  1. prettyprincesscharlie, If you call the number at the top of your letter, you can request the money be returned to you. They will send you a cheque in about 14 days (mine arrived in 3) As for your arrears, if you have already arranged for them to be added to the outstanding mortgage, then I assume that your monthly mortgage has gone up, in which case there are no longer any arrears (your yearly mortgage statement should show this)

I totally agree that you would pay less interest on a monthly basis but the point is they took the money under false pretences and the consumer should be able to decide whether to use it to lower their mortgage or not - not the Halifax. For the Halifax it is a paper exercise as it can be adjusted on their balance sheet without physically parting with any money. i.e. they can spread the estimated £500 million out over the remaining term of everyones mortgages by adjusting their year-end debtors and creditors. If the "average" amount to be repaid is £1667 as has been reported, then an interest only mortgage would reduce by £41.68 per year. £1667 X 2.5% / 12 months = £3.48 per month If you get the £250 then the saving is 52 pence per month. For people who are cash-strapped in these difficult times its not hard to see which option they would choose.
  3. My Halifax mortgage is interest only. As I was overcharged by them I will be arguing for the money to come back to me. It is not their money and therefore they have no right to say that I can't have the cash back and try and stipulate where it goes. If they allocate it back to customers accounts then it is just a paper exercise on their balance sheet, however if they have to physically pay it over it will hurt them and their cashflow, hence why they are in favour of re-allocation.
  4. As an aside to clamping vehicles left on private land, the rear of our office contains a small parcel of private land giving access to our garage by crossing the public footpath. On arriving at work I was greeted by a van parked half on our piece of land and half on the public footpath, blocking access to our garage, the local police decided as it was on private land they could not intervene. They were not bothered about it blocking our garage or the path (for which I have received parking tickets in the past). It was there all day causing all staff to use short term pay & display parking at significant cost and was finally retrieved by its owner late in the afternoon. The reason for it being left in front of our garage – the police had arrested the owner and placed him custody the night before and didn’t want the van parked at the kerbside. It’s a lose lose situation with no help from the authorities.
  5. Subbing....I have also had a letter threatening Aylesbury County Court (arrived yesterday). Out of interest, should I also send Credit Security the above letter? I CCA'd Lloyds regarding this alleged debt a few months ago, however I don't recall getting a response. Regards to all, Scubadiver
