  4. This is the first thing they do is to be vague that way you will ring them , DONT. Once filled in include a postal order for £1.00 and send off to the dca they have to respond in 12+2 days. Do this 1st and send it recorded delivery, keep all letters they send you as well then come back, dont ring them at all thats a must if they ring you simly state you will only communicate in writing then hang up ok By the way who is the DCA as they play differently to each other, I am new on here too but the help is invaluable and if i say it rong someone will correct me anyways good luck

Welecome to CAG A CCA request must include copies the agreement t&c's at the start the end and any adjustments, You should have had a letter stating the a DCA is involved Now for the nitty gritty part can you please post up more details please so we can help, like when was it taken out , the last payment any history regarding this debt thx Then stay off the fone ok mm

Hi I would use the I&E template to see what you can realistically afford, but don't give this to anyone else, it's for your info ONLY, Also have you got any charges? if so reclaim them, Also when were these cards taken out? Don't fret about the silly letters from the dca's you've done the best thing coming here for advise. have you got all the details of both accounts? if not you may consider a SAR to both creditors, but this is just the start, don't worry plenty of templates are available as and when needed, someone else will be along shortly with better advise, so do the following 1 Never ring a DCA they are not bailifs, and as such have no legal powers, they will try to bully/lie to you into paying DON'T listen to them 2 Don't go through their security questions just say in writing then just hang up 3 Never beleive anything they say all they want is YOUR money asap with as little effort as possible, 4 Dont agrre to any payment plan till advise is sort 5 Don't acknowledge the debt either

Hi and welcome to CAG What you needed to do 1st was control your debts, you have 2nd was coming on here for advise thats a great choice have you received any defaults or any of the card/accounts with any DCA's? Debt collecting agencies? if so can you post up the details please so we can advise and have you got any demands/discount letters from them yet if so post them too please mm Never ring the dca always say in writing only and hang up never confirm the security questions till further advise is sort, keep all documents safe as you will need them later When you say is "owed" to the dca, who are they and are they (a) acting as agents (b) have purchased the debt if so its a little different. On your credit report it will say who owns the debt if it is still with the OC (Original Creditor) then pay them but did you receive notification from the OC that the debt was being passed/sold on and did you get a DN (Default Notice) amd a notice of assignment,let us know what letters you have and when you last made a payment/acknowlegment of these debts to the OC's or Dca's and never pay a fleecing dca they will lie and cheat you always seek advise before you part with your money 1st and a good place to start is to read here while you wait http://www.consumeractiongroup.co.uk/forum/showthread.php?327930-Getting-Started-With-Your-Debts-*****-PLEASE-READ!-*****
  12. Hi you are welcome I am a newbie myself but do all I can to help, also if in future always send off the V5 yourself never give it all the new keeper,only the part that refers to them you have a legal obligation to send off the rest to the DVLA

Hi welcome to CAG If you know nothing regarding this offence apply to the Magistrates Court that dealt with the matter or your local one will do, and say you want to make a statutory declaration it will stop the action, and you will have to reattend court and the case will be reheard again, try and find out if you informed DVLA that you was not the keeper at the time, did you send off the V5 with the new keepers details on it, and did you receive notification from them stating you are no longer the registered keeper, I think this advise is correct but someone mat correct me if I am wrong keep us informed so we can assist you more if needed, they may infact offer no evedence in this case and it could be dismissed..IMHO

That's easy to do, thank them for their letter asking you to review you finances, and after going through them you can afford XX for XX months and will review it yourself in say 6 months, by the way they don't have the right to make you send them your/their I&E details only a judge can say that, then make your payments in the usual manner please keep all receipts and keep them safe Have you any further details you can share? are there any charges to reclaim and things like that, all this helps to give you better advise. Hi can you please post up more details of the debt like what its for and as much detail as you can please so we can offer advise, also it is fraught with pitfalls, like they may sell on the outstanding debt to a DCA (debt collecting agency) are there any charges or PPI involved and things like that we need the full story to offer the best advise If you do it without further advise you MUST get them to include in writing that That they will mark your credit file as satisfied They will NOT pursue/sell on the balance to a 3rd party Always get them to confirm this in writing before you do so Never phone them to discuss this always in writing Never ring a DCA or go through security always state in writing then hang up mm
  18. Vanquis are nortorious for charging late/over balance fees, this how they make their profit. Always challenge their fees use the complaints procedure till the give a final responce then complain to FOS they may takew up your ase as they have mine and have had some success with this avenue, I'm still disputing several 100's of £'s in new charges IMHO pay this card off asap cancel the card and stay well away from them. Also are you paying the ROP (repayment option plan) did you ask for it if not get reclaiming come back for more advise MM

Freddericksons use Brian Carter LLP and he will run a mile allegedly if you put in a defence but thats a way off yet Then if you write to any DCA always send it off recorded delivery then get proof of receipt from the RM (royal mail ) site and start a file keep all letters in the file comne back for more advise when needed

Dx 100 corrected me and at the end of the day have you any bank statements from your past regarding this debt? as any DD (direct Debit ) will have the Vodafone refernce number on it, is there any chance of you have still got anything from Voafone have a look around you may find something, Ps any site team member has far better info than me just starting to help people myself after great advice from here, having re read your reply you say that the debt was defaulted in 2007 was that your last payment/acknowledgement of this debt? if so it may be coming up to being SB (statute barred) 6 years in England and 5 in Scotland and therefore the OC (origninal creditor) may/not have your agreement anymore so in that case try to find any letters from Vodafone, then SAR (subject access request) them costs £10-00 and they have 40 days to conform with it. Also Lowells are very quick to issue SD's (Statutory Demands) I think I had 5 with them and got them sorted from here, If you have not made any payment/acknowlegement PLEASE PLEASE do not make one now as it will start the 6 year clock all over again then you will have to wait all over again, do not admit the debt till they can prove you owe it

Please remove by editing out all personally identifiable markers ie: name ref number bar codes any thing that can identify you then await more advice , someone will come along and offer further advice, by the way it seems there maybe a problem if discounting already so get info up asap
