  1. With Vanquis have they charged you the ROP (repayment option plan) did you agree to this when you took out the card? I bet you didn't so get reclaiming that too, Also with Vanquis they won't be to happy to let you use the ROP and they try to make you deal with their tin pot DCA's or other's I am in dispute with them and have been for 2 years they will try everything not to sort this out with you, don't ring them ever, and also keep all the letters from anyone regarding this matter it help MM
  2. It is always best to send in your letters each time by RM RD so if it goes to court or further action you have a paper trail, also they can not say they didn't receive it it's worth it in the long run, Don't pay a DCA always the OC why line their pockets?
  3. Hi also if you have the high rate you can apply for the bus pass too and if necessary one for yourself as a carer its free and expires as your award comes to an end hope this help too?

Wb dont worry too much atm about the default or assignment, what you need to do now is send off the letter for the cca request that can be found her enclose a postal order for one pound staing it it for your CCA req and for no other purpose the letter is here ok send recorded delivery http://www.consumeractiongroup.co.uk/forum/content.php?414-CCA-request-letter. once sent they have a very shor time to respond i think its 12+2 days once received come back thx MM

  6. Thankyou to id6052 for the update but this does in fact relate to council tax but being some what daft in the way I communicate. I do struggle big time and am learning everyday, I have fully replied with the above to confirm the OP. As I am learning every day I like to say a big thanks for the input of id6052 which will allow me to gain even more knowledge from this site to use in my everyday life, and this sort of thing allows me to become a smarter person

To everyone that has commented on my OP I did'nt intend to confuse people with the post, I am brain damaged and I don't clearly state things the right way for that I am sorry, I will try to explain, Years 2010-2012 I had to pay no CT this year 2013 it went up to £88-00 pm, I appealed this decision and was told about this new excemption, for which I have applied for, still waiting to hear the outcome So with this in mind I thought it appropriate to let others know this, Also as stated there are certain criteria to be able to receive this, as I am not in the knowlegde maybe I posted in haste, also that on this form you will have to have a medical practioner fill in the for and they have to be a ble to say for certain that under the rules as listed below will apply.... If a person who resides within a premise is severly mentally impaired a discount or excemption can be given. whether it is a discount or excemtion that is applicable will depend on the circumstances of any other occupants A person is considered to be severly mentally impaired if: the person has a severe impairment of intelligence and social funtion (however caused which appears to be permenant (and) the person obtains a certificate duly signed to that effect by a regestered medical practioner and, the person is entitled to (although not in receipt of the following benefits) Incapacity benefit under s.30A sscb (Social Securty Contributions and benefits Act 1992) Attendance Allowance under s.64 SSCB Act Severere Disabledment Allowance under s.68 SSCB Act The care component of a DLA payable either at the highest rate or the middle rate under s.71 and s.72 SSCB Act An increase in the rate of Disablement Pensions Act under s.104 SSCB Act A disablity working Allowance under s.129 for which the qualifying benefits is: A) one falling within s.129 (2) (a) (1) B) Income support, and the appilicable amount formally payable included in a disability premium An unemployalitlity suppliment under part 1 s. 7, SSCB Act A constant attendance allowance under article 14 of the personal injuries (civilians) scheme 1983 or article 14, Naval,Military, and Airforce ect. (Disablement and Death) service Pensionorder 1983 An unemployability allowance under article 18 of either of the provisions referred to immeadiatly above Income support where the amount includes a disability premium. Incapacity benefits under s.41 and s.41 of the SSCB Act 1992 Employemnt and Support Allowance Because of the complexity of the particular disregard or excemption it is essential that the Taxpayer be required to complete an application form. The standard form requires full details to be provided including evidence of benefits received and also a signature of a medical practitioner. I typed all of the above by hand from my appilication form I now hope this will clarify any missunderstandings

  9. what I meant to have said is save SOME money no disrespect to mums and dads that have child support, I am a single dad too and have custody of the child, i have a problem with my mind it does'nt work normally and say write the things slightly different to what I actually want to say/write if i offened sincere appologies offered, if like me you like the thought of going swimming/activities your local council may do as ours does and off a advantage card, so like when I go swimming the cost is normally £4-50 the seesion with the card i can go for £1-00 instead it's worth the look at

Having been on DLA for 3 years due to circumstances i found myself in the place many will do in the near future, not being able to afford the extra cash to pay the council tax bill, for 3 years I was excempt then got this years bill, I panicked as they demanded the full amount but took off the single adult part of it, so my bill went for £0-00 pa to £80-00pm. I spoke to the dept concerned at a residents meeting and they looked into it for me and stated, that they had got it wrong, now having had this new form I went to the Drs and they read the form and agreed to sign it for me, so I will have to wait till the documents have been checked to find out if indeed I can get this new discount, my OP was to bring to peoples attention that this IS avaible but has certain criteria to get it, so you will h ave to ask if you can apply for it then you MAY get this discount, if you don't know about it how can you apply for it,

  12. Hands up if you are on DLA mid to high rate? and now have to pay the excess in council tax? Me too but today i got a letter from them stating that now under the rule you can apply for something called "Severely Mentally Iimpaired Ddisregard" the title says it all lol, so get claiming if you get the above mentioned benefits at the rates stated, you are entitled to claim the disregard and you may get it reduced even more please spread the word about this post to all of our disabled friends that have been caught out by this You will need to conatact your local council benfits section and ask to be sent the form to apply, hope this helps someone as it has done for me and do this asap as you will now have being possibly paying to much CTAX already, also if you do apply the form will offer the option for a health care professional to fill in the form this form, and state that they are in the opinion that you should receive the extra discount offered, there is sections that may be of assistance to you as in my case, so its may be worth looking into

You are welcome, personally if I had extra money for the child I would put it in a savings account and let the interest accumilate and they will have a nice nest egg for when they leave home, Also if you are awarded DLA for them the household will have protection from certain people like bailiffs and DCA's (debt collection agencies), which helps in many ways, also you may want to look at getting a discount card for the local services like swimming and so on, goto your local council and ask at reception for anything you else that may benfit your childs health and welfare, also look into applying for carers allowance and a things like that, hope this all helps you. Then if you are awarded the higher rate for mobilty you can get a free VED (vehicle excise disc) for your car

Hi, if by forcing your tenant to support you then you are playing into their hands, do you have A: Have a tenacy agreement in force with the person B: Why is the tenant having control over your utility bills? C: Who is ultimatley responsible for the house/is it yours or rented? TBH I think that more information is in the background and needs to be disclosed, so we can advise better for you, and also that you need to get all of your bills back in your name and sever any and all financial tyes with them in that respect, and keep it strictly landlord/tenant

As my first line says, or didn't it was her 1st offense and they are so cracking down on fraud because its so prolific now, they want to reclaim as much of the missing funds as they can, then fine you for commiting the offense as well I wish the OP luck for Monday but advise was/is get legal advise as this is so serious in the courts eye?
  16. If you are in receipt of any benefits like JSA/ESA/DLA then you will need to send in a change of circumstances to your local ctax/housing benfit dept and state that you are getting these benefits, do this straight away if you are on them now

DLA is wawrded to to the child, for the disabilities he /she has and is disregarded for income purposes, your ex will still have to pay support at the required level, again this is for the child and should be used for only that purpose and not for running expenses of your household bills. Any income must always be declared if not you run the risk of being pursued for overpayment, as nanny always said "Honesty is the best policy" always declare any income to the DWP everytime, also depending what level award they are given you may also be allowed to apply for a blue badge and/or a free bus pass look for this when you receive you award
  18. A WOMAN who dishonestly obtained £30,000 of benefits she was not entitled to has been given a suspended prison sentence. They are cracking down big time on benefit fraud, if you google benefit fraud you can get an idea of what might happen, the case will go towards the way you hid your funds, now in court they give you credit for admitting the offence at the first instance and reduce any sentence you may get? The fact you repaid the public funds asap will go someway to show remorse, but please be prepared for the worse, the first sentence is a clip from a case I knew about and knew the defendant invoved, if you still have not consulted a solicitor do so at court ask to speak to the duty solicitor and maybe once he hears the details may ask the court for a adjournment, please don't get me wrong this is a "so serious offense" that a custodial sentance maybe imposed, but likewise you may receive a community punishment. It really does have cause for concern, so see the duty solicitor asap, also when you book in for your case and are unrepresented you will be offered what they call "advance disclosure" this is the evidence that the prosecution will present to the court, read this in detail and if you feel you can not defend yourself ask the bench for the adjournment yourself , then seek legal advise straight away..
