      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Boris Johnson wants to renegotiate EU terms if possible to stay in. He said fhis on LBC the other day and he is not alone.

 

Will the EU concede greater restrictions on rights of free movement and other sweetners to stay in ? Possible.

 

What happens if there is an early general election and a pro EU party (Labour ?) wins ? An election result would trump a referendum.

I think the majority did vote purely on the EU, Uncle B. Every 5 years we vote in the general election, a party that will respect the wishes of the voters. Unfortunately, this doesn't happen. the UK Parliament inflicts the wishes of the EU on us.

This will now drag on for months and years causing economic damage to the country.

 

I think Cameron will resign at some point this year and there will be a general election before the end of next year.

 

Some people have voted for leave as an anti government vote and not anti EU.

 

I just hope then that Jeremy Corbyn ( call him Cob-on) does not become the next PM, I do not support any party but that man is about as good as a chocolate fireguard!

means asset stripping the country and selling everything off (think BHS)

Cameron will be gone by October and it will either be Bojo or May as new PM. Bojo wants to use the referendum to negotiate revised membership terms. Get ready for a civil war in the Tory party and a bad few years for the UK.

 

If you have investments or pensions you will see a consequence of this vote. The UK will be worse off for years, all because of the hysteria whipped up by some people over a long period.

 

When people vote tactically without engaging their brains this is what happen.

Disastrous result - lets see if the Brexiters are still smiling when their mortgages go sky high and they're paying more at the supermarket. Although the majority of leave voters in my area seem to be either pensioners(who still think Rule Britannia etc) or unemployed neither of whom are likely to be paying mortgages or have any foresight as to what it means for jobs for the following generations.

When I woke to the news this morning, I didn't feel anything! I expected to feel relief that the will of the British people had been heard. Nothing!

 

I cast my vote on the basis of my beliefs but this morning, I began to wonder if some of the people did a protest vote due to the (mainly) Tory campaign to stay. I hope not.

 

I was expecting my own area to be remainers as it is mainly rural farming but in fact it was about 64% leave.

 

Anyway, the deed is done, we will be leaving the EU and the country will either suffer or recover over the next few months. Once it becomes more clear, I suspect the pound will bounce back a bit

Immigration will increase for two reasons. Brits returning to UK from EU mainland and EU mainland citizens coming to the UK before any exit date. One of my nephews teaches English in Spain and there is huge demand for courses. This will cause more pressure on all services. Rents and house prices might increase further due to demand.

 

Even after Brexit, there is no guarantee net migration numbers will be lower than they are currently.

 

If interest rates increase, inflation increases because we import more than export, pound sterling reduces, we will be worse off.

 

Your kids will most likely suffer due to this vote.

It depends on what happens. If for example UK government stops paying Spain for healthcare they offer to British residents in Spain, those that cannot afford to pay will come back to the UK.

 

Many EU mainland citizens who have come to the UK will now apply for British citizenship to ensure their rights are maintained. I think it was Migration Watch who said that Brexit would see a large increase in UK population before the Brexit date. I agree with them.
