  1. Hello All, I have received the attached "SAR" reply from Barclaycard and would like some help please? I better give a brief history of the problems. I went through personal and financial difficulties in 2001, I had "unmanageable" debts and basically stopped paying everyone. I had, or rather still have debts with Barclaycard and other organisations who walloped me for charges, left, right and centre. I am still paying these off on a monthly basis to Link and trying to cope on a limited budget. I then found this forum recently and have been intently reading as many threads as possible. I have SAR'd every single financial institution that I had debts with. Back to Barclaycard, I have received the attached response to the SAR request that I sent to them. 1) I can view the letter and THREE statements as, the balance shown is "purely" Default charges as their letter implies, go back six years and try and claim them all, bearing in mind, these were actually in 2001 and not 2007 as their statements imply. I am not sure if I view this as Barclaycard trying to help me by suggesting I claim these but forget about going back to 2001 as their statements are dated February, March and April 2007, just within the last 6 years!! 2) Write back and say I am not happy with their response, as I actually had two Barclaycards with them at various different periods, the other one being approximately 2003 to 2007, that I was also hit with charges on. Any thoughts or comments please?
  2. Hi, I have had a bad credit history through no fault of my own, however I have been running a business and using barclays for a few years now as a business account and not got into any trouble. Does anyone know if barclays will issue me with a credit card? Many thanks!
  3. Hi All, First off I have made a similar post in the NatWest sections too – hope that's OK and not seen as a duplicate post ? I know, I know – much written already but I have spent the last few days reading through the many threads on here and elsewhere to try and get my head around things ! As with others who have have “left it late” why I have never got on with this earlier I don't know.......anyway... My enquiry just relates to Late Payment charges only. I have a Barclaycard VISA and Mastercard that go back some years when Barclays gave you just Barclaycard VISA and other banks Access. From late 90's to mid 2000's all four cards had fluctuating and at times high balances that resulted in quite (ahem) a bit of interest together with late payment charges varying from, initially £10, £15, £18, £20 and then back to allegedly “acceptable” £12. Most of these charges were made over 6 years ago. From mid 2008 all card balances were cleared and have since been operated without any late payment or interest charges. I have all my original statements going back over this and earlier periods so have documentary evidence. There is nearly £850 in total late payment charges, of which £250 or so is over the "£12 figure". So I guess my questions based around “Can I still claim ?” are: 2. Should I claim for the charges only even though most are over 6 years. I have seen some mention on other forums that over 6 years and its Statute Barred and cannot be claimed whereas on here I see some that have had success. 2. If I was to claim should it be for all the charges and add interest (compound) – if so at what rate (Statement ?) and to what date - my claim date or when the balances were cleared ? 3. Should I just claim for the charges over the complete period but only those over £12 ? Plus interest ? 4. Not bother too late Thanks very much in advance for any info/input. Blagton.
  4. Hi, I am trying to get hold of my Barclaycard statements for the period August 2006 to January 2007. I was at a different address back then, and the Barclaycard account was closed in January 2007. Having phoned several times and getting the usual bad customer service, I wrote to them and requested the information. I first got my credit report to check dates, part of the account number etc to put in the letter. They replied saying they have no record of that account. I am now replying to ask once again for the statements. Does anyone have any advice on what to include in the letter to help the situation? Is it my right under the data protection act to have these? Many Thanks Andy
  5. Hi all, Ive recently received all statements for my Barclaycard account, which fall within the last 5 years. Ive whittled out all the charges, all fourty eight of them at £12! So Ive entered them into an interest spreadsheet I downloaded from this forum. The total inc interest is £1074 based on a rate of 29.90%APR. So my first question is, is this the correct rate to use for a claim? My next question is, what is the next step once a claim ammount is finalised? Could someone please point out the correct letter template to use? Many thanks in advance.
  6. Starting a new thread for this PPI action against Barclaycard. Originally an Egg Card, then taken over by Barclaycard. Card is still active. I am helping a family member with this, so the card is in their name. They never needed or wanted PPI, they were self employed whren the card was opened, and they have phoned once in the past to cancel PPI and were told that they couldn't (hopefully this contact was recorded and will be confirmed if / when the SAR is complied with.) Action so far: 30.11.12 - Sent a SAR and £10 postal order to Barclaycard's Data Compliance Officer. Used one the templates off CAG for the SAR. 03.12.12 - SAR was received by Barclaycard (according to Royal Mail track and trace) 12.12.12 - Barclaycard returned the SAR and postal order, with a standard letter: "Thank you for your request for information under the Data Protection Act. Unfortunately we are unable to process your request due to the reason(s) detailed below: It is possible that the account has been closed for a period of more than 6 years and as a result customer details are no longer retained." Now, given that the card is still active, this is nonsense. As they received the request on 3.12.12, I reckon their 40 calendar days are up on 09/01/13. I am now unsure on the best way to proceed. Should I re-send the original SAR and PO, with a cover letter advising them that the card is active and they are running out of time to reply? Or should I wait until the 40 days are up and send a LBA? Any advice gratefully received!
  7. Hiya For the past ten days or so I have been getting recorded telephone messages at all times of the day and evening from Barclaycard on my home telephone. These messages are NOT for me, they obviously have the wrong number, the person concerned has never lived here, nor is known to me at all. As they are recorded I cannot tell them that they are calling the wrong number. If I call them back I cannot talk to anyone as I am not the person they are trying to reach, so cannot get through the security questions to talk to a person. if I call any other Barclaycard number it requests my barclaycard details in order to get through to a real person, and I DONT have a barclaycard! This is driving me nuts and it is so wrong. does anyone know of a number that I can call and speak to someone directly about this? Thank you
  8. Hello I have seen on the site some threads regarding the reclaiming of premiums paid to stonebridge insurance for Barclaycard Accident death cover. As some of the threads seem very similar to my own experience with these two companies I was wandering whether there was any updates available. In my case this goes back to May 2002 when I saw a payment on my credit card statement for £8.59 accident death cvr. As I had no knowledge of this I contacted the number next to the payment stonebridge insurance and asked what this was for and was told that all barclaycard holders had this applied in case of death. Recently I have phoned Stonebridge insurance and said I would like to cancel the policy, but was told that I could not do this as I was not the policy holder and that my wife was now the policy holder. I then phoned barclaycard and told them not to pay this anymore. I have now contacted Barclaycard to tell them that i want to make an official complaint and awaiting some forms to fill. Does anyone have any thoughts or experiences this. Thanks
  9. Hi all - I've successfully claimed from MBNA for missold PPI - incredibly easy so I thought I'd have a go at Barclaycard. I submitted SAR and got 6 years of statements showing my PPI active from 2006 - 2007 when I cancelled it (I realised it was a pointless expense). However I noted PPI has been on the account since 1989. Now initially BC turned down the complaint so I went to the FOS and strangely they've caved in as soon as the FOS process was started. I've received a letter from the FOS telling me I will receive an offer by the 4/1/13 however I'm not sure what a fair offer would be - ie will it only be for the year I can show PPI payments or should it include the payments back to 1989? As I can't prove how much I paid can I be paid an amount based on a average yearly balance etc and do barclays keep records like that? Thanks all
  10. I recently sent a SAR into Barclaycard as the starting point for a PPI claim. I received a letter back with details that I had PPI on my account and returning my own letter and £10 cheque. The letter noted (in summary) that my letter "was in relation to a claim for the sale of PPI" (my SAR letter made no reference to PPI) and that "this information is sufficient to enable... to progress a claim for PPI". I writing back and sending the cheque back asking for full details to be supplied. I couldn't help but notice though that the bottom of my original letter had been stamped with a large rubber stamp saying "PREQUAL". Does this suggest that they already believe I may have been mis-sold my PPI?
  11. Hi all i am new to all these problems and forums so i apologise in advance if i am not making sense or i am posting in the wrong area. my problem is that my dad is away for a month and i have been checking his mail. i came across a county court claim form against my dad for a sum of £1560 owed to barclaycard. i understand that my dad is required to respond to this within 14 days however what happens if he is not in the country?? the reason he has got himself in this pickel is because he tends to ignore anything he doesnt know how to deal with instead of asking for help. if i dont intervene he will continue to ignore this and i am scared of what the consequences will be. this is all scary to me. i can pay this amount for him, if that is the best course of action or do i have other options such as negiotating with mkdp???? i have briefly spoken to my dad and he has explained that he had missed one payment and the charges and fee added where extortiante, therefore he refused to pay. Instead of contacting Barclaycard im sure he probably just ignored calls, letters etc. i am really confused as to how to deal with this, i know if i leave it up to him he will continue to ignore this problem. can i contact mkdp and negotiate with them or is it too late for that? what would be the best course of action regarding the claim, since my dad tends to ignore all lettes i cant say if he has recieved any notices etc. i feel that defending part of the claim will be weak on my part hoever i dont want to just hand over more monies then i have to. hope someone can offer advise on this . Regards
  12. The Barclays account in particular is dated 2000 . I have read that many of the agreements dated as far back as then do not have enough terms and conditions on the credit agreement and it is by a long way the most uncomprehensive agreement i have seen . Outside of that clutching at straws to be honest , like i said i would have settled them for her had they been able to meet me at a slightly lower per centage but my understanding is link are less likely to negotiate downwards than others.
  13. Last year I was trying to sort my finances out and noticed Barclaycard were taking insurance money every month. I thought this was my I.D. protection insurance which is only meant to come out once a year, so I phoned them. The person on the end of the phone told me it was meant to come out every month, I told him I was told when I got the I.D. insurance that it would only be paid yearly, after about five minutes of insisting it comes out ever month he finally told me it wasn’t the I.D. Insurance it was P.P.I. At the time I had no idea what this was and asked him to explain it and after hearing what it was I told him to cancel it as I never asked for it or even wanted it. I was then told someone would contact me about why it was being paid without my knowledge. I did asked how long had they been taking it and was told since I opened the card account in 2001. No one contacted me and I forgot about the whole thing until a year later when someone asked me at work if I sorted it out. Phoning them back up I was again told I’ll be contacted about it, around a month later I got a questionnaire form about why I think I was mis-sold P.P.I which I filled out and sent back. I then got a later stating I would have a decision by 11th November 2012. Having heard nothing I phoned them yesterday 22nd November and was told a letter was sent dated 16th but they would resend it as it never arrived. The person then told me it stated they refused my claim and said there was an eight page reason as to why but it was pretty much their standard response (his words), he stated it said that it is Barclaycard’s policy to explain everything to their customers regarding the P.P.I. and they can find no reason to suggest that all aspects were not fully discussed with me, therefore they will not uphold my complaint. As I said at the start the first I knew I had P.P.I. was in 2011, I never asked for it or indeed even knew what P.P.I. was until last year when I phoned them up. I have a stable job that I’ve been in for fourteen years and have no reason to think I would lose the job so again have no reason for P.P.I. Could anyone here give me any advice on what I do now to reclaim my money? Thanks in advance, James
  14. Paid about £83 in PPI from Dec 2006 - Feb 2008. I received letter back saying that they are not able to uphold the complaint and that this response is their final response unless this is through FOS! Any ideas what to do next? thanks!
  15. Hi everyone, I have a new profile but am not new to CAG as such. I have a claim against me by MK and am in the process of dealing with it. I submitted my defence online and since then have heard from Mk in that they are contacting BC for the paperwork I requested ( cca etc). I took this as a sign they intend to proceed to court but someone else on here suggests it means they don't have their paperwork in order and just issue these claims on the basis that most people will do nothing and judgment will be made against them. Anyway, I will post up here with any news and progress. Thanks for reading , all advice is welcome. Or if anyone is a few steps behind but in the same boat ,feel free to contact me . Dex
  16. Hi I have been chased for a while for a debt for 2 barclaycard debts. A few days ago a chap knocked on my door and handed me a statutory demand. I have sent off a CCA request by recorded delivery and am awaiting a response. Would it be advisable to apply for it to be set aside if the CCA request is not received by the time the demands 18th day has passed? BW Legal has assured me it wont go any further until the CCA request has been processed, I do not have this in writing but have been told it on the phone. I have tried to read up as much as I can but there is so much info on the site im now confused ! Thanks in advance. Derek
  17. I had a barclaycard with a £500 credit limit which I last used in 2004 and never cleared the debt. Due to employment relocations I never received any correspondence on the subject which is clearly a matter of my own neglect. I still use the same Barclays savings account from that time. I have lived at my current address for the last 7 years and receive account correspondence. Having read various threads on the subject I am concerned that my card account is dormant accruing charges. I don't want to ask in case this triggers an immediate demand. Do they have a deliberate policy of dormancy and what circumstances would cause them to activate a demand. Pete
  18. I have been paying my Barclaycard debt on a self administered debt management plan for about 3 years and have now received a telephone call from Barclays offering me a settlement figure approx half of the outstanding balance to be paid by 26th November. I have a good chance of raising the sum required, but they have not confirmed the offer in writing and say I will only get a letter when the payment has been made. The sum and the due date has been confirmed during two telephone calls, but I have nothing in writing. I could send a cheque with a letter outlining that this is a full and final payment as described by their customer advisers, but is this enough to cover me. Would appreciate any advice from members who have been in a similar position.
  19. My partner and I seperated in September, since then he has missed the October payment on his BarclayCard. Barclaycard have been on the phone every three hours for a week and a half, it's been quite creepy in that they have been trying differant patterns of times to catch him in. He visits his son regularly and I have asked him repeatedly to get in touch with them and get it sorted but he keeps 'forgetting' to do so (head/sand interface) a statement arrived the other day and it accidentally fell open, like they do. Since he left he has been living on his card and his balance is scary. What's the best course of action? I'm a single mum, living on benefits and I don't want my idiot ex's creditors chasing him at this address or worse still Bailiffs turning up if he continues not to pay. I wrote this letter to Barclaycard: Dear Sir/Madam, Re: Please can you update your records to note that XX XX doesnt live at this address, we have seperated, and hasnt done since the 20th September 2012. Can you ask your agents to contact him directly on his mobile number: XX this is the only number my idiot-ex can be contacted on. I dont have a forwarding address for him but he does pick up his post from this address every so often. My personal circumstances are such, single mum on benefits, that I do not want idiot ex's creditors chasing me or this addresses credit score adversely affected in any way. Thank you for your time. Best regards I feel a bit mean but I have enough to worry about as it it.
  20. Hi Sorry that this question might have been asked before, but i am not able to locate it in the forum Back-ground: Got the BC card in July 2003, application made by face to face sale at train station (barclaycard booth). Sales man filled the form, did balance transfer etc with PPI added. I don't remember whether he explained anything to me. Didn't paid any attention to the account (my fault for not staying on top of finances). I was paying minimum balance every month, BC increased credit limit few times etc until financial difficulties in 2008 due to illness while traveling etc. Financial situation got worst and even after paying minimum charges on the statement, actual balance was going up every month put me outside the credit limit. Claimed for PPI: Reason for miss-sale with initial claim: Force full face to face sale, not explained anything. It got rejected but they told me that they will reconsider if i provide any proof. After searching through my records including my credit report, realized that I was unemployed when PPI was sold to me i.e. finished the running contract in june 2003, PPI/CC started in July 2003 and next weekly job contract started on Sep 2003. I have replied to the letter with charges and proof by proving the letter from the employer confirming the contract duration. It has been more than six week since i replied to them but they are yet to respond. To save time, i have forwarded all the documents to FOS for their consideration. Please let me know your opinion on the chances to get the PPI back from this account. Thanks P.S: I am also claiming for unfair charges on the account due to the fact that they were keep changing the cc limit and due to their charges and PPI i got over the recent credit limit is acquiring £12 charge every month
  21. Hi all, I posted recently about my PPI claim being successful over Barclaycard/Egg. Unfortunately and what is without doubt a retaliatory action, I have just had it confirmed that my Barclaycard (BC) has been permanently suspended. They have simply stated its because of my other account previously held with EGG. I have never missed a payment with BC and pay back more than the min payment each month. The Egg account has been settled in full. I regret settling on simple interest only but I was struggling at the time. I have now decided to claim for compound interest. A couple of years ago i found a compound interest exel sheet that you just put the amount in and the number of days and interest rate and it calculated the compound interest automatically. Can any one tell me where this might be, i can't find it anywhere. I am so angry, they expected me to settle on simple interest on the money [edit] taken from me and now they are expecting me to pay their APR on the balance of my account. T They were 21 Days late with my SAR request, I accepted their offer as long as they paid within 21 days and it took 35. BC increased my credit limit by £2k 6 months before my claim, i didn't request an increase they just gave me it, they weren't worried then were they? I'm going for it despite being the underdog. I know it was a bit foolish to accept simple interest only, but when you are struggling to feed the kids at the end of the month it was an easy route to take for a swift solution if your still awake after this rather long waffle, i would be grateful for your help
  22. Yes folks - it's the BC Slayer going for the jugglier again. After BC failed to produce the SAR information requested earlier in the year, I took them to court and they finally provided the information and I won nominal damages. I submitted a new claim to them for PPI on an old account operated between 2002-2004 at the beginning of the month and although I have received an acknowledgment, it isn't clear as to what they are acknowledging because I also sent (in seperate envelope) a claim for unfair charges. They have since written to me with their final response in respect the unfair charges claim and said 'GO AWAY' or go to FOS but I haven't received anything in respect to PPI. Therefore, I will be now submitting my lba giving them 14 days and preparing my N1 claim ready to submit to the CCMCC next month. They obviously do not realise who I am so bring it on BC. The BC Slayer:
  23. Hi all , I have a defaulted barclaycard account which was sold to MKRR recently, ouststanding balance about £4500. I have been passed from one dca to another over the number of years that i have had this account set up payment plans then things have happened so they havent been stuck to, it then goes quiet for a few months and then seems to get passed to different dca i have received 3 letters to date first 2 were to inform me that barclaycard have assigned and transferred my account to MKDP LLP etc the third one i received today from MKRR asking me to contact them to set up payment plan quite a nicley worded letter and very non-threatening actually ! Having read all the posts on MKRR im slighlty curious about exploring the possible loopholes that might be avaliable to me not really sure about what is the first letter to send to them and quite nervous about what is the impact of going down this route if it is unsuccessful
  24. Hi all, Long time no post on this site for me. Hoping for some advice. I've received a letter this morning from Barclaycard advising they may have mis-sold me PPI insurance on a previous Barclaycard account (now closed). Now I must admit I didn't realise I'd ever had PPI sold to me - or I would have claimed myself earlier... Barclaycards letter suggests I fill in a questionnaire online, call or write to them. Is this a trick? Or are they being forced to write to people who may have been victim to mis-selling? The card I had with them was during a particularly bleak spell in my finances following redundancy where I entered into a debt management plan - does anything about that agreement affect me claiming? Thanks in advance for all pointers! Steve
  25. I sent Barclaycard a CCA request last year as per procedure on here and received nothing but a bunch of old statements. Debt was passed to MKRR and same thing - another bunch of statements. A few threatening letters followed and then today I was shocked to receive a claim form from Northampton County Court stating that MKDP were claiming over this and stating that they had served a DN. I have never received a DN and had not heard from MKDP up until this point. As I haven't seen a DN, I can't see whether or not it complies with all regulations. I did not CCA MKRR but just Barclaycard originally. Help please! There is no court date on the papers - just a requirement to file a defence and/or make payment etc
