  1. Hi All, I have red though several of the threads but still I need some clear advice. Today I received a Removal Visit letter from Collectica in regards to a Unpaid Magistrates Fine, with the client name simply as HMCTS London NW. Now I have no idea what this fine could be for since I don't drive, don't own a car, have a valid TV license and nothing outstanding as such. Now I live on the South Coast so also confused as to the HMCTS London being involved. The amount they are after is £984 sound exceptionally high for a court fine, but I may be wrong... Now my real question is how do I discover the source of this fine so that I can resolve it. Or at least start the process of getting it resolved. The letter from Collectica "states" that it is a final notice and that no further arrangements are acceptable. I am stressed over this as I don't know what it relates to. But they have my name right (most get it wrong!) as well as the address. If you can help point me in the right direction I will appreciate it.
  2. Hi, This evening an open (not in envelope) Removal Notice from Marston was pushed under my door (I live in a block of flats). Its says 'despite previous visits and notices this matter has not been settled... .' Its for a claim of £635. The client is illegible something like Knots, Avon & Somerset. I have never heard from these people and have not received any notices from any Court. I am sick with worry and would greatly value your advice. I am a 62yo single woman on Housing Benefits and who works in a supermarket 2 days a week. I have no car, no tv or any assets or savings. There is a name and contact number on the notice but I'm scared of contacting him. Please help?
  3. Hello, I went on Friday 23rd Of May to a beauty retail to buy hair removal sessions. The woman done a patch test on me and we took appointment for the week after. She ask me to pay on the front and ask by cash. I paid £210. After few hours I started being red where she've done the test. I went to a boots store they say I have an llergy reaction, gave me a cream and this is it. I went back to the beauty store on Tuesday 27th explaining that I can not do the treatment I had a reaction and if I coud get my money back. The lady told me to come back the next day to deal with the person who has done my test. I came back the next day and the lady who has done the patch ask me if she could do an other patch test which I refused and said I have to call the week after and ask for the manager cause she was on holidays. Question is How long they can keep my money?? and Do they have to give me my money back or can they offer me a voucher? Am I gonna see my money back to my account??
  4. I am thinking of applying for a mortgage this year, so thought it would be good practice to check the old credit file. I found that a default had been lodged on my Call Credit file for £5,650.00 by "Barclays Partner Finance" ( default date has been set at 11/05/2011 ) when I am sure they have changed the date of default forward, as I defaulted on that loan way back in 2008. But on top of that, they forwarded that same debt onto a Debt Collecting agency called "CapQuest Investments Ltd" who have set their own default for the debt - Date 31/12/2009 amount £5,961.00. I am not sure if this debt has been sold on to CapQuest, or if they are just acting for Barclays Partner Finance, but in any case, is it legal to lodge 2 defaults for one debt? The default lodged by CapQuest, is on all 3 credit reference agencys, but the default lodged by Barclays Partner Finance, h as only been put on Call Credit, either way, my chances of getting a mortgage with even one default is remote I think? I just need to know what the best way forward is going to be for me? I have read somewhere on the forum, that people have managed to negotiate with the Debt Collection Agencys to remove the default by paying off the debt in a lump sum, and if this is possible, then would I be right in saying that, Both companies would have to remove the default, if the original company holding the debt agrees to remove their default?   5. I have been at university for the last 3 years but after calling Marston Bailiffs apparently I owe £575 to HMCTS North East London Magistrates for TV Licence. I dnt even own the property or own my TV?! I have called the debt company who advised me to call the magistrates. But I just need advice on how to possibly over-turn this. I had no knowledge of this debt till today and yet it dates back to November 2011? Thank you for your help. Eman.

Hiya all, A few months ago I came to the realisation that a number of loans/ credit cards had been set up in my name Now first things first I should have been checking my credit file and never done that before until I got a letter from a debt collection agency ( at my new address ) contacting me to say that a default has been issued against me for a credit card company ( Santander ) - now I have never ever had a credit card in my life I have checked my credit file and have noticed amongst a lot of applications 9 similar successes for different companies I have written to the companies advising these were fraudulent and have had responses from some of them and have got a police ref number from Action Fraud My question is how do I get these removed from my credit file? Do I write to the credit file companies advising or to the original companies to get them removed? Is there a timescale in doing this? Many thanks

I am after some help and advice on a default I have recently found on my credit file. here's the story(have posted before about disappearing account) I had a bank account with Lloyds for a long time, also had there credit card, overdraft and savings account. everything was going fine until some time ago when my debts got to a stage where I was paying out more then I was earning ,so something had to be done. I sent off a token payment letter asking for six months to sort my finances out on credit card, was refused but started to pay token payment anyway. This was then defaulted after about six months but I still continued with token payment for a couple of years.(this is now being dealt with). During this time I moved accounts so Lloyds couldn't take all my wages to pay off credit card. my current account was going over the agreed limit every month due to the account charge and interest, I set up a standing order from my new account to make sure there was a payment every month to cover this as I wanted to keep the perks of the account i was paying for and I was using.(insurance, AA etc;). A couple of years ago I had to move house and phoned Lloyds credit card services and told them of this, I was told that I do not need to phone anyone else in Lloyds as there systems would update all accounts. After about 8 months I moved back to my previous address and again phoned Lloyds credit card and advised them. When the changes occurred with Lloyds my bank was one that was going to become a TSB, so on the day of the change i checked my online account and although the savings account was there , it showed no current account.(post under tsb forum). i contacted a Lloyds branch and was told it was nothing to do with them. i contacted a TSB branch and was told it is owed to Lloyds so speak to them. A couple of months latter i checked my credit report and it showed that the account has now defaulted and it mentioned that " i had gone away". i received no letters form Lloyds or tsb regarding this, i believe that all letters were sent to the address i stayed at for about 8 months, but i gave them my new address straight away. so i believe although Lloyds had my new address(noddle account showed cc debt at one address, current acc at another) they sent letters to the old address then defaulted the account , gave me false information as to who i need to speak to about this(recently received letter from Lloyds regarding this debt being collected by there DCA) to punish me for the credit card default. is there anyway i can challenge this?   8. Hi an (alleged) default was added to my file July 2008. I settled debt December 2008 but lender refused to remove data from my credit file. Does anyone here know if the toxic data will come off this July or December? Thanks for looking and thanks in advance for any help
  9. I was hoping to get some help with an old Welcome debt which was apparently bought by MKRR in 2010, I took out a £2000 loan in September 2007 and unfortunately only managed 2 payments. Welcome appeared on my credit file until recently but all payments recorded are not accurate it says I started paying in May 2007 with first late payment in July 2007 this before I even took the loan out.History also shows as various late payments of between 1 and 6 months from July 2007 to October 2009, I have definitely made no payment or contact since October 2007, I am 100% sure of that as I lost my job at that time amongst other things. In December 2009 the account shows at satisfied (no defaults) and then in January 2010 MKRR recorded it as a default. I have received varying letters from MKRR, Willen, Raven Recoveries and Keynes Collections since 2010, the most recent from Keynes looking very official with a notice of intended legal action in 14 days for the sum of £6,000. I have been looking through some of the other experiences on here and it seems that this has happened to quite a few people, some advice is to ignore as it’s statute barred but others advise to make contact in writing I want the default removed but didn’t want to make contact with mkrr without some advice first also if they wrongly believe that they have a judgement claim I want to try and stop action before I have to deal with the courts. Any help and next steps would be greatly appreciated.
  10. My final CCJ turns 6 today, Happy Birthday Equifax removed it last weekend But it remains on Callcredit and Experian Does anybody know how long it takes CRAs to remove it?
  11. Sometime ago I requested clarification regarding the removal of courtesy telephones for claimants within the JCP'S. My local MP addressed this question to IDS, now some months later I received a copy of the letter sent to my MP clarifying the situation. This is the response below. Dear John Thank you for your letter of 11 November 2013 on behalf of one of your constituents regarding the withdrawal of Customer Access Phones from the Jobcentres. I apologise for the delay in replying. There is an intention to commence the removal of the phones from the (my home town JCP) from April 2014. Research has shown that the main use for the phones is for benefit enquiries, usually concerning when a claimant is due to receive their payment. The purpose of the Digital Jobcentre project is to introduce further Web Access Devices that claimants can use for both benefit enquiries and job searches. In addition to this, there is also an assisted service available in all Jobcentres where vulnerable claimants who need to use a telephone can do so at a specific desk. I hope my reply will reassure your constituent that when the Customer Phones are removed the replacement devices will ensure the service we provide our claimants is enhanced and not compromised.   12. Hello All I am not going to go into details as my story would be extremely long. Anyway, i have received a CCJ (Down to a dodgy company lying). It has just been added to my Credit File with a judgment date of 16/01/2014. If i pay the full amount before the 16/02/2014 will it be removed from my credit file? I have read this somewhere but not sure whether it was true.
  13. Hi Guys, I have one late payment marker from Barclaycard from 3 years ago which I have been told may affect my chances of getting a mortgage in the near future. This is the only late payment I have on my Credit Report in the past 5 years so would like to try and get it taken off if possible. I think the payment was literally 3 days late due to a banking error on my behalf but it is still there either way! I do have some other marks on my credit report which are 5+ years old but they are due to drop off after this year so aren't such an issue. I was just wondering if any of you guys have seen or had any success with getting things like this amended by BC with a good will letter and if so could advise on what is the best way to go about it?   14. Hi I was pointed in the direction of your website and it has been very helpful. I am looking for advice, rather urgently, since i came home from work yesterday, to find a 24 hour removal notice through my door. This was a shock as the last contact i had with jacobs was back in aug 2013, the account was put on hold as i disputed it ( bit of a lon winded reason why, but it was a back dated change a few months after i left the property. I am a lone parent, working part time and my circumstances changed twice, propmpting all benefits to be recalculated, ending in this underpayment) Anyway, I do not have the funds, i have £30 in my bank account. The bailiff has never been into my house, nor, as far as i am aware, made any levy. I have not been given the chance to make any payment plan. ALl doors and windows are locked, burgler alarm is on, curtains closed and car parked a few streets away. I have text the bailiff on the letter, the following: I returned from work yesterday to find a 24 hours removal notice from yourselves. I am quite surprised by this as i have had no correspondance from you since august 2013 where my claim was disputed and put on hold. I do not believe this to be in line with policy and will be making a formal complaint to the council on monday. I al requesting that my account be handed back to the council under the protection of vunerable people act, so my income can be assesed to enable me to make weekly payments. Thirdly, since noone from jacobs has ever entered my property and no levy has been applied, no goods will be being removed. Please provide me will a full break down of ' costs' as detailed on your letter. I shall be emailing a copy of this to your office and to the council. Is that ok? I shall be speaking to the council on monday, but there isnt much i can do before then. And although my house is all locked, im pretty terrified. Can anyone offer any guidance, help. reassurance?
  15. I have two PCN's from the local council, which apparently have been handed over to a company named EQUITA which keep sending me threatening letters concerning removal of my car and other goods. This has been ongoing for a while now. The notices are being sent to my old address, and according to the letters, the bailiffs have been to my (previous) address on numerous occasions to remove the car! Today I received a letter with "BAILIFF REMOVAL" printed in red ink and large letters and asking me to contact them (on an 0870 number!) and make arrangements to pay this debt now. I have not been able to pay the fines off because of unemployment over the last two years. However, I am in a position to pay the fines now; but I do not want to pay all the excessive bailiff fees that these agencies add on! My questions are: 1. Can I make payment without giving out my new address? 2. I have not changed my address with the DVLA, but am planning to send the form out tomorrow. ( Four months late! :-/) Will this have any backlash? 3. The bailiffs notices do not indicate how much I owe (except one which has a little red box at the bottom left corner stating "You must pay: £95.44") 4. When I call them, am I required by law to disclose my new address? 5. I've read about others in my situation filing a ?Statutory Declaration and ?Witness action. How do I do this? How much does this cost? What are my chances if I pursue this route? Thank you for your replies. Sorry for the long post!

This adress is council property and my wife main tenant owner solely. me and 3 children live too. But house in wife name. I got court writ nearly 29,000 from a claim that was friend name. friend was man driver i was passsenger, we got hit and claimed. but court struck t off. now i need to pay court costs everything and not my friend. Why? but problem is everything in house my wife buyed. i buyed 2 bed only. Marston coming tomorow with removal guys. what should do? if Marston take anything, my marriage finish
  17. Hello everyone, Just what I needed the week before christmas! The council have a liability order for rates. I fell behind with payments as I haven't been paid for several months. The letter was posted through the letter box, so as soon as I saw it I called them. They said it had to be paid in full and to ring back with payment. I told them that I don't have it, he said they'd be back to take stuff and if they couldn't get anything they'd commence bankruptcy proceedings. He also said they finish on Friday and it would have to be sorted by then. I've tried to ring him again this morning but am getting voicemail. The debt is circa £600. I spoke to the council but they said there was nothing they can do. I don't dispute t, I just can't do anything about it right at this moment. I'm having a read through the forums, but could do with quick advice of what they can / can't do. Really worried that they'll turn up with a lorry and take our car or something.
  18. Hey everyone I hope i'm posting this in the right place as i'm new to the forum! Just a quick question really! I have recently payed off all of my debts (woohoo!) and I was wondering if anyone could shed any light on getting my CCJ removed. The judgement was made back in October 2010 and I have a letter off the debt collection company stating because I paid the debt off within one month of the date of judgement I can use this letter in support of my application to have the registration cancelled, but the problem is I have no idea of how to go about this. Can't seem to find any information on google either so any advice would be greatly appreciated! Thanks in advance for any help -Adam
  19. I have had a Barclays account from the age of 16 and I am now 23. In December 2012 I changed bank to Natwest and I had gone into my Barclays branch to change the account to a free one as I was on the current account plus paying £6.50 I believe. In February I changed address and I sent off the change of address form to get the address changed to my new one and Ive not used my Barclays account since until I decided to transfer money into it and the money was bouncing back. A week ago I tried logging into my Barclays online account and found my account had been closed II had around £10 in the account at the time of moving account as I moved the money too today I received an Experian notification to say a change had been made to my account and to my surprise it is a DEFAULT NOTIFICATION from Barclays for £27!!! I immediately went into the branch to sort this issue out and to cut a long story short I have been told that I need to call the debt collectors to pay the money and they will satisfy the account… I let them know that I had not even had any correspondence to say anything was wrong and then I find the address they have on file is my OLD address which is where all the correspondence had been going to. I have argued the fact that 1 the address should have been changed and 2 the money owed is because my account was in the minus for X amount of time yet it was because they kept on taking out the monthly amount for the current account plus when I should have even been on it in the first place when I made the change In December. Now I have just been advised to call a number which is in Manchester and let them know I am unhappy about the situation and go from there The way I see it is that I shouldn’t even owe any money to them in the first place and they are going around closing my account and issuing a default Can anything be done about this as I am supposed to be getting my mortgage in 2 months and I now have a default  I am panicking at the moment also because I have a baby on the way and this £27 default is going to ruin everything if I cant get it sorted in time. Help?
  20. Hi Guys, I'm new here so please bear with me if I appear to know next to nothing about this whole thing and please excuse if I'm asking a question already asked. I am currently trying to apply for a mortgage and it had thrown up a few problems, the first was a default registered against me by Lowell, I have now managed to have this removed as when I informed them that they made it clear there would be no default and that I have never received a default notice they were more than happy to oblige. Unfortunately my partner also has a default on her credit file placed on in July by Barclays Bank. This was due to an unpaid overdraft on a joint account with her ex partner. Over the past 11 months we have been trying to get him removed from the account so that we could pay it off and then she could continue to use the account without any worry of him getting to her money. She visited the branch twice in March/April and was told on both occasions that there was nothing she could do until HE contacted them and confirmed his request for removal. Despite trying via post phone and email we were unable to get hold of him. She called Barclays customer services on several occasions and was told that nothing would be done until he had contacted them. She then went into the branch again Sept and they advised her that the balance had been paid and the account closed, the member of staff in the branch even asked a second member of staff to come over and verify it which they did. Now she has had BCW call up and try to get the money off her and offer her settlement at 40% less than the original amount but also Barclays have registered a default against her. Now I have no problem paying Barclays the £1,700 but not unless they remove this default as at no point was she advised by post, phone or face to face that there was going to be a default registered. Had we have been notified then I would have paid the amount just to avoid it even though its not my debt to pay. Advice is much appreciated. Many Thanks Julian

Hi, I've seen this question raised many many many times on here over the years "How do I get a default removed?" - Well after some hard work I managed to get 2 defaults removed from my credit file this week and working on a third. So it is possible to get defaults removed and not just marked as SETTLED but completely removed. One company even removed the entire account. One of the defaults was on my account since 2009 and the Financial Ombudsman instructed it to be removed in a written judgement back in 2009. (This goes back to the forum post I made back then regarding a vehicle). Finally this week the finance company removed the default and showed the account clear. The second one was for a credit card I had never held. In May of 2013 I spoke with the DCA and asked them for proof, the DCA was unable to supply this information and confirmed "Your details was traced but we made a mistake" - Again default removed. The question I have now is.... because these defaults was on my credit file for all this time incorrectly, do I have any sort of claim against these companies?
  22. Hi all, I received a debt letter some months ago and sent the prove it letters I have never taken out those home collection loans as the APR's are horrendous. They have told me they have closed the account as they can't find the credit agreement after about two months of looking. I asked them will the debt be removed from my credit file and they sent me this: I can confirm that our letter dated the 18th September stated “At this time we have closed our file and will not make any further contact with you concerning payment against this account unless the copy of the agreement is received at some point in the future from XXXXXX." Therefore, the account could reopen should the agreement become available. However, as you have stated that you never applied for a XXXXXXX account I have passed this matter to our Fraud Team to investigate your concerns further. One of our advisors will contact you in due course." Is there anything I can do to get this removed as its hit my rating? I haven't had any contact from them since. Thanks
  23. Hello! I truly hope someone can give us some good advice on this situation. The current situation is that myself and my wife have been trying to get a 95% mortgage, which has been accepted but under a condition we can get a TMobile Default removed on my wifes credit. Up to this month we didn't ever know she had a default on her account so was a shock to see it on the credit report. The default is from 10/11/2011. Upon investigation with T-Mobile it appears the situation happened as follows: My wifes had a T-Mobile contract on her name but for her ex partner. When they split up she phoned up T-Mobile and advised she wanted to cancel the contract, but would require a PAC code so that her ex could take the number elsewhere. She was also advised she could cancel the direct debit as no further payments were needed.. At this point, the TMobile account was actually out of contract so there shouldnt of been any more fees. According to T-Mobile, on their records, at a later time they spoke to my wife and offered to move the contract to PAYG but she took the PAC code instead so her ex could take the number with her. After this happened shortly after she moved out of the property and she moved in with her friend. According to T-Mobile her ex didn't use the PAC code so apparently the contract continued which in turn caused the account to default. Apparently they sent letters but as she wasnt living there she had no way of knowing if they did sent letters, but according to her ex he doesnt remember seeing any and apparently he used the phone up to April that year. As my wife was the account holder and cancelled the account I dont see why the account was continued, especially as it was out of contract! According to experian the first charge was £30 and each month went up to £171 and then jumped back down to £91 before showing a default charge. We have sent letters to TMobile and have since paid off the £91 as we didn't know the full history. We have also now spoken in length to people there but they are unwilling to remove the default even though we feel that default is unjust. We are really upset as we have found the family home and we feel we may lose it if we dont secure the mortgage in the next week or 2. We would even be willing to pay a nominal charge to get the default removed if it would help. With the above information in mind, do we have a chance of getting the default removed? Should a contract continue if a PAC code isn't taken? Many Thanks and sorry for the wall of text! Terry
  24. Hi guys, Back in 2009 I defaulted on my Capital One account. It only had a limit of £100 but back in those days I used to pay it off in full each month. However, my hours were cut and so I started making smaller repayments. However, interest and charges sent the account overlimit and then overlimit fees + charges + interest led to the account falling into default. A short time later I paid off the debt in full (£192) and thought no more of it. However, reading this forum I have come to the belief that the default was solely to blame on the inclusion of charges & interest. So I have decided to look into this further. I posted a SAR to C1 Nottingham on 08/10/13 but checking the tracking number it says that the post is still working through their system. Is this normal? The address was to a PO Box in Nottingham... I'll update further to this initial enquiry when I have more details, but do you good folks think this has any legs?
  25. Hello, Firstly thanks for anyone taking the time to read this and offer any advice. About half an hour ago, a bailiff from Marston turned up at my door and handed a letter to my uncle, addressed to me. My uncle told them that I was not in. The letter is a removal notice, stating that they want 633.30 or they will come to my address and remove my goods. The debt is for an unpaid magistrates court fine for an unpaid train fare (Yes, I am a complete idiot). I have no idea what to do about this. The house belongs to my parents and I live here with my brother, mum and dad. My parents are on holiday at the moment and will return on Saturday. I can't get to the citizens advice bureau until Monday. Are they allowed to come in and take the things that do not belong to me? All I own is a computer and a TV. I'm very very scared right now and don't know what to do. If anyone could guide me in the general direction of the best course of action, I will highly appreciate it.
