    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My lovely new neighbour has stepped up her war of wits with me, after all the shouting and swearing the other day when i sent the community police officers round to her, her new tactic is to have her music on loud for a couple of minutes and then turn it down, turn it up for a further couple of minutes and then down again...this will happen a couple of times then she starts throwing something at the wall!

 

I just dont understand what the hell is wrong with her, she seemed such a nice quiet girl when she moved in.

 

Last night i saw her dragging her 18month old toddler down the hill to her sisters house so that her boyfriend could stay the night....I know this because it sounded like we were in the same room as them when they were .... at it!

 

Just hoping I am going to have a good bank holiday weekend without any more trouble :(

The thing is I have tried to be nice about it and said that i didnt mind her having parties just that i think 1am is late enough....the thing is now, if I actually had to stand face to face with her I wouldnt be sure of my own actions!

Oh dear Monx, fingers crossed she'll get fed up and stop. Try not to rise to it (I know it's bloody hard). If she sees it's annoying you it gives her a reason to carry on.

The guy that is supposed to take over my shift at work.

 

I work 7am to 1pm on a Saturday and this guy is always late, and today I had plans to which I had to cancel, as the wanders in at 1.30pm to say Im sorry I SLEPT IN!!!!! :mad:

 

 

So I am now going to report him to the manager, although the manager knows what he is like but he cant discipline him as all that has to be done by the area manager!!

 

He stays less than a 5 minute walk from work as well :mad:, so as you can imagine he got the wrong end of my bad temper today.

My former housemate.

 

He's normally a decent bloke, but I've been trying to get him to pick up a pile of his post and his polling card for the past three weeks.

 

He keeps saying he'll come on a particular day, but never bloody does, it's the fourth time he's done a ****ing no-show now!

2nd Mum back at hospital again as her stoma tube thing has gone into her stomach. She's not been out of hosp long and it's coming up to a year since she was first rushed in with pancreatitis. Awaiting news.

Problem with fish tank so we had to drain. I didnt time the syphoning right and got a mouth full of dirty pooey fishy water, yuk. Tipped a bottle of mouthwash in my gob and still cant get rid of the taste...:(

Thanks chuck :). She is back home now. They were worried that her bowel had started dying (again). Luckily after tests it seems to be ok and just a retracted stoma. She had a lot of problems when she had it first attached as her bowel kept dying and they kept having to operate and remove the dead tissue and re attach it. She's had so many ops and it's constantly been one step forwards, a million back. I'm so relieved that she's ok. Phew :)

Venting some stress here so switch off if you don't care.

 

My Dad is still no better and has been told by his surgeon he has to live a life in constant pain, 'just take painkillers, as many as you need'. He can't even stand his shirt rubbing against the site where his pacemaker was fitted, it's that painful and it's been few months now. It's big ..like an old mobile stuck under his skin and bulging against his collarbone ..not nice and he wishes he hadn't had it done as he more disabled now than ever. Every step hurts him and it hurts us to see him that way. We are waiting to see another surgeon that said it was possible to move it, a 2nd opinion, and if that doesn't work out then we'll pay to get it done as it's obviously not right, a pacemaker should not be rubbing on your collarbone and keep swelling up.

 

And yes my Mom still annoys me but it's an Asda day tomorrow, voting, Lidl and then me calling about the road tax on a car that isn't driven! My life is on hold for now despite trying to fit in work, kids and the usual. She flaps so much I'm sure she was a chicken in a former life, bless her. She wants to vote Labour .. I'm sure I have a faulty spark plug or my battery is on its way out..could take me a while to sort out!

Hi CS, I can certainly sympathise with you and your dad on the Pacemaker. My dad had one fitted last year (and it does stick out like an old mobile phone). He too was in utter agony, but after about 3-4 months, the pain did subside. It's about 9 months on now and tou would hardly know he had it.

 

I'll say again, I think it is a lottery postcode and that chooses the professionalism of the surgeons and medical treatment people receive. We live in a horrible place that's full of cime, hoodies and generally a lack of dicipline, but I beleive our Health Care is second to none.

 

I would certainly look for it to be replaced/moved for your dad. It has obviously either been put in the wrong place, or it has slipped out of place itself. Nobody should have to suffer like that for this long:mad:

 

Things can only (hopefully) get better.

Having a good old rummage through my kitchen cupboards. I thought I sorted them out last year when I found exactly where they were getting into the house and sealed up the hole. They stopped coming in immediately then and I thought that's that.

 

The little s***s have found another way in, and I can't find it. I know they are getting through a gap at the back of one of my cupboards, but I can't see how they are getting in from the outside.

 

I have fitted units, so can't take them apart to discover the hole. I hate these bloomin things, and every type of poison you use seems to make them stronger IMO.:mad:

 

If a politician was to come round to my house right now and get rid of them, I would go straight to that polling station and vote for them.:p

So sorry your dad is having such a bad time, and you are still coping with it all.

 

SOD'EM, try sprinkling some Ajax at the back of the cupboards. They don't like it - or at least most ants don't. You could go and hang around your local polling station until one of the candidates turns up and ask for one of their entourage to deal with it for your vote. :D

 

MP, Sorry your second mum had a bad time and glad it wasn't as bad as it could be.

 

fluffy_bunny, hope your earache gets better. I've got a pounding headache this morning, so really sympathise with you.

Council made appt for 12/5 and turned up today. As on my own didnt answer door as in bed with headache(another one of us). Wrang them to tell them they had again made a mistake and was told my fault:mad: I think I can safely prove from my annoyingly long thread that they do make mistakes, but of course to peep on the phone my error and closed repair.:mad:

 

How do they behave the way they do and yet make you feel guilty for it as if my fault, gets me each time;) If they could on the other hand tell me off for eating so much choccy, I would be thin by now :)

It's nice just to know that someone understands. My Dad doesn't have much muscle and the device is still where they put it. I understand there are limitations and sometimes things have to give but he can't carry on like this. He has been active all his life and worked bloomin' hard over the years and resents being disabled unlike some that relish it and claim all they can from an early age.

I am only 40 but have been feeling not right for some time. I lost my job last year and the DPW were really at me to restart work. Do this, do that. Attend this, attend that. If you don't, we will stop your money. It was ridiculous. I applied for more jobs than ever (even much lower paid ones) to no avail.

 

In the end, I went to see my GP as I was feeling so down and tense. My blood presswure was 181 over 112:eek:, so no wonder I wasn't feeling right. I was sent for the usual tests (bloods, heart trace and chest x-rays etc). I was even in hospital over Easter with irregular pulse rate and obviously high blood pressure (Hyprtension).

 

In the end, I told the job centre this as my GP had given me a medical certificate. I have never claimed sickness benefit in my life, but had no choice on this one. The jobcentre was fine at first and cancelled the backl to work appointment that they had planned for me, I had to apply for Employment Support Allowance (which incidentally is the same amount of money as JSA). They then sent a form out that was as thick as the Yellow Pages for me to fill in to explain why I cannot work?

 

I couldn't tell them much because I had not got my results back. Now they are questioning me. Anyway, I went to my GP for my results and my blood pressure was still way too high, so he put me on the highest dose of Losartan he could (100mg).

 

Also, my chest x-ray has showed that I have an enlarged heart (probably due to my bllod pressure being high for so long), and I have been refered to a chardiac specialist. This is made worse by the fact that (although he is still alive now) my father had a chardiac arrest when he was 44 and has had 7 or 8 heart attacks since (hence the pacemaker). Also, his brother died from a heart attack when he was only 51. Therefore, they are paying close attention to me.

 

Despite all this, I have to go and see one of the DWP advisors to discuss helping me get back to work.

 

My point being.....Can they just not let the doctors get my blood pressure down and sort out my heart first? Mind you, I suppose if they pressure me enough into an early grave, then that would save them a lot of money in benefits in the future.

 

Government....Shmoverment!!!!!:mad:

So sorry Sod'em. I used to work for them so I understand where you're coming from. This whole back to work thing is rediculous and only serves to make it 'appear' that they are tackling people who are not wanting to work. In actual fact all it does is put stress on the genuine people! The people who have no intention of working quite often know the procedures very well and are still able to manipulate the system. I lost count of how many times someone who 'should' (in my opinion) have got the benefit didn't and how many people slipped through the net and were awarded when you KNEW they were fibbing and not entitled but there was nothing you could do about it as fraud only look at cases that are likely to increase their figures, and certain benefits don't even count towards their figures so they don't take them on.The back to work interviews are one of many things I've seen introduced so that on paper it appears they are doing something but in actual fact it doesn't help the claiment or the benefit who need to and should be getting on with processing the claim.

 

I hope your doc gets things sorted with your blood pressure :)

I don't understand it at all. My doctor tells them (at least for the time being) that I am unable to work. I have been awarded Sickness Benefit (which is now Employment and Support Allowance). But I still have to attend Back To Work Interviews. It doesn't make sense. I wouldn't mind if I was receiving more money, I'm not. ESA is exactly the same amount weekly as JSA. I beleive stress is the root cause of my High Blood Pressure, so why do they want to give me more stress. I've paid my taxes since I left school and have never claimed any benefits up until last year when I lost my job.

 

I've got a good mind to just tell them were to stick there benefits and just see how I get on.:mad:
