Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

 

I received the below letter a few days ago and

 

 

wondering what to do about it?

 

 

I was in debt a few years ago when married to my ex with credit cards

and as far as I was concerned its all now been cleared.

 

 

This letter came out of the blue,

 

 

I have remarried and changed my name 18 months ago and moved house 3 times in the last 5 years,

 

 

I don't want to ring them, do I just ignore it?

Don't assume it is actually your debt either. Although this is a natural thought process, they will have written to every Chris**UK that they could find in the address book. It could very well be nothing to do with you at all.

 

If they really do think they have a match with you then they will write with an account number, sum outstanding and demand for payment. Only then should you think about doing anything more than checking your credit file.

How interesting as its against the law to open mail not addresed to you.

 

The letter was fully addressed correctly so the DCA is not making the Op break the law.

 

The DCA has sent these letters to everyone with the same name as the Op both in the local area and beyond in the hope that one will be intimidated into paying.

 

The DCA has usual will put all the other letters down to either a computer or administrative error.

They have POSSIBLY address it right. My FIL is a RM area Manager and has informed us that even if the letter is addressed to us but we dont recognise the address then return it to sender.

Chris was talking as a recipient of mail not as postwoman. The law is Postal Services Act 2000 s.84(3). Nowt to do with O S A.

As regards Clarity, I would ignore as they have no powers.

Their largest "client" is Arrow Global who, of course, buy more debts in value terms, than any other ****. When Arrow are coming on heavy, they call out their solicitors, not DCAs, eg Restons, Shoosmiths, Wilkin Chapman. You're not at that stage yet, Chris.

I agree oleg, there is some flawed advice being given here, if a letter has your name and address, why would you not open it and read it to say return to sender if one does not recognise a sender is rather odd.

Actually under the old RM they were classed as Govermemt contractors. Most of the posties stayed on. I no when my partners dad uncle 4 cousins and quiet a few other ppl started working for RM they were under the goverment ownership, please remember l have been with my partner for 12 yrs, anyway under the official secrets act of 1989 anyone who is a goverment official and carries out as part of their job any sensative docs has to sign the secrets act. Also under a FOI request before the sell of section 31 of contracts clearly says they have been made aware, it states my attention has been drawn to, to OSA and lists a few subsections o f further info. I will copy it in later as its on my hard driveinstead of my tablet

Chris created this thread to ask what to do about fishing mail from Clarity [or lack of, in this case]

and the question arose whether one could legally open mail addressed to someone else.

 

I don't think it's helpful to bang on about postmen signing O S A or any other act now, in the past or in the future. It's totally irrelevant.

 

btw Chris I had a strange encounter with Clarity.

 

They sent me a letter saying they'd like to "help" me by way of a 30% discount. No threats warnings, just an offer to "help".

I almost broke my strict rule of non-engagement to write and ask whether they were a charity.

 

That was their one and only letter to me.

 

Maybe no more relevance to your question than the O S A other than to give you an inkling perhaps of what a Mickey Mouse outfit they seem to be.

Hi all

Thanks for all the replies,

 

I checked my credit file, nothing on it,

 

but now I have had another strange letter from Arrow stating an outstanding amount of £927 from a mail order company in 1998,

in which Arrow took over in 2011 has been transferred to Clarity,

 

I have no idea who they are or what they are talking about,

 

I have never had any correspondence with these people, and

 

I honestly cannot remember having an account with 'shop direct mail order' but as it was 16 years ago

maybe my memory doesn't serve me too well, not sure what to do next really, ignoring them feels the best option ;)

Ignore it. Something that long is very likely to be SB. Especially if youve never heard of it before. I wouldnt even waste the money on a 2nd class stamp with a prove it letter.

Sounds like a shop direct company eg littlewoods or something. Think they had Gus and Littlewoods at the time as my Auntie had one

If it is not on the CRA files, it is likely to Statute Barred, personally a I would send a CCA Request to Clarity £1.00 statutory fee Use a Postal Order Marked for Statutory Fee only) Clarity have 12 + 2 Working Days to Comply, get free proof of posting.

I wouldnt even waste the money on a CCA request. It's very likely to be SB. I'd just wait and see what they do next, if anything.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
