Hi All I have had a letter from Advantis credit control stating that there sre clients for the DVLA,claiming they want to verify my contact address,and its in relationship to a outstanding business matter as i have moved to Devon from Leicester,they had my address to send the letter and i have retaxed my van here to, any help please
  2. Hi Need some advice guidance as im at a loose end at the moment. This is in releation to my now wife, who in 2002 claimed for housing benefit she wasnt entitled too, as a result she went to court in 2004, who found her guilty and she got community service. She moved back to her mums address in 2003 (so prior to court so all documents went to this address), she served her community service however there was no mention of paying the money back to DWP. Fast forward to april this year, where we bought a house in 2011, we recieved a letter from DWP stating that you owed £3500, she phoned them up asking what the debt related too, then ended the call. We sent a letter stating statuary barred as the debt is long past the 6 years. We have now just recieved a letter from a DCA (CCS Collect) asking to make payment within 7 days of the letter. We were under the impression that the debt could only be repaid from benefits etc and they couldnt pass the debt onto a collection agency due to it being over 6 years old? Can anyone help?
  3. This company called Harland is chasing me for £114.99 for a months gym membership that i never used... I agreed a month to month contract with Simply Gym in reading... no ongoing contract.. after 1 day i told them i want to cancel its awful. the gym was disgusting and falling apart... then 2 months later a debt copllection agency mails me saying they want 6 times the monthly amount of the gym... what is going on in the country?
  4. hi. Few days ago I had a phone call from employment agency I`m working for and was told that sometimes in September I was overpaid £208 gross and they will deduct this from last Friday wage. They should pay me last Friday for 53 hours (those hours were signed by my manager on the time sheet), I was paid only 40 hours. Problem is I`m self employed working on building site for stone company through agency, so stone company pays agency they take them profits and pay me through payroll company. Payroll company send me only basic payslip which does`t show what I was paid for. I know what stone company is paying for as manager from this company is signing time sheet every week for me which I have to send to agency. But on the payslips there is no breakdown what I was paid for, etc. I asked them for breakdown of my payments for last two months which will cover the week they claiming that I was overpaid. I was just ignored, no breakdown of payments came through to me yet, so I don`t know if I was overpaid in September. Can they take this money of me the way they done it if I was overpaid? if not what can I do now? I know that`s not a lot of money but if I let them do it now they will keep doing it all the time. thanks for any advice given.

A few months ago ; we made a claim against Consumer Loans for PPI on a secured loan provided ; the Consumer Loans Ltd ; the Loan Company our rejected the claim grounds that the time limit has expired ; we therefore approached the Ombudsman for redress; We have just received a response from the Ombudsman that it can not pursue our claim grounds that my claim has expired; but then will investigate concerns with the insurance company who actually provided the cover. The facts are that Consumer loans provided us with insurance cover for five years of the secured loan; but then after the end of the 5 years kept on collecting the insurance premuims for another 10 years until the secured loan was paid off. We are unhappy about the ombudsman position and also the fact that despite the fact Consumer loans did not offer cover kept on collecting premiums on the secured loan:mad2: Any suggestions on how to proceed with the Ombudsman
  6. Hi, I have a few payday loans which have got out of control and with my current financial situation I am unable to make a repayment anytime soon. I have a couple of questions. 1) How can I stop these DCA from contacting my employer? as I am getting multiple calls each day? 2) How can I find out what DCA my debts are with? 3) At what point is it deemed to be harassment and who do I contact in regards to this? 4) I sent a denial of access letter to one of them and they continue to leave me voicemails and letters saying they are going to arrive unannounced, what can I do?   7. Hi everyone I am new to this site and hoping someone can help. I recently started work with an agency who verbally offered me £11 PAYE per hour before the job commenced. After working for two days I received a contract by post stating I was to be paid £9.50 per hour. (I know I have no legal standing). I am however formulating a complaint about their conduct. The agency then refused to pay any more than £10 per hour stating I should never have been offered any more than that as they would not make any money. I am aware of the week previously the tradesman before I was paid £12 per hour as self employed however the client was only charged £13.50 leaving £1.50 left over for the agency. The temping agency receive £14.50 per hour from the client for my services leaving £3.50. I know accrued annual leave would be deducted from the £3.50 but are there any other costs deducted?   8. hi. I`m self-employed working for an employment agency. Used to work for them on day rate £120/day and then I was paid at 1,5 for Saturday and double time for Sunday. About three weeks ago they changed how they pay and now I`m on £16/hour. Sounds great, but since they changed it they don`t pay me extra for Saturday and Sundays, which means I`m paid through all week at the flat rate of £16/hour. For example, before changes for 60.75 hours I done I was paid £840 after tax, after changes for 61.5 hours I done I was paid £787.2. how can I make them to pay me at rate 1,5 for hours done on Saturday and double for hours done on Sunday? can they change things like this without telling me? thanks ps. I have pictures of all time sheets signed by manager and all the payslips
  9. Hi, I am hoping for some advice over a problem we had with a letting agency. We no longer rent this property as we were served notice to quit as the owner was selling it but we are still having problems with the agents. We first rented the property in august last year, after a week in it the burglar alarm began to go off continuously, i rang the letting agent to try and sort it out and they told us that they did not know the code so there was nothing they could do, we arranged for someone to come and disconnect the alarm at our cost, we paid for the disconnection, were advised that the whole system had been installed incorrectly and where given an estimate for the cost of repair, we forwarded both the invoice and the estimate on to the letting agency but in the twelve months we had the property it was never fixed. We claimed back the cost of the disconnection via a reduced rent payment the following month as agreed with the letting agency manager. ( will come back to this later) In november of last year the upstairs bathroom developed a leak. We notified the agency who initially ignored our requests. Only when the ceiling of the downstairs rear lounge had actually started to bulge did they send someone, and only after my wife had gone into the estate agents to tell them the ceiling was in danger of collapse did they actually send someone to do the repairs, they fixed the leak, but not the ceiling. Within a couple of weeks the leak started again so we informed them again to be told to contact the builder ourselves. I disconnected the water supply to the bathroom myself at this point then tried to contact the builder who did not respond to my messages. We again informed the estate agents who told us that the builder who carried out the initial repair had to be the one who came to fix it. He eventually conttacted me in early January to say that he had been in hospital but arranged a date to come a few days later to take a look at it and also a window in one of the childrens bedrooms which was side opening with a broken lock, in our view, dangerous. Also reported to the estate agents He never turned up so we again contacted the estate agents who said they would appoint someone else. After numerous phone calls and emails to them they eventually arranged for another builder to come, We had no contact details for him other than an email address which he never responded to so we failed to make any progress, even though we made the estate agents aware of the situation. At this point the estate agents stopped responding to our calls and messages. When we went into there offices the management team would send somebody out to us to tell us they were not available and they would get back to us which they never did. In june of this year we received a letter to vacate the property due to the owner wishing to sell it. We referred the estate agents back to our numerous messages about the state of the property and the fact that we had a bathroom and a bedroom that had been unusable for the majority of the tenancy but the estate agents have fobbed us off with excuse after excuse and basically stalled us until the tenancy was up. We issued a formal complaint to the estate agents two weeks before we were due to move out and were told that it was under investigation and we were to wait and hear back from them My wifes father was the guarantor for the tenancy and last week he received a 'final demand for a payment of £820, this was for the last months rent of £750 plus £70 for 'unauthorised deduction of rent'- this was the £70 mentioned earlier that was an agreed deduction for the cost of the alarm disconnection, which they had accepted and taken the invoice off us for. They told my wifes father that they had been trying to contact us on numerous occasions which is why they had issued the final demand. We had received no letters, phone calls or emails from them, we live in a small village and my wife actually owns and runs a shop directly opposite to the estate agents so as you can imagine, he wasn't to impressed about the fact that his credit rating could have been affected and we were neither about the fact that they had not only lied to him but pressured him into paying it. I decided to email them and ask about the situation with our deposit as it has now been 6 weeks since we vacated the property. I also asked for details about the Deposit protection scheme the deposit is with as i had previously requested this information only to be ignored. We have had no certificate issued to us to this date. We basically had a property were 20% was unusable (Toilet and Bedroom) which we were still charged full rent for, nothing ever got repaired, and we are still awaiting the return of our deposit. They have completely ignored every request we have sent them and we are not sure which way to go with this. I have looked into whether they are registered with any schemes where i could make a further complaint but they do not seem to be, and we also looked on the DPS websites and rang up to see if our deposit was protected with any of them, they all said that they could find no record. any advice would be greatly appreciated and apologies if this doesn't read very well!!
  10. Hi all, Need some advice and guidance please, am in unknown waters here and not sure what to do. Im march of this year I moved into a 3 bedroom property with a lad I knew, we were friends but not really mates I guess you could say. The house was available for rent through a local Letting Agent, all above board no problems yet. Agreed rent was £600pcm and that alongside Council tax and utility bills was more than manageable. My Employer kindly lent me £1200 as a long term loan to cover the £600 bond and £600 1st months rent. My housemate paid back me back the rent over 3 months and this was fine. In June my housemate split from his long term girlfriend and started behaving oddly, so much so he was threatening to leave his job as he didnt like it. Luckily this didn't happen but this is where things began to go sour. One day in June his ex came over and demanded a sum of money from him, I dont know the amount but it was something that arose from their breakup, this meant he couldn't pay his half on June's rent straight away. I paid it in full and the bills and between then and the end of June he paid me back but had a little outstanding from the bills. In July he began talking about moving jobs, my opinion was that aslong as he paid his rent and bills then it was none of my business. July 15th I went on Holiday to Ibiza, 10 days later when I returned the house was trashed. He had punched the upstairs light switch and cracked it, punched through both the dining room and kitchen doors, his dog had pretty much run right through the greenhouse smashing some of the panels, the downstairs toilet handle was broken making it hard to use, the towel rail in the kitchen was snapped off and too make things just that little bit worse, had taken my sports car out, even though he had no insurance or license ( not even a provisional ) and crashed it!! causing upwards £2000 of damage Rumour was he was drunk but I couldn't prove it. He promised he would have it all fixed asap, that was until he told me he had resigned from his job and the job he was hoping to move into had collapsed. I paid the rent and all bills for July and August on the understanding he was looking for work, this never happened. On the 19th of August I left the house to go to work and found my housemate had pulled the beam clean off from the small porch outside the front of the house, apparently from doing pull-ups again drunk. I stopped talking to him at this point and decided I needed to get out of the house. On the 22nd of August I wrote a letter and took 15 photographs explaining pretty much what I have written above and also letting the Estate Agent know I was vacating the property on the 2nd of September, leaving my housemate there as he had no intention of leaving. Also that as the 6 month tennancy was up on the 11th of September I did not wish to renew. Upon hand delivering the letter, I was met by the manager of the Agents who read my letter and agreed it sounded a mess and had no issue I was moving. Within 30 minutes of leaving the Agents I had a call from them asking me for permission to do a visit, I agreed and so did my housemate. Roughly an hour later I got a call from the bloke who did the visit trying to quiz me about the damage, I explained it was all in the letter and he surely had seen it, he said he had and then stopped, finally he asked me if he could have somebody else come out on the 2nd of September to do a hand over.Which I agreed. On Wednesday 31st August I had to call the Agents as I received a letter requesting a time of 5:30 to do the handover, due to work commitments I requested to change the time to 6pm and also that I hadn't finished moving a few bits out of the house, this was agreed and I was somewhat pleased. The 2nd of September arrived and as of 5:30 I received a constant stream of phone calls from the owner of the Agents, I was driving at the time and could not answer, as I arrived at the property at 5:50 he called again, I answered only to be asked why I wasn't there at 5:30 and if he could be available then, why couldn't I, I explained I had called his office and arranged it, his response was 'oh, ok then' he wanted to come back to property there and then, I agreed. When I got in the house, my housemate was packing, strange I thought as that morning it seemed like he was intent on staying until the tennancy expired. Turns out he was sent a letter aswell asking him to hand over keys on the 2nd, but assumed it only applied to myself. I was upstairs when then owner of the Agents arrived, I didn't hear him knock but he shouted up the stairs and promptly came into my room where I was packing. His first question was ' Why has July's rent not been paid?' I showed him on my online banking it had been paid on the 1st of August and he apologised. He then told me it was unfair to place blame for all the damage on my housemate and I should pay for it. At this point I asked that my housemate should be present for this, however, he declined and said ' He doesn't seem the talkative type' he then said he wasn't happy with the damage and I agreed. This moved him onto the rent for August to which I said I need my housemate to give me what he owes, since your here why don't you ask him?, again this was refused. I informed him that my housemate was intent on staying in the property until atleast the following weekend, at this point he told me he had already spoken to my housemate and agreed to let him stay until the friday of that week. I told him I would be out of the property be 8pm I was met with no response. When asked about the outstanding bills, I explained I had them all upto date and that the Water and council tax were paid up until the 2nd and were now in my housemates name. He was happy with this. However, he said he couldnt do the hand over because of the mess, and asked me as I was working and getting a wage if I would pay it, as it was the responsible thing to do, I laughed and said no chance, I'm gone tonight mate, you know this. With that he said he would return on the friday and expect the house to be empty, odd I thought but nevermind. I had moved out of the house by 8pm, a friend told me my housemate had between the Tuesday and Friday repaired all the damage and had tried to claim the bond, but he was told no as the last months rent had not been paid. This morning I have had an email from the letting agent asking for the last months rent to be paid, I don't mean to sound like I am trying to get out of anything but I am so angry its beyond beleif, I was of the opinion that since I had left and my housemate remained there, it would now be his responsibility to square things up. But also that the bond which I can prove I provided would in any case cover the outstanding rent? The Letting agents are now panicking as they didnt ask me for a forwarding address, but I have covered all the bills so I'm not worried about them. What can I do? should I respond to the email asking about the rent and tell them to use the bond or... should I say it's my ex-housemates responsibility as he remained in the property after I had left? I hate to sound like im avoiding responsibility but I am not and I thought I had done the right thing by going to the letting agents with the photos and letter I wrong. Any help would be greatly appreciated
  11. Scenario: An employment agency is alleging I have been overpaid, this has occurred several months after I last worked through them. The alleged overpayments where paid directly into my bank account . They are asking for the money back. I had no formal contract with these people and there is no payslip or any other evidence of what this payment may have been for. The job I was working on (with no contract) actually ended some six weeks earlier than it should have - with no contract I had to take that on the chin. Ironically the amount of alleged overpayment is about what I would have earned had the job lasted as long as I hoped it would have. They have given me 1 week to get back to them with a written proposal on how I intend to pay the money back. Any help re the legal position on this would be appreciated. Thanks.
  12. Trying to keep this brief and have read a bit on it but still not sure. I started work at the local council as an agency worker beginning of July - the council requested Level 3 (agency pays £8 an hour for this) and as the work wasn't too high level thought it okayish - not great but a job - no one else did this role and it was to help out for 12 weeks. After 3 weeks I was offered a kind of promotion being in charge of Admin for the department and a chance that this will last more than 12 weeks - it's still Level 3 no hassles with that. What I am concerned about is that from my reading on the council jobsite is that Level 3 wages are 15875 up to I think 18500 - as my £8 an hour rate works out less than that, could I potentially ask for in 6 weeks the same rate from my agency that the council would pay a directly employed worker? The agency did witter on a bit that I would get the same holiday rights after 12 weeks but no mention was made of comparable pay. I'm lucky my boss at the council is quite cool - I mentioned something about this to her this week and she said she would show me what the agency were charging me out for and I know she wants me to stay - so maybe I can put something together that I would be better on their books than on the agencies cost wise for the length of the contract. If this doesn't happen - would just like to know if anyone knows where I stand after 12 weeks re what my wages should be. Thanks in advance:roll: Clare
  13. So I have a job 'interview' next Thursday afternoon. Job is being advertised by an employment agency - i'm told it will take about 2 hours and will be a group thing. As whilst we're there we will be undertaking health & safety or food safety training (can't remember which now). This seems strange. More like an induction than an interview. Anybody come across this?
  14. Hi I would really appreciate your help I rent out a single bed flat and used a letting agency back in December. They found a tenant who paid 5 months in advance on an assured residential contract. I agreed as I was 8 months pregnant with a lot in mind I did not do appropriate checks. After the 5 months the tenant was late with the rent for two months and on the third month he is just not contactable. I asked the agency to go and have a look as I am not local and found that the property was empty. The property was filthy, some furniture was missing, keys and entrance fobs were not returned. there was no evidence of anyone being in the flat for a while. fridge empty, wardrobes empty. I have the following issues: - I cannot relet the property as the tenant has not officially abandoned the property - I cannot claim rent arrears from the deposit as the tenant in not contactable The letting agent is no willing to refund me part of their fees I also asked to see what reference checks they did and it was a joke. As a profession the tenant gave an address is berlin without a postcode. An their income was -£1. No next of keen, o work address nothing. If I was ever told that I would not let them in. Arent they also liable or at least obliged to return me their fees from when he left? Any advise? I am struggling financially, I am not a typical landlord but rent the house as I have moved away from London. Also my mortgage is quite high, it is a 400k property. help please
  15. I went to Galsgow UK Border Agency office on 28th of August for my ILR application in person. They refused to take on my application saying that they don't deal with 'self employed' cases thereby meaning that they don't deal with the application wherein the applicant is self employed. Neither the form, nor their website talks about Glasgow office not dealing with self employed case. UK Border Agency has seriuosly let me down. Did anybody had similar experience? I would be interested to know what they have done or what is the right course I should follow on my in-person application fiasco (courtsey UK Border Agency). Regards Varun
  16. Hi, I am a new user and don't understand forums that well but I could do with some advice. I have read similar arcticles of my concern on this site but they seem to cover Statute Barred at 6yrs. My issue is:- After 13 years I have been approached by a DCA about a debt and a CCJ that I was never aware of. I would be grateful of any advice on how to deal with thefollowing situation. Sorry if it’s long winded, wanted to get all the facts down. I received a letter from a DCA asking me to contact them, as far as I’m aware I have no debts I contacted them and they asked if I had lived at certain address which I confirmed I had, they then advised that I had a debt dating back to 1994 for £4,500. that they were chasing and required immediate payment of. I said that I had no debts and asked for evidence; they said I would have to send them a cheque for £1.00 for this information. I have never received any information or correspondence regarding this so called debt. I wasn’t happy with what they had said and looked on-line and found out about statue barred, I wrote to the company using the standard templates that are available on-line saying that I did not acknowledge the debt and as the debt was 19 yearsold it would be statute barred. They have now written back stating that a CCJ was securedagainst the debt in 2000 at the Northampton county court bulk centre and was subsequently transferred to a local court. They have not sent a copy of the CCJ from Northampton but they have sent copies of correspondence from the local court and the student loan company with the court advising of hearing dates, notice of non-service, progress report on attachment of earnings application and a final notice of non-service advising that the court was unable to serve the N61 order as the defendant is no longer at the address and there is no forwarding address. All of this must have been sent to an address I had long since left I wasn’t aware of any of this. However, I’ve always been on the electoralregister and all the normal registers that exist, it’s not as if I’ve been trying to avoid anyone. I’m more than concerned that 13 years after a CCJ that I’ve never been aware of, was awarded without my knowledge that this DCAis now saying I have to repay in full. I’m not clear if the original enforcement still stands or what to go back to the DCA and say. Any advice on my options or what to do now would be appreciated. I have never acknowledged the debt to them although their latest letter implies that I have and is now referring to two accounts!
  17. I've been working for one employment agency on one of the construction sites at central London for several weeks. Today's morning me and another guy from the same agency came on site, changed our clothes and were ready to start working. The director of the construction company was very surprised to see us there today and he told us that we were not supposed to come today... he said that he had called our agency last week(!!) and told them that Friday would be our last day... The director didn't even know that we had been on site yesterday (on Monday), and he said that the company will not pay us for Monday. I called the agent straight away and asked him what was going on. He said it was his mistake(he said he phoned and texted us, but we have neither missed calles from him nor any text messages) and the agency will pay us for Monday. While composing this message I received a phone call from the agent. He told me that the payment for this Monday will be made this Friday together with the last week's wages. I didn't object to that, but I asked him if the agency was going to compensate me my today's travel expenses(£10), and he said NO... I believe that it is the agency who MUST compensate at least today's travel expenses to say nothing but the lost time since last Friday which I could spend searching for another job. I'm going to wait until my wages are into my bank account this Friday and then I'm planning to demand them to pay my travel expenses, but I need to know the correct way to do so. Could anyone please tell me what is the best way to claim that money from the agency? Thank you.
  18. I've been working nearly solidly for the last 18 months and I have joined a new recruitment agency. I had 12 months continuous work and another 5 months continuous work. The recruitment consultant said because I have not been working for 2 years I have to provide proof I was claiming benefits before I started work 18 months ago. Well I threw all of my job center paperwork out when I began work. I just do not understand why they would want this...you would think they would want to zap you into a job asap...but instead I've been made to jump through hoops! I don't know how I'm going to provide this since I dumped all paperwork out....

  20. I am being harassed by a company by the name of Final Demand based in Liverpool. The circumstances bare as follows I April 2008 I signed as guarantor for my Daughter on a rented property. This was on a 12 month tenancy agreement. During 2011 my Daughter entered into a dispute with her landlord due to disrepair of the property. She moved out of the property in January 2012 with 6 months rent arrears. Yesterday I received 2 letters in the post, one dated 1/5/2013 and the other dated 8/5/2013 demanding that I pay the outstanding arrears and added costs within 7 days or I would receive a visit from bailiffs who would remove property from my house. My Daughter rented her property from a company called Lex Developments but Final Demands client is a company called S&B Brickwork, they trade from the same address. I have reported Final Demand to the OFT and the Financial Ombudsman but I am really concerned that this company can target me in this way without first investigating the circumstances. I am currently off work suffering with stress and this has added to my symptoms and set me back. What can I do, any help is very much appreciated.
  21. My former business partners and I obtained an over-draught facility from Lloyds TSB in 2006. Each business partner acted as guarantors on a joint and several basis. I left the partnership in 2007 and have since discovered that the remaining partners did not inform the bank of the indemnity that they'd signed relieving me from all guarantees relating to the business. In the intervening years they have fallen into arrears with the bank and now I have received a letter from Rockwell demanding the full and immediate payment of £22K. At no point since I left in 2007 have Lloyds TSB ever written to me to express concern over payments or to discuss any options that may have been available. In addition Lloyds TSB have never informed me that the debt had been passed to a debt collection agency. Any advice would be gratefully received.

I have a slightly complicated situation and I am trying to find out if I have the same rights as the other people I basically work alongside - both agency and directly employed workers - whilst I am employed by a 3rd party company who have a contract to supply someone in my position. The company we all ostensibly work for, I shall call K. My Direct employers are N. We work in a warehouse environment handling K's products and I follow out requests by K's staff to move trailers around the warehouse and yard (there is only only person there at any time to do this job, 1 day shift, 1 night shift) and I also operate K's forklift trucks carrying out the same job as K's directly employed staff and also agency employees. K even put me and another colleague through a forklift refresher course at their expense, just as they do with their own staff. K's direct staff and agency staff have kitchen facilities and a canteen, whilst N's staff (myself or whoever else is on duty) are now banned from these premises and relegated to the drivers room. I fail to see why K have the right to discriminate against people who are paid by N when we are essentially the same as agency workers. There are also delivery drivers employed by N, but as they are not classed working at the warehouse, and I know the rules governing delivery drivers are different and separate so I can see why there is a case to be made that they may not be allowed into certain areas, but when there is only 6-10 people working there on a night shift, all working together , sometimes doing the same job.... Opinions are always good, but some case law would be excellent Thanks for any help.
  23. Hi, Can anyone please help with the following. I am a freelance creative. I started contracting for a company (the end client) through a creative agency. I use an umbrella company to deal with my invoices. I was booked on a daily rate. My initial booking did not include overtime payment. Shortly after I started freelancing the client asked me to do overtime. They got in touch with my agency to confirm this request. My agency asked me if I wanted to do overtime and I said yes. The agency confirmed the hourly overtime rate by email and I informed my umbrella company (with the agency cc´d on the email). I filled in my weekly timesheets with the days (start time and finish time) and the overtime hours per day. The timesheets were signed by the client and sent weekly to the agency. Two of the timesheets including overtime were paid in full. The following week the agency fails to proceed with the weekly payment as confirmed on their booking form (which I interpret as part of their contractual obligations). I ask why I haven´t been paid since the agency received all timesheets and invoices on time. At this point they hold four weekly timesheets that have not been paid - all of them containing overtime. They come back to me saying that they don´t pay overtime and I need to reissue the invoices with no overtime included. I reply asking who decided that and when since I wasn´t informed I shouldn´t be doing overtime - I had been doint overtime at the company for the past 4 weeks, the clientt signed those timesheets and I submitted them to the agency. Surely if I wasn´t supposed to do overtime someone at the company would have told me (they saw me coming in early in the morning and staying late at night) or the agency when they saw my weekly timesheets? Not come back to me after 4 complete weeks saying that they´re not paying my invoices because they have not agreed with overtime?! In addition, on my initial booking it states the start time but not the end time. On the timesheet provided by the agency it says that overtime starts from 6pm to 9pm. When I started I asked to the client what were my daily hours and I was told 10am to 6.30pm. I thought that was fine, although it was an extra 30min after 6pm I was Ok in giving that time to the client, one always ends up staying a bit longer anyway. On top of claiming that they don´t pay for overtime, the agency came back to me saying that since I was working 10am to 6.30pm I wasn´t doing a complete day of 8h of work that I should be doing 10am to 7pm and that they would charge me back 30min for everyday I left at 6.30pm. In my understanding this is not only ridiculous it´s outrageous because: - I was told by the client work hours were 10am to 6.30pm; - I was booked on a daily rate - no matter when I leave for the day the client always has to pay a full day of work; - because I am on a daily rate the agency cannot charge me half an hour of a normal day´s work; - The agency´s own timesheet states that overtime starts from 6pm so if in any case if any is due 30min payment it´s me not the agency; So, they asked for a credit note of all the overtime they suddenly decided is not payable plus the extra 30 daily min they decided I should the working everyday (despite the client signing the timesheets confirming all´s Ok). Because I challenged what I consider to be an extortion (my paperwork is all in order), they took the liberty to withhold all my payments since the beginning of March to force me to agree in asking my umbrella company to provide them with a credit note of the amount they´re claiming. This is completely abusive - it would be bad enough if they withheld the amount they think they´re claiming back but withholding ALL my payments (which is currently about 4 times the amount they´re claiming) is taking a serious financial stroll on me. They currenlty have 7 invoices outstanding (none of them include overtime so there is NO reason for not paying them - I reissued invoices with no overtime for the ones outstanding to comply with their stupid request and accelerate my payments), I haven´t been paid in weeks and I´m in panic as I have to pay my bills and rent. I tried to reason with the agency but the self-absorbed monster that´s making all this trouble could not care less about the impact of her actions. The client´s happy with my work. I am happy with them. The agency is making up all this mess and withholding all my payments. What can I do? Is there a way I can force her to pay?? Can I complain to someone? The agency is seriously affecting my ability to support myself and causing me great distress. Help... Thanks.
  24. Hi I was stupid enough to take out several payday loans with the same company. All but one have been cleared. I very recently noticed that the company in question has recorded them against my Credit File within the last week. The problem is that they are all recorded with outstanding balances even though they are months old. These loans have been paid back. It is even displayed as satisfactory on the status. Each one is recorded as a new account, affecting the credit score that I had displayed. Entries have been recorded for 2012 even though they have never shown up before on my report. I had checked my credit file in the last month and these entries were not recorded so these are new entries during that check. What should I do? This has been a total shock from the massive negative impact on my credit score from the concerned credit agency. The company in question has recorded information from 6 months back and given a last status of this year. My understanding of a Credit File was that they could only record forward, not entries six months back. Any advice would be appreciated.
  25. Hi, Today my partner received a letter from Mortgage Agency Services Number Four Limited saying that they believe he now lives at our address and can he fill in the form to confirm this. He had a home repossessed from him about 2 years ago and has heard nothing since, so I'm assuming this is what it is for. Can anyone advise us the best thing to do? Shall we fill the form in, ignore it, call them?? Has anyone ever had dealings with thes people before? I'm worried sick over this as we've just found out we're pregnant and are going to struggle as it is! Any help would be really appreciated.
