    CSA Hell

when the CSA calculates the amount you can afford living expenses are not factored in it. Unfortunately they will come after you, however when your wife gives birth that will be taken into account and should reduce your payments
  2. Indeed the mother can change her mind, here is a particulary scary story not same as yours but indicates how much power the mother does have in this http://www.dailymail.co.uk/news/article-1375861/Child-custody-Couple-ordered-pay-surrogate-mother-monthly-baby-wont-meet.html
  3. You can only sue the company and not the director he was carrying out his duties on behalf of the company which is a seperate legal entity
  4. If going down icy hills at 5 miles an hour still causes the car to skid then the obvious thing too say is the speed was not appropriate to the conditions. The way to avoid the collision or potential collision would be to avoid the hill as it was clearly too risky to drive down.
  5. Irrespective if the owner does not do refunds he is required to act within the law. You have every right to reject the car and ask for you money back. how did you pay for the car?
  6. What do you mean "I understand that this tactic has been known to work on many occassions" what happens if it doesnt work? To the OP you can ignore this
  7. With CSA you should never stop the payments allow them to do this. You also need to check if there are reciprocal CSA agreements between UK and South Africa. However no matter where your son lives he is still your son and there is always the moral question of support for your child.
  8. I assume she would still be claiming child benefit and the CSA have the ability to check this. However my concern is for the child, as the PWC is stating she no longer has the child (if this is true or not) does the other parent contact the Police to state their child is missing? Because basically this is what we have presented in this case.
  9. How can they claim £100 is their liquidated damages and then in the next sentence say they will accept £50. What rubbish
  10. According to the thread Parking Eye. Anyway to the OP it is not a fine and you can safely ignore
  11. I have been asked to remove them or face an MOT failure. Even phone and sat nav holders
  12. but if it is a private company on private land then it is an illegal act. In this case I would report it to the police they may say it is a civil matter but it is not. As for n otices stating clamping/removal these are now illegal on private land
  13. Do Defaults dissapear if you pay the account off
  14. This means that businesses could claim that the sale does not fall within DSR as most of its business is done face to face. That is not what the seller is claiming in this instance and has not been used as a defence in similar cases in this forum. I stand ready to be corrected if any other posters have seen this defence to avoid DSR
  15. Here are the exemptions to the DSR Exemptions to the Regulations The Distance Selling Regulations cover a wide variety of situations where you buy something on line from either the UK or the EU. However there are some situations where you do not have a right to cancel (unless the seller has given you this right prior to the sale) and some good and services that are definitely not included in the DSRs. Note that you don't have a right to cancel on all goods. There are some items that are exempt from the regulations as it would be unrealistic to include them. So unless the seller agrees otherwise the types of items in the list below are exempt from the right to cancel: personalised goods or goods made to a consumer's specification goods that cannot, by their nature, be returned perishable goods (eg flowers, fresh food) un-sealed audio or video recordings or computer software newspapers, periodicals or magazines betting, gaming or lottery services services that begin, by agreement, before the end of the cancellation period providing the supplier has informed the consumer in writing before the conclusion of the contract that he will not be able to cancel once performance of the services has begun with his agreement goods or services, the price of which is dependent on fluctuations in the financial market. Certain goods and services are exempt from all or part of the regulations: business-to-business contracts financial services sold at distance, which are covered by the Financial Services (Distance Marketing) Regulations. contracts for the sale of land – although the regulations do apply to consumer rental agreements products bought from vending machines goods or services bought at an auction with an auctioneer. http://getoffmymoney.com/distance_selling_regs.php#except Conducting your business normally on a face to face basis is not there, Thats the law for you.....
  16. What stops the dealer from claiming he normally sells face to face and therefore DSR does not apply
  17. It wont even go to court you will get variety of letters from different people in the office pretending to be solicitors and they will expect you to be dazzled by their use of the red font
  18. there is nothing preventing them from taking you to court it is just highly unlikley and then they have to win which is even more unlikely.
