  1. I have just sold a mobile phone on ebay. I described the phone exactly and honestley as possible. The phone sold and the guy paid instantly. Three days later I received a message thanking me for sending it so promptly but saying it wasnt as described. Corners were broken and there were big scratches on the screen. The phone I sent was mint but naievley I posted a libary picture of phone. I messaged back offering a full refund if imei number matched. He replied asking for imei number for his inbox??? Too cut a long story short a case has been opened and he has just sent the phone back. The number is obviously different but the only proof I have is my service upgrade agreement, which has phone/imei number. Help needed as dont want to end up out of pocket with this guys crap phone Thanks
  2. Hi all, I really need some help with this. Over a month ago I purchased a guitar from the USA. I paid via PayPal from funds already in my account. After not hearing from the seller for 2 weeks, I contacted him and asked for a tracking number. He replied telling me that the guitar was not built yet. I was notified in his email the guitar was not the one on the listing, it was a replica (copy or fake in my mind) that he builds. Next thing I did was respectfully ask the seller for a refund - he declined. I informed him that I did not want the guitar as in my mind, it was a copy. This was not pointed out in the listing. I then opened a PAYPAL dispute, the seller did not respond at all. Six days later I get an email informing me that they have sided with the seller. So to top it all off - he has over £400 of my money. I haver nothing and ebay/paypal wont offer me any protection at all. I have truely been ripped off in a big way! Now - to add insult to injury - the guitar 'I purchased' was relisted and sold again. The ebay buyer who bought it the second time has now left negative feedback saying the seller has 'stolen his money'. I do a lot of business on ebay/paypal, and I can not believe they have sided with the seller when I am clearly in the right. A friend of mine has told me that I can take paypal to small claims. Please if anyone can help out - I would really appreciate it.
  3. I bought a item on ebay ( mobile phone) & waited for delivery of the item item. After several weeks asked the seller about tracking number & seller gave me a number from One of the online courier service provider. Wait few more weeks & since there is no item or refund , had to file a ebay case. After another week or so ebay closed the case seller favor saying " tracking information shows Item has been delivered to buyer(me)". when I read check the same tracking details it shows " 17.07.2014 05:42 Delivery attempted 17.07.2014 09:44 Awaiting courier receipt ( the last update on tracking website). & did not find anything showing that the item is delivered ( even delivered to wrong person). Further to that it show they attempted delivery morning 5.42 which is a lie. Again appeal against decision pointing all above things but again ebay has denied my appeal. In the meantime I contacted the online courier service provider where seller bought the service & on staff had confirmed that the this particular shipment is "believed to be lost". I have the chat transcript in my email as evidence. During last week I contacted eBay through email & they keep refusing to accept the mistake they made. Yesterday I emailed the seller for the last time. I got the reply saying " it was unfortunate what has happened "& seller wants to refund me £30 once he/she get the refund from delivery company that means even seller accept this item has gone missing. I paid £140 & I lost my money & waste valuable time going after eBay & this seller. Would be much appreciated if you could advice me that how can I get my money back from eBay or this seller. thank you.

Hello, I recently bought 9 silver coins off ebay that are fake and I have opened a dispute and provided evidence which to the best of my ability proves this since the seller is refusing my right to return the items. The seller is saying that the coins are not fake, that I am lying and that he can trace back the authenticity of the coins. I have provided evidence that suggests that the coins are fake. The 8 day communication period is over and tomorrow it will be sent to ebay customer support where I do indeed think they will side with me and refund. The buyer is saying that if this happens and the coins he receives are fake he will sue me for total costs and damages. There is my problem, the buyer could potentially say that I switched the coins for fakes and sent them back when this is not the case at all. I believe that this could be a scare tactic and a last resort trying to force me out of the dispute considering I have provided proof that has led me to believe the coins are fake and the seller knows that he is beaten. I would appreciate any advice on this as a legal threat is not particularly nice when all I am trying to do is get a refund. Thanks
  5. Hi All any help would be appreciated. I have purchased an item on ebay, and the seller asked for payment by Bank transfer. I (stupidly) sent him £260 from my nationwide account. He then gave me a fake tracking number for the item, and of course nothing arrived. I have contacted him about this, telling him I will contact the police etc and he could not give a flying.. . To be fair his English makes me wonder if he is about 7 years old. contacted my bank. Won't help, cannot get the money back. I mean I am guessing my money is gone. Forever. But I have this guys details from ebay, all the emails, what can I do? I don't want him to get away with it..
  6. I will keep this as brief as poss..... I bought a car through Ebay, I went to the persons house test drove the car it was fine, handed over the cash, drove down the road approx 20 miles and the car broke down, I called the seller, who came to meet me and after a long very heated and difficult conversation including calling the Police, he would not agree to give me my money back or offer a repair. I managed to get the car working again drove off only to completely brake down after approx 10 mins, I called the AA who attended and discovered that the cars engine management systems had certain codes by passed and cleared just before I picked it up, in their opinion the trader had deleted the faults in order for it to drive perfect on the test drive. The Diesel particulator filter needs replacing along with the mass air flow meter & the turbo along with the manifold cover that had been bent. The trader will not enter into any discussion about returning the car or even a refund. He tells me as I bought the car from a trader and I signed a piece of paper saying that I was buying the car with no warranty and that he had told me about all known faults ie none! there was nothing he was legally obligated to carry out. Is there any course of action I can take to get part or all the money back, can I get him to pay for the repairs..... Help needed please.
  7. I'm not sure if this is in the right section or not but I'm after a bit of advise. A few months ago I sold a phone on ebay everything was going smoothly until 2 days after. The buyer open a case as as item not as described . The buyer said he had received an empty box which wasn't the case I had sent the item special delivery I kept all the receipts. The weight of the package was on there aswell. Ebay straight away settled this case in the buyers favour and refunded them the money due to their money back guarantee policy. I appealed this decision not once during the case did they ask for my input on anything. They declined my appeal. I then started emailing ebay eventually after a few emails they didn't reply. Some other things cropped up. I left it at that. I paid the seller fees for the item. Then they kept emailing me telling me I need to reimburse them because they had refunded the buyer. The other day I had a text message and a phone call from transom saying I owe them money etc I'm guessing they work with ebay I'm not sure. I need to know what my next a steps should be in dealing with this.
  8. Hi im looking for some assistance please. I have an ebay buyer threatening me with the small claims court for an item they say they returned but we havent received. To cut a long story short they were not happy with the item they purchased so we asked them to return it. A few weeks have now passed and we have not received the item back and they cannot provide any proof that they returned the item. Can any one help me where I may stand if they were to take me to the small claims court? Thanks
  9. Trying to make sense of the terms and conditions of ebay's Global Shipping Programme - In places, somewhat confusing and possibly unfair. This would seem to indicate that all fees and charges have been paid up front.... This clarifies the claim that all fees, including VAT has been included in the price paid for shipping.... Then we get to this section: Err.... Unless I am mistaken, previous clauses would suggest that no further charges will be liable once payment has been made.... Finally, the unfair clause: So eBay can amend the T&C without giving notice - Something is seriously wrong with that ! Having paid for this "service" on the assumption that import duties, VAT, brokerage fees, and shipping costs have all been paid up front, should I incur any additional charges, would I be within my rights to: a) Lodge a PayPal dispute and/or b) Do a S77 charge back on my credit card. c) Demand that eBay refund any additional charges on the grounds of unfair contract or mis-sold "service".
  10. Question for the experts. Need advise on where do buyers stand on returns of brand new items that the buyer has gone against terms and registered the hardware and software in their name which cannot be removed. Thus rendering the product useless to resell on new and cannot really resell on as used as its linked to someone else's name. Advice on that?

After going through ALL the correct channels for obtaining a refund for an item not received, (dispute resolution centre) ebay founded in my favour and sent me an email stating that a refund is being made. The dispute was closed by ebay when I got a 2nd confirmation email of the refund being made on the 28th May Then I get the following email from paypal (on the 4th June)... >Subj: Refund failed > >Dear 'xxx Buyer xxx' > >The refund sent by 'xxx the seller xxx ([email protected])' did not clear from the sender's bank. You have not received funds for this payment in your PayPal account. > >Please contact 'xxx the seller xxx ([email protected])' regarding this refund. As it turns out, the seller has done this to a number of other people at the same time - Although a relatively new trader when I purchased my ebay item, the feed back had no negatives. As soon as I received the above email, I tracked down a number for ebay as the dispute had been closed. Spoke to them, explained the entire situation and they agreed that a refund should be forthcoming and said they would get it sorted. A week went by, no refund so I used went onto the ebay help and opened a chat window. They said I had to call them but at least I get a free-phone number. They apologised for a delay and said that they would do a manual refund. This was Friday 20th June. I am getting a little fed up of the onus being put on me to secure a refund, and the false promises that ebay has given as it contradicts their money back guarantee that is advertised all across their website. All I want is my money back and for Ebay to deliver on their advertised promises. What's the best way of doing this as I'm a bit reluctant to waste time on the phone again.
  12. I purchased a replacement laptop battery via Ebay in August 2013, and chose this supplier as they advertised a 1yr warranty. I paid for the item via Paypal. 9 months down the line, the battery has failed. The supplier has refused to replace it FOC, and wants a part payment, about 75% of the full cost to send another battery. My view is that a warranty supposedly guarantee's the item purchased for a given period of time, and if it fails within that time, then it should be replaced at the suppliers cost, not the consumers. What are your views, please?
  13. so, I have an ex partner, and it seems she used an ebay address of mine a few years ago to sey up an ebay account. the account has a balance owing and every week for the last 3 or so years I have recieved an email threatening me with further action. the account is not in my name, but my email address has been used. multiple times i have replied to the email and had an answer back saying that they would et back to me with a solution. they never have. what is the best course of action, it's not so much an issue as just damn annoying!
  14. Ebay has asked users to change their passwords following a cyberattack that compromised one of its databases. The auction site said that the database contained encrypted passwords and other non-financial information. The US firm added that it had no evidence of there being unauthorised activity on its members' accounts.   15. I bought an item (via ebay & paypal) on 10th march, which was never delivered - seller disappeared. I opened an ebay case on 29th April, which has resulted in them telling me i "cannot escalate the case to a claim for refund due to expiry of Ebay's 30 day timeframes for submission" This is not a legal reason to deny my refund and Ebay are simply cutting down on their internal adminstration by blocking people from claiming refunds after 30 days has elapsed. I intend to challenge this by submission of proceedings against Ebay Europe SARL via the Moneyclaim county court service in the UK. moneyclaim.gov.uk Has anyone ever done anything similar, any advice appreciated..
  16. Hello I sold a amateur radio transceiver on ebay. as its an item that can be tampered with I put on no Returns. I have a personal account. buyer contacted me a bit later saying that the microphone was not working some buttons on it were at fault i offered the buyer out of good will to replace the wire on the microphone. Buyer claimed that he has tried a different microphone from another radio that is none compatible. Then the buyer said there was other faults with the radio but no mention of this before microphone was put in to radio. only thing was that radio did have stick on rubber feet but buyer claimed i d id not say this in the description but these were visible on photographs. The buyer even tried and said for to relist the radio but i refused as i do not know what the buyer has or may have done to the item. Now ebay and paypal want me to give full refund and accept the radio back that is now broken an refund 300 pounds which i don't have. The buyer has sent the radio back and i know that legally i do not have to accept the item as once i sign for it then i have accepted its my fault when it is not. Just thinking on what is your thoughts about this any more advice do i decline radio then take buyer to court Thanks g
  17. Hi This is new to me so please I really could do with some advise on Ebay account being hacked and pay pal account also. I have reported this to the national fraud office as Ebay would not listen, leaving me and some buyers out of pocket. This is only the start of a whole list of strange things attached to this fraud, so if anybody can help me tell my story of how I find myself with angry people emailing me about items that I have meant to be selling on ebay but the truth is that somebody has stolen my account. I have received a letter from Transcom for ebay i had a dispute with ebay as i sold a leather jacket, the buyer messaged to say it was not leather and wanted to return it, i said no as the label clearly states it is leather and pic of the label was on the listing, obv he just didnt like it or it didnt fit. i refused a refund and contacted ebay. i told them what had happened and said i was not refunding. he opened a dispute and of course ebay took his side and refunded the money. i had no money in paypal so it went to neg balance. i left it that way as why should i refund, its up to ebay if they chose to refund. I got the coat back a week later with a big mark down the front, clearly done by him. I still havent paid ebay back and now i have this letter. Anyone know where i stand
  19. Apologies if this is in the wrong place. I recently purchased an item off Ebay. The item cost £4.99 plus postage. The seller gave me a tracking number for Yodel. A courier for an item that costs £4.99? Strange! After ten days the item had not arrived. I went onto Yodels website and input the tracking number; it was delivered on 10/4/14. No it wasn't! I rang Yodel and gave them the tracking number and my details. "Sorry that tracking number is not for your address and we are unable to give you details of where the item was delivered due to data protection". Went back to seller: gave him the information as above. After many days of toing and froing the seller kept saying item delivered even though I explained the tracking number did not relate to me . Having lost my patience I escalated it to Ebay Customer Care(laugh!). The email: I have been involved in a dispute over non-delivery of an item. The item number is xxxxxxxxxx. The tracking number given to me does not correspond with my name, address or postcode. It is the wrong tracking number and the seller refuses to budge. Please help. Another Ebay problem lol Trying to keep as brief as possible, sold an item to a guy, it arrived broken, he sent it back str8 away, didnt arrive back, tracking reference says delivery not completed, ebay know delivery not completed per live chat I had, ebay refunded the buyer and now they are chasing me for reimbursement fees. My card was damaged and I got a new one, so they couldnt take it auto thank god. In Ebays T&C's, they state that once the item is returned then they would reimburse the buyer. However they reimbursed him before knowing it was returned. Its only £36.56 but its the principle. Numerous emails in dont even get a response. Live chat wont help they tell me to call in. I called in and got a foreign lass who needed me to repeat everything I said. And basically said to contact the buyer. Personally though its not my responsibility to do this. And I have ebay rep on live chat admitting this too. I really want to sue them for harassment as now I have debt collectors chasing me. If I received the item back then fair enough, but I havent, so why should I pay?? If they would respond to emails then maybe I could get into a dialogue with them, or even speak to an "english" operator who understands the f***n language Any ideas on next move?
  23. i have major issue with ebay myself. on the 7th i bought an ipod 160 gb. on there it says seller refurb and hen had put loads of new parts. so i get it and it wont work it says corrupted and error message when plugged in it wont sycronise my music and keeps saying error message when i try to restore on my pc wont let me basically useless. and its been in box all this time almost three weeks. i have tried everything. the seller told me downloaded new i tunes that should work. spent weeks emailing him but it hasn't worked. even tried i have and tried it on other computer. problem is seller has been denying it was not working and saying i wot get refund he got a bit snotty when i opened a case he constantly blames it on my pc but any issue so i know its not problem. its dragged on two weeks and i still haven't had a resolution. then earlier i got email from head office saying i should find someone to fix it and that made me very angry i spent all that money on it and i am supposed to just fix it but the way i see it i bought and it doesn't work why should i fix it. if i had wanted to buy one that needed to fix it would have only cost a few pounds. i bought it for it to work and it didn't at all. i have sent long email about sale of good acts and it not being fit for purpose. and that i should be entitled to a refund repair or replacement. my main issue is i feel i have been lied to because the seller said stuff in the description he said it was seller refurb and lots of new parts and i buy it for that reason and it doesn't work and i feel like the seller is laughing he gets my money and i get heap of junk i can't use. i have use ebay for years but i am really upset bout the whole thing i have to wait 48 hours for their verdict but if seller had accepted responsibility and said it was his fault in the first place it would have been sorted out quicker. any advice can't see this one going my way personally.
  24. I have recently made a purchase off ebay, as a winning bidder and made an immediate payment via paypal, which was the payment option in the listing. I very quickly received a message from the seller saying that they didn't want paypal used and it was only cash on collection. I called the seller and they were adamant that the listing was cash on collection. Having re-checked the listing, in the sellers instructions it just gives a phone number to contact them it doesn't state NOT to use paypal. The goods had to be transported by courier, so I contacted them and they agreed to pay cash on my behalf when they collected the items for me and I have taken delivery. When does theseller know that funds are cleared in their paypal account and can safely issue the refund? They have said they will send it but it's not yet been done and it's now four days since the collection was done and cash paid. Am I being too impatient? They keep pushing for feedback to be given and I obviously don't want to do this until I've had my money back.
  25. Morning all, Now while I am technically competent I find myself with an issue I am not sure about. I bought a Pomp W89 quad core mobile from a seller on Ebay. It is a Chinese knock off and looks good. After I contacted the seller he (I assume) replied with this I had already done this so I replied saying it still wasn't working so today I got this. Now, it is my understanding that when outside, the GPS chip should work without having GPRS switched on. GPRS is an additional factor to ensure quicker location. If I left data roaming on, this would cost me once my PAYG payment expires. Are they trying to fob me off?
