  1. I have a problem with Barclays. In 2006 I defaulted on a loan and they entered a Default on my credit files. In the meantime I have been on an arrangement to pay them. The default came off my credit files this year aftyer 6 years and then, a couple of weeks later, barclays have filed an "Arrangement to Pay" marker for the same debt. Can they do this?
  2. Hi, I requested a copy of my CCA to Barclays and I got a negative response. Not too sure what they meant. Can anyone help me with this. The letter is as follows: Dear XXX, REFERENCE: SECTION 78 OF THE CONSUMER CREDIT ACT 1974 We refer to your request for information under Section 78 of the Consumer Credit Act 1974 (the "Act") As no sum is, or will or may become payable under your credit agreement, Section 78(3)(a) of the Act provides that we are not obliged to provide you with the documents and information you seek. We can confirm that the cheque enclosed with your request has not been banked and has been destroyed. Please advise as to how I can attain this information. Thanks!!

Hello, been a while since I posted here as been sorting my debts out and moving home I wanted some help with my Barclays Overdraft my limit is £1000 My current balance is £980 and I get about £14.80 interest on it a month, I have been paying £15.00 a month back for a few months just so I didn’t get over my limit but to be honest this is just kinda pointless as im getting no where and im currently out of work and cant afford to pay more then £15 a month back. I rang Barclays a month ago and I got told that my account would get closed and it would get moved to a debt recovery company Just to note ive had Barclays bank account all my life since school so it’s the only card really ive had the longest, but I guess that means bugger all to the people at Barclays What’s the best way to sort this?
  5. I have just recieved a letter after 8 weeks from barclays to say my ppi claim has been refused on the grounds it was submitted by post and as a result they are not able to uphold my complaint. I was paying about £10 a month for at least 5 years . What steps can i take now ?
  6. Hi all. Wondering if I could get a bit of advice here on a situation I'm facing with Barclays. Basically I called on the morning Thursday the 7th due to dodgy transactions on my account, the card was cancelled and a temporary credit applied to my account (I've contacted the police etc). I was told that my new card should me with me Saturday or Monday at the latest. Come Monday - no card! So I call them on Tuesday and they say the system was slow and to allow until Thursday, if it hadn't arrived by then I was to call up and they would cancel the card that I had not received and send a replacement out as a priority delivery. Bang! Come Thursday afternoon - no card! I call up customer relations, and speak to a guy who tells me that it has to be given until Friday and thats the banks policy (I find out this was not the case at all!) he says he's checked with Debit Card Services and the cards been sent out and that I should receive it on the Friday. Low and behold, come Friday - still no card! I call up the bank and speak to another Customer Relations/Response member who ordered me a new card and cancelled the one that I didn't recieve - while on the phone and checking online banking, we discover that the card I didn't recieve had been used online and over the phone on the 13th and 14th! Something which the advisor that I spoke to on the Thursday should have noticed and could have stopped it. Its at this point I'm fuming and the advisor tells me that he could have cancelled the card as he was supposed to (notes were left by the manager on the Tuesday) and now I have to wait until these other fraudulent transactions that were made with the missing card debit from my account before I can dispute them or do anything - Leaving me currently £200 out of pocket. Basically I want to know where I stand and what, if any, other options there are! And I'm still without a card!
  7. Good evening all, I'll "try" and keep this brief. I'm looking into claiming some overdraft protection charges back on behalf of my mum, who has (still active) a barclays personal account with a £1,600 overdraft. She's recently requested all of her statements and has totalled up the best part of a grand (£998) worth of these mysterious charges she has no idea about. Is this O/D Protection same as PPI? Can you claim in the same way? She's printed off the payment protection questionnaire from the FOS but a number of questions on there don't apply or seem relevant. I was hoping somebody might have dealt with this situation before and could advise how we proceed with this one? Thanks for reading, Jim

I have just won 3 loans with ppi back for my mum of just 12 000 pounds from start to finish it took me 14 days, one loan of 10 000 payed out 8000 pounds ppi refund, barclays did all the leg work and were very helpful although they did sell ppi to a disabled woman who would not of been covered. I have 7 more to GO OUT WITH BARCLAYS possibly worth around 60,000 over 20 years and near to completion, I found it quite easy and barclays did give me all the loan agreements over the phone, just awaiting the rest of the money into my mums bank accounts, but without this site I would noot of been empowered to do so thank you all so much, as my mother had been taken advantage of all them years ago And a thankyou to barclays for making it so easy, but they would not of looked good in court with what I put on the fos quetionaire Tina

  11. Hi all, I've previously used this site myself to successfully claim back all ppi owed to me. My partner now wants to claim back all ppi owed to her from Barclays on various loans dating back to around 1999-2000. She doesn't have the paperwork for any of these loans now so am I right in thinking the first thing to do is send a SAR to Barclays to try and obtain all the account numbers etc ? It's been a while since I claimed back all my ppi so any advice on what we should do first will be very much appreciated. My partner wants to go through one of these ppi reclaim companies but I've told her I can do it myself using this site !

  13. Hi Another Grandma reclaim! Just received SAR reply... Barclays have given my grandma statements starting from Jan 1998 !!! There is Overdraft Protection on the first few statements: O/D PROTECTION 150 @ £0.80 /100 -- £1.20 However it's only appearing on: Statement 1 - 02 Feb 98 Statement 2 - 02 March 98 Statement 3 - 01 Apr 98 Statement 4 - 01 May 98 Statement 5 - 01 Jun 98 Statement 6 - 01 Jul 98 Statement 7 - 03 Aug 98 Statement 8 - 01 Sep 98 Nothing then from Statement 8 to 2012. Because barclays have only produced evidence for 8 statements, does that mean we cannot prove overdraft protection was added to the account before 02 Feb 98 ? Therefore my grandma does not have claim? I know she can claim back what is evident, but I don't see much point in claiming back £9.60 + interest. Any help please Thanks
  14. Hi, I am not sure if anyone can help with this. My husband was forced by Barclays Bank back in 1992 to take out a Business Loan or be shut down. He had to take out a loan for £7,000 over 7 years. On seeing all this about the PPI etc I had a look at the old paperwork, found the statements from this loan and low and behold this insurance is on the loan. It was a one off payment added on at the start of the loan. We have tried to claim the PPI back and have been turned down 3 times, because they cannot find the Policy. Well we can prove we had the loan, we have the statement with the £7,000 on it, we also have the statements and the first statement showing the insurance payment. The fos will take it up but they have said it can take 12 months. Not sure now what to do, anyone got any idea's?
  15. Hi, A couple of years ago I contacted Barclays to increase my overdraft to £3k. They said on the phone I was eligable to make it £15k and were seeing if I wanted to do it. A bit of a shock that I was eligable for so much, seeing as my accounts hadn't been run well, but I accepted. Since then, my cashflow has gone down and I was struggling to keep inside the £15k (often over it). Any money I put into it, kept getting sucked up in interest, it was like walking up a sand bank. Then Barclays contacted me and said that there were options out there for me and that I could consolidate my overdraft, credit card and a loan, all into 1 loan. They said this could be the best way, as they could see I was struggling to keep up and had slipped up on a previous repayment plan. They also said, that sometimes depending on my circumstances, the loan could be interest free. I uhm'd and ar'd and they suggested that I compile a list of my income and outgoings and that they would call back in a week to discuss. Knocking the interest off things, seemed like a good idea to me, so I have been waiting for their call. Two months down the line, still no call. Then I find out from Barclays (by chance), that my account has been closed and it is showing zero balance! I have also just had another of my Barclays accounts (which I rarely used and always kept in 100% good order) closed out of the blue. When I called them about this, I spoke to someone in collections who said that my main account was showing as zero balance and coming up as 'Money Manager'. The guy didn't know what this meant though and couldn't tell me much more. I have recently had a couple of voicemails from a firm called Credit Solutions. I guess this could be in connection with the situation? My questions are; a) Is there a deal to be had with this Credit Solutions, b), will it effect my credit history in any way, c) can I hold Barclays accountable for anything (i.e. puting me in so much debt, charges etc) and d) is there anything else I should know?   16. Any advice on this would be very much appreciated. Barclays have frozen my personal and business accounts and are demanding repayment in full. I'm overdrawn £1,765 on my personal account. The overdraft limit is £1,600, with a £150 buffer. The business is no longer in operation. That account has no overdraft limit but somehow I've arrived at £1,700 overdrawn in that as well. I have no other bank account and my credit rating is already dreadful as a result of other, ongoing debt problems. I doubt I'd be able to get another account, unless there's a very willing bank out there somewhere. I'm currently only working in a voluntary capacity. I've had mental health problems and I really don't feel as though I could hold a job down (much as I'm sure the benefits people would disagree). I don't claim any benefits at all. I've been told that I'd be unlikely to get any as my husband is American and I haven't paid national insurance for a few years. We have no income and I'm living off my parents. I really can't see a way out of this. Thanks in advance for any advice you might be able to give.
  17. First of all, amazing site, was so happy to have found it and a glimmer of light to my miserable problems with Barclaycard. Recently requested my credit report from checkmyfile and have quite a few problems relating to defaults/late payments with Barclaycard. The problem lies with a combination of me moving house and then direct debit being cancelled at the same time, hence Barclaycard not getting paid for months on end which I was not aware of. I only found out about the problem when Barclaycard took the outstanding amount in full (plus lots and lots of fees) directly from my Barclays bank account. Therefore the debt was cleared in full including all fees. Im now trying to tidy up my credit report as im desperate to get a mortgage but have got no chance with all these late payment markers all over my file. What I wanted to know was if there was any way I could ask Barclaycard to remove the defaults/late payment marks on my credit file. I know they probably wont do it just out of goodwill, but could they be removed as part of a reclaim of credit card charges? Just checked my statements and every month the balance was outstanding I had: Late payment charge £12.00 Over credit limit charge £12.00 These charges were applied from statements October 2008 to March 2010 – so the charges alone came to £432. The account is still showing is open on the credit report as for the last 8 months under Barclaycard its showing as green. I will call Barclaycard tomorrow and ask them to update my address details to my new address. Very confused as I read a lot about things changing regarding reclaims to bank accounts. Hence im not really sure if I could reclaim these charges, and if as a consequence of reclaiming the charges I could get the late payment markers removed. Any help will be greatly received.
  18. Hi Im hoping somebody can help. I bank with barclays and have a credit card with barclaycard. I pay the minimum amount each month on my C/C which is approx £20 on the 14th ish of each month. i checked my statement this morning and it showed £100 DDR First Payment DDR Barclaycard Visa payment on 5th december (today), then straight after it showed the same payment as a credit with UNP next to it. So this payment was firstly out of the blue as i normally pay £20 on 14th to £100 on 5th... I am also confused at the fact it said 'first DDR payment' - when i have been paying this credit card off for at least 18 months now. Can anybody help? Thanks
  19. I have recently run into Cabot Finance, an experience that I would not wish upon anyone . The problem I have is as follows: 1. Following the sale of my house due to mental illness in 2001, I asked Barclays to close the current acount associated with my mortgage. 2. In 2009, whilst checking my credit file I was made aware that there was a default against my name logged by Barclays. (I have a copy of this credit record). The debt had arisen, not because of a credit agreement per se, but because Barclays had made an error. The debt was the accumulation of account fees that had been charged against my account, even though the account should have been closed. The statements had been subsequently sent to the house that I had sold. I had not given a forwarding address because as far as I was concerned, the account was closed and the house not longer mine. 3. Barclays acknowledged that they had made a mistake and cleared my account and any mention of it on my credit file. I even have a hand written fax from a Barclays manager requesting that their debt recovery department remove the debt because of Barclays error. 4. In July this year Cabot Finance started calling every day, sometimes twice a day for over a month. (I am still recovering from a 3rd bout of mental illness so this only added to my problems) 5. I complained to the CSA and the FSA as I stated there was not any grounds to contact me. 6. The CSA stated that there did not 'appear' to be any breach of their code of practice as Cabot 'claimed' that they were legitimately chasing a debt that was outstanding. 7. In September 2011 I received a letter from Cabot restating that I owed them (they had bought a debt written off by Barclays) the sum that had been previously written off by Barclays - a total of £186. Not sure how this had happed 8. Having checked my credit file again, Cabot have now logged a default on my credit record, thus making it impossible to even have a modest bank overdraft 9. After reading the advice on this site (thank you) I wrote the following letter; Please note that I do not acknowledge any debt to either Cabot Financial nor Barclays Bank. I require you to supply the following documentation in order that I may correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement in relation to the debt to which you refer. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account for such debt. I enclose a postal order made out for a £1 in order that you will supply a copy of such agreement and statement of account. 2. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted by me to the relevant statutory authorities, including the FSA, The Financial Ombudsman and the Credit Services Association. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defense to any court regarding the claim that is issued. I have also noted that you have placed a default against my credit record. On the basis that there is not any basis for your claim I would respectfully ask that this is removed with immediate effect as there is not any justifyable reason that such default has been logged, which would also be contrary to the CSA Code of Practice and the FSA regulations. 10. Today (7th November 2011) I received a letter from Cabot asking me to CALL them. Other Facts It should be noted that I have not informed Cabot of the evidence I have (re Barclays fax above) as I was hoping that the onus or burden of proof was upon them to demonstrate by way of a statement etc that I owed Barclays money i.e. Cabot had to prove there was a legitimate reason for making demands upon me. QUESTION I WOULD LIKE ANSWERED A. Even though the debt relates to an alleged debt relating to bank charges, is this covered by the CCA and does my letter (see above) hold water? B. Should I write back to Cabot and state that they should refer to the letter I sent (see above) and reiterate my demands for proof of the debt. C. Even in the absence of the CCA not being applicable are Cabot obligated to provide me with proof of any alleged debts and the reason for them being outstanding. If so, is there any legislation or consumer law I can quote? D. In relation to the default, and on the basis that I can provide written evidence, should I write to the Information Commissioner to enforce the removal of the default by Cabot? If so, should I bring the following CCA paragraphs to their attention (from advice on this website): Removing a Default s159 Correction of Wrong Info provides, etc (1)Any individual (the “objector ”) given— (a)information under section 7 of the Data Protection Act 1998 by a credit reference agency, or (b)information under section 158, who considers that an entry in his file is incorrect, and that if it is not corrected he is likely to be prejudiced, may give notice to the agency (in this case Cabot Finance) requiring it either to remove the entry from the file or amend it. do note the rest of s159. in sum, they have 28 days to respond. either removing, editing, or taking no action. after, a further notice of correction can be requested to be added to the file. again, 28 days to respond. if refusing they should apply to the ICO for an order. an 'objector' can also apply to the ICO. failure to comply with an Order is an 'offence'.

Hi all, I thought I would use this helpful forum to document my story not only in the hope that others here who are more in the know may be able to assist but also to help others who may be going through the same situation. My story is currently ongoing. Currently, I am attempting to claim back charges applied to my unsecured loan account. These are made up of the £22.50 late payment charges. There are enough of them that they add up to a few hundred pounds. I have had numerous conversations, both over the phone and in writing with Barclays over the last year and have always come up against the same response, which is "you signed up to the terms and conditions therefore the charges apply" At one point they agreed to remove some of them but not all. I am going through a similar situation with Santander. I have sent a Subject Access Request to Barclays and the 40 days expired at the beginning of last week. I heard nothing from them at all, not even an acknowledgement of my request, even Santander managed that. I admit that I was a bit cheeky and 'forgot' to send the £10 cheque along with my request. Santander replied by asking for the money at which point they said they would proceed with my request. Fair enough I thought and send them the cheque. Shortly after, they sent me a letter saying they had received the cheque and would be completing the request within the 40 days which commenced on X date. All well and good. From Barclays? Nothing. Well, that's not quite true. Last week I sent them the reminder letter from here, giving them a further 7 days or I will commence court action. Yesterday I got a generic letter from the complaints department, saying they will look into my 'complaint' and I should expect a reply within 8 weeks! This was my face upon opening the letter.... They just seem so disorganised. I get that they must be dealing with so many of these at the moment but that doesn't remove the frustration and the opinion that I am dealing with an incompetent organisation. I will update the thread along the process, which I am quite prepared to take all the way. Any advice would be gratefully accepted.
  21. I have other threads here and have found CAG advice very u$efu£! I have a business account (ltd co) with Barclays. I wasn't using the company for a while as I was first unemployed then had a perm job so didn't have any money going into that account and never arranged for an overdraft facility. Last year I had around £1000 in the account when they started charging commission every month (despite their literature saying it was charged quarterly, they charged the 'quarterly' amount every month!) and also added things like 'business essentials' that I never ever ever requested! I withdrew/used most of the money I had in the account and they kept applying charges which caused the account to go overdrawn and they'd been charging quite a lot of interest on the O/D (which was made up mostly of their own charges and was never requested or arranged by either me or the other Director!). Recently my bosses put their company into liquidation and made everyone redundant but hired us back as freelancers so I'm using the company account again. Naturally the o/d amount was deducted from the deposit, leaving me with little money till the end of August . Would be great if you guys could point me in the right direction for reclaiming charges and interest on charges on a business account, in particular those for 'services' I never requested or even knew about!!!   22. Hi everyone, I hope someone can help… A friend has had repossession proceedings started against her by Barclays/Woolwich. The hearing is set for 1st August and I’ve been helping her by writing all the letters to Woolwich and their solicitors trying to get the full picture and making offers to them. Briefly the mortgage was taken out in 2004, all payments on time until Oct 2009 when her work virtually dried up (she is self-employed). She was in touch regularly with the Woolwich - but unfortunately these contacts were all by phone and she was told as long as she made the effort to pay something each month there would be no problem. Her bookkeeper tried to talk to them in March this year to try to get some sort of reduction by reverting to interest only or even a mortgage holiday for a short period until her work picked up again. The answer was a definite “No”. Her work has now picked up and she has made several payments – despite this the case has been passed to their solicitors who have taken repossession action. When the letter arrived stating that she would receive the court summons, the solicitors included a computer screen printout of the last 2+ years statements and I noticed that her contractual repayment of principle + interest had reduced to about £320 from July 1st . I queried this sudden drop of about £100 per month and eventually received a letter stating that she had been on a fixed rate mortgage for 5 years and that it had just reverted back to their current rate. I have sent a SAR to Woolwich to try and obtain all information regarding this and transcripts of the phone calls which were supposedly recorded. However time is running out… Do I fill out a N244 to apply for an adjournment to give them more time to clarify the amount of arrears (They are saying around £3000) but I do not recall there ever being any fixed rates for 5 years – and the mortgage started in 2004. Unless they put her on a fixed rate in 2006 this doesn’t compute. She cannot remember what the deal was. If she was on a 5 year fixed rate and she has got the arrears they state – she is now in a financial position to pay the contractual amount plus around £40 pm off the arrears. This has been offered (and paid for the last 2 months) but basically asking them to clarify the exact amount of arrears first. What do I do? Any help greatly appreciated Thanks
  23. Hi All, I have banked with Barclays since 2001 (13 years old) having the same account since then. On Saturday 18th June 2011, I attempted to log in to online banking it said I couldn't log in due to a problem with my debit card. I called the OnLine Banking team, they said there is an issue and put me through to debit card services. They advised to take my ID into the bank, they need it and would sort it. I go into the bank and the Personal Banker (PB) photocopied my ID and apparently got the block removed from my card. 1/2 hour later it still wasen't active, so went back in, the PB had been on the phone since I left as his saw there are blocks on my account related to falcon fraud, I attemped to read the notes he had on screen but said I was not permitted to read this information. I was due to go on holiday the next day, which I did despite not being able to access my money, I called telephone banking Monday (20th) they advised a closure notice was in the post but couldn't release any further information. The PB too called me to say I could withdraw cash at the counter, a letter was in the post. On Thursday (23rd) I recieved two letters, both were automated saying on the 1st July 2011 they will be closing all my accounts, it's not a decision taken lightly but is related to numerous factors from account conduct to a buisness change. But nothing specific, they also said they couldn't give me a specific decision. Firstly as you will see the PB mentioned Falcon Fraud, my research shows them as a card processing fraud detection system. But no mention of this in my letters, staff in branch can't give me answers, I want to complain for answers, also to have data protection release to see the notes etc, they hold on me. Has anyone heard of falcon fraud? I don't know what I'm supposed to have done, use my account wellish had a couple of bank charges for failed dd but nothing major, always in credit? Help basically... thanks guys!
  24. Hi all, I'm writing this on behalf of my partner who is sitting here looking very worried and stressed... I was hoping someone could give me some advice whether good or bad! We received a letter today from Cabot Financials asking us to contact them. My wife phoned them back, they checked her details and then asked if she remembered having a current account with Barclays. She acknowledged that she had one quite a few years ago, when they told her that they had bought the debt of that current account. They've said that the account was opened in 1999, and went into default in 2007, just after which they claim a payment of £135 was made. They are saying that the value of the debt is now £2150, but they will be willing to settle on £1950, but we said no. They are calling back tomorrow to discuss how much they will accept, as we started discussing what payment plans would be possible. We have also asked what the process is to obtair our original agreement - which they will let us know tomorrow. I just know that the majority of this debt will be those horrible £25 charges for being overdrawn every month, but have no statements to prove it. I don't know what our options are, if any, so any and all advice is appreciated, particularly since it has made my wife sick and teary Plus she is pregnant so I'd rather she wasn't stressed!!!!   25. I have been a barclays customer for 33 years, a Premiere customer for the last 20 years. I had a 9000.00 agreed permanent overdraft facility I have used on and off and it was at 7300.00 OD. I live permanently abroad (monaco) and following advice from a barclays manager, I wrote to barclays last year to inform them I am now separated from my wife and the divorce is taking place in Monaco, and with the account being in joint names, there was a mandate dispute (this is what the manager said to put) and I wanted them to stop any further payments being made from it (to avoid my wife spending more money and increasing our joint debt). I sent them back my barclays card and they actioned my request. I sent them my new address and started receiving statements, the last of which was March of this year (2011) The interest accumulating was only 18.00 and it was added to the overdraft monthly. Due to the ongoing divorce, despite the fact I am a high earner, until the divorce is resolved my outgoings are much higher than normal (I am having to pay rental on two homes now and associated expenses of two separate households). In 12 months my situation will be much better. At no time did I receive any communication from barclays that anything was untoward, that they wanted the loan repaid, nothing at all. Two weeks ago I received a letter from RMA, a debt collector acting on behalf of Barclays. I contacted them by phone and said I knew nothing of this or any problem between myself and Barclays bank whatsoever. They said they were only interested in recovering the debt. I asked for copies of any correspondence from barclays to me re the debt and they refused. I contacted my local branch via email and related the above. They said the account had been cancelled and they were very sorry, but now it was in the hand of debt collectors there was nothing they could do, and weren't even able to access my account to see if any letters had been sent or why the account was ever in dispute. They apologised but said there was nothing they could do. I wrote an email asking for my complaint to be made official as it struck me as irregular, and I wanted the ombudsman to look into it. I received an email saying that my complaint had been forwarded to barclays customer services and to contact the ombudsman if it wasn't resolved by barclays. Last friday the debt collector called me and I expained I had made a complaint to barclays bank and needed a couple of weeks to hear their response. They agreed to put it on ice for two weeks. Three days later (monday this week) I received a post card from the UK saying that someone from RMA debt collection would be visiting me this thursday between 8am and 8pm at my home (in monaco). I called them to confirm my conversation with their associate re two weeks on ice and they said that that had been posted prior to that conversation. I work from 8am to 6pm and am not able to hang around all day and can't believe this is how they operate. Are they seriously going to fly someone to Monaco on the offchance I might be in to discuss a 7000.00 overdraft? I have never previously owed any money, or had any dealings with debt collectors. I am a high earner, who, for the first time in my life needs to use an overdraft for one year (until the divorce is resolved and our assets split). Does anyone know if Barclays are allowed to just put my overdraft with the debt collectos, or have any advice as to the above? I have no problem servicing the interest on the debt, but can't pay it off right now. Nobody at barclays will talk to me as my account has been cancelled and is now with debt collectors. I repeat, I had no forewarning of this whatsoever and it has all come as a complete shock. Does anyone know how long I have to wait for Barclays to come back to me on my complaint before I am allowed to write to the ombudsman? Thanks for any advice. I can't believe this is happenning and I am really stressed about it.
