this is what i was saying and i now understand the statement "we hope this clarafies the situation" , because it does 100% , there is now nothing to stop ppl from taking their banks to court.

 

 

Precisely, they did not say the charges are fair they said the OFT couldn't rule as such which leaves the consumer the right to continue their challenge

so i guess the route to go down is , forget the oft - penalties which are now charges for service are still highly unfair , then let the bank explain the charge in court , not going to happen!!!!

The finding DID NOT say the charges are fair & reasonable it said the OFT could not rule as such which means we are still able to challenge the banks as before Its just that a ruling in favour of the OFT would have saved us the trouble

..... But it does make you wonder what bl**dy point there even is for the existence of the OFT in the first place; when the the "Office of Fair Trade" cannot rule on what actually is "Fair Trade" ??

Exactly. It's a Government Department. It shouldn't NEED to go to Court. It should simply have the authority to state what is fair.End of.

As I said before the judge stated that the OFT was free to use "other criteria" meaning regulation 5

As a relative novice to claiming bank charges (having only filed my N1 in the last month and got my AQ in yesterday), if we are now going to use Regulation 5 of the UTCCRs as the way forward do we need to amend our POCs at all please?

everyone is a winner here trust me

heres how it will plan out

 

the rulling stops a mass payout safeing the banks billions .

but we will all be offered a payout of sorts calling it a goodwill gesture.

some may accept some wont .

if you dont you can then take it to court .

the banks will change there charges to fall into line

 

the banks will still payout to thoses that have made a calim but it maybe a little less than you fault .

 

but like i sed there are many that havnt put in a calim therefore safeing the bank billions .. by only paying in part to thoses that accept

 

it was the only way to get the rulling so everyone is a winner
