I have to do some proofreading of an English grammar book for an Italian publisher this weekend - for money! - so I'm afraid corrections and suggestions will come in dribs & drabs.  I've totally knackered the layout, the numbering and the order of your Exhibits but there will be several versions done so don't worry about that ATM. Your arguments are superb. What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge. IMPORTANT - did you ever send Simple Simon a CPR request?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Some drs are uncaring but i will admit it does seem a bit strange or even different.

 

It's quite common really when people have been badley attacked. I have gotten worse in the last few years though. I think it's because I am not around dogs at all now and it's dogs I haven't got to know I have problems with. My older brother and cousin were teasing the dog that attacked me before it attacked me. I was in a different room and so didn't have any idea and went into the room and to stroke it. It naturally flipped and went beserk, but on me. My parents explained what happend in hope that it would prevent me from thinking dogs are bad or being afraid of them but now when I see a dog walk round a corner I'm I guess on some level thinking that I don't know what happened to it before it came round the corner, or if it's owners or other people tease it treat it well etc. I LOVE dogs. If they are on the other side of the street i'll stand cooing. It's just if it's off a lead or close enough to me for possible contact I freak out. I can't help it. There is loads they can do for phobias apparently so lets hope they can re-train my brain, or at least stop me from getting any worse.

 

I admit that the climbing tree thing is a bit unusal and extreme :). My sister goes mad when I run and try to hide in the bushes :)

 

Hope your ear is better and the rooms have started moving back lol

Hi GM, hopefully your ear thing will get better, try some olive oil in a dropper, usually works even when I have sinus ear...

 

Just got back from pub, had good afternoon with friend and collected a banner to be repaired, now going back out and into another pub.... got a busy weekend ahead too so really getting in a chilled out mood.

 

Can't believe how much junk I seem to have hoarded in old garage, 9 binliners of junk, 3 binliners going tomorrow to local school and 3 boxes of vinyl records belonging to nephew! Not to mention trip to Manchester and visiting American next week!

Just doing my online banking to find that the Council did not take last months Council Tax payment. Then realised that it is spread out over 10 months not 12!!!!

Yayyy I have 2 months of Council Tax money I budgeted for to spend Willy Nilly:D

TBH l have never heard of your dog issue.

I normally check it every day but I have been working away a lot lately. I realised the DD had not come out and thought I would give it a couple of days to see if it went late but then I went away for a few weeks and forgot. I get paid monthly and leave enough money in the account to cover all the monthly bills.

 

Never mind cos I've bought a new coat and shoes with the money instead.:D

Just got back after earlier post.... much chatting and discussions, got nice dress (havent worn one in YEARS) for Manchester meeeting, jusist have to get nice flat shoes for event otherwise arthritis in foot will play up.

You've never heard of or come across anyone who's afriad of dogs?? I find that quite surprising I have to say, especially if you have children. It's a very common fear, I've known lots of people throughout my life who have been afraid of dogs to varying degrees. I don't know how many have needed to seek help though, I guess it all depends on things like the severity of the attack, how old you were and how traumatised you were. I guess I assumed that everyone would have come accross or heard of someone at some point in their life who is afraid of dogs.

2nd Mum is leaving hospital today after 3 months. She is excited but scared at the same time. She is moving into a new flat so that will be strange for her, and after having so many set backs the thought of not having medical staff around is worrying her. She's been through so much and it's going to be another big adjustment for her. It's going to be a long time until she's better but the fact that they are letting her leave is a big step forward. We are all happy but at the same time a bit apprehensive after all the drama. But it is a good day and it did make me smile. She's got about 3 hours left. :)

She is moving into a new flat so that will be strange for her, and after having so many set backs the thought of not having medical staff around is worrying her. She's been through so much and it's going to be another big adjustment for her. It's going to be a long time until she's better but the fact that they are letting her leave is a big step forward. We are all happy but at the same time a bit apprehensive after all the drama. But it is a good day and it did make me smile. She's got about 3 hours left. :)

This'll make you laugh.

 

Got a threatogram last week from someone threatening a doorstep visit.

 

At 7.00 p.m. there is suddenly a hammering on the front door, the doorbell is rung incessantly, and the doorknocker is banged very loudly too. I go to the door and shout through, "Who is it?" No answer. "Well, if you don't answer, I'm calling the police right now." Which I did. The phone is by the front door, the police ask if he is still there and again I shout the warning through the door. No reply.

 

Police turn up. I tell them I have no idea what is going on. Must be a nutter. They go out, grab my poor neighbour as a suspect, let him go when I vouch for him, and go out to look round the block.

 

20 minutes later they come back to say that other neighbours further up the street have had the same thing, they have apprehended the suspects

and, wait for it

 

 

they are two deaf guys trying to sell cleaning products, and as they are deaf they don't understand the racket they are making, and they wouldn't have heard me threatening them with the police. I suggested they should have i/d to post through the letterbox.

 

Anyway, it wasn't a doorstepper. :D

My major smile is getting one over on a traffic warden!

 

I parked on health clinics car park that was pay and display. It's free for the first 1 and 1/2 hours but you still need to get a ticket. 2 machines were out of order and I was told that one wasn't needed.

 

Wrong! I stayed with my car and a warden appeared. So I went to a 3rd machine and got a valid ticket. He went over to a car opposite me and gave them a parking fine for not having one. An elderly man had parked next to me and didn't have a ticket either. I went and got another ticket and stuck it on the outside of the window of the car while the warden was getting his pad out ready to write a fine. The rules say you can't transfer a ticket, can't return within 2 hours, and must clearly display one. It says nothing about it being your car or the ticket has to be on the inside of the car.

 

Result. One happy gentleman thanking me and not facing a fine (he was only in there a few minutes) but some evil looks from said traffic warden. I could do that all day just to p them off!

Yes i have never heard of ppl afraid of dogs. I know small children who dont like dogs bigger than them near them but my 2 children are ok with our dog and was ok with our other dog b4 he got put down.

 

My daughter is now 20 months and my son is 6. We had a 9 year old german shepard and have a 3 year old jack russell. We thought the shep was older and so did the vet due to his problems.
