  1. Sometimes a Charging Order is made when the creditor wants to try and get an Order for Sale. I just wondered why they would go for the CO if you were paying on time… TB I'm thinking this must be an Interim CO… you don't get to defend those as the application is made and granted made without notice… TB
  2. Hmm... what about home insurance, where you want to cancel but they won't let you unless you pay for the whole years premiums? AA automatically renewed my home & contents insurance... I cancelled the DD payments but they then took the whole year's premiums (without telling me) from my debit card, then cancelled the policy. They say I entered into a loan agreement when I agreed to pay by DD... very confused. Been left without enough money to pay my bills. TB
  3. Just bizarre! What do you mean by 'he refused to acknowledge them'? They get judgement by default if they make a claim and it's not acknowledged… Did you not say anything to the creditors about it being a joint loan? What about at court… did you remind the court that it was a joint debt? I'm not really getting my head round this.. is there something missing? Did you agree with your partner to take on his share of the debt? TB

  5. It's a joint debt but that the creditor only charged you? That would show as a standard form K restriction, but if you and your partner were charged jointly, it would mean there's a full charge on the property… I'm still a bit confused… Do you know what type of charging order it is? TB
  6. I suppose there's not much else you can do apart from try for an OFS or perhaps bankruptcy… but I've no idea how you'd do that… it would probably cost more in legal fees than they owe you… TB
  7. Not 100% sure, but I believe a joint mortgage automatically reverts to a tenants in common situation once a charge has been put on the property. TB
  8. Hmmm… I didn't know about that! I wonder if the FOS will uphold my claim, being as there is a signed agreement but no actual proof of payments…? The other thing is that HFC also put a charge on our property as well as the PPI insurance… (only my husband was covered on the PPI as I wasn't working, so I suppose they thought they would secure the loan every which way they could, just in case)… Thinking back … we were very young and totally naive at the time… I'm now wondering if they were paid twice. . once through the loan payments and then again when the house was sold, unless they removed the charge when the loan was paid up… I've no idea… erk!! Just updating this... have now involved FOS... they have just emailed to say that HSBC have contacted them to say that they do not hold any information and are asking if I have any proof by way of bank statements, etc... this is 30 years ago!! Also, I believe we had an HFC bank account at that time, so they are probably just trying to get out of it... The FOS has asked me to report back if I have any proof of payments but said they don't expect me to have these as it was so long ago... So... ball back to HSBC...(I notice they are in the papers again for their involvement in some financial scandal)... Will be back again as soon as I hear any more. TB

  13. But won't the companies involved just say they only keep 6 years worth of data and refuse to supply you with details of anything that's really old? I mean, why would they give you this info if they don't need to keep old agreements.. . I bet they are all clearing out their archives like mad... TB PS CPP are very good... just write to them with the policy number and they will reimburse you... you don't need a SAR:-D
  14. Do you have to agree to an extension... can you refuse it if they have not met the deadline for producing documents? They are not allowed an unlimited amount of time, surely? TB

Finding this thread really difficult to understand.. . if it's a joint debt on a joint mortgage, then you have a charge on your property, rather than a form K restriction, (where the non debtor is entitled to 50% of any equity after the property is sold...) Are you and your partner paying equal amounts towards the mortgage? You say the OFS was in 2008... what has happened since then? Did the creditors not follow through with their threat? You can't turn joint ownership into tenants in common retrospectively as you say your partner has done, although I believe once a charge is placed on a jointly owned property, the status automatically changes to tenants in common when the charge is made final. What your partner has done is unlawful.. ..it was a joint debt which he has defaulted on and by his actions he seeks to increase his own share of any equity whilst depriving you of your 50%... I believe repossession is better than an OFS as your lender will return any equity to you rather than to your creditors.... TB
  17. Yes... been TPS for years and get so many cold calls, both on landline and mobile... is there a way to block numbers? Of course, many don't leave a number...It's really annoying, though! TB

I think the benefits system is too complicated… it must be dreadful for people who work on a freelance basis, as they may only have a small handful of jobs per year and every time they inform of this, their benefit gets stopped and then they have to re apply, etc… It would be much easier if they could review a person's income annually and deduct any benefits to which the person was not entitled. This way, there would be continuity of income and debts could be paid.. TB
  20. I think solicitors are guilty of drawing things out in order to make more money… They don't care if you win or lose. TB
