    • Hi everyone, I have an update on my case that I’d like to share with you all.  so after submitting 371 pages in my bundle, a witness statement and skeleton argument for my court case due to take place in Manchester on June 21st I got an email from my litigator stating that hmrc have pulled out and the case is now closed!    this is the body of the letter….. This letter, which is copied to the Appellant, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (Tax Chamber) Rules 2009, the Respondents gives notice to the Tribunal of their intention to not defend the above appeal.   The Respondents respectfully invite the Tribunal to allow the appeal and close its file. In lieu of the above the Respondents would respectfully ask the Tribunal to vacate the hearing scheduled for Friday 21 June 2024. We would accordingly invite the Tribunal to close its file. Obviously this is extremely good news which hasn’t sunk in that after 3 years of fighting it is over.    I do have a further fight on my hands in that the Group Action I had joined with Independent Tax that had been disbanded in November last year and I chose not to continue with them. They are trying to bill me over 5k for the work they did under that Group Action which is ludicrous bearing in mind the whole point in joining was that it would keep the cost to a minimum as it would be shared between us all. They had asked if I wanted to continue to have them represent me on an individual level which I declined, if I hadn’t, goodness knows what they would have been trying to charge me now.

Oh I am the British PM lets just leave early I have better things to do and as he is called out on disrespecting all those veterans that served our country for the freedoms we have today he gives a groveling apology to little to late. He knew about this event for a long time and also knew that this is probably the last D Day Commemoration due to the age of those Veterans who gave so much for there countries freedom. Even on the day of the D Day Commemoration he still could have changed his plans As PM and stayed but choose not to showing such DISRESPECT to those Veterans, those that lost there lives and Families for the Freedoms we have today Being a Veteran myself I have never known a PM to show such disrespect what the hell was he thinking SHAME ON YOU PM SUNAK

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received CWP on Dec 22nd and having just checked am due another one any day. I've got a 3 year old and am on Jobseekers Allowance.

A+L S.A.R - (Subject Access Request) sent 28th July. Statements rec'd 01 Sept. Letter requesting repayment of £4,979 sent 18/09 MCOL sent 15th Nov £6389.57. Cheque received £6425.54 4th Dec.:D

MBNA S.A.R - (Subject Access Request) sent 28th July, promised reply by 28th August. Cheque rec'd £250 31 Aug.:confused: . 2nd letter sent 7 sept for rest of charges to be returned. £243 rec'd 28th Oct:D

CCA sent 1st Credit 11th August, reply 15th Aug

Request for repayment Rooftop Mortgages for £1095, reply saying no on 17th Aug.

Still to come: Cap. One, Time retail, HFC Bank.

Says on the website that my area has qualified for 1 period (up to today's date)... what it doesn't say is WHEN I can expect the payment to hit my bank account. :-(

 

Bookie, currently sitting here with thermal socks, legwarmers, jumper AND blanket, and that's with the heating on full blast... :-(

Site today says 1 payment due but no idea when to expect it.

 

Anyone any idea if its paid with benefit or seperately? If we have to wait til next benefit payment, we wont get it til next Friday & might just have frozen to our sofa :shock:

I dont think DX2 was been posting inflammatory remarks, just pointing out that NOT everyone will be getting these cold weather payments, people jump on others postings without good cause, not thinking that there might have just worded things alittle wrongly, giving others the sense to just snap back, these cold weather payments are just that, to assist in covering extra heating bills, given that most will put this money to such, there will be a percentage that will just spend the money on other things, like the local pub, which my next door nieghbour does, and those that live abroad in warmer climates, there still get the cold weather payments, the elderly and most thunreable should be the ones to benefit from such payments, I,m sure DX2 meant no harm in there posting.

People whom work full time on minimum wages etc also struggle to meet the extra costs of switching the heating higher, sadly there can-not claim such, so some people/workers will feel bitter towards some people whom do get such payments and waste the money elsewhere, the system helps some and hinders others, but at the end of the colds days night, whether we work or claim benefit, the goverment should asissit all to turn there heating that little higher to make sure we all dont freeze our socks off, sadly this govermant will not help all, only the small few. No one is ere to cause arguments only to help each other in some little way, least typing on ere has warmed my fingers hehehehehe

Well said. I did comment on the wfp but my post has gone as someone had a nerve hit i guess with what i said. Hope all the older people ect who need this benefit get it. Good luck.

however, when there are lives at risk, it is important that these payments are made, and folks have the heating on. If that means a minority get some money they don't deserve, and those of us lucky enough to be in employment have to foot the bill.. well that's something I can live with.

 

In truth, the only ones laughing at the moment are the greedy energy companies who are making a lot of money by stuffing us with prices much higher than they should be, but thats another story. ;)

I'd much rather be working than how I am at the moment, facing repossession through not working.

So I get CA and carer's premium on IS, I also get MRC and LRM for my son with a child disability premium on CTC phoned today was told I don't qualify for CWP.

Something wrong here?

I have been in contact with the Income Support dept, who told me to call DLA dept, DLA said nothing to do with them! Phoned Income Support again told to phone Tax Credits office and get them to email Income Support telling them that I get Child tax credits with a disability premium, called Tax credits told no I have to get Income Support to call them as they do not email details like that :-| I spoke to a supervisor and she told me yes I am eligible and a payment would be in my bak on Wednesday and to go check it I would be "surprised", yes I was "surprised" feck all there.

Seems like nobody knows what to do since everything changed on to the child tax credits system.

 

3 cold weather payments have been triggered for my area already.

According to the info on my postcode, we are due for three payments, at the moment.

 

And, for the benefit of the "holier-than-thou" brigade, who intimate that you're not working, then you must be a sponger, I have been out of work for exactly 12 months. I would love to go back to work. I am capable of work, (provided it is not severely physical).

I would suggest, as an exercise, that you try applying for a job in industrial electronics, not forgetting to tell them that you are diabetic, suffer from congestive heart-failure and have defective kidneys.

That, in itself, is not the problem. The problem comes when you tell them that you are 63 years old.

Your application goes straight into file 13.

I am located in North Birmingham. Anybody got any vacancies?

Income Support should pay your cold weather payments, they can check DLA screens to see you child has DLA, CTC dont pay CWP if you have a claim to I.S

 

Push it with I.S, they have a scan they can double check it on there as well :)

I know too well how you feel, they say their is no discrimination at interviews well that is a load of bull.

 

I had a stroke in 1990 which needed major brain surgery now the effects of that have left me with a slight weakness down my right side inc claw hand and drop foot.

 

Despite this I consider myself 99% fit because over the years since 1990 though recovery I have found ways to do things.

 

Anyway in Sept 2007 I was made redundant so had the terrible task of looking for work I found and went on many many interviews but got no where due to the claw hand.

 

If fact one smart ass said what you doing here you should be at home there are benefits for you people.

 

That one comment really done me in and yes I gave up looking and went to my doctor he put me back in touch with a physiotherapist in the hope of getting my hand working better.

 

After two months she gave up and said it will not get any better so now im on IB.

 

If it was not for my understanding wife and my beautiful dog I would have totally cracked up by now.

 

I am only 46 and can work but blimey what is this country coming too when no body will give me that chance.

 

I am now looking for voluntary positions and have a DLA claim ongoing as I feel that is my only chance I have left.

This comment is more about employment than cold weather payments.

Back on topic for me anyway, how long does it take for these payments to come through?

Can anyone give a simple yes or no as to whether you get this if you are on IB please. My DLA payments ended in December and I am now at appeal stage, so would these be payable aswell if my appeal is successful ?

are you still on IB now and no DLA, or on IB appeal rate and IS hardship

then No to both

 

or I.S and IB with a Disability premium through long term IB ?

then Yes

 

If just on IB and you win your DLA appeal and its backdated so it a continuos claim, then yes you get the CWP backdated to cover the weeks its was due and wasnt paid to you, But it may take a few phone calls :)
