So wierd - can anyone help.

Police have been told by someone I was in a hit and run (I have not been in any accident, I don't even have any speeding points).

They simply don't believe me and say their is inconsistency's on my part (I'm not part of MI5 just a normal working mum who does not document every hour of every day).

I'm fully insured so if I ever was in an accident it's not a big deal to me.

Can anyone help- they have basically harassed me for 9 months and said yesterday they are going to summons me for - driving awat from an accident and attempting to pervert the course of justice AND not assisting a PC. All becasue I complained about the PC's attitude when speaking to.

I honestly have not been in any accident. I think it is either a huge error or someone who dislikes me falsely reporting me.

I would suggest you get a report on your vehicles

Condition from a vehicle engineer. Should prob cost ~£50. That would prove there had been no accident damage to the vehicle or any accident repairs done. E.g. Fresh paint. Panels. Glass. Etc.

If he has no evidence to support his accusation, then he wont get far in court. It sounds like he's made a mistake, wont admit it and is trying to push it as far as he can.

It's so weird. He say's its an allegation made against me - but will not tell me who or originally what the offense was. At first I got a letter saying - you have been showing disrespect to other road users! Then when I say I have not it has now become (9 months later) a road collision with a moving vehicle that I fled.

I've tried to complain to the police but they will not accept a complaint whist an investigation is ongoing. The only truth I know is I have not been in any car accident.

Like I said, and its just my opinion. It looks like hes messed up and is trying to cover his tracks.

 

Perhaps get in touch with his sergeant or chief superintendent and force them to give you the full story.

You should inform your local MP of what is happening and see if they would be willing to write to the Police to ask them to account for their actions.

We could do with some help from you.

Have you checked your car for any damage, even slight?

Once a friend of mine left his car parked in london and another car hit his front metal bumper (it's a 4x4).

My friend never realised but was then contacted by police two months later with allegations that he had rear ended this car and left the scene.

They didn't prosecute eventually because of lack of evidence.

The same thing could have happened to you: someone hits your car, the go away, then they realise their car is badly damaged and make false allegations.

It is unlikely it will go to court without evidence.

My car is perfect and this is why I'm so confused. I think it must be a fake report or an error in some way. The things that concern me are the initial letter asking for driver details (which is now over 10 months old) never refered to a RTA or collision of any sort.. It is only on my most recent visit to the station to try and resolve this an actual car accident was mentioned.

I find that odd.

The police don't want to tell me anymore. I feel like they think I have done it and they are just questioning and questioning me about my whereabouts to try and trip me up. As if me not having an aliby makes me guilty. Totally bizarre. I said I don't think I need to prove my innocence and guess what - I think me not being all meek and mild might have made them more determined in a malicious way to get me. I have to stress I have not been in an accident because their behaviour makes you seem guilty. I'm 37 with 10 years no claims a car accident wouldn't be an issue to be - but being harrassed for one I have not been in is very stressful.

If it was me, i would get those complaints rolling and also get a full mechanics report on your vehicle.

I do actually. That's a another good point.

I've just read that if the police prosecute you maliciously and they subsequently fail in the prosecution (ie no basis) you have the right to sue them.

I don't want this stress but I'm thinking I might get a solicitor to write to them regarding this and just state my position. I don't want to antagonise them but I feel like this thing is hanging over me either way.

The police cant prosecute. Only the CPS can, and only if its in the public interest. A random policeman cant take you to criminal court. They simply dont have the authority to do so.

I also would not tell your insurance either as regards legal cover as they will simply ramp up your insurance for the next five years whether you have an at fault accident or not in your case. A friendly local solicitor may take this on on a pro bono basis.

Yes ok. Thanks. don't mind paying a bit for a solicitor but I can't pay thousands.

Since when in this country did we become guilty till proved innocence. I thought it was the other way round!

I've submitted a data access request to find out who falsely reported me but they refused it on the grounds that they are investigating a matter. Kafka esq or what.

And if they say "Will you accept a caution", say no, you have nothing to be cautioned for. A caution is almost as bad as a conviction with fingerprints and dna samples being taken and stored.

i would suggest either the informant got the reg wrong or your plate has been cloned. The former is most likely. Your police constabulary will have a specialist team dealing with motoring issues so ask to speak to them. if the shirty pc is one of the "black rats" then you need to raise a complaint with the chief constable's office. If it is an ordinary pc then going to the specialist team should be all that is necessary

It sounds like Fraud to me.

 

But why or how? I've gone round my street and there are 2 other cars my make and colour. I did wonder if it was a mix up - someone maybe had an accident didn't take a reg then came back to street and looked for that type car.

Or just a neighbour hates me? Who knows. How can I knew if I don't know who reported and what it any damage is being suggested to have been done.

I'll raise this again as I have suggested this as I have around this time put a private plate on I was given as a gift. Police simply dismissed it. But I'll raise again. I'm not sure how I could prove that - I would have expected some other things to rise like parking tickets if it was real plate fraud but maybe not.

I made this mistake with something unrelated that I was being accused of, but hadn't done. I was told "If you don't accept the caution you will go to prison". I never had been in trouble before, and accepted it just to make the mess go away. Completely the worst mistake I have ever made.
