      I've spoken with a number of others who have confirmed their issues MUST be from new leaks from lyca, not the october '23 leak. That the regulator is NOT on this is shameful

I couldn't have done any of this without you, genuinely.  I cannot afford to donate much right now, so please do not think the amount I have donated is in any way reflective of what I feel is right because it isn't. I don't have a million pounds to donate right now, nor will I ever most probably, but I do promise that when I am back on my feet a bit more, I will donate again x

      Sorry - Spoke to soon...    So great news!  - They should remove it in 28 days. Hopefully it should be enough to ward off any further issues with account closure etc  What you need to do is keep this letter and use it should any further account be closed from this further point. You can actually challenge it and provide the evidence - Should give the provider course to reconsider. May even beable to take it to your old bank etc     Also ask for confirmation from MCB that they will not be placing another CIFAS marker going forward to cover all bases.    Also one more thing,  - Please consider a donation when you get a chance Glad we could have been some help

      There has been a development Submitted the N225 application yesterday.   MCOL now states: A Bar has been put in place?? (Take it that means cannot enforce judgement) A defence has been filed with the court This has all happened on the 34 day, so a day late the defendant's submission.??? Options???   Please note that the defendant can still reply to your claim until the court has processed your request. If the defendant’s reply is late but arrives before or even on the same day as your request, it will have priority.

      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

There's been a curious development in connection with the CCTV, which is too delicate to post at the moment, but I do need to speak to someone if they have knowledge of CCTV and or video production.

If anyone out there has experience in that sort of area, could they pm me please and I'll explain?

The defendant's application relating to striking out and the police caution to be listed on the first open date, after 6 weeks, namely on 9th February 2010 at 11am.

So there we are, another delay.:-)

 

Life is somehow a little vacant now and still another 2 months to wait!:(

Hi everyone, sorry I haven't been around much for a while. I've had a touch of flu or something and to be honest there hasn't been a lot to report. The Police investigation is ongoing and no news there.

One small snippet I've just learned though is that Universal Security (remember them?) who went into voluntary liquidation mysteriously in July, are now trading again under a different name.

Ah, that sort of Company. Why am I not surprised! Perhaps a spot of digging via Companies House might be interesting, to see who is now running the Phoenix Company!

WOW - What a tale. I have just finished reading this 'cover-to-cover' and i really am gobsmacked at some of the claims and revelations through out the whole story.

 

I am hoping that Fred and Patma get the justice they so obviously deserve. I doubt i could have gone through all of this. I also hope that the likes of LD and PCAD - or at least the individuals responsible - get everything they deserve.

 

I would also like to pass on my compliments and best wishes to everyone who has helped Fred and Patma with advice and assistance, it gives you a good feeling to know that there are total strangers who are prepared to put themselves out to help somebody they dont know let alone have never met. I feel that special mention should go to TLD - fantastic support. I notice that he / she has been very quiet recently, has anybody heard from him / her?

 

When i read the 'secret' of there being no caution, i actually punched the air and muttered 'Yes!':oops:

 

I do hope that Fred and Patma and their families can now put this out of their minds for now and have a good Christmas and i truly hope a successful ;) New Year.

This case case seems to have gone on longer than the OFt v Banks...with just as many twists.

Just one quick question.

 

How long does it take the police to "investigate" their involvement?

 

They moan constantly that they waste their time on paperwork and yet they don't seem to be able to find any relating to this?

 

If you happen to see Santa on your travels Patma, tell him that all involved in this case have not been good girls and boys this year!

You're sooooo right about all the wonderful help we've had with this case. What has been revealed on the thread is not the whole story of all the help we've had either. In fact there are unsung heroes in the background too who are being an enormous help.

 

Yes, TLD does deserve a very special mention. I don't know what has happened to him, but I very much hope all is well with him and that maybe one day he'll be back.

I'm very grateful to everyone who's taken the time to read and comment on this thread and for all the many of you who've come up with some really excellent ideas and support.:D:D You're all stars, thankyou:D;)
