Hi all

I really thought that after all this time they would leave me alone - but no - here we go again.

A NOTE OF INSTRUCTION

From Philips Specialist Bailiff & Debt Recovery Agents.

Saying

 

We write to inform you that although you have been sent previous correspondence to this Notice you have failed to satisfy arrears which remain outstanding to County Parking Enforcement Agency. Therefore we have been instructed to commence recovery procedures against you.

 

Full payment of the outstanding amounts is hereby demanded within seven days of this notice to prevent further recovery procedures commencing.

 

This demand is dated 15/09 and got here today 25/09 thats already 10 days and they've only given me 7 to pay.

 

Do I just keep ignoring or will I get a bailiff at my door?

For a real bailiff to turn up they:

 

 

  • Have to take you to court (they won't)
  • Win in court (they can't)
  • You then have to ignore the judgement (hopefully you wouldn't)

 

 

Don't weaken in your resolve now, you've done well so far. As a BB holder myself, I have a particular dislike of PPCs that prey on the disabled :mad:

In my opinion you would have strong grounds to challenge both the ticketing company and the hospital for disability discrimination by failing to make reasonable adjustments. If this is something you'd like to explore, let me know and I can explain further.

Hi all

 

long time no post, happy new year to all and here we jolly well go again.

 

I Quote: Dear Sir/Madam,

 

We have written to you on no less than three occasions and despite Philips collection Services also corresponding with you the above parking charge notice is still outstanding at £XXXX.

 

The notice is now being prepared for County Court action and no further notice will be given by County parking Enforcement Agency Ltd.

 

You will be advised of a court date by Northampton County Court in due course.

 

Yours etc.....

 

HELP NEEDED PLEASE. I don't know what to do.

Complete scaremongering going on there!

 

Surely you notice all the "mis-direction" going on with them and their letters?

 

eg Note the name, County Parking Enforcement Agency.

"County" implies council.

"Enforcement" implies a legal entity

"Agency" implies government body

 

Now for the court appearance. Where are they suggesting you will get your court date from? Answer; Northampton County Court. Now is that because they (or you) are based in Northampton, is it more likely that when you receive a council PCN, this would be referred to the TEC (Traffic Enforcement Centre) which is based within the Northampton County Court! What a weird co-incidence. I'm sure it's not!

Looks like CPEA must have nothing else to do at the minute because I have had EXACTLY the same as you. I know it sounds all rather intimidating and it is a worry what else will drop through your door.

 

But please hang on in there... the support from the peeps on here is magnificent and the advice they give is excellent.

 

We're both in the same boat here... but I bet we'll both be posting on here again in a few months time saying we've heard no more :)

received today:

 

We refer to the above matter and the long outstanding amount of XXXX. As you know we have written to you on no less than 3 occasions requesting payment but this has not been forthcoming.

 

We are now preparing the papers for issue of proceedings in county court. If we issue proceedings against you this could incur additional court fees and costs. We always consider this as a last resort and are concerned that a number of drivers have been relying on inaccurate information obtained from online blogs and websites in regard to the legality of the issue of Parking Charge Notices. For the sake of clarification we have successfully pursued Parking Charch Notice cases through county court, most recently Cambridgeshire and Northamptonshire the details of which are on record.

 

In order to reduce the number of unpaid notices that we are having to process through the court system because of the misinformation online we have decided to offer a short term payment amnesty. As such we are prepared, on a completely without prejudice basis, to offer you a reduced settlement figure of XXX. If this is paid within 14 days of the date of this letter that will be the end of the matter but should you not take up our offer of a reduced settlement we will issue proceeding against you in the full amount outstanding together with court fees and any other costs and expences we are entitled to claim.

What does everyone think? Have there been proper judgements? I really am tempted, if I can find the money to pay this just to get them finally off my back.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The tiny amount of judgements that have been won by PPCs in defended cases are all highly suspicious, and look very much like put up jobs. Then they crow about their "victory" for years afterwards. Of course, they are extremely quiet about the countless cases that they have lost :rolleyes:

 

If they were going to take you to court they would have done so by now, if they thought they could win.

I think that if this team were going to take you to court it would have done so months ago..

This seems to be a case of final final final demands before court.

This company are like a spoilt child trying to wind the mother up so it can have its own way.

They are coming to the end of the tantrum.

NO!! For gods sake, don't cave in and pay them now! You're nearly at the end of their template letter chain. One more letter and you've won.

thanks for the support, it really is appreciated, however I can just about raise what they want and they are gone forever, but if they do take me to court they might just win, and if they did how many hundreds of pounds would I then have to find, plus of course a county court judgement against me, then I don't have hundreds of pounds so then it would probably be bailiffs, I'm really not sure i can take this risk.

 

Is there anyone out there who has had a letter like this and held out and won? I would really like to know, If there are some and I'm not alone I just might hang in there.

Tortilla, before you do anything stupid, please read some of the other posts on this thread and in this subforum. These PPC scare tactics are well documented. There is a 99.9% likelyhood that they WILL NOT take you to court. Even if they did, they would have to somehow prove to a county court judge how your actions/omissions have cost them the hundreds of pounds that they are claiming.

 

No laws have been broken, they can only make a civil claim against the driver for a supposed breach of contract. Assuming you have done the right thing so far and ignored all correspondence from them, they will have absolutely no idea who the driver was, and are only harrassing you as your name is on the DVLA's database as the registered keeper of the vehicle. Their letters will imply that you are liable for the debt as the registered keeper, this is 100% incorrect. Their paperwork is designed carefully to imitate official council tickets and PCNs, this is all part of the $cam.

 

PPCs in general do not do court at all, it simply isn't worth their while. The victories that they claim as mentioned previously seem to be put up jobs plus there was one case documented a while back when a seriously disabled driver was unable to attend court, and the judge ruled in the PPC's favour in his absence.

 

They were apparently "preparing for county court action" back in January. Registering a claim with the county court takes minutes. If they were really going to do it, they would have done it long before now. The fact that you've received the "we will accept a goodwill reduced amount" begging letter means that you're nearly at the end of the chain.

 

Trust me, they WILL NOT take you to court. They WILL leave you alone. DON'T fund their little money making scheme by caving in to their demands.

tortilla,,,you are responding exactly how they want you to,this will not happen they are fraudsters they want to play on your emotions causing you anxiety, worry and in the end hope you cave in,,please please keep reading this forum, and i now set you a task,, find the person who these **** have taken to court and won? the pope will get married before you find this as it wont happen.

Please don't pay them. This letter has had it's intended effect, and it's made you worry and wobble on the whole issue. This forum provides the flip side to the coin - hundreds of posts and testimonies that these people are chancers and will go away.I've had lots of letters telling me how I'm going to end up in court, how I shouldn't ignore the problem, etc etc. I stuck to my guns and they've never bothered me since. Hold tight!
