Hi anyone who has any ideas on this subject. right i took out a logbook loan in sept 2012 for £1000 i then sold the car jan 2013 with every intension of clearing off the loan april , i phoned loans to go last week to get a settlement figue and they say i owe nearly 2k to settle. i only sold the car for £1400 ,i have been paying 160 quid a month since sept. i need to know if there is anyway of negotiating an early settlement, what if i file bankruptcy ??? i want these of my backs asap but i dont have 2k

Hi please help Having spent over a week reading posts i am more confused than ever,i went to the bank asking if they could help with a loan to buy a taxi as i could not find any work after losing my job.I was very stupid really, but they gave me a loan of £7,500 on our joint account on my wife's part time income but she was not present and did not consent to it.Basically the business failed as the car i got was in the garage more than on the road and cost me every penny we had + i made a total lose. When we unable to pay for these loans anymore(i already had 1 and so did my wife with same bank)i contacted them for help and thought at first they seemed very helpful,they said not to worry they would put me on to a company that dealed in IVA's (payplan)plan plan took £289 of my wife a month and £189 off me,this was a little better than what we was paying the bank but after nearly 2 years of this and seeing the statements that showed the bank + max credit (was virgins cc mbna must have sold)we was barely paying anything to the bank or MC some months as little as .18p. We have failed our IVA and have received letters confirming this.We asked PP for help on a few occasions and the best they would do was drop £5 a month which was a kick in the teeth as in that 2 years our expenses had gone though the roof.The new job i got after the failed taxi business has ended(2 yr contract) Now the bank has sent a letter to me about the overdraft but still not received anything about the loan which my wife has, the letter was dated 3/4/13 recieved on the 11/4/13 and we have not heard from Max Credit YET.We have been to see a advice person from a local charity who has said for my wife to go Bankrupt,she also said with my debts been less than 15 k they should have advised me to go for a debt relief order and that is what she is saying i should now do. Ok to the point now as we have no assets and a car we need for work and school which is less than £900 should we go ahead with BR or should we try and fight this by asking for original paperwork or sar which i no nothing about yet or should we just go with the advice center and after the BR is over the 6 yr make will our credit rating start to improve,and can Debt people still chase us for money. (Deep Breath)I have tried to put as much info in this and i thank anyone that reads this and i will answer any questions if i have not got it all in,but my head is spinning now. Kind Regards Mark & Clare P.S my wife still unhappy about bank giving me loan on the strength of her wages which she believes this was illegal.They included our tax credits which that lovely man Mr Cameron has since stopped. also our income is soily my wife's wage which is only P/T and we get very little child tax credit.

  5. I recently recieved a letter from Hermes Property services aka logbookloans, stating that interest on my account was frozen,no more would be added and they actually refunded some charges !! I had been paying the full monthly amount until a few months ago when I then started paying a reduced amount weekly but still £40 per month. I called them and the advisor told me that as I was now out of the contract with them, which ended last July, I would not incur any more interest chrges n the account. So, my question is, as out of contract does this mean that they can no longer bring the bill of sale into play. If they cant what do I do now ?? I dont want to ask them as we all know they will put some spin on it. Has anyone else come across this at all ??

Hi there I currently have 6 payday loans: Payday Express £100 Monkey Dosh £150 Pound Access £100 Square Money £200 Minicredit £100 CFO Lending £400 I've found my self taking these loans out to cover interest to defer others and I feel its going to be a never ending cycle and now want rid of them (Payday loans are the worst thing I've ever done). After reading through threads on here I have now cancelled my card and switched my wages to be paid straight into my everyday savings account as I'm now looking to default these loans and hopefully set up payment plans with them when they fail at the end of the month. Is there anything else I need to do to ensure the money isn't taken? Also, am I best contacting them before or after they default? And which lender are the worst to deal with? Thanks M

Hi all, I'm sure a few can relate to my circumstances and I'm kicking myself for doing such a stupid act, it started with a daft 100 pounds then appreciating how easy it was now 200 then 500, at the stage where I couldnt pay it back, I cancelled my bank card and just ignored it. However its now at the stage where dc are putting threatnening correspondence through my letter box. Its my own fault but I have done nothing but worry about the thought of these people coming to my parents house and demanding money. This whole experience has got me ill, anxious and my health is not good. So I am going to try and deal with this best I can...so im looking for advice on how to deal with these companies and basically say I can afford this much and thats it. Is there a letter or something I can send/ say to the company in order to stop them knocking at my door. Any advice would be more than appreciated Thank you

QuickQuid say this about their rollovers: "How QuickQuid Loan Extensions Work By extending your loan, you will only owe a finance charge on your next pay date, not the principal of your payday loan. The principal of your existing loan will be 'rolled over' into a new loan and you will be charged an additional finance charge. This will allow for you to wait until your next payday to pay off the full amount due on your loan. If you have a one-period loan, you will be able to extend your loan a maximum of five times. If you have a two-period loan, you may extend your loan a maximum of four times." This means that if somebody uses the maximum five extensions on a one-period loan, they could get six defaults without borrowing any more money than what they borrowed in the initial loan! All they have done is extended the time they need to pay it back. Indeed, on another site I post on somebody has posted and has received two defaults when they only took out one loan; one for the initial debt and one for the rollover. Surely this can't be legal? Is it just a way for them to add lots of default fee charges to the debt? Thank you in advance for any comments.

  10. Hi all. Firstly thank you everybody for posting on here, you have helped me a lot. I am now at a point where hopefully I can help other people. Please ask for any information/copies of letters etc that might help you out. Very brief history: I have been suffering from a very severe gambling addiction for a number of years. I have a good job, but haven't really seen any of my salary for three and a half years. I borrowed on overdrafts, loans, credit cards, off my family and... payday loans. It all added up to over £60k that needed paying back (I had/have no assets). All this obviously made my gambling worse, but that's not for now... I reached the point last year where I had 12 payday loans all due on payday. Had I rolled over each loan and just paid the 'interest' I would not have been able to afford it on my £1500 salary. I decided that I had to sort my mess out and followed the advice on here. I cancelled my debit card, got my wages paid into a different account and wrote to each lender explaining that I couldn't afford to repay them and asked for 14 days to review my finances. It was my father who advised me on the next step - I was still trapped in the cycle of lending to get out of debt - he is much wiser than me. He spoke to the OFT and the Financial Ombudsman Service and took advice from them. Following that I wrote a letter of complaint to each of the payday lenders. In this I stated my debts, how much I earn each month and what other payday loans I had. I explained that they could not have conducted ANY checks into my financial situation, and that they had not lent responsibly. I then asked that, due to their irresponsible lending, and my inability to repay (I explained that they would get £1 per month etc) that they write off the balance of my account and close it down. I won't name companies names (one stated that I couldn't in their reply) but four companies agreed to my request straight away. I forwarded the other complaints to the Financial Ombudsman Service. Another two companies wrote off their loans following this (before judgement from the FOS). It has taken almost a year to sort out, but yesterday I got a judgement from the FOS regarding one of the outstanding loans. This is the first time that the FOS told the companies what they thought, the FOS agreed that inadequate checks were conducted, that I was vulnerable and could not repay the loans. They recommended that the loan was written off. The company has agreed to this. The others should all go this way (I can't see a company taking me to court against the FOS's recommendation). These companies have acted irresponsibly and preyed on vulnerable people in order to make a lot of money. I appreciate that I applied for the loans, but had they checked, it was blatantly obvious that I would not have been able to repay the loans. They have to take responsibility for this. I'm still in a lot of debt, but it's manageable at last. Hope my story helps somebody, again - feel free to ask fro any specifics.
  11. We are seeing a few people report that they are receiving letters from Bailiffs in respect of defaulted pay day loans or other consumer debt. If you have received communication from a Bailiff company and it is not in connection with a warrant / fine / court judgment / council tax, can you please pop a link to your thread in this thread. We would also like to see copies of these letters - unedited - if you are happy to provide us with copies, please let us know so we can provide you with a secure / private email to use. Thank you.
  12. I'm a little irritated at the stupidity of my younger sibling who decided to take a loan with the the website samedayloans365.co.uk. She applied for a loan 2 days ago (provided all her bank details) and she has not received any money from them. Has anyone every heard of this same day loans company before? Ive checked there website, It looks a little woeful to say the least. Ive contacted them via there contact form but not received any reply. Could fraud or identity theft be committed using the details shes provided. Shes ok for money now after Ive helped her out but don't want other people to use her details? I could be blowing this all out of proportion but thought I would seek advice from you lot first:) Thanks
  13. Hello guys, Can anyone help with the case of OFT v Nine Regions Limited/Logbook Loans on the point of attestation of a credit agreement and a BoS? My understanding is they (NRL/LBL) lost the First Tier Tribunal, but then appealed to the Upper Tribunal and won. Was that the last of it or did the OFT appeal this? Also, did I read, or indeed imagine, that a credit agreement has to take a specific form for it to be legal/lawful and binding/enforceable? What about charges for late payments? I accept that the Pre-Credit Information sheet did say that 'we will make a charge of £12 when we have to send you a reminder for an instalment that has not been made on time', but, Hermes Property Services have charged me, on a weekly basis, for the same letters about the same 'late' payment - a total, on occasion, of £48 for a late payment of £20?!?! Unjust enrichment? Your help appreciated.

  15. sept 2005 took out a business loan with barclays included in the loan was a premium loan to cover my insurance value of main loan £3,000..march 2008 took out a futher loan business for £5,000 inc again was this premium loan that was taken out for the insurance cover.these loans was taken over a 5 yr period.i thought nothing more of it and was under the impression this insurance was compulsory to the loan ie condition of loan .no advice ever given loans done by post.mater of signing the docs money in your account .the insurance was barclays dublin . can i claim this back if so what do i do from here please. your advice helps

Hello one and all Site donation due, but can someone please provide instructions on how to please I received a payment from the Bank before I even received thier letter with regards ppi on a loan and then refinanced with another loan provided by them. EXAMPLE Loan 1 PPI (Bank) Loan 2 PPI refinanced PPI (Bank) Problem is refinanced again with another loan not bank Loan 3 PPI refinanced loan (Egg loan - ppi on this loan already paid back) What and should I, write back to my bank and state, as I have no idea how to explain the above and whether they are even responsible for me getting this last loan to pay off thier loan 6 months later and also a credit card bill

Have loan agrements for all four of these with same lender, statements of rebates when first, second and then third were refinanced - under 1983 regs (we're going back to mid-1990's here) - and have approx date (within 14 days) of final settlement via new loan from a second lender. Due to time etc, we have no actual statements, we don't have statements for bank accounts to show repayments being made (we could try a SAR if really going to be needed, but have not done as yet), but the rebate calcns from the lender and amounts rolled over do broadly tally to estimates made using the loan progression sheets. Taking the loan 1 settlement figure, I've an approx figure for the PPI rolled into loan 2, ditto into 3 and then 4. I also know the new loan for PPI with Loan 2 itself (and 3 and 4). When I make my schedule of charges using the single premium spreadsheet, do I do one sheet for all four loans, or one for each - I've read the helpful notes faq etc, but am just unsure on this last stage.   18. Hi, I am a new member of these forums, but have been using them as a guest for a long time. After watching the 'how to post' video short, here is my question. My Question today concerns Link Financial Outsourcing, AKA Thesis Servicing. They took over where the Student Loans Company left off some time ago. My original loan from them was in 1994 when I was at Portsmouth university. when I left, I filled out a 'referral' form because I did not not earn enough to reach their 'minimum earnings for repayment' limit. That was the last that I heard from them until last year (August 26th). They got my address from my parents and started claiming that I repay the loan (now £3026.46 with interest) I conducted some research here and on other forums and sent them a letter claiming that it was my belief that the alleged loan was statute barred under the Limitation Act 1980 Section 5: "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued". I heard nothing, and so I emailed them on November 11th 2012 with a copy of my letter. They responded on the 13th November with the following: "Further to your email we are writing to advise that your letter dated the 30th October 2012 has been received and your claim that your account is statute barred under the Limitation Act 1980 is being investigated. We are currently waiting for some information from the Student Loans Company and on receipt of this information we will write to you with our response" Again, I heard nothing from them until this morning, whereupon I received a 'Notice of Sums in Arrears'. As you can imagine, I was amazed. I telephoned the company, admitting no liability of the debt, and using phrases such as 'the alleged debt' and was told that a 'CCJ was issued before the 6 years had expired from the original date' and therefore the account was unable to be listed as statute barred. They claim to have sent me the 'legal documents' in the post back in November, a letter that I have never received, and have told me that they will be pursuing the alleged debt. After a check at the Trust Online, I can see that there are no records of CCJ's for me, which means to me that they either don't exist or have expired (6 years limitation). There is also nothing listed on my credit report, obtained from Experian What can I do now to get this company off my back? As a sufferer of Acute Unipolar Disorder (Clinical Depression) their communications are causing me a lot of mental anguish and stress. Many thanks , in advance, for your assistance and advice, Martin

  20. Hiya Everyone, I am new here this is my first post. I joined because I am extremely worried and anxious that I may have gotten myself into a really serious situation. I will be honest from the outset. I am in debt with so many different payday loan companies/ mail order companies that I don't even know what they are any more, so has my mum (who I live with) In November 2011, my mum got a loan with a PDL company, she entered 'MR' instead of MRS and she entered 1 year out of the DOB, she was accepted for the loan and we haven't paid it back. I am now so worried sick that that is fraud? What happens if they find out, could she go to prison for this? She doesn't even remember doing it that way, but that's the information on her online account with them, so she must have! Late last year I opened several accounts with catalogue companies (simply be, brilliant gift shop) I got credit with them, and haven't paid it back - now this is where it gets really awful - I didn't pay them back, then I tried to open several more accounts with them (using variations of my own name, and a different DOB) I don't know why I even did that, obtaining credit kind of become an addiction and I now feel absolutely terrible and worried sick that my stupid actions are going to bite me in the arse in a big way! My mum also has several account with them, she also has credit with those companies that we have never paid back! I am in the situation now where I cannot think about anything else other than this! I do not want me or my mum to go to prison, we owe so much debt that I don't know how even to find out who we owe to (on my mums brilliant gift shop account, she used her maiden name instead of her married name) I am a very socially nervous person, and my whole life is my Dog (I know that sounds silly to some people but it's true) I love her more than anything and I am crying just thinking about what would ever happen to her if we was to go to prison for fraud! I am so scared right now! We are currently paying back Rent arrears, Council arrears and water arrears - we are sticking to the agreement and all is going well. I would ideally like to know exactly who I owe money to, so I can start payment plans with them - but I don't know who we owe it to, and I am also really scared that if I try to find out they will discover the untrue information and decide to prosecute us! Especially as I opened several other accounts that didn't get credit - they may notice that and say that we quite obviously had no intention of paying the debts back! I am overwhelmed with guilt and anxious, I wish we had never been this stupid, I don't know how to fix it and these worries are dominating my life it's so horrible. I would simply never cope with prison (and I know it's my responsibility to not get in trouble in the first place, I really know that, but I so wish I had never done this!) Does anybody have any advice here? Can we go to prison for this? How do we begin putting this right again?   21. hi On 19 nov 2012 i sent a SAR request to everyday loans , they did not respond but did cash my cheque on 2nd december I sent a letter before action to them which was signed for on 7th feb 2013 but they have not responded. please advise me what my next step is. many thanks
  22. A few months back i was having real financial problems and resorted to a payday loan. ( i refused to belive they werr as bad as everyone made out) I missed payments and got charges and so on but last wednesday i made i payment plan with payday express which i was going to pay 15 pound a week starting from march, this agreement is in writing. However payday express went ahead and took out the outstanding balance despite our written agreement. They offered a full refund and promised the funds will be in my account within 24 hours which they are not so i have had to take out and overdraft with my bank to stop charges from being overdrawn and so on. (I know im rambling on but just trying to explain as clearly as i can!) Ive called and e mailed serveral times to see where my money is but they just keep giving me different times and i dont know what to do. I need that money asap for bills and rent ect. So basically im asking for another contact number or email for payday express if anyone has one and general advice what i can do to get my money back quicker. Thank you in advance for any info!! (ps, spoken to my bank and they cant do anything about getting my money back)
  23. I have sent my first letter off to the Yorkshire bank today. I have been with the Yorkshire bank for aprox 20 years and over that period I must have paid out a lot in charges especialy when the children were younger and money was a bit tight. Does anyone know if I can claim for more than 6 years or is that the maximum time I will keep you informed as to how things are going. regards david
  24. Hello everybody. I just want to know the legalilities in principle. say for example I successfully applied for 200 payday loans from different companies for the top amount, lets say £1000 from each. I would have £200K What is stopping me from leaving the country with the cash?
  25. i am having issues with a few payday loan companies taking money from my account. They have been taking money via continious payment which means they can take it whenever they like i am led to believe. now i have contested with the bank about these which they have told me to wait until it shows on my statement which i did, and then got them to reimburse the amounts. i have cancelled all CP on my account but still more have happened one amount made me overdrawn then they still took another payment after this making me about 500 quid overdrawn! first of all is this allowed? secondly if i instruct the bank to cancel the continous payment do they have to? the bank said it is not gauranteed that it will be cancellled as its a financial company? also do i have to wait for it to clear on my statement or can i use this chargeback angle to get them to do it instantaniously?
