  1. Last November I went overdrawn on a Flex Account Plus. (I hadn't asked for the upgrade, just got upgraded automatically after 18 months, couldn't be bothered telling them not to bother) Phoned Nationwide CS, the lady I spoke to told me there were some charges to be applied and these would appear on the next statement- December 2012. Doh! Without prompting from me, the lady then told me, that as a goodwill gesture, she would ensure that I wouldn't be charged after all, if brought the balance into the black the next day, which I did. I phoned again the next day, to get them to confirm that the charges wouldn't be applied and the person I spoke to assured me once again that I hadn't imagined the previous evenings conversation and that no charges would be applied. This time I recorded the conversation. I checked December's statement and true to their word, no charges had been applied. However, on January's statement there they were, but with no explanation as to where they came from... Also, last week I drew £10 from the cash machine outside my branch, at the same time I got a mini statement from the same machine to check my balance. While I was reading it, the machine took my tenner back! The tenner was not recredited to my balance. At least Dick Turpin had the decency to wear a mask. I don't consider that I have been treated fairly and intend to sue for reimbursement for both the above using BCOBS.
  2. Hi all, I have a flex account with Nationwide, that I had used between June 2011 - Dec 2012. I was using the account mainly as a bill paying account, and just transferred money from my main account to pay for bills etc. In Dec 2012 I stopped using the account, as my housemate took over the responsibility for paying the bills etc. In March, out of interest (was desperate for money and hoped to find a bit left), I checked the account, and found it was £15 overdrawn. I called them to ask where the charge came from, as I hadn't used the account in months. They told me that a standing order was returned in December 2012, and that a charge of £15 was added to my account at the end of Jan. Now, I have to admit that I opted for an online statement, and rarely bothered to check it. However, after this charge, I decided to check the account properly, and luckily they had all the statements available online for me to go through them. I found that between June 2011-Dec 2012 they had in fact charged me a total of £235.41! This included 13x Unpaid direct debit and standing order fees of £15 each. 2x Unauthorised overdraft fees of £20 each and 6x Interest charges of £0.41. I just can't believe that within 18 months of use they put £235.41 of charges on my account. A Flex account that shouldn't have an option of going overdrawn. As I am already using this fabulous site for help with an issue for JD Williams, I had a quick look around to see if there was any help available to re-claim bank charges. I was lucky enough to take Lloyds TSB to county court and win over £1500 back from them in bank charges some years ago, but since then I have totally forgotten the actions I took, and reading here rules seem to of changed etc. So, because I have been on long term benefits during the period I used this account, and from reading other peoples comments, I decided to use their secure messaging system to raise the complaint. (I would of entered the exact quote, but online banking is not available at this time ) I said that I was in severe financial difficulties, and under the BCOB rule regarding hardship, regulated by the FSA, I was requesting the charges be credited back to my account, to avoid court action. I received a reply today to say that they were sorry I was in financial difficulties, but that my account is being managed by their collections department, and that I would have to ring them directly, to discuss the issue. I have no intention of calling anywhere, especially as I can not record calls, and need thinking time on how to respond to things, so I have composed a letter to send into their complaints department: Basically, I want to know if I am taking the right approach to re-claim these charges, and whether the wording I am using is correct, before I send the letter above? Any help on this would be grately appreciated.
  3. a couple of weeks ago i sent off my claim forms to the nationwide just received s letter asking for the the following info who was my employer at point ofsale how long i had worked there full time roll and what benefits i was entitled to any changes in employment since taking card out in 2002 did i have any other income protection plans or other means of supporting myself is this relevant the point i originaly made was i was unaware i had it when i took card and a recent letter they sent showing my last 12 months ppi payments on this letter it showed my unemployment status as unknown how should i reply to this letter
  4. Hi everyone, I have recently received a letter from Nationwide about a loan I took out in 2005 this loan had "Loancare" AKA PPI. I had completely forgot about this loan and of course the attached PPI the interesting thing is that they state I have 3 years from the date of the letter to respond. If I don't then they state "You've three years from the date of this letter in which to make your complaint to us and the Financial ombudsman service(FOS). After this time we can't guarantee that your complaint will be considered" This is the first letter I have received from any lender regarding PPI that helpfully gives the account number. In fact I owe Nationwide a drink because I had a look at my CRF from 2009 and released I had a loan with MBNA that I had also forgot about thats another thread . OK on to the chase sadly I don't have the CCA but I don't think I need it. Details as follows Loan amount £4000 Period of time 84 payments Monthly Repayment £70.50 APR 6.7% So using CAGS superb spreadsheet this works out as follows :- 84 x 70.5 = 5922 without ppi this would have been 84 x 59.4 = 4989.6 So going back to spreadsheet the initial loan + ppi would have been about £4750 The ppi element is therefore ~15.7% and equates to £11.1 per month. I paid the loan off early and Nationwide have admitted that the PPI would have attracted loan interest so I bet that they never applied the correct rebate to the loan. As previously I'm going to send a rough spreadsheet with each £11.1 paid and statutory interest. Reasons for Miss sell, 1. The PPI was very expensive 2. I was never made aware that PPI could have been purchased from third parties much cheaper. 3. My job would have paid sick pay for 6 months. 4. I was never told that a one off premium (£750) would be added to the loan and would attract 6.7% for 7 years. 5. Prior to sale I was never asked if the policy was suitable for my needs 6. I simply was not given enough information to make an informed decision about the policy and its suitability for myself and my needs. 7.On early settlement of the loan the full rebate of the PPI premium was not refunded. Does this sound ok? Thanks PT
  5. Hi everyone, my friend recently applied to their mortgage company for some extra cash to do some home improvements. To their great surprise they were turned down. Nationwide stated that the reason for not getting the extra cash was due to their CRF. After further calls Nationwide finally admitted that the mortgage was in arrears of approx £50. The arrears was due to Nationwide messing up their calculations when they took a short agreed mortgage holiday in 2010. It appears that Nationwide have never mentioned these arrears to my friend before (no letter was sent) and simply posted them on Experian the mortgage was taken out about 10 years ago. My friend agreed to pay these arrears just to put an end to it and maybe get the loan. The OC has agreed that the error was completely theirs. Due to Nationwide's error my friend has been unable to change credit cards etc last year to a 0% deal. So they can show damage to their CRF caused them financial loss. What if any action would you suggest other than a very strongly worded official complaint would be advised? I'm unsure what parts of the CCA actually apply to mortgages would BCOBS be of any use? Reading BCOBS quickly it appears that they have breached by not communication information correctly or even at all. "information to be communicated to banking customers, including appropriate information and statements of account;" Does this seem correct, any help would be appreciated. Thanks in advance Pumpytums
  6. Hi! This is my first time on CAG and I wonder if you can help me turn off the Nationwide’s steam roller? I have been with the Nationwide for about 30 years. About two years ago, I was made redundant and all was fine until my redundancy pay ran out. All though I did my best to keep everyone happy, I was amazed at how quickly the Nationwide turned difficult. This shocked me. Where is their loyalty after all this time? They’re supposed to be on my side aren’t they? I can assure you they are NOT. The problem is that I have an account in dispute with them and I am awaiting their final reply, I will be passing the problem to the Ombudsman once it gets to that stage. However the Nationwide are steam rolling this through the County Court and got me a CCJ whilst the account is in dispute for irresponsible lending. I have written to them regarding this and been told that they can still take me to court even if the account was in dispute. Does anyone know how to stop them so as the Ombudsman can have his say before it’s too late? Thanks in anticipation notNBSagain

Arguing with current bank, Nationwide, over their treatment of me as I live solely on benefits and have been hit with charges relating primarily to the immediate aftermath of transferring my account from Clydesdale and subsequent change in date of direct debits.Have now had charges refunded 'as an act of goodwill' but for some reason the customer service idiot dealing with me, Barbara Jerome, thought I was talking about Social Security Act regs and not BCOBS. Now need to put her bank straight, again, so wondered if anyone has a name of a senior contact in Nationwide operations team I can contact in order to complain about this ongoing treatment. On a slightly humorous note I've spent two days adding to my skillset as a CAB adviser in overturning DWP ESA and DLA rejections, but I have to say the Govt make Nationwide look like Mr. Clued-up!
  8. Hi all. I posted last year on getting advice for PPI claim against Nationwide credit card and was successful last May/June. I got a letter saying the money would be refunded to the card so was very happy, the agreed limit on the card was £1900 so I was relieved to think that I had it available as an emergency source of funds. I also after accepting the amount offered asked for a replacement pin as hadn't used it in awhile and forgot it.The day after I did this I logged into online banking to see my accounts etc and noticed that when the refunded amount was credited back to the credit card my Credit Limit Amount was reduced to just £500. I had not been told of this and found it highly convenient timing on their part, so I contacted the card services team, who assured me they had the right too do this and that it was "mere coincidence" I asked why it hadn't been notified of this prior to my PPI claim, to which I finally got a letter later in June saying that as responsible lenders they "reguarlarly review customer's limits and that the decision to lower mine was to help me manage my borrowing". I also during the conversation asked once again how convienantly the card wouldn't work online or with the pin number I had been sent out after the refunded amount was credited back to be told that was an actual BLOCK on the account and I had to send them some financial information. I explained that if they could put it in writing exactly what I needed to do I would then send them the information. I never heard anything and recently I had my latest statement through and I owe a current balance of under £4.00 and it for some reason triggered me that I hadn't ever heard from them, so I sent a message via online account to card services. I then got a phone call asking what my concerns were etc, etc, so I went through it all again and the next day got a confirmation call telling me that she had looked into it and that they would send me a "copy" of the correspondance in the letter to me about the block. The letter dated 12th Feb had NO copy of this alledged letter and states that the" block was placed on the account when a claim was made on your PPI policy in 2009" !! This made me puzzled as I was sure I had used the card since 2009, and having checked a couple statements I did indeed use the card on 6th April 2010 for £172.63. How would this have been possibke with the BLOCK being on the account, as I cant use it now??!!! I am self-employed so have been asked to provide 3 months bank statements, but before doing so wanted to check that they can actually do this?!! It all seems very convenient timing as prior to my 2012 PPI claim on the card I was never told of any block, or even had the credit limit reduced whilst it was near maximum, then I win a case and have trouble. Sorry for the long story but not sure where I stand, so advice greatly appreciated.
  9. We have been receiving odd letters from a variety of companies AA, RAC, Age Concern and Nationwide. All of them started with weird names like Mr Xitlqqlc and the like. Today we had 9 letters in one go all from Nationwide Car Insurance renewal all wit the Name Mr Caisoncca the only difference was the last three letters of the names were all different like a bot was choosing them at random. I am wondering if this is some attempt at fraudulent activity but cant fathom what the instigator is getting out of it as currently I am just returning the letters not known at this address. Has anyone else experienced similar problems or have some idea what the instigator would be hoping to gain?
  10. Hi Folks I really hope someone can help me. My husband was in a previous relationship that the OH abused his bank account and got him into debt. One of the things she did was use his bank details for an AOL broadband account. The account was in her name but with his account details. This was in 2006. Despite phoning them several times and speaking to his bank they are STILL taking appx £30 every month. We need to get this stopped and would like to claim in back as its fraud. Any help of where to start would be gratefully appreciated. C x

Hi I could do with some advice My sister engaged a firm called ****** (much to my dismay) to reclaim her PPI from the Nationwide on the grounds that she did not ask for it as she was employed by the NHS at the time (6months full pay in the event of sickness), nor did she realise she had it and when she did,what it was for. To cut a long story short the Nationwide refused the complaint and it went to the ombudsman who consequently sided with the Nationwide. Can she try again or is it final once the Ombudsman has been involved? I also feel she was misrepresented the CMC who wanted a quick outcome and payment,they didn't even fight an appeal. Any suggestions from you good people will be welcome Thanks for looking saranev :mad2:

  13. I'm wondering if anyone would be able to offer me any advice. I have a Flex account with Nationwide which I use for bits and pieces (an account that i've had since 1999) Approximately 5/6 years ago I called Nationwide to remove the reserve limit that they put on my a/c without my knowledge. This meant that if I went slightly over a 15 POUND unautharised overdraft charge would be applied to my account. Apparently it's a 'buffer' incase you run into trouble and need it. I asked for this to be removed as I don't use the a/c as a main a/c and only have limited funds in there. They removed the reserve limit so I could not go a penny overdrawn - meaning NO charges. ...GREAT..... .until it started happening again by way of paid item charges. They assured me this would never happen again but unbeknown to me it has. Is this allowed?
  14. I had a basic bank account with nationwide in 2006, no overdraft facility. At the beginning of 2007 one of my direct debits couldnt be paid due to lack of funds in my account and so i was charged a fee causing me to go overdrawn. Im not sure if there were other returned DD fees, but then i was also being charged fees for being overdrawn, fees upon fees, this has caused me to have an overdraft/debt of £429.96 on that account. Recently ive been getting lots of phone calls to my house about this debt and letters from Credit Security Limited. How do i go about tackling this situation? I am 22 weeks pregnant and dont want to keep being harrassed by these people!

  16. I sent Nationwide a SAR's request at the beginning of September around the 9th enclosing a cheque for £10 to cover the charge. The cheque was cashed about 10 days later the funds left my account and since then I have heard nothing from Nationwide. I requested the SAR's as I need to information to continue a PPI claim for my credit card but I am unsure what to do next do I need to contact Nationwide again and request they sent this information?
  17. I received a CCJ for £400 from Bryan Carter in January 2008 that I have almost paid in full now. The actual debt was £8,000 and reading through these forums, I am already anticipating the 2nd CCJ for the same debt. I've read a lot about how this is against the county court rules - is there a definitive wording to put when you contact the courts to make sure it gets set aside? It seems like so many people have this issue, it may be good to get a template together for it. Also, if this hypothetical CCJ is set aside after they try to chase me for £7,600 - what is the status of the debt then? 1. Can they still chase me privately? 2. How does this debt go on my credit file? (will it be a new debt entry for £7,600 with no default date - or will it go back on the original account, which defaulted in January 2007?) Any help / advice appreciaed, thank you!
  18. Hi, I originally had a hire purchase agreement with Black Horse some years ago but decided to terminate the contract after the half way point and return the car. I got an invoice from Black Horse saying I had an outstanding balance of £1200 for repairs etc to the car. The car was in good condition apart from the usual small scratches and stone chips. Anyway long story short I decided to pay and this was through Nationwide Collection Services of which I have been paying up until July where by I changed my direct debit details due to a change in jobs. August goes by as my payments were due on the 26th of each month but I changed to 6th so next payment from July was 6th September which they agreed. In September I get a letter from Allied International asking for the outstanding balance. I told them I had an arrangement with NCS but they said I had missed a payment. Anyway I now have them chasing me for the money but I cannot find a way of speaking to someone at NCS as everytime I call I get cut off after the automated part. What should I do?
  19. ... and so they charged him for that aswell! Son only earns £200.00 a month (he works part time in a primary school) and they've taken £100.00 off him. Son was in the process of closing this account as he had nothing but trouble with them and I honestly believe this is a retaliatory gesture. Put together a letter asking for charges back and received the attached in reply. Any help and advice on our next step would be appreciated.

Hey I currently have the following outstanding debts with Nationwide: Credit Card - £1,500 approx Loan - £900 approx Both accounts are now being handled by KPR Collections and i am in a £50 per month repayment plan with both for six months. At the end of the six month period my finances should be in better shape and i was wondering if Nationwide accept settlement payments, being at this stage with KPR? If they did would there be any downside, would the debt definitely be written off or should i just stick to making regular repayments on an agreed repayment plan? Nationwide will be my only remaining creditor owed money next year so want rid of them as soon as! Any advice on this will be greatly appreciated. Thanks.

Hi Have a credit card from nationwide going back to 1988 and have sent them a section 78 cca with no success and they have stated no agreement available and sent t & c's which only relate to mid term of the credit card usage. However i have now been advised by moorcroft and nationwide that moorcroft have been asked to collect. Sent moorcroft a letter advising nationwide in default of my cca request and that they return account to nationwide. moorcroft have replied account on hold whilst they contact nationwide VOLVO
  22. Hi, folks. I could do with a little advice / insight if anyone has the time. [NB: Not sure whether this should have been posted here or in the Legal Issues sub-forum, so please move it over if posting there would have been more fruitful.] As per thread subject, I have received a LBA from Fredrickson (acting on behalf of Lowell) regarding an alleged debt to Nationwide. The debt in question does appear on my CRA files, is wholly disputed (by me) and won't be statute barred for approximately one more year. Some background: In 2007 I discovered that my identity had been stolen and that multiple mobile phone contracts had been taken out in my name. Additionally an account was created with an ISP using some or all of my banking details. These companies all set up direct debits which later 'bounced'. I managed to convince the ISP and one of the mobile phone providers over the phone that the contracts were entered into fraudulently. Nationwide were utterly incompetent, however, so I ended up sending them a letter sometime in 2008 stating that I was a very unhappy customer; that I had been a victim of identity fraud; that I was refusing to pay their extortionate fees; and that if they were less than pleased with my refusal to pay they should take me to court. Since then I've heard nothing substantive from Nationwide. I have, however, received 5 or so letters from Lowell offering discounts (a tell-tale sign of things awry, I know). A few years ago I did send a letter to Lowell disputing the alleged debt but I never actually got a human response, so I reacted in kind by ignoring their machine-generated threats. Now, out of the blue, I receive a LBA from Fredrickson. Should I not have received some kind of notice from Lowell that they were lemon-loaning to Fredrickson? It might also be worth pointing out that the Nationwide account in question was opened with them when I was a teenager some 12 or so years ago. Also, I am 100% certain that I didn't receive a Notice of Assignment when Lowell bought the debt. Any help or advice would be appreciated, immensely!
  23. Hi Guys I have been paying Nationwide for a cc which I defaulted on last year but set up a payment plan with KPR at £20 per month. They sent me court papers to ccj it presumably with a view to co. I filled in the papers and sent them back to Nationwide who are saying they didnt receive them so had the judgement by default. I rang the court who told me fill in the forms etc and have it redetermined which I did. I enclosed copies of letters etc one which is of KPR offering me a 75% reduction yet when I rang them they denied it!! I have today received forms back from the court saying I need to pay £40 as it was never determined in the first place so cant be redetermined. I feel loathed to pay them £40 for an error on Nationwides part. Nationwide have written to me since saying they are willing to accept monthly payments if a co is granted. Do I pay the £40 and have the judgement relooked at or do I carry on paying the £20 every month and wait until they ask for the charge order and then produce my papers etc and hopefully get a payment plan. I have since been advised if it happens again to only send the paperwork to the court. Feel so down over this Nationwide are so callous in the way they work they already have 2 ccj on me but have spread them over a year so it feels that ist has been going on forever. All help is much appreciated.
  24. Hi. My Wife has received a Default notice for a credit card. She has about £2500 on the card account and they are demanding payment in full. We haven't been able to make any payments this year due to first her & then me being made redundant. She has contacted them before by phone to ask that they freeze all interest/charges but to no avail. She has a current account with Nationwide, and today Nationwide put a stop on it. She had to go into the Nationwide branch to find out why she couldn't access her money. They explained that KPR had frozen her current account - due to her being in arrears with her credit card. Is this allowed? I assume KPR are part of Nationwide due to the fact that the bank assistant gave my wife a telephone no. to ring and it was KPR on the other end. My wife asked them to release the account, explaining that we were both made redundant and all that was in her account was our child tax credits, which we were using to buy food. They agreed to open the account up again, but only after grilling her about our finances and asking about my situation. Incidently I am no longer on JSA as I started my own business due to the frustration of not being able to find a job. I am in fact now earning even less than I was on Jobseekers due to the fact that I've had to start my business from nothing. We can't afford to service her credit card at the moment. We are a month behind with our rent, behind with our water and electricity. What do we do next in regards to Nationwide / Kpr? Any advice would be appreciated. Thanks.
  25. Hi, Last July I went over my overdraft. My dad put £300 in my account and I did not realise it was the other account he put it in. I found out but by then I had incurred fees which were capped at £90 and I was charged a further £20 for going over my overdraft and interest on top. I did not know I could ask these to be waived. I then went into my overdraft the next month by a few pounds. I found out that I was charged an unauthorised overdraft fee as my overdraft was taken away without any warning or letters. I went to Nationwide and the fee was waived however nothing was explained to me about the overdraft. I once again did not know what to do about it so I did not complain. I have had no problems with overdrafts since then. Now in April I decided to move to HSBC for their student account as I felt I may need an overdraft this summer. I got one and I want to close my nationwide account. However in June I made a silly mistake of thinking my payments from some shops had already cleared and ended up having an unauthorised overdraft. I did not understand why and the woman in branch explained how I had got into my unauthorised overdraft as some payments had cleared later. She was no more help than that. I moved out of my university accommodation but I forgot to change my address as I thought by the end of the month now funds had been added my account would close. My bank letters have gone there so I did not know the fees I would be charged. I checked my account yesterday and found I had been charged £45 in unpaid item fees and a £20 unauthorised overdraft fee. This sunk me into my overdraft by £20 and then I had 3 payments clear on the 1st August from Amazon which means next month I will also have the same situation. I have credited my account so I now have £43 in there. How do I go about getting my the money from the charges back? I think I have a fair claim as nationwide took my overdraft away without informing me.
