    • Hi dx, the only secured debt we have is the mortgage on our property and that is a joint mortgage.  all payments are up to date with a clean credit file albeit with a of debt so no missed payments etc sorry what is f&fs? If I am made redundant I am not wasting it on paying all this unsecured debt down and leaving my family broke. This is the dilemma I am currently in. i am not sure I can mentally keep living the way I am I am weighing up how to deal with it without leading to needless ccj threats etc… not sure what direction I am to go in. Hi uncle, okay but 3-6 years of a bank owning my debt means our files are destroyed for longer than 10 years based on that ? Not sure this works out for us that way? Unless I am misunderstanding you
    • How are you funding the privately run supported living housing in the new city ?  Why are you moving? Have you served in armed forces previously? If you are registered with the existing Council as disabled or have other needs they assist with, then depending on the reasons for needing to move, your current Council may help with costs of moving. But you would have to submit an application to them. So you are best to speak to your current council about the help you are seeking.  It is not about a Council being responsible as I don't think there are specific laws saying a Council has to help with costs of transportation. And in regard to Housing costs in new city, as this is going to be private, I don't think the Council will pay under Housing Benefits. You might have to claim Universal Credit, but UC might not cover the full cost as Housing is limited to Local Housing Allowance. Citizens Advice are generally worth contacting about complex Housing issues.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Parcelforce delivery driver complaining that my parcels were too heavy and asking me to carry them! I weigh 8 stone. Apparently they're only allowed to carry 30 kg and my cat litter weighed 30 kg and with the packing it was over. I didn't carry them as couldn't but have emailed Zooplus and they can sort it out with Parcelforce. Either they can pack it into 2 parcels or the drivers are supposed to carry it.

 

The whole reason I order in bulk online is because I can't carry them!

Yesterday, it was Martin Lewis thinking the result was sewn up, and not realising how out of touch lawlords tend to be (they have form on this worse luck)

 

Today it was monster trying to get me to do a survey when I was looking for a job. The same bloody survey I completed last month... (the same survey where I gave them a slagging)

To be honest when have court judges ever been in touch with how the rest of us live, or have any idea of the consequences of their judgments, I remember a highly publicised child rape case where the judge said the rapist wasnt wholly to blame as his 8yr old victim "lead him on"!!!!!!!!!! I really think that the sooner we recruit our judicial staff from all walks of life and not just Eton, Harrow etc the better.

Advice given is my opinion only, I am not a legal or financial expert (far from it).

Someone playing the racism card and telling bare faced lies just because they were caught breaking the law. They shouted verbal abuse, threats and physically assaulted the person that confronted them.

 

For some reason they think that making an allegation of racism would condone their actions. Fortunately the police think otherwise .........and excuses of' 'it's the first time I've done it' don't wash with them.

Companys who send out letters you dont want on Fridays so you get them Saturday and you cant ring them up and tell them to sod off untill Monday

or they email you at 5.33 on a friday night so you know they have have gone home and you are seething

Hmmm What made me wanna swear today... Your gonna love this one.

 

Gang of 4 or 5 hoodies stole the wheelybin from out front of our house (they do this to have a fire). I heard them take it. So, I followed them to the woods (just down the path at the side of my house!) most of them ran off, 2 of them stayed and grabbed sticks out of the woods and threatened me, so I walked back home, grabbed my German Sheppard and took a gentle stroll back. They weren't quite so in my face with my dog just, they were just yelling abuse, so I got my phone out and took a photo of them, one of them who had originally scarpered, shouts I'll set my dog on you, then out of the woods comes a Labrador/pit bull cross (it's a local stray that has been wandering the area all morning), it runs at me, sniffs me, sniffs my dog and follows me wagging it's tail as I wheeled the bin home. Now I'm in my house with this damn dog (it's a friendly little thing, but it's filthy!) and the police say all I can do is call the dog warden!

lol sooooooooooo you have 2 dogs now then!

 

This morning I filled the bath with warm water, dragged my smelly dog upstairs for her pre Christmas bath.Heaved her into the bath where she went rigid like a 2 year old, got her all wet and soapy with her special doggy shampoo, ignored tthe sulky looks, was washing her with one hand the other firmly placed on her back when the doorbell went! OOOOO for goodness sake. one wet soapy dog escaping from the bathroom and I just knew she was going to hide under something where I could not reach her! B*****d postman

2 dogs at the moment... and I think this other dog needs a bath :(

 

I spoke to the dog wardens out of hours contact, and I told him I'd give it the weekend to try to find the owners. (I'll put some posters up in the park and in the woods)
