  1. Hi everyone, I need some help with my recent Welcome Finance Claim rejection. This has been an ongoing issue that I have been fighting through Welcome Finance as the loan I originally took was made conditional of taking PPI. This has been my main point when responding to Welcome however this has been dismissed. My claim has been rejected as Welcome Finance feel that because i was a Mortgage Broker and therefore Regulated individual under the FSA. This is despite the fact I explained I was unable to / Did not sell PPI products as a mortgage advisor. The response I received is as follows: DECISION NOTICE Your Claim We regret to advise that your claim reference ******** has been rejected on the basis that the responses to question D2 of the application form indicate that your employment placed you in a position where could reasonably have been expected to make an Informed decision before making the purchase of Payment Protection Insurance. We do not therefore accept your submissions of Mis-selling in this instance. As far as I am aware this response is a cop out? Any help appreciated. Thanks
  2. Hi Ive have received a reply from Egg saying “After carrying out a full review of your account. I have etablished that you purchased the insurance through the egg website on XX Nov 2001 Our online sales process: - Does not require you to take repayment protecection insurance as a condition of obtaining the credit card. - Does not provide an advisory service - Required you to positiviely confirm that you wished to purchas this policy during the online application - Provided full terms and conditions of the policy and requested you read them before submitting” I was unhappy with this response particularly with the use of present tense and not past tense “does NOT require you to take repayment protection…” Can you please tell me my what the next step should be as I believ that the box was pre ticked or you could not go further unless you ticked the box. I have looked on the site and seen lots of answers but after reading so many Im a bit confuse. Thank you

Hi, I'm new on here, hope you can help Some weeks ago I posted my PPI reclaim documents to my bank (NatWest) and a few days later I received a text message from RBS saying, "Thank you for letting us know about your concerns regarding your PPI policy. We will acknowledge receiept in writing within the next 5 working days." This was about 5 weeks ago, since then I've heard nothing. Not received any written acknowledgement, email or any other texts. Is this normal? What should I do now? It seems from the text I received that they have got my documents but since then nothing has been actioned. Should I give them more time or should I chase this up? (who do I speak to?) Hope one of you guys could help me with this. Thanks for your time. Ginger.

I did not want ppi I was told if I did not get it I would not get the loan I was not told I could cancell at any time .If i had i would have cancelled as soon as money was in account. I was not told I could get ppi else where and probably cheaper. I only signed aggrement not ticked the box SORRY ! HAVE NOW DOWNLOADED PDF,S
  6. Hi all, Barclaycard recently refused my complaint against them for the miss selling of PPI which was originally on an EGG credit card. I then sent a SAR to them and the information arrived this morning. Not only does it not contain all the information I requested (about 5 years short of statements) but the letter says it also contains a copy of my original internet application. It does indeed contain an application but it is not mine. My question is where do I go from here as I'm a bit stumped, any help would be appreciated.

I have accidentally damaged my TV after having it for around 10 months... i am paying extra KNOWHOW insurance monthly and was told it was covered for all accidental damages etc, it was broken on the stairs once i brought it home from university!! I sent it off to be repaired and was notified by voice mail my television hasn't been repaired and needs re-collecting. I wrote this letter: I am writing this letter as my television was sent back from PC world without being repaired or any other actions being offered; I was notified by voicemail to write a letter with more information on how the damage has occurred. I bought the television whilst I was a University in Leeds and had to bring it home for the summer, once I had the TV back at my house it was getting it up to the third floor, once I was on second floor I accidentally tripped and the TV fell onto the corner of the table by the next set of stairs. This resulted in me falling onto the TV, twisting and bruising my hand. The TV is covered for all accident damages, which in my case it has happened by accident and there was nothing I could have done to prevent these damages. I then was told i would receive a call from a private investigator, i answered all of his questions and was told i would receive a reply within a week maybe two. 16 days later, [name edited] replied saying it was rejected, that was it, no reason or anything!! This is the next letter i sent and i sent and i am yet to have a reply, 21 days and waiting!! I am absolute disgusted in the way I have been treated towards making this Television claim, the accident occurred over a month ago, every time I was given a time I would be contacted, it has happened at the very end instead of been told straight away. It would have been a different matter if I had missed a payment, use would have been on my back straight away and I would have faced fines. When I received the call from the private investigator and I answered all of his questions the only thing he said that could be used against me was carrying it on my own. When I bought the television from PC World in Leeds, I carried it from the back of the store to the till, they watched me take it out of the store on my own and back to my accommodation, as they seen I was capable of doing so. They didn’t say two people had to carry it or offer me another option. I carried it less than half a mile, I set it up on my own after taking it to the fifth floor, all easy to do. Carrying it in my house once I broken up from University, taking it up the stairs was no problem; it all happened after an accidental trip, this would of still happened if there were two people carrying it. I would class myself as a strong build person, I could understand if I found the weight to of been heavy. I am not stupid enough to try and do something if in the back of my mind I can see it going wrong. When I bought this TV I was told it was covered for accidental damages and other things, I even took out extra KNOWHOW insurance as I was advised highly to do so. As it took me ages to save up and with it costing a lot of money I knew with this insurance Id always have it. You were quick to sell the insurance but not follow it through when something had happened. I was worried when I accidentally dropped it and visited the store in Teesside twice, both times I was assured that in my case it will be sorted, repaired or replaced and got told not to worry about it. I have been paying this £7 extra insurance for around 10 months I believe, which now seems like a bad idea. It took me a long time to save up for this Television and my claim is being rejected due to what is known as an ‘accident’. I have never made a claim like this before. Due to me being a Multimedia student I would class myself as a very loyal customer to PC world, not only me, but also my whole family. All of my technology is always from this store and I feel like I am being robbed from something I deserve. In last few years I have bought things like: · 3D Television · Apple Mac · Macbook Pro · Ipad · Sony Ipod Docking System · dLAN Wireless Powerline Adapter · Printer/Scanner The list goes on. I am always using this store for updating my things and adding to what I already have. I am only home for 2 months until I go back to University and have already waited more than a month, I ask kindly if you could go over my claim again and respond in better timing with hopefully a better result. If this is un-successful again, I will be looking to take this claim further.' I have now waited over 2 months, nothing has happened, im sick of waiting, what is my next steps can anyone help me win this case!! Thanks.
  8. Hello, I am writing on behalf of the wife who cant find her way around the site:|. She applied for MBNA credit card in 1998 when stopped by one of their 'reps' at a stand in a shopping centre. The card was repaid in full or balance was transferred, she thinks to Virgin. After calling MBNA they confirmed PPI was added and would send a 'offer letter'. Instead they wrote to her saying that as a UK resident betweeen 18 and 70 , in full time employment, non advised sale of PPI and she basically 'ticked the box' they could do nothing, if unhappy she could go to FOS and said there was an attached leaflet (there wasnt). Tricky bit here is she was a full time University student in 1998 with a part time job at Greggs doing all or some weekend work (is 16 hours a week full time? she didnt do this every week but worked most days during Uni holidays etc so as an average over the year probably did). Did she commit fraud in her application? She definitely remembers being told her application would be more successful if she took PPI because of her student status and only part time income. Is there a template complaint letter to FOS to review this or will she have to SAR MBNA first to get all the relevant info? thanks in advance
  9. Hi - Heard this morning one of my claims was rejected. Very early one taken out in a dealer in 1993. I was self employed at the time and still. This was the grounds for my complaint on this and other subsequent ppi complaints (the latter ones taken out in Blackhorse Offices). They have sent pretty much a standard response , acknowledging my self employment but saying " Your status at point of sale confirmed in your application meant that you were not significantly affected by any of the exclusions or limitations associated with your ppi policy". I believe I was adversely affected , but when I appeal ( all their lines are down currently!) do I keep to this defence or should I say about the whole premium was added at the commencement of the loan. I await three other ppi claims with them all with the same complaint grounds of self employment. I am most annoyed as when I called yesterday I was told the complaint value was being calculated, or was that to get me off the line !" Any advice would be much appreciated
  10. Really hope someone can help... I have had an account with Lloyds TSB for as long as I can remember and as part of this account, mobile phone insurance with Lifestyle Services Group. I have never had the need to claim but in March earlier this year, my husband lost his Nokia 8800 Arte. I reported to the police and to Lifestyle Services Group within a few hours of discovering loss. They finally accepted the claim in May 2012. I paid the excess and was offered 2 alternative handsets or a cash settlement of £350. I rejected these as I felt the phone was worth much more to which they said they would look into it. When i next chased it, I was told that the claim was being assessed again and was no longer an accepted claim! They were waiting for '3rd party info' and could not tell me when they would recieve this information. After numerous calls, in the middle of June, they finally sent me a letter saying they had rejected the claim as both the phone and the sim had been used after we reported the loss so they felt the circumstances in which we had reported loss were not accurate. I emailed them saying I wasn't happy with this decision and if the phone had been used, it had not been used by either my husband or I but they have simply responded saying I have exhausted the appeals process with them and I should contact the FOS if I wish to discuss further. Is there anything I can do about this or do I just have to accept this very unfair decision? It seems to me as though they just decided that they were not going to pay out for an expensive phone, no matter what... Please advise.
  11. Hi took out a credit card with the halifax around 1995 and did not know i was paying for ppi until september 2003 when i broke my left leg in two places . I rang the halifax about a personal loan i also had and because at the time of my accident i was self employed they refused to pay out . I got into a heated argument with them at the time but to no avail . So i asked to be put on the credit card side to see if that was any different . They also refused my ppi at the time so i cancelled it CC ppi . Roll on to march of this year i rang them to complain about the ppi loan as to why they did not pay out in 2003 and they paid me nearly £3500 even going back as far as 1998 on a previous loan . I decided to claim on the CC ppi and have just got back a reply today saying its rejected . I have downloaded the form from FOS is there anthing else i can do .

This weekend I’ve received a letter from Halifax rejecting a PPI miss-selling claim and I’d appreciate any guidance that can be offered over possible next steps Background to my claim is as follows Personal Loan taken out 12/13 years ago. I know PPI had been applied A SAR to Halifax returned the original agreement only, with no other data/information Submitted the claim, using the FOS Questionnaire and the CAG Single premium PPI spreadsheet My claim essentially stated that (at the time of the sale) Benefits & exclusions were not fully explained Not told it was optional Not told it could be cancelled Not told I could have sought cover elsewhere Not asked about my health or employer benefits Led to believe that PPI would enhance a successful loan application and was pressured to take out the policy to meet sales targets The reasons for rejection basically falls into a number of categories Benefits and exclusions were defined in a policy booklet sent to me at the time of the application I had 30 days to cancel and the agreement and policy booklet defined all of the costs Sales techniques used at the time meant that I wasn’t pressured No alternative products were available at that time Identification of particular needs would only have been taken where it was practical to do so Halifax are satisfied that there was no miss-selling Finally the letter advises I have the option to submit additional information, or otherwise I can take the complaint to FOS Given all of the above, it appears to me that Halifax are not rejecting the claim based on any hard evidence, but more over “what would have happened at that time”, therefore my interpretation of this is that it becomes a dispute over my word against theirs and therefore it will difficult to force a change in this viewpoint. Is there any guidance that can be offered about where I can go with this, or am I at the end of the road? I’ve got initial views, but would welcome any alternative views before I make any further decisions on this TIA

Hi Everyone, I am after a little bit of advice after receiving a letter this morning where Lloyds TSB have rejected my PPI claim, details of the letter as follows: Lloyds PPI Rejection Letter.pdf Is this a standard response? Should I do a SAR and get a copy of my application form, although it does goes back to the 90's? Do I complain back to Lloyds or straight to the FSA? Has anyone else been successful after an initial rejection? My initial application was made via a leaflet through the post, but a few years ago the TSB altered their cards to have a joint Amex / Mastercard, this is where I think the PPI was added, I wouldn't have added the PPI intentionally and actually cancelled the policy 2 years ago, there won't be much to come back like some of the claims on here but it could still be a few hundred pounds.   14. I sent off a CCA request to a DCA with a £1 postal order payab;e to the DCA. They have returned it asking I make it payable to the Creditor. They have also asked me to cinfirm if I have ever opened an accoun t with their client and the balance. They finally state if I am disputing the balance or feel it may be subject of fraud I should supply full details. What is the best way forward do I send a payment payable to their client, and what is their role in this matter
  15. I took out a Sainsbury's credit card in 1998. I filed a PPI complaint with Sainsbury’s two months ago claiming that I was mis sold PPI and it was added without my knowledge. It has to be noted that I do not have the Credit Card Agreement or the terms and conditions that were applicable at the time I took out the agreement. Sainsburys have denied my claim on the basis that they established that I have applied for this credit card in 1998 via post. The Credit Card Agreement had an optional tick box for consent of PPI and that box was ticked. Therefore I had knowingly asked for this PPI. I am angered by this decision. I don't have the Credit Card Agreement or the terms and conditions that were applicable at the time I took the agreement so I can't verify their claim. I have requested a copy of this information and waiting for it. I am sure that I didn't ask for PPI, in fact I can’t remember how I applied for this Credit Card. I applied for it in 1998. Could it have been that Sainbury's were selling the credit cards in their branches and one of their representatives filled the application form up for me and posted it?? Can anyone help me with immediate remedies! Please advise! Thanks
  16. I have written admission for the mis-sale of PPI. However I dispute the amount of compensation due and wish to proceed in court.
