverpool but they send theor mail in Barclaycard envelopes with a return address that's a PO Box in Northampton. And they seem unable to write a proper DN ... :rolleyes::smile:

Advantage Credit - called and asked me to answer security questions to which i refused and he said "I am from a debt collection agency and we will take you to court if you don't answer my questions" To which i replied that fine take me to court and i will see what the judge says when this call is played in court and they find you have just broken Data Protection Act guidelines by disclosing account details to me without confirming i am the account holder. He promptly hung up!

Mackenzie Hall- Still constant calls even though requested by writing only to be contacted by writing, threatening behavior on the phone "i suggest you find a way of coming up with the funds because i cannot possibly accept a payment plan"

This is great! It's about time we fought back against these lowlifes.Want to mention Arrow Global LLC again, together with their accomplices, Eversheds solicitors. Failed to respond to CCA request over one year ago. No communication or any documentation whatsoever. Then started chasing again recently, with the usual misinformation about legal action and still no documentation.Also Equidebt - they continue to ignore requests to communicate in writing only and are particularly dumb.

Moorcroft - For trying to recover a debt that was in dispute. Saying they would look into the situation with the OC, but instead fabricated a payment agreement and then told me I had defaulted on it. Then taking the pound I sent with my cca request towards the debt.

 

Lowells - For showing up out of the blue with the debt that Moorcroft had washed their hands of 2 years earlier. Then passing it on to their other department Red who sent a letter with some completly made up information to try and convince me that i owed money and should pay up, despite the fact that i had sent a prove it letter which I got a response to about 2 weeks after the red letter. Still awaiting a response to a letter I sent about the red letter which I am sure is verging on some kind of fraud. Been waiting over a month now

Connaught collectiions who phoned my Mother & threatened her with Baliffs if she didn't tell them my address, this has happened a couple of times, i'm thinking they must be going through the local phone book & contacting anyone who has the same surname as me!!

First Connaught Collection on behalf of 1st Credit! They threatened with a Statutory Demand & i had to go to court to defend & won!

Then a couple of years later, 1st Credit decided to start themselves in January 2009...until i wrote complaining to Barclaycard, who eventually admitted fault!

 

Nevertheless, Connaught/1st Credit threats to bankrupt me via the Statutory Demand and take my belongings, property etc, was well below the belt!!!!

JBDR debt collection... Making out they had started a bankrupcy case against me, numerous phone calls even though they've been told to stop.

 

Also they are chasing a statute barred debt!!
