  1. hi, im new so please be gentle with me:wink: been looking through my credit file and have notice welcome finance have put more than a dozen late markers of 6 ,s on my file ,actually over 5 years worth and has never been defaulted i had car with them over 7 years ago and had paid more than half and volunteered to hand car back and that would be it as i had paid more than half seems for over 5 years its geting late markers on my credit file and i heard from a friend that ICO says after 6 late markers it should be defaulted ,is this right ? ive heard nothing for over 6 years from WF and have paid nothing in that time ive also sent CCA over two months ago but no reply can anyone give me advice how get markers off my file also im from scotland and aware could be status barred after 5 years ?
  2. Hello helpful people. First off a huge thanks to all who have posted here, you have helped this long-time "lurker" to a successfully upheld claim with the Halifax for my credit card PPI. My card has had a largish balance on it for nearly all of its 15 years and my average PPI payment per month has been £28, with many payments £30-£35. My situation is thus. The SAR came back with ALL statements and payment details going right back to the issuing of the card in June 1999, so there should be no guessing or averaging on the part of the bank. I painstakingly input all the details into the spreadsheet posted on this forum (The running credit one titled "FosRunningPPI v102.xls") twice! and got the same settlement figure order of £26K both times. Halifax have now written to me upholding my complaint and made a final response offer of almost £16K. They are saying that I have 28 days in which to accept the offer, or to call them if I am unhappy with the decision. How accurate is that spreadsheet above in terms of how the account should be reconstructed? Could there be any other reason for such a discrepancy? I'd would like to contest the amount if it is wrong but don't want to end up like that guy who was offered £22,000 and ended up with £3,500!! Thanks for any help and advice. Much appreciated.
  3. In Nov 2012 we were subject to a CC judgement for £299.00 The court ordered us to pay £8 per month from Dec 2012. The claimant objected but was overruled. We have paid diligently every month and in one or two cases paid more.(We have every bank receipt). We have paid a total of £132.00 Today, a letter came from the court with an attachment of earnings and the claimant claims we have failed on our payments & still owe £211.00 !!!!!!!! They also have lumped £100 onto this. I have to fill in the attachment and send it within 8 days..What can I do? The claimants are telling lies and I have the receipts to prove. This is scandalous...Should I see a solicitor on Monday?
  4. Hello, I have taken a loan from Lloyds TSB 2 months ago. It was to consolidate a £4K debt (high apr). The guy that sold me the loan said that in order to get a low apr I should get a higher loan. I told him that I was planning to pay it off early and he suggested that I don't touch the money apart from the actual consolidation amount. I took a £15K loan at 11% and 3 month buy now pay later. I came into the bank today to pay it off early and I was told that I had to pay additional £670ish in fees. so all in all £15670. I was told that the fees would be minimal. I complained that I have been missold the loan and have a meeting with the manager this week. Now the guy that sold me the loan called me couple hours after my visit and it seemed he tried to convince me it was ok and the other guy was wrong about the fees. It seems to me he was worried that he messed up. Any similar situations/any hints how to sort it out? Would finance ombundsman help? If I knew these fees apply I would have never taken the loan - the seller convinced me it was the right way forward which clearly it isn't. Help! (Many thanks)

  6. Hi there I am seeking advice about approaching creditors for a settlement offer, and wondered if this was wise, and what is the best way to do it. I have been on a DMP with Payplan for over 10 years, drip feeding my debts - no IVA or bankruptcy. Originally over 25K, now looking at just over 5K. One of my creditors last year offered me a settlement of 60% write off (mbna), and I was lucky enough to have a family member to help out in that respect. This drastically reduced my overall debt. Still chipping away, I wondered if there was any merit in approaching other creditors on my DMP to see if similar settlement figures could be offered. Has anyone done this? Many thanks
  7. hi all, bit of info needed please if you can help.i'm trying at the moment to get my finances in order as i have just been told that i will be changing shifts at work and will be losing a small fortune in salary. i have a car that i would like to try and hand back as i'm paying nearly £180 a month for i have paid 16 months into a 39 month contract and i know you can hand the car back at 50% ,which i just fall short of. What i want to know is want are my options on this am i better to try and voluntary terminate it (what would happen) or am i better to voluntary surrender it (what would happen)the car is in negative equity and at this point my credit rating is this least of my worries any help would be great as i'm at my wits ends to try and get my outgoings down to try and make up my salary. thanks
  8. Hello A PDL company issued a claim against me on MCOL in early March. I acknowledged service, and admitted part of the claim,and put in a defence for the rest (the biggest part), within the time limit, and put in financial details to ask for time to pay. (I am on a DMP which the PDL wouldn't accept) I've tried to log back in today to see if anything is happening, but there is no longer a link to the claim, and if I put the Claim Number and password in the boxes, it just comes up with the message "claim number or password is incorrect" Is this normal at this stage of the process? Should I still be able to view my details? Are the PDL company expected to respond to my defence, or does it go straight for judgement? How do I find out the result? Does it come in the post? And normally what timescale? Thank you in advance WHT
  9. Hi All A new default has just appeared on my credit file for a loan from about 9 years ago, as far as we were aware this was a statute barred debt and it had already defaulted years ago. Is there anything we can do?
  10. Hi, advice please? I have made a claim on my contents insurance (1st claim in over 5 years), my son lost his mobile phone at a music gig, it is nearly 2 years old so he has not got the receipt just the box with iem number and charger and earphones. They say without proof of ownership they won'y pay! It doesn't mention this on my certificate nor did they say this when I took the policy out, and after thinking about it, I don't have receipts for over 90% of my possessions and home contents! so this makes my whole policy useless, it can't be legal surely?

  12. I have been working at the same place for over 15 years now. We at paid an hourly rate + production bonus per week. Our current rate is £5.05 per hr + bonus (this can vary from £30 -£70 P/W) Looking at my payslip on friday I thought it didn't look right. Gross pay was £248.87 for 40 + 1.5 (overtime) This comes to £5.99 P/hr. I also looked at another slip. It was, £250.26 for 40 +1.25 This one works out at £6.06 I believe they would try to argue that it's because my appraisal score (done monthly...or so they tell us) and therefore my bonus has been cut. Am I right in thinking that this is no excuse and they are breaking the law regardless of what reason they decided to cut my bonus.

Hi im new here so i dont really understand alot of the things on here, firstly i applied for an mbna card some time in 2009 whilst at work however recieved a text message saying call us as they needed more information. A few weeks later although i didnt call they sent me messages saying please call to activate your card once you recieve your card. At this point i was like hmm as i didnt ring them up before so it seems like they just accepted me after all. I called up and told them i hadnt recieved the card and they seemed surprised but they said they would send another one out etc. Anyways 2 months later i get a statement for about 1500, i rang up MBNA and told them that i hadnt recieved the card and what the balance was for. They advised me that they had a picture of my doorstep and a signature from the person that signed for it, both of which i asked for but didnt recieve. i started getting letters, calls and all sorts of weird and wonderful conversations. I finally decided to stop talking to MBNA as a senior advisor blatently lied to me about recieving an emial from my own personal university email which was impossible and i have proof of this to. In the end they just put a default on my name, ive asked to be taken to court but they refuse, i am now being chased by ageis however they really aren't bothered and don't pester me too much to be honest. Also MBNA wrote to me stating on the basis of probability they cant say this is fraud or not etc. Also the fraud was on the card and on some cheques they has sent out which i didnt ask for. I dont know how the card was verified or acivated but they said someone had called many times and they believe it to be me. Ive asked for the recordings, and asked them to look at the signatures,cameras etc but they arent bothered one bit. i want to write to them to ask for all the details they have about me, I did the apllication over the internet and did not sign for anything. I dont understand what the cca, dn etc etc is Can someone please explain this. I dont know where i stand or what to do but one thing is for sure, getting a job is proving way to difficult due to the default. Any help would be greatly appreciated Thanks in Advance xx
