I wonder if the situation with the existing freeholders is such that the property is really unattractive, in ways possibly not obvious to someone who also has an interest in and acts for the freeholders.

    • Hello, I will try to outline everything clearly. I am a British citizen and I live in Luxembourg (I think this may be relevant for potential claims). I hired a car from Heathrow in March for a 3-day visit to family in the UK. I was "upgraded" to an EV (Polestar 2). I had a 250-mile journey to my family's address. Upon attempting to charge the vehicle, there was a red error message on the dashboard, saying "Charging error". I attempted to charge at roughly 10 different locations and got the same error message. Sometimes there was also an error message on the charging station screen. The Hertz 0800 assistance/breakdown number provided on the set of keys did not work with non-UK mobiles. I googled and found a bunch of other numbers, none of which were normal geographical ones, and none of which worked from my Luxembourg mobile. It was getting late and I was very short on charge. Also, there was no USB socket in the car, so my phone ran out of battery, so I was unable to look for further help online. It became clear that I would not reach my destination (rural Devon), so I had no choice but to find a roadside hotel in Exeter and then go to the nearest Hertz branch the following day on my remaining 10 miles of charge. Of course, as soon as the Hertz employee in Exeter plugged it into their own charger, the charging worked immediately. I have driven EVs before, I know how to charge them, and it definitely did not work at about 10 different chargers between London and Exeter. I took photos on each occasion. Luckily they had another vehicle available and transferred me onto it. It was an identical Polestar 2 to the original car. 2 minutes down the road, to test it, I went to a charger and it worked immediately. I also charged with zero issues at 2 other chargers before returning the vehicle. I think this shows that it was a charging fault with the first car and not my inability to do it properly. I wrote to Hertz, sending the hotel, dinner, breakfast and hotel parking receipt and asking for a refund of these expenses caused by the charging failure in the original car. They replied saying they "could not issue a refund" and they issued me with a voucher for 50 US dollars to use within the next year. Obviously I have no real proof that the charging didn't work. My guess is they will say that the photos don't prove that I was charging correctly, just that it shows an error message and a picture of a charger plugged into a car, without being able to see the detail. Could you advise whether I have a case to go further? I am not after a refund or compensation, I just want my £200 back that I had to spend on expenses. I think I have two possibilities (or maybe one - see below). It looks like the UK is still part of the European Consumer Centre scheme:  File a complaint with ECC Luxembourg | ECC-Net digital forms ECCWEBFORMS.EU   Would this be a good point to start from? Alternatively, the gov.uk money claims service. But the big caveat is you need a "postal address in the UK". In practice, do I have to have my primary residence in the UK, or can I use e.g. a family member's address, presumably just as an address for service, where they can forward me any relevant mail? Do they check that the claimant genuinely lives in the UK? "Postal address" is not the same as "Residence" - anyone can get a postal address in the UK without living there. But I don't want to cheat the system or have a claim denied because of it. TIA for any help!  
    • Sars request sent on 16th March and also sent a complaint separately to Studio. Have received no response. Both letters were received and signed for.  I was also told by the financial ombudsman that studio were investigating but I've also had no response to that either.  The only thing Studio have sent me is a default notice.  Any ideas of what I can do from here please

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't understand what link you want me to post.

Brexit happened: if you want a link to this fact you really need help.

I then made 2 predictions. 

There are no link to predictions because if they happen, they happen in the future.

I was right with my prediction that Brexit would go ahead, you were wrong.

Let's see my other 2 predictions,  it will take 5 years for the first and 15 for the second.

Thats fine, you are entitled to it, and I understand how brexiters have had enough of 'experts who disagree with their epiphany's,

... especially as those experts have not much more than experimental results, science, history, prior examples, maths and common sense to support them - particularly as they do very occasionally get it wrong.

 

I do hope you can understand and accept that some prefer to take more note of those expert quality relevant supporting reasons for holding an opinion, despite them occasionally not getting it 100% right.

We quite clearly seem to actually be on a fast boat to Singapore-on-Thames - something we were specifically told would not happen.

* no need to bind UK to agreement. 

(For Farages Sake  - effectively -  no binding agreement just trust us)

* Will include fisheries on an annual basis - just trust us to be fair and honest

* Gibraltar part of the non agreement just trust us to do whatever we want agreement

 

EU

* Both the EU and UK must agree on level playing field

(eg no dropping of standards - shouldn't be a problem for Johnson high standards eh? LOL)

* UK financial services will no longer have passporting rights  

(oh dear, the EU doesn't give a monkeys about the UKs'  'world financial centre' at least whatever might remain in a year)

* FTA would need to include deal on fisheries

(seems to be largely the EU saying nowt else is that important to them)

* Gibraltar not part of any deal

(As Spain is a member - the UK isn't - Spain has a veto - as the EU rules require - just like the UK did as a member)

 

 

On currency markets, the pound fell sharply

I was looking at that earlier today HB

 

Theres some snippets which allow some significant interpretations too.

 

" It estimated that the economy would grow no more than 1.1 per cent a year if the bank stuck to its 2 per cent inflation target. "

- it was projected to be 4.8% although God knows where that 4.8% came from - I certainly don't.

 

 " elements of Britain’s productivity performance had not been this weak since the Victorian era "

 

" Javid has written to other ministers seeking suggestions for 5 per cent savings from their budgets "

 

So much for kings growth wishes already ...

That looks like a prophesy of austerity ++ to me

.. especially if you are sticking two fingers up to your largest and best market ... and all those fab deals that aid trade

 

One of the reports i scanned seemed to be indicating that £100B+ injection into infrastructure projects was needed just to stave of a number of major company 'restructurings' - err collapse and asset stripping.

Now what do we know that costs £100B and mostly benefits a few.

 

and it now seems to be 100B that simply isnt there. Pile a few more meters on that debt mountain ..

and Just pour some more of that endless supply of manure onto the magic money tree and make it work a bit harder...

 

 

We do need to remember that these are not Conservative politicians, they are self serving populists.

Expect loads of carp from Johnson about whats going to be done by year xxxx - when it will be somebody elses problem to deliver it ...

Boris is a disaster who can hardly string a sentence together, and can't tell lies from the truth.  I knew someone like that at school who BS'd and lied so much it seemed that he actually believed his own untruths.

 

Worst thing is there is no opposition to this walking disaster area at least for the next 5 years if not longer.

We could do with some help from you.

The big problem with the fallback 'rely on the rebel conservative to rein in excess' is that most prior Tory PM's would listen to the elected MP's and wouldn't dream of kicking out somene the people voted for.

 

Johnson is more than happy too - particularly as Corbyn set that low standard.

 

 

 

Imagine it at the box:

 

Corbyn to Johnson: This is a leader who has to threaten his MP's, elected by the British people, with losing the whip to progress his extreme agendas

 

(Howls of laughter and Jeers from Tory benches - utter silence from the Labour benches)

In a warning before next month’s budget, Britain’s oldest economic thinktank says the government’s plan to raise investment in infrastructure projects by about £20bn a year can have only a modest impact on the UK’s dismal productivity levels.

Johnson has pledged to invest in new transport projects and other large public works but NIESR says the positive impact on the economy will be less than 0.5% of GDP over the long run, compared with an estimated 3-4% cost of Brexit.

In a blow to the chancellor, NIESR says Sajid Javid will fall short of achieving his growth target of 2.8% per year while his new budget rules will probably be trashed by public spending at the levels promised in the election campaign. The Bank of England has already warned that Brexit will strike a blow to British productivity as higher trade barriers harm efficiency gains, while growth can only run at 1.1% on average until 2023 without driving up inflation.

I've posted this in the NHS forum because of huge US drug firms being able to access patients' data.

 

But part way down the article, it says

'Access to NHS data is increasingly sought by researchers and global drugs companies because it is one of the largest and most centralised public organisations of its kind in the world, with unique data resources.

 

Washington has already made clear it wants unrestricted access to Britain’s 55 million health records – estimated to have a total value of £10bn a year – as part of any post-Brexit trade agreement. Set your NDOO status to "do not allow" https://digital.nhs.uk/services/national-data-opt-out

AND

Make sure you have a secondary uses, Type 1 (9Nu0) objection in force on your GP record - do this via your GP surgery

AND

Consider contacting your local hospital trust, mental health provider, or social care organisation (local council) that you use (or have used) and express "the right to object" to the dissemination of confidential information about you for secondary purposes (including to NHS Digital), where it is not legally mandated.
You have the right to object where your data might be processed in this way and the organisation concerned is relying on Article 6(1)(e) - Official Authority - as the legal basis under GDPR.
