Hi, I put a PPI claim in to the FOS on behalf of my husband October 2010,at the time he was still managing to pay his CC and loan, however it all went belly up in April this year and as I have heard nothing for months from the FOS I'm wondering where it will leave this claim when the HSBC take action against him which from the letters received yesterday could be soon Ro
  2. My partner has a graduate loan and credit card with hsbc. The guy at the time said he'd 'sort out' the fact that he didn't work full time. Boxes were ticked by the guy after he left the bank. There was also some ppi. My fiance has written to them several times regarding the ppi and their response has always been that they have thwarted wrong signature on file and can he go into his local branch and sign something and get them to take photocopies of Id. He's done this 3 times. We sent a sar to them a few weeks ago after reading the info on this site. They've replied with a letter that salsas he has not signed the request and a signature is needed to confirm his identity they have enclosed an application form for him to complete. The letter we sent did have his account details and his name and address. They've also sent to postal order back because it needs to say hsbc bank plc in the payee field rather than ***. I read on here somewhere that it's ok to not have a name know the payee box. What shall we do now? Hsbc have been stalling for over 6 months and it's getting really frustrating!
  3. t is ridiculous the amount of power Banks and Credit Agencies have over our lives. We have a joint account with Halifax and not used since 2010. I wrote a cheque that took me £4.71 over. I could not find my HSBC chequebook at the time. Now applying for mortgage I am shocked that for £4.71 reported by the Halifax as unpaid is stopping me getting anywhere near a mortgage application. Since it is a joint account it is the same for my wife. It has taken me a week to get documents together so that my account can be updated at the HSBC to prove I have cleared the £4.71. So as yet the HSBC underwriters will not move until my local branch updates the fact I have paid off the Halifax. Now before all you smug people out there who have OCD in sorting out every penny in their accounts and pockets advise me that I deserve my predicament for £4.71 in debt...get a F***** Life !!! I say the banks especially the ones where us tax payers had to write off £billions ( Halifax HBOS ) just get real and stop reporting such small sums that ruin our chances of getting a mortgage. There should be a minimum total amount that should be reported to these credit scoring agencies. also big banks like HSBC should have the information that they can see how small the debt is and stop acting like the bitch out of Little Britain who says 2 computer says No ". I mean where is the risk where someone has forgotten about an old account with £4.71 in debt!!! Stop then acting like Shylock and Scrooge. Where do we get the chance to report the old accounts our Granny opened for us in 1960 which lies somewhere with money still in it....It makes me want to start a riot !!!
  4. hello this is my first post so please forgive any mistakes. i have recently defended a court action with mkdp for a old hsbc current account with overdraught that has ended up at 4800 pounds . the posision now is that mkdp didnt send a cca request but sent a letter saying it could take 8 weeks. the 33 days for them to respond to my court defence has passed. i presume this will now be stayed. sorry forgot to say my defence was that this account is statute barred. 7 years of no contact or payment by myself since cause of action. should i now send a n244 to ask it be struck out on the basis that this claiam is without merit. mkdp had put a default on my credit file in 09 which was 2 years after cause of action. but served nothing on me before the court claim. i would appreciate some advice as to whether i should leave alone and see what moves they make .i would prefer to kill it if poss but i am now stumped. thanyou in anticipation. chindit
  5. Yesterday 16/10/13 i received 2 seperate claim forms from MKDP on behalf of HSBC. The debts as far as i can remember are from a credit card and an overdraft from accounts i had about maybe 6 yrs ago. MKDP say they were assigned the debt on 8/12/11. Now i admit that there was a debt that was at a time when i was going through a messy separation but i believe a major part of the debt were charges put on by the bank after i spoke to them to explain the situation and reqested time to pay. When the debt got bigger however i did ignore letters. Is it worth defending this claim as i really dont want to pay the charges/interest that were put on when things went bad. Also i have no paperwork i can refer to that shows the charges or the amount of the debts before i got into trouble with them. Hope someone can help me with this. Also it says i have 14 days to respond. Another thing im worried about is i will be out of the country for a few weeks (work) at the end of November, what happens if i miss some corespondance.????????? HELP
  6. Hi guys, Could do with some help. Rec'd court papers yesterday from MKDP regarding an old HSBC loan account. Have already filed my AOS and intention to defend the claim in full, but need some advice on my defence before I go any further. POC: The Claimant claims the sum of 2xxx.xx being monies due from the Defendant(s) to HSBC Bank plc under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the Claimant on xx/xx/xxxx. The Defendant(s) account number was xxxxxx/xxxxxxxx. It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant(s) has failed to make payment as required by the statutory default notice served by HSBC Bank plc. The Claimant claims the sum of 2xxx.xx and costs. The Claimant has complied, as far as is necessary, with the Pre Action Conduct Practice Direction. Now there's a few things wrong here: 1. The account number provided relates to a bank account I held with HSBC. However, the alleged debt was a personal loan under a different number. This claim should be for a loan not a bank account. 2. I haven't made any payments or acknowledged this debt since sometime in 2006. It is 100% statute barred although defaults don't expire until early next year. 3. There are 2 defaults registered on my credit file for this debt. Both with different account numbers, one registered to MKDP LLP and one to HSBC, registered 5 days apart, neither account number relates to the one stated in the POC. Both defaults are for the same amount which is the amount stated in the POC. I'm quite looking forward to taking this on, but i'm unsure whether I should go down the standard statute barred defence route or if things are different because of the points I have made above. Thanks in advance for any help.
  7. Hi New poster so be gentle..... I recently signed up for Noddle to keep an eye on my Credit File as I reach the end of my DMP. Subsequently I noticed that there is a Default on my file for a HSBC Credit card that was part of my DMP -- dated 2012. I set up my DMP in 2005 and I am due to finish in December this year having paid in over £50,000!! So, as you can imagine, I am not happy about this default as it won't drop off until 2018 despite being accepted into a DMP 9 years ago! A little bit of history: - DMP set up in Nov 2005, all creditors accepted offers including HSBC for this account. - HSBC transferred this account to Moorcroft in 25/4/2006. - Moorcroft transferrred this back to HSBC 11/1/2013, administered by Metropolitan Collection Services. - The account is showing on my Credit File on Equifax as Satisfied on 31/8/2012 and no other payment info - The account isn't on my Experian file at all!! - The account shows on Callcredit/Noddle with no payment info apart from the account showing as Satisfied and also a Default, both dated 31/8/2012! I have no idea why HSBC decided to resurrect this account on the CRAs and why they decided to register this default. Here comes the Questions: Could this be a mistake? - How do I check? Are HSBC allowed to register a default without informing me - particularly 7 years after it was originally defaulted and included in a DMP. I haven't received/seen any communication relating to this. What are the initial steps to get this removed as I think having worked my @rse off for 9 years to clear my DMP that I would come out the other side with a reasonable credit file! Any advice really appreciated? Thanks MJSWIFT
  8. Hi! 4 weeks ago I found a default on my credit rating from HSBC Bank. I have no knowledge of this, having never had an account with them. Sent a letter to them and recieved one asking for more address's as they cannot find me on their system. They recived it 3 weeks ago and no reply. I phoned them up today and they say they cannot find me on the system and that I need to take a copy of my credit report into a branch for them to scan into the system so they can find me. this is what my credit report says....   9. Hi all, Need some advice please. I have just switched my bank account from HSBC to Halifax using the 7 day bank account switch which is backed by the government. On the final day of the switch my car insurance went out of my old hsbc account and not the Halifax account like it should have. After taking to halifax and elephant i was told that if it wasnt taken when it should have been then they will just replay and do it 7 days later. I didn't think nothing more of it, account moved and Hsbc closed. I got a letter on 24th March from hsbc £68.68 had been taken out of the account and that it needed paying. So on the 26th March i rang them up, paid it and was told my account would now be closed. I got a statement today out of the blue showing that hsbc have added £25.10 in charges to the account, so i rang them explained everything and they have point blank refused to close the account and will not remove the Charge that they have put on. Can anyone advise me on what the best course of action would be please,

Many years ago, well since 2006 to 2010 ish me and my wife was in difficulty at times and we had DD's on her account with HSBC, on a regular basis we were charged for returned Direct Debits, I think at one time there ere 3 returned this went on for a while and was wondering if its possible to claim these type of charges back. And OD Arrangement fee's, are these reclaim able
  11. Afternoon, Back in 1999 I purchased two items, a TV & a Hifi (on separate occasions) from Dixons on higher purchase over 48 months, on each loan. At the time I was a student with a job, and I wasn't informed about PPI being applied to the loan. It only came to my knowledge recently when rummaging through old paperwork, whilst clearing out my old room at my parents house. I have the account number for the TV loan (taken from a payment book) but nothing else. For the Hifi I have the account number, the credit agreement with amounts and printed on X in the Credit Protection Insurance section. The loan details for the Hifi are such: Sony Hifi £169.97 1+3 yr (I suspect this is the insurance) £75.00 Total cash price £ 244.97 Less deposit paid £ 30.00 Credit Amount £ 214.97 Interest Rate* 2.06% per month APR* 27.7% Anticipated number of monthly repayments 48 Amount of monthly repayments £ 7.87 The loans were underwritten by HFC The TV I think was around the same price, but without any actual amounts I'm unsure. On both of these accounts I do recall getting behind on my repayments later on into the loan, and gaining a lot of bank charges, to the point that I had to loan money from my parents at the time to both clear the charges and the loans. I've never tried to get these charges back as I didn't think I had the documents with it being so long ago. My really after some guidance as I not sure how to proceed with reclaiming both the PPI and the charges. I did recently do a SAR request using the account number for the TV loan however HSBC wrote back to me saying that they now service HFC accounts and they have been unsuccessful in their search to locate my account, using the information I have given them (account number, my name, & my old address). They have asked for: personal information - Previous address history and date of birth. legal agreement to confirm the account information bank statements to show the account had the benefit of Payment Protection Insurance, including proof of any early settlement payments. They have also said that they have destroyed the cheque for £10 that I sent to them. I am thinking of starting from scratch as I haven't sent a request for the Hifi loan and I have thought that it would be easier to start the TV loan request again along with the Hifi so that the dates will tally. Could someone point me in the correct direction, as I've been reading a lot of posts on here and several other website & forums and I seem to be getting lost in how to go about gaining both the information relating to the accounts & their charges and if I receive that information how then to proceed with reclaiming the PPI & the charges. Family & friends has advised passing it all over to a PPI company, however I would only like to do this as a last resort, as it would feel like a bit of a defeat. I have reclaimed bank charges in the past for family and some for myself but from what I've read the whole procedure has changed since 2007 when I did it for them. Hello I took a complaint to the Ombudsman about HSBC's overdraft charges and ended up getting around £350 back...all of which has ironically all been added back on in interest since my financial position hasn't improved since the FO payment. My overdraft is at £1800ish and my limit is £1750. I've not heard much from them, no chasing or anything until a text message yesterday asking me to call them. Cheeky. When I got the refund through the FO it stated they were also refunding £130 for my credit card fee's (something along those lines) This shocked me as although I was given a HSBC c/c many years ago I never used it. In fact they cancelled it because I never used it. When I called HSBC I spoke to a random customer service person who said there was no info about a credit card. What should I do in this case? Why would they refund for something I never had? Could my card have been copied? As for the overdraft, I changed bank accounts a year ago, the only way its increasing is because of the interest. I can't afford to pay anything off it. Should I send a I&E form to prove this and see what they say? Thanks, and sorry for babbling

Ive suddenly had calls from Scottcall,about 1 a day for a debt with hSBC form 2006. £462.00 This debt has never appeared on my credit file and last payments were made in the end of 2006. I guess they are trying there luck as i imagine they have recently brought the debt. Can anyone tell me the procedure to go through to tell them toprove or stop calling? Kind regards Chris
  14. Hi all, I have a general query but first a little background. I banked with HSBC bank from 2002 to march 2011. finances were very tight and Towards the end of my time with HSBC roughly 2009 I went overdrawn and incurred a charge, not having enough available funds to cover this charge meant the following month I incurred another charged, This escalated and ended up with me having paid HSBC bank over £3000 in charges in little over a year. in March 2011 I decided enough was enough as I was now over £1000 overdrawn (made up of charges), I asked that they close the account and pass the debt onto a debt company. By the end of April 2011 I began paying the debt company a little over £45 a month and paid off all that was owed in April 2013. I have just got my credit report for the first time, Everything is perfect on it. Any credit I have gotten has been paid in full and everything says satisfactory and settled. Everything except the HSBC Debt, Which is showing as "Defaulted" and "Satisfied". Its also showing that I defaulted every month between April 2011 and March 2013. I would have thought that seeing as I made every payment to the debt company in full and on time I would have been ok. I fully expected there to be a default with HSBC but I expected it to be dated 2011 which would have cleared it from my report in 2017 but It is showing as default in February 2013 which means I will have to wait until almost 2020 before it clears my account. is this correct?, I thought the default date would be when it was passed to the debt company.

Hello all, This is my first post here, I have been reading through several threads and am delighted to see the overwhelming support and guidance this forum offers, I would be truly grateful if some of you would take the time to help me with my situation. I was a victim of identity theft in 2006, this is not disputed by either HSBC, the police or myself. I've never had a credit card, yet in 2006 someone was able to take one out in my name, with my own bank (HSBC). I was called by HSBC in 2006, they asked me to pay off the debt owed on "my" credit card, I told them I've never had a credit card, they said they think it is identity theft / fraud, the police gave a crime reference number and I was assured by HSBC that I would not have to pay a penny of the amount owed and that it would not effect my credit rating in anyway. All of this took place within a matter of days and all on the telephone. HSBC apologised for the situation and reassured me that I had nothing to worry about. I stupidly trusted them and thought nothing of it. Fast forward a few years - 2009. I was consistently being turned down for credit in every shape you could imagine. I couldn't get simple things like a mobile phone, laptop, car, tools for work, credit cards, any form of credit I was denied. I didn't understand, I'd never really borrowed money before (only student overdraft), my friends were able to get mobile phones and some of them didn't even have a job! I was working in a business development role at the time and could more than afford the credit I was requesting. I decided to contact HSBC in branch (2009) to ask if they knew why I apparently wasn't trustworthy enough for credit (HSBC deny this, they think that I haven't asked them about my credit rating in over 7 years, ridiculous). In branch the HSBC advisor literally put her arms up in the air and said something along the lines of, "Oh dear, I'm so sorry, the fraud incident in 2006 has not been cleared from your name and has been negatively impacting your credit score, we will rectify this asap." I should have created a scene there and then but instead I agreed to allow them to correct it and not create a fuss. By this point I had put my credit facility needs in family members names and friends names, it put an immense amount of pressure on my family and friends and made basic life unnecessarily difficult. I probably should have gone straight to market and taken out a form of credit, just to check if they corrected it, but instead I stupidly accepted what they had to say. Looking back at this, at no point during these telephone calls or face to face meetings in branch did HSBC advise or even mention that I could complain (let alone tell me they existed) to the FOS or at least independently check my credit score at a later date using a credit agency. I was in my early 20s and had limited knowledge about financial services and banking regulations and at the end of the day, I stupidly thought I could trust the bank that I'd been with since I was 10 years old. Fast forward a few years again - 2013. I'm still getting turned down for credit. I'm confident that it is nothing to do with HSBC as they have on several occasions promised me the situation would be / had been sorted. I go to get a credit report and guess what, my credit file in November 2013 stated that I am currently and have been defaulting on a credit card with HSBC since 2006. I was stunned. I called HSBC again and immediately arranged to visit in branch. They first of all had the cheek to say that I must have misunderstood my credit report, I emailed them my credit report and they realised it was crystal clear that it was their mistake. The HSBC advisor in branch informed me about the FOS, for the first time. By December 2013 HSBC told me my credit score had been restored (this isn't the case, will explain later). I checked my credit score with Experian again and on the surface it did seem that they had rectified it. My credit score overnight jumped up by nearly 600 points to a new total score of around 900 points!! The difference between a poor credit score and a good credit score, the difference between being lent money and not being lent money. I contacted the FOS and they initiated a complaint against HSBC. HSBC wrote to me and admitted in black and white that it was their error and that I should quantify the damages so they could form a compensation package. I didn't know where to even start with this. I wrote them a letter explaining how unknowingly to me they have manipulated and negatively impacted my reputation, career, relationships, psyche, life at the same time as stripping me of any opportunities to engage in any form of borrowing / credit, which in our society, in my opinion, is pretty much paralysing someone. HSBC have stopped me from buying a property with my partner, she went ahead and got a flat on her own. They have stopped me from setting up my business, forcing me to take any work available. They have forced me into rented accommodation and at times made it very challenging to agree on contracts for rented accommodation and even on two occasions I was turned away for a flat in London because they carried out a credit report, the estate agent would not tell me specifics, just that they had run a credit check and it had shown bad results. I have also discovered that I had work / client proposals rejected whilst abroad because of them checking my trustworthiness through credit reports and again the report portraying me as untrustworthy. The list goes on and on and on, I'm overwhelmed, HSBC have silently turned my life inside out, unjustifiably punished me, all in error, and all after being asked to rectify the situation several times and all after assuring me there was nothing to worry about, several times. It's almost too much to mentally process. Related but a slight side note, whilst travelling in India and the Middle East, I accidentally went over my overdraft limit and without informing me HSBC suspended my account and blocked my online Internet banking access. Admittedly I was travelling (my transactions in india may have hinted at this?) but surely they could have used my registered email? The email registered to my Internet banking account perhaps? I tried to engage in credit facilities online to pay off the amount but of course , no one was prepared to give me credit, I wonder why? When I returned to the UK I cleared all the charges in full and restored my HSBC current account to a clean state. If I remember correctly I paid them nearly £1800 in charges, fines and monies owed, I had been out of the country for nearly 18 months. The joke is HSBC offered me £100 compensation for the "stress" caused. Last week Sainsbury's gave my partner and I £30 compensation because our online shopping didn't arrive on time, quite rightly so, and yes we will be using them again. I called the manager of resolutions at HSBC and spoke with him on the phone, after several phone calls they up'd their offer to £1000. In my eyes this is still a joke. What do you think? If you've got this far, thank you so much for reading. I have just received their final written response offering a grand and asking me to sign to show agreement. I don't know what to do and I was hoping you may be able to give me some kind of advice or suggest what my next move should be. I'm going to go back to the FOS with the written response but to be honest I feel like I should just be taking them to court? I need help quantifying the damages and I honestly can't afford to pay a lawyer or accountant to work for me. I'm 27 years old and earn about 16/17k annually as a freelancer, not enough to pay £200 +vat per hour for someone to listen to my story and then tell me that I need to pay more in order for them to do anything about it. I would truly be grateful for some pointers, don't know where to turn and it's really getting to me. I have recently checked my credit report, last week, on checkmyfile.com and my scores are still bad, it still implies that I am untrustworthy and clearly says that i have historically defaulted on credit card payments, indicated by a red number 4 (worst kind) next to the sole credit card with HSBC's name next to it. Surely the credit card shouldn't even be associated with my name, especially on information accessible by lenders, employers etc? Surely HSBC should also clear the one time I did default with my overdraft as they paralysed me from being able to pay it off through other means of credit? Any ideas? I've started building a documented case against HSBC, I am gathering all the information I can find, I have been contacting previous clients, who are now aware that I am trustworthy as I can prove to them my reputation was listed as bad in error, one client has already offered to write a statement and stand as a witness if required.   16. Hi My wife and I had a joint HSBC bank account together up to 17th March. We are separating and wanted to have our own separate bank accounts, HSBC seemed the easiest route to take. I initially went in to see them on a Monday and asked to open a new account, this was done. They also froze the joint account (with about £400 in there) until we could go in together to see them. Here's what I don't understand and where I think that HSBC staff basically lied to us, but I don't know the rules. The clerk who was dealing with the accounts said that because we'd come in and told them that we were separating it would be illegal for them (not HSBC rules but FSA rules) to keep the joint account open. The problem that this caused was the Direct Debits I then had to transfer from the old joint account to my new (and empty of cash) account were returned. All of a sudden I get three letters more or less within a day of each other from HSBC that they are closing my new account because of 3 returned DDs. Did HSBC lie to us that they MUST close a joint account when they've been informed that the couple are separating? To say I'm furious at how they've treated me when I've been a decent customer (paying for their Premier account when it was a joint account) for the last 7 years or so.

I today received a court claim from MKDP LLP for 16,368.28 for an old loan and overdraft from the HSBC Claimant: MKDP LLP Issue Date 14 March 2014 Particulars of Claim The claimant claims the sum of 16,368.28 being monies due from the Defendant(s) to HSBC Bank plc under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the Claimant on 28/11/2013. The defendants account number was xxxxxx/xxxxxxxx. It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant(s) has failed to make payment as required by the statutory default notice served by HSBC Bank plc. The Claimant claims the sum of 16,368.28 and costs. The Claimant has complied, as far as is necessary, with Pre-Action Conduct Practice Direction I'm assuming that this claim is for both the overdraft and the personal loan. The overdraft was around £1500 and the loan was around £15000 all were taken out before 2007. As it was quite a while ago i can't remember when the loan was originally taken out but it I think it was 2006. The loan and overdraft were defaulted in November 2007. MCS were originally passed the debt after i defaulted. After the default i contacted the CCCS who helped me put a budget together which i sent off and was accepted at £5 per month. I continued to make payments until 2010 when i found that my earnings (I'm self-employed) dropped considerable and i had to cease making payments. Since then the debt has been passed to numerous different collection agencies.(I think it's been through 4 different ones). After the debt was passed on from MCS, of which i didn't get any notice, I wrote to each collection agency asking for a copy of my credit agreement and notice that the debt had been passed over. Requests were ignored, and after going back and forth asking for information the debt was then passed on to another collection agency and the whole process started again. Now it has landed with MKDP. I don't believe i received a Notice of Assignment from MKDP. I do think i received a Default Notice form the HSBC back in 2007 but i can't find a copy of it I have never received any Notice of Default sums, from anyone I found your forum and people in similar situations, so i hoping that someone will be able to help me moving forward. This court claim has come out of the blue and I'm quite anxious about it. There is no way i can afford to pay it back, and as I'm on a low income repayments would be very low. I've had a look at the CCA1974 request, and a CPR31.14 request - am i right in thinking i need to send these to MKDP and should i do this before responding to the court claim? Any advice as to my next course of action would be greatly appreciated. Andy
  18. Hi, I took out a HSBC Business Protection Plan when I took out a business loan. I now believe it was mis-sold as I was told it was compulsory and they wouldn't give me the loan without it. I'm hoping this is the same as PPI? and I am able to reclaim. Would really appreciate it if anyone knows of this product to let me know. I'm one half of a partnership, not limited, and we both had to take a policy in order to get the loan. Your help would be much appreciated.

Hi all, I had two loans over the years with HSBC and I'm pretty sure I had PPI on one of them (I was self-employed so there was no way I could have claimed on the policy anyway I have since found out). First off, as both loans were over 6 years ago, can I still make a PPI claim with HSBC, and secondly there is a dispute over an old HSBC credit card, that apparently was defaulted on and is currently subject to ongoing CCJ claim that has been filed by MKDP who allegedly took over the debt. Would that affect any PPI claim for the loans? Many thanks.
  20. hi all just need a bit of advice being chased for a debt of 13k by mkrr for an old hsbc loan from 2006, no payment or acknowledgment has been made since jan 2007, there is no ccj against this debt and the default fell off my credit report jan this year am I right in thinking this debt is statute barred .
  21. Hi I'm not sure if this is the correct place to post this but I have received court paper through the post from MDK regarding a HSBC account for £645. I only had a basic current account with them with no overdraft so I can only conclude this figure is made up of charges. I was in the process of reclaiming charges several years ago (unsuccessfully ) I've never been in this situation before so I don't know what to do and am very worried - I work and my other half takes care of our young children but we normally have nothing left from my wages after bills and about to start a claim for housing benefit as our income has gone down again If anyone can offer me any advice I would really appreciate it, as the stress is making me so ill.   22. overdraft: Account opened: July 1997 Last payment: September 2010 Current balance: £2000 Status: Gone away credit card: Account opened: July 1997 Last payment: August 2010 Date defaulted: Feb 2011 Current balance: £6000 I have an overdraft and crdit card with HSBC, it was a young savers account and converted to student account and then joint account over the years. I think that opening date of 97 was the student account but Im pretty sure the same account number existed since the 80's. I lost my job and used the overdraft to make a mortgage payment, my credit cars which was high was also run up further while i looked for work, then when I did find work I found my monthly salary wasnt enough to get me back to £0 on the overdraft and things spiralled. I opened a new bank account and then wrote to HSBC explaining my difficult situation and basically have heard very little since, especially on the overdraft. I also have a credit card that I sent the CCA and SAR letters and did eventually get a large box from the SAR request, but they admitted that they held no agreements to satisfy the CCA request. They attempted to open a case in he bulk Northampton court but it was thrown out when they failed to provide the evidence required in time. I have had the usual letters from Metropolian and DG Solicitors but I am unsure of what to do if anything. I have been saving with the aim of making full and final settlements to all of my debts but I owe close to £40,000 in total and Im not sure how I should prioritise.
  23. I have received a claim form for a very old Access account. Despite a couple of requests, HSBC have confirmed they do not have the original agreement. On the S77 response they put my current address- not the one at the time of conception & there is no date of conception. DN is faulty - not enough time. Is this enough to kill the claim? My thoughts were to acknowledge via MCOL, 31,14 request to obtain agreement, DN & TN which they intend to rely on. Submit defence & application to strike as no realistic prospect of winning. I'd appreciate any help or input.
  24. Hello All, I hope someone can give me some advice on this matter as not sure where to go from here? In a nutshell, 6 months ago HSBC closed my credit card account after I alerted them to fact I hadn't received my new card at the same time as got my debit card as usual (I only noticed a few months later as I only use my card in particular times of year). They were in process of sending it out to me again when the account was closed with no notes and no one signing off on it, according the the advisor who had been helping me and was no longer able to. She said it was not the usual protocol and suggested writing a formal letter of complaint, which I did. I was told the account was closed because I no longer "met the criteria". I asked for a copy of said criteria. I not only couldn't get that, I couldn't even get any advisor to speak to me in a branch, they all said once it was closed there was nothing they could do in branch and couldn't help me. They would send the receptionist out to tell me there was nothing they could do and not even come out personally to speak to me. I then went to the Ombudsman. After 6 months of waiting/bothering (probably about 10 calls in total to HSBC, Ombudsman, formal letters to both, and about 4 trips to both the Bristol and Cwmbran Wales branch) they admitted fault through the Ombudsman but with no letter or information about what happened other than they admitted fault and offered to compensate me 100 GBP, and seem to only be willing to reinstate the card account when I accept this payment which makes me feel a bit blackmailed really or coerced as I feel 6 months of my time, I am self employed as a club promoter and dj (hence I use my card not all the time but for flights, visas, hotels, etc) in this time I had to have other people cover costs for me (so technically I am not out of money per se) but it was a lot of hassle!! Some tours I didn't partake in because I couldn't front the international flight while invoicing my clients like I would usually do. I still do not know for sure if my credit rating is affected by this and how to triple check? (I am originally from the US so I don't know UK legal/credit system well - though I am a resident of UK). It's hard to calibrate how much this "cost" me, but I was definitely inconvenienced more than 100 GBP as I run my own business and depend on the cards, despite not using them that much..the times I use them are "club season" which is say Feb - May and Sept - Nov for me especially. So when I told HSBC in July that I hadn't noticed as I don't use the cards that much, I didn't mean never and that they weren't very necessary when I did use them. I just didn't do loads of personal shopping or holidays or use it every week is what I meant. It is for special, business, purposes. I lodged another complaint at the time of this one...which was simply they charged me twice for my monthly debit for the card. I made a stink to prove how they can make a mistake, as this was still at the time they were denying their error in the credit card closure. That took 45 mins and talking to three different advisors to have them admit what I said from start of conversation, which was they obviously charged me twice, as the amount is exactly double (they hilariously tried to convince me that the interest could go up 100% from one month to the other with no notice or formal letter etc). For that trouble they compensated me 50 GBP. So I don't see how 6 months reflects only double compensation of 45 minutes on an in branch phone. My question is, if I am not happy with this offer, where do I go from here as feel the Ombudsman, who is meant to be in my favour, is also pushing for me to accept this, and I am not looking for loads of money or anything, but I feel it grossly under reflects my stress and life upheaval in this time and frankly takes the ****. I want to be clear that during this 6 months, I paid all the monthly fees and interest still I believe being incurred. I have never defaulted on any loan (or had any) overdraft, card payments. HSBC told me themselves a few months prior to the incident that I had stellar credit with them. Can I take it further or should I just let it go?
  25. I'll start at the beginning because this is a complicated one! 1. Opened up a joint account with husband at HSBC. 2. A few months later in July 2006, we applied for an overdraft, this was granted. 3. Autumn 2007, we opened up an account with LLoyds TSB & they transferred the O/D. 4. In the last 6 months I've started to get letters from Raven/MKDP asking me to pay back £1709.01. I sent letter back disputing this, even did a CCA request, which I now know was pointless. What I have had back is some historic statements dating back to 06/Nov/2007 with a balance of £1201 O/D. This account then has lots of fees/charges added to it until 09/Jan/2009 when the balance is now £1709.01. 5. Had notice this morning that a claim has been filed at Northampton County Court. 6. I called MKDP to ask if I could ask to make a SAR, was told I couldn't do this!! I don't know what to do for the best now, as far as I'm concerned the balance was transferd over to Lloyds TSB & the O/D was £1201. Any help would be much appreciated!
