  1. And lets not forget that its probably been screenshot by people at marstons who have a profile on their! Heres one id heard about them recently.... They were going after an EA - (the same one who got their fearless leader arrested) They encouraged and grouped together to get the lady who he had visited to do an EAC2 complaint. Naturally it was thrown out of court, videos of burnleys finest "mark gillard" following him out of court and provoking him appeared on the Internet. Few months later they encouraged her to approach the court with the allegation that the EA had lied to stop himself getting into trouble and committed perjury. Back to court it went. This time the EA had printouts of all conversations off the social media sites. The womans response - a look of disbelief and the comment along the lines of - oh i thought that was a private group and no one could see anything! Naturally that didnt go well!
  2. The reason why they were refusing to pay is because they are freemen idiots, i believe they had previously had the car clamped and removed the clamp which is an offence by itself. But thats another long and boring video ... these cameras arent new they have been used for 2+ years and the quality is equivalent to a hd 720p youtube video. And furthermore the EAs are supposed to tell the people who they are their to see from the start that they have the intention to record before beginning discussing the reason for the visit
  3. If you're referring to who i think you are, his so called "advice" is just as bad as all the other nutjobs. There isn't 1 person on that group with good intentions - not 1.
  4. The courts have been asked to collect a part payment under a ccj - by paying it it cancels the warrant and the remaining balance remains outstanding but not under a warrant and then further payments can then be made to the company who bought the debt off the original creditor If payment is not made you will be visited by a county court bailiff. They are crap and will likely just post a letter thru asking you to sort a payment plan out. If you cant pay it over a short-term period they will ask you to do an n245 to request a stop on the warrant and set up a payment plan with the creditor The warrant lasts for 12 months from when its issued
  5. The councils can pay a 7 pound fee to re register the fine at tec so it lasts a further 12 months This isnt a debt avoidance website so i really dont know what you expect any of us to say to you
  6. I asked my mate who works for marstons he didnt know either. He did say the vast majority of EA's would blag it and give the impression they could and would take it but ultimetly leave it if push came to shove. Reason i asked is because a fmotl posted a vid recently - went in to a logbook loan company asked for 250 over 3 yrs. with interest would mean it was approx 330 quid. Offered to give company 300 cash and pay £1 a month for 3 years. Obviously we know why.
  7. I apologise if this has already been covered but i am not reading through 9 pages of arguing / bickering Want to know if this goods can still be sold if on finance would also apply to cars with a log book loan on them
  8. These aren't my views they are the views of friends within the industry. in principle it sounds good that EA's are getting a voice. But what exactly are they getting a voice for? the word of EA's "moaning" about conditions on the street? where is that going to get them? The MOJ aren't going to call the bailiff companies and say please give your staff more money, please be nicer to them and give them the best work are they?! It is my understanding that apparently the vast majority of EA's leaving are from collectica who as you know dealt with court fines. The new regs are nothing to do with people leaving nor the fees. Its primarily because of the payment rate per collection dropping significantly. And due to the courts back office outsourcing proposal the fines sent over to collect for all companies have been extremely poor old recycled fines.
  9. The real reasons this association has been set up. The county courts have downsized massively leaving many Bailiffs out of work. CRAR has virtually wiped out the small business putting a great deal of one man bands out of business. The big firms who have the vast majority of work have the industry pretty much sewn up and can treat the self employed EA's however they want - and they are doing exactly that. People are leaving the industry at an alarmingly fast rate. For example, last month Marstons who had bought out Collectica, swift & rossendales merged them all together and so far over 50 people have gone!! It's all good having a voice of the bailiff, but ultimately they wont get a say in who gets the contracts, and telling a company they aren't paying enough. They will be shown the door and an advert goes in the paper the next day! And the training is being offered so that it looks better to members so it seems it is giving value for money rather than just a few emails.
  10. Think that sums got a fair few years of bailiff chasing in it yet before its written off. i wonder if in that figure quoted it includes issued bills altered on appeal (student exemption for example) or where people have gone bankrupt or even cases where people have left the country or passed away.

  12. Marstons would not continue enforcement if they been withdrawn simple as that- therefore the OP needs to contact the issuing magistrates court so they can send over an email to cancel the warrant. Nothing to do with harassment
  13. Waste of time. The originating magistrates court is who to contact as they can stop enforcement action. Marstons are protected under the warrant from harassment.
  14. Even if they say they will, they wont take anything like that. Goods will fetch average of 10% of retail value at auction. I wouldnt worry about it.
  15. Apparently she was deliberatly hiding her goods so when the EA was telling her not to interfere with controlled goods when she was bending down she actually s**t on his leg..
  16. It will probably end up not being reported about because no one wants to hear a story about a bailiff doing nothing wrong. Only when there is a story that sounds like it sounds like it has the shock factor will it get put in the paper. I have it on good authority that the lady/woman at the property defacated on the bailiff but of course that failed to be mentioned to the local paper!
  17. 1 letter in law has to be sent Some councils prefer more On notice of enforcement it will say If you dont come to an arrangement or pay by xx/xx/xxxx then they will attend That should give you your deadline before the visit could take place and a 235 goes on
  18. Ive been told that marstons are deliberatly going after people who pay direct and send these letters in to court or company and forcing entry with a locksmith to make a point that it doesnt work. Mate of mine said 60 times forced entry was used last week... And furthermore they are being encouraged to use reasonable force more and more (ie foot in door) - referring to court fines here only by the way.
  19. It appears He is also in cahoots with a well known freeman called jay bradley (formerly of beat the bailiffs) who has recently set up a ltd company called mary the clamp fairy ltd and is offering his services through a facebook page called the bailiff bible which has the dealing with bailiffs logo on it...
