  1. Thanks for that. I'll get the form sent back to the court & do the letter to Arrow Global & see what comes back. Where it says that the information has to be presented to me by a certain date, is that the 14 days from the date i recieved the court papers?
  2. Your right about it making your head spin. I read it through last night & still don't understand it fully, but having discussed it with OH, i'm going to send whats needed back to the courts & see what happens from there. From what i've read they'll have problems enforcing the debt without the agreements i've requested. I havn't worked for a few years & don't recieve benefits but if it comes to it, my OH would pay affordable monthly payments to pay the debt off. We were looking to sell the house anyway, but don't want to be pushed into it, we'd rather do it on our own terms! Does that sound ok?
  3. Thanks:) Does everyone think thats the right thing to do, send the form back to the court? Or is it better to go the set aside route?

Ok, So i've just spoken to Guildford court asking them what the paperwork was all about, i said that i really didn't know what the debt was for & i'd contacted Arrow global for a CCA & SAR & had heard nothing back after 3 1/2 months. Also asked why there was no date set & he said that it won't be set untill 14 days after the date on the letter recieved (5th Nov). So basically he's advised me to send the N210 form back (acknowledgment of service form) ticking the 'I intend to contest this claim' And put a note in saying that i don't know what the debts for & have requested CCA's & SAR for the account which has not been sent. Is that the right thing to do? And thanks for all your help:)
  5. OK, i've re read, is the application notice form, the N244 form? And do i have to take this direct to my local county court? As i put before would someone be able to take this for me as i'm not sure i can get there. The support for my application, is this the fact that i havn't been supplied with a CCA & SAR? And do i need to include copies of the requests i've sent & letters recieved back from Arrow global? Lastly, if all this fails & it does end up in court, instead of the sale order going through, is there anyway i can offer to pay something so we don't lose the house?

I believe the original debt with Lloyds was for £3500, i've just checked back over the court paperwork i recieved this morning & the debt with costs is now £5200 & it's accruing interest of £1.04 daily. The letter i recieved back from Arrow global regarding the CCA i'd requested was that as they were not the original creditor so returned my £1 PO. Up untill that letter arrived i didn't have a any idea who the original creditors were so couldn't send a CCA to Lloyds. Also as far as i can see there is no date on the court papers as to when the case will be dealt with, it just says that the claiments final charging order to be sold without further reference to the courts & the estate agents have been chosen to conduct the sale. Thanks for your help, i'll have to re read to see if i can get my head around it all. At the moment all i see is us with a new baby & homeless!!!

  10. I've just found the N244 form on the court website. Do i just print this off & fill in the relevent details? Also would the reason for the set aside be that i havn't recieved the requested info from Arrow Global? ie: the SAR & CCA? And do i attach all the letters i've sent & recieved? All these questions probably sound stupid, but i've never had to deal with anything like this. And do i have to take it to the court, or can it be done on my behalf? I'm 5 1/2 months pregnant & have been pretty much housebound for the past 2 months. Thanks for your help:)
  11. Thanks for your help. I Didn't defend the CCJ. And as for any paperwork, so far they havn't been able to send me anything. How do i go about getting a set aside?
  12. No i didn't recieve a Stat demand for this debt, but did get a charging order in August 2008. At the time the house was on the market & i ignored the CO thinking i'd pay it when the house sold, which is didn't, i know i shouldn't have buried my head in the sand....but unfortunetley did!
  13. I havn't acknowledged that i owe the debt & i'm sure the original amount was for around £3000. When i first recieved the paperwork about this debt, i was told on here to send for a CCA & SAR, Arrow global refused the send the CCA as they said they were not the original creditors, but i have been waiting for well over 3 months for the SAR, to make sure the debt is definately mine.

  15. Hi, About 3 moths ago i post here regarding a Sale order on my property from Mortimer clarke solicitors on behalf of Arrow global. I was advised to send an SAR, which i did on the 16th July. I didn't hear anything ntill a letter acknowledging the SAR letter arrived on the 26th October, i was basically told that they were sorry for the delay & would get the requested paperwork to me as soon as they could. Today i recieved a claim form from Guildford county court, according to this they are pushing to get the sale order put through. Basically i'm not sure what to do next! As Arrow Global havn't issued me with the requested information what do i do regarding this claim, it's got 5 options for me to fill in, I do not intend to contest, I intend to contst, I intend to dispute the courts jurisdiction, I object to the claiment issuing under this procedure & I intend to rely on written evidence. I really don't know what to do next. Do i send the court all the paperwork regarding the SAR? I hope all that makes sense! Any help would be appreciated. Thanks.

Hi, I sent a CCA request to connaught collections just over 3 weeks ago, i had a letter the day after posting confirming they had recieved my request & were dealing with it, but they also said they may not be able to get the CCA to me within the alloted 12 days. After 20 days, & no CCA i sent them a account in dispute letter, again i recieved another letter from them stating: 'you have not specified upon which grounds you rely for your notice under s10 of the data protection act & therefore we do not consider this valid, furthermore this is not a valid request as it falls under the exemption in schedule 2 section 2(a) of the act' Could anyone let me know what this means? Thanks in advance.
  18. Connaught collectiions who phoned my Mother & threatened her with Baliffs if she didn't tell them my address, this has happened a couple of times, i'm thinking they must be going through the local phone book & contacting anyone who has the same surname as me!!
