  1. I sent my van to be repaired at a local garage and he has sent a bill that is almost double the dealer quote. They have done no extra work and are quite clearly trying to rip me off. When I've disputed the bill they've said they are placing a lien and charging storage until I pay. the storage charges are hidden in the garages t&c on the website which I didn't no existed until he sent the storage bill. I understand I should pay under protest then reclaim but I've found out the owner is bankrupt and the garage is I liquidation therefore I'm reluctant to pay the full amount as there's little chance I would get any money returned if I took the matter to small claims court and won. Could I pay him the amount I think is right ie the amount the dealer quoted and then issue proceedings for release of the vehicle ??? Any help great fully received
  2. Hi all, I hope someone can help me with some advice. I lived in the UK for 8 years with my English husband. Then our relationship went sour, he moved out of our joint mortgaged property, leaving me to pay all the bills (such as the mortgage) which I couldn't. The house is now being sold but with a huge shortfall (£30k) and I have some smaller debts which are in my name because he was unemployed (credit card £1900, personal loan £1200). First there was talk of voluntarily handing back the property to the mortgage company because of arrears so to avoid being homeless I moved back to the Netherlands where I'm from (moved in with my mother in January 2013). My husband is now saying that he will declare himself bankrupt and leave me with the joint debt (which is the shortfall on the mortgage). I don't see how I can pay back the debts (unemployed) and find it unfair that I will be solely responsible (but understand that's just how it is). I am now also considering bankruptcy but want to do that in the UK where my only debts are. I understand that I will have to move back to the UK for at least 3 months plus 1 day to show that my 'centre of main interest' is in the UK before I can declare bankruptcy which is fine. I can rent a room and find some kind of job. Alternatively, someone suggested that since I still have a house in the UK, I wouldn't need to!? I could just go the local court and apply for bankruptcy. Do you need to prove to the Official Receiver that I've been living in the property? I do pay all the bills still such as council tax and home/content insurance. Will he need to see any bank statements to prove that I've been paying for food and such? How will the official receiver look at me moving back to the Netherlands after I've applied for bankruptcy and before it's been discharged? It will be pretty obvious that I moved to the UK just to declare myself bankrupt, right? But will the OR care??? I read that he might care if I have debts other than in UK and I moved to the UK to clear those foreign debts (to make use of easy UK bankruptcy laws). But these are UK debts only incurred whilst living in UK. I have a child that I'll leave with my mother but don't want to stay away for a year or more. I will remain in full contact with the OR when back in the Netherlands. I don't have assets in either country after the UK property has been sold and no debts in the Netherlands so it makes sense to be bankrupt in the UK only!? I have nothing to hide. I just don't want to be bankrupt in the Netherlands where it takes 6 years for a clean slate instead of 1 year. Sorry for the long story. Any advice would be MUCH appreciated!

  4. Hi Everyone, I come to you all in an hour of need as I am not sure where to take this from here. All of this related to my partner, and her ex husband. They split in 2008 and divorced a few years afterward. They had a house together when they split, this was in negative equity so they decided to rent out the house until it came out of negative equity. They also had a number of debts together that were consolidated and paid through a debt management service. When they divorced an agreement was put forth via solicitors that formalised the agreement that was already verbal. My partner would pay her ex half of the cost of the debt management service, and she would pay half of the cost of the shortfall that was present because the tenant in their house did not cover all the mortgage with their rent. Her ex, as part of this agreement would pay off the mortgage and the debt management loan. We found out recently that he had not done this for up to a year. He'd taken the money my partner had been giving him, and instead of paying off the debt management service and the mortgage he spent the money on his own personal lifestyle. The first we heard about this was when he told us the house was in the process of being repossessed. He told us initially this was because the tenant wasn't paying. When we investigated further and checked all the places he should have been paying we found out the truth, and he admitted to it. He has subsequently told us in the next month or two he is going bankrupt. This is going to cascade on my partner and she is likely going to end up bankrupt too. My question lies in how I deal with this. I am unsure if what has happened here is something the police need to get involved in or something that needs to go to small claims court etc. Taking it to small claims court seems a bit fruitless as he is doing to declare bankrupt anyway. Any advice would be much appreciated.

Will try and make this as short as I can with as much information as possible so u can understand the back ground Basically me and my ex partner split 5 years ago we have 2 children together and were jointly buying a property together When we split she agreed to sell the house but as time passed the house didnt sell I got into a new relationship and my ex started playing games she then decided to take the house off the market and refused to sell it. After several visits to a solicitor it became clear I had no rights to make her sell the property as we had children living there. So its all been ok for 3 years untill I started getting letters to say she wasnt paying the mortgage, council tax was in arrearsi confronted her and she said she sorted the council tax and was in the middle of srting the mortgage. I then had baliffscome to my parents property to recover debtfor the council tax Well come to it now that the house has been repossessed and there will be a shortfall of about £40.000 between us. Im really concerned about this and feel through her games she has landed us in a right mess. I have a decent job earning about £2000 a month but feel im going to be paying this debt off for the next 15 years whuch will then take me to being 45 years old. I will then have no chance of being able to set up and buy my own home again Any advice would be greatfull

  7. Hi all, My friend has recently had his home repossesed and the sale went through two weeks ago. Another friend saw an ad in the paper that CAI Finance have now applied to make my friend bankrupt and citing the address of the property that was repossesed. The only debt other than Inland Revenue is for a Halifax credit card he stopped paying around a year ago. He believes there is around £3k on this Can he be made involuntarily bankrupt for an unsecured debt and for such a small amount? This all seems very coincidental given that he will soon be receiving some money from the sale of his home Should we call CAI or their solicitor to ask for a copy of the petition? I don't think he's too keen on giving the address of where he is renting a room as he doesn't want any hassle to the landlady The date for the court proceedings is at the end of the month so we have a little time. Its just lucky it was spotted! Thanks in advance
  8. Hi there Any advice would be appreciated. My husband and I are both self employed, work really hard and tried different business ventures that have failed - we are on the right paths now tough we feel. With a new child and two others & 2 businesses, we have seen ourselves slip into debt with credit cards and bank loans to the value of £32,000 (£8000 is a car loan and £4000 is a business loan). We rent out our house which we jointly own (on Interest only and we make a loss), and we rent ourselves in an area where there is more work for my husband. We have joint bank accounts, joint mortgage but we have our own credit cards. Can one or both of us go bankrupt? No idea where to go to for help to get all the details. If I do, will I just clear MY credit cards and will it affect my husband? If we both do, will they shut down our sole trader businesses - work so hard and still up like this. I see all these people better off on benefits and it make me so cross. Any help or direction would be appreciated
  9. I am so distressed and absolutely horrified on how these [edit] people got away so easily with this... devastating. On Monday I received a thick pack from The Insolvency Service informing me I was made bankrupt. I thought it was just another [problem], and read through it in disbelief... Slowly sinking in, I called the Official Receiver on the letter, and was confirmed. I just can't believe it... I called around, Citizens Advice Bureau, Legal Aid (for which I don't qualify because I'm a home owner), and others who said I'd have to make a couple of thousands available for legal costs alone. I also called Lowell to see what this debt was related to as the pack from the IS didn't have reference to the amount or original creditor. They jumped on me trying to get money through my wife making a payment and said the debt is for a Barclaycard, for £3,500, and they said they would settle for about £5000 because we need to pay costs... Outrageous. I have been avidly reading through threads on here, especially 42man thread below, which seems to be exactly like my case: Bankruptcy-Order-!!!-***-WON-TWICE-*** Re. Statutory demand: Apparently, I was served personally on 6 March this year, which I can't recollect at all. My wife and I run our business from home and we receive tons of post, every day, by Royal Mail and courier. We also have interns who would go and fetch the post, or answer the door when they are here. The building entrance is communal. We live on a second floor. We open everything personal. If I did get the SD, then I probably would have ignored it as a scare tactics if I didn't recognise the Creditor's name. Never heard of Lowell or Hamptons until I google them. Definitely not nice people!! The affidavit fits my description, though. But then, my picture is around the internet quite a lot if you Google my name... Re. Petition, they seem to have attempted a few times during August while we were away (from end of July to 1st week of September) house and dog-sitting for friends. Then the got a substituted service and they said it was posted by Recorded Delivery, but there's no proof of postage on the file and I certainly didn't get anything like that. It's gutting to be at this junction where everything has already been decided at my back and I have, so it seems, no chance to defend myself!!! I wonder if anyone can advice if there's any way I can get this bankruptcy annulled? Do I have any chance? Would greatly appreciate comments and help! I am worried about our home and finances are tight... I have 2 small children, and income is meagre at the moment as business is doing really badly with the downturn. Thank you all in advance!
  10. Hi everyone. Never used a forum before so please bear with me. In my mind I feel like my situation is the worst anyonecould ever hope to face...but I am trying to convince myself that this isn't the case. A few years ago I started a business that just didn't makeit. I borrowed £25,000 from a bank to start the business andafter the Company went into liquidation I was left with the bank loan. I went to the bank to try to discuss a revised loanagreement to spread the outstanding balance over a longer (and more affordable)timescale. After being told I did exactly the right thing in coming tothem for help, they subsequently froze all my accounts and demanded that I payback the total balance within a relatively short period. I had another self employed freelance business with abusiness account at the same bank at this account was also closedpreventing me from receiving payments from clients. Ultimately it had a negative effect on that business havingto inform clients to pay me personally into a newly opened cash account. The financial ombudsman, after granting the bank numerousextensions, simply replied that the bank had acted in accordance with its termsand conditions. My freelance business was only able to pay small amounts tothe bank and towards a £10,000 credit card debt. I rented out my home as I was then living with a girlfriendand after a reasonably short while I found myself out of work completely...andthen single and homeless. The tenants in my home started receiving lots of letters andknocks at the door and ultimately left. At that time I didn't know what to do and I felt like Ineeded to keep pushing for work to attempt any chance of surviving and settlingthe debts. I couldn't face the creditors and so didn't doanything. I moved into a bedsit without telling anyone andstarted to rebuild a small amount of work to survive. An opportunity to work in Italyarose with the possibility of making larger sums of money that I thought mightbe the key to paying back the debt. After 2 years there is no chance of that and I am nowabout to move back to Englandto live with my parents, wait 6 months and then declare myself bankrupt. I have no idea what the total level of debt is as I have hadno contact with creditors for about 3 years. I tried to have my accounts prepared by an accountant butwas unable to pay his bill and so these were never completed...about 3 yearsago. I'm pretty sure my home was repossessed although I cant findany evidence of this. I believe there are tenants in it now which Iassume is being handled by an agent acting on behalf of the mortgage company. 3 years later I am kicking myself for not going bankruptright there and then. I did exactly the wrong thing and I have been living in fearand constant worry for so long and I have now come to the conclusion that Icannot resolve it by just working. I have a job to go back to in Englandbut I am extremely worried about how to find out about my old bankaccount and re-contacting creditors for settlement figures etc because Iam really struggling to function with so much worry and stress. I need to be able to work and I have to try andfunction until this is all resolved which seems impossible but has to done. I have a bank account in Italyand a 5% equity stake in a small Italian Company which is still alive butbarely trading and doesn't really generate any profit. My home was in negative equity for about £10,000 beforeI left. I might owe about £4,000 in VAT. I have no idea if I have any CCJ's or whatever but I don'tthink any of the creditors have forced me into bankruptcy. It's time to face the music and sort it all out but I ambeside myself with worry. 12 hours sleep last WEEK! I would really prefer to have an insolvency practitioner orsomething/someone help me through the whole process because I justdon't have the strength or knowledge to be able untangle the mess. After 3 years, 2 countries and endless changes ofaddress I have very little information left about my state of affairs. Can anyone offer any advice about how best I should startthe process and alert me to the kind of procedures and penaltiesetc I am likely to face? I am not looking for sympathy - I know I did the wrong thingin not sorting this out 3 years ago. I prioritised survival first and thought I could sort it allout later...it's 10 times worse now.   11. Hi need some advice my Daughter some years ago got into financial problems due to a broken relationship. My Daughter and my self have a mortgage on the house we live in. she set up an Iva with dfh and is paying them £300 per month plus £30 for doing absolutely nothing and in fact most of her debts are still accruing interest so in the last 5 years of paying this her debt has gone up from a start of £12k to about £22k. I thought that when she took out the Iva the interest should have stopped. it has been suggested that she declares herself bankrupt but my only concern is would we have to sell the house because of this. Or would she be better of contacting her creditors herself and sorting out a payment plan with them. your advice would be most helpful as she is getting very distraught
  12. Hello, I am a new user. I hope someone can help as I have a court hearing early November. I stopped paying my Credit Cards middle of 2010 after I lost my job. I could not reach an agreement with the Credit Card companies to pay a smaller repayment until I find a new job. Few months later, I was getting letters and calls from different Debt Collection Agencies. I ignored their letters and phone calls till they stopped. Earlier this year, a man came to my door and asked of me. My brother opened the door as I was not in as he was here on holiday from abroad. He asked the man who he was and which company he was from. As the man appeared suspicious and was evasive with his reply, he refused to confirm my name when he was asked and the man asked him to take a letter from him. He refused to do so and he throw it through the door and said he was served, thinking he was me. I usually do not open the letters and return them back to the senders. But I received a letter from the County Court. This I found out because it had the County Court address on the envelope and opened it to find out that I have been declared Bankrupt in my absence. Apparently, this was the second time the hearing took place which I failed to attend. To my surprise, the only time I got a letter from the Court was when I found out that I have been declared bankrupt. There was no letter from the Court to attend the first and the second hearing. There was no way I could have missed the letter if it was addressed like the only one I got, which had the Court's address on it. I found out from this website to contact the Court immediately and apply for a stay of proceeding and advertisement. I also said that I was not aware of the Court hearing or having any knowledge of owing the company that has filed bankruptcy against me any money. The Court has granted another day for the hearing early November. I sent 2 recorded delivery letters to the company. One of the letter I sent with £1 postal order giving them 7 days to provide original copy of the Credit Card Agreement. I have received a reply saying that they have requested it from the original Creditor. Another letter (SAR) I sent with £10 postal order requesting full information about the debt (used a template I copied from this website). I have received a reply saying that they can only provide evidence of purchase of the debt and any communication they have with me, but that I need to contact the original Creditor for earlier documents. Two things I will like to mention: 1. The original creditor was xxx Card which I signed the agreement with. It was later taken over by xxxxxxxcard when xxx Card pulled out and no longer providing Credit Card facility. 2. The Credit Card number on the Court paper is different from the number of the card I stopped paying. The only similarity is the first 4 digits, everything else is different. 3. I did not receive any letter from xxxxxxxxxxx that the debit has been sold to the company that took me to Court. Can anyone advise on how I should prepare my defense for the Court appearance. Should I send SAR to xxxxxxxxxxx request for a copy of the original credit agreement, even though I know that all the previous bills I still hold do not match the card number on the Court paper. I am worried they might contact the company that took me to court and inform them of my possible defense. Please help anyone. Thank you.
  13. hi all, i have for a while been collecting my debt letters so i know what and who i owe and to my shock its around £16000, i had a telephone interview with CCCS they were helpful and sent me a folder out with a list of my debts that they could see on my credit file and what i told them from letters i had they also sent out my income and outgoing and explaining why going bankrupt is what i need to do, i basically have about £30 a week spare as it goes, makes me wonder why i work sometimes but id rather work than not. once i find £700 i will go bankrupt but for now should i not send a letter to all my debts stating i am going to go bankrupt but for now make a payment to them like £1 a week as i owe to about 14 different people so i cant afford to much per week or month? i am still struggling with how to make a start on this but really want to get this done and get the ball rolling with dealing with this debt and to let my debt people know i am aware i owe money and i am not wanting to ignore it but i cant afford lump sums or weekly amounts they would like. any help or advice would be appreciated thanks.
  14. Hello everybody, great forum. Im a newbie here so im sorry if this is in the wrong place. I have a potential serious problem. In August 2012, I purchased an Audi Q7 from a privateindividual from Derby. The car was advertised on Autotrader and EBay. I won thecar on eBay and went down to check it out. Everything checked out ok, the HPIreport was clean. I made arrangements to come and collect the car the followingweekend, when I had time to tax and insure the car for the way home. There was nothing wrong with the car and I paid £20,000 forit Cash. The seller requested CASH, I tried to pay by bank transfer or Bankers chequebut he refused. I have all the car details Inc all documents and a receipt fromthe registered owner at his home. I’ve had the car nearly 3 months no problem. Until today I receiveda letter from the BIS Criminal Investigators (Department for Business and innovationand skills) who are wanting to know the circumstances of how I obtained thevehicle. I have telephoned the previous owner and he started cryingon the phone. He stated that he actually went bankrupt in April 2012, some 4months before I bought the car. He has stated that he told the Official Receiverthat he disposed of the car in NOVEMBER 2011 to a garage, which he has admittedto me, was a lie. He then admitted to trying to pull a fast one with thereceiver and begged me not to tell the investigator how or when I bought it,especially what I paid for it. He stated he would go to Jail. Im very worried now as to who is going to come knocking atmy door to take my only car away. I have 3 children under the age of 7 and it’s our only car.My wife uses the car everyday for work and her work employer has said if she losesher car she loses her job! I also can’t take my kids to nursery in my van! We had to take a £20,000 loan out to buy the car from afamily member, we’ve spent £4,000 on extras on it upgrading it and simply can’tafford to lose our money, not to mention buy another car. Come anybody please tell me what to do or what my optionsare? This is so confusing!
  15. My first post so hello there people! I need some help as i am about to suffer from depression! I need information regarding people living with you and wanting to go bankrupt. Long story so bare with me. Me and my partner moved in with the inlaw so we can save up, get married and move out with the intention of buying our first home. The first year has gone so fast we dont even know where our money has gone. The second year (January 6th 2012) my brother in-law landed on the door step with his marriage ending. He loves to drink! He goes out every Sunday now and get plastered and my little 8 year old girl has to see this. Now last Monday he decided to not get up for work (still drunk) and told his boss, he's not going to work for them anymore. so he's walked out! Now he has been out everyday to the pub drinking the last of his money behind the bar. he doesnt pay anything to his mum for food, bills etc. He has a 4 year old girl but not a full time parent. He has maybe £14,000 worth of debt and said he is going to file for Bankruptcy. Please help me with some information i cant find. If he files for Bankruptcy, will the debt collectors or bailiffs look at my stuff and my partners stuff? Will they take anything belonging to us? I own alot of stuff but its all in either the celler or my bedroom. Im going on holiday with my partner soon and dont know if i should take everything i own to my mum or dads house while im away. please help me as any information will be greatful! kind regards. joe

Hello All, I have used this web site many a times but I was not ready to deal or face my problems hence not registering before however the work you guys do to help others keeping people positive, motivated, not feeling isolated and on track against the big bad world of debt is amazing, keep up the good work to all involved Well here goes ...... My husband and I started having severe debt problems after a change in job amidst relocating back to Edinburgh from Kent. At the same time we lost all the equity in our house which was subsequently repossessed in October 2009. All our financial problems started around March 2008 where we started paying nothing or reduced payments to every company we owed money too. After spending years of moving around since our repossession with our two children, over two years of homelessness and serious consequences to my husbands health and our relationship we need to sort this mess that still haunts us before this ruins the future of our family, we don't where to turn. We always knew deep down Sequestration was our only option not only because of the total owned but after my husband health started suffering too and continues to do it really left any repayment options unavailable to us. So now we have the money needed to pursue our bankruptcy at long last however I wondered if we could have some personal opinions in what you what do in our situation. We are currently in receipt of benefits and have advise that we could take the LILA route for Sequestration. However all I do know is that preferably I don't want to pursue us going bankrupt and the time to recover from this when the debts with the largest capital against them are pretty old and they all relate to the house which was repossessed. I am more than happy to shed more light on the situation and give more details to allow anyone who can help to do so.   17. I was discharged from bankruptcy 5 years ago. I require a full report from the TIB (trustee in bankruptcy)and would like to know if I have to pay for this and if I have to make an application to the Court if I get no response from the TIB. Do I have the right to know how the TIB managed the bankruptcy estate? ie who got paid who didn't etc etc. The TIB has never contacted me as all my dealings were with the official receiver, he was only appointed 3 days before my discharge and then represented by a creditor's solicitor, which I thought was a conflict of interests. I have a terrible gut feeling that the TIB has only paid out to the same creditor's solicitors, who is actually his own solicitor!!
  18. I have just sold my house & paid off my mortgage & 2nd secured loan I will have 5k left after the sale. Is the best route to go bankruptcy? I have about 32k of unsecured debts, these include loans, credit card, student loan, council tax, gas & electric, money to friends & family. I realise I will have to hand over the 5k to the official receiver Will I have my bank account frozen? & will they want me to contribute some of my disposable income as I may have about £100 left over when I move into my friends house. I know it will effect my credit rating, but its not that best anyway, What other repercussions will it have & how long does it normally last? Thanks in advance

I took a payday loan out with this company about a year ago and defaulted After some initial chasing I have heard nothing from them for months and today recived the e-mail below saying they will make me bankrupt if i dont pay them over £4k. The original loan was for a couple of hundred I am scared and worried - please help Attn xxx We issued you with advice in our last correspondence that should you fail to respond in regards your debt with us Bankruptcy proceedings would be initiated. We are now writing to inform you of the next step due to the fact you have failed to comply. Re Amount Outstanding £4968.00 With regard to your overdue account, we have decided to start bankruptcy proceedings against you. In the next few days you will receive a statutory demand requesting immediate payment. If you fail to respond to this we will make you bankrupt and you risk losing your home. Hi there, i went bankrupt in may 2007, this year in january i received a letter from a company called aktiv kapital, advising that they were the collectors for halifax for the sum of £**,***, bla bla bla, basically the dept in question was part of my bankruptcy which was settled in may 2008, I've had 5 or 6 letters since, and I've repeatedly told them i went bankrupt, and that the halifax sum was included in my bankruptcy and gave them the bankruptcy details are halifax allowed to have done this???
  21. Hi, I was declared bankrupt in 2009 and as it is approaching 3 years the OR is asking for valuations and settlement figures for the house. It looks like after paying off the secured loans (£130k) there will be anywhere between £0k and £15k equity in the property. This is based on 3 valuations by estate agents: £130k to £135k £140k to £145k but test the market at £150k Asking price of £140k to £150k to acheive a minimum figure of £135k These are the figures in the letters from the estate agents, but I have no idea how the OR will interpret them. Will they take the highest amounts, add them together and divide by 3, or take an average from each estimate? Once the have a figure, I know that there are 3 options: Do nothing, there isn't enough equity Place a charging order on the house Force a sale Lets say they decide the property must be sold. Who sells it? Is it me that has to sell it, or do I move out and the OR sells it via auction? This is what I really need to know, as I will no doubt have to go to court and I would like to be able to point out that if sold at auction it would possibly achieve a lower price than on the market. If I am the one who has to sell it, what if I can't find a buyer? What if potential buyers see that the windows need replacing (something 2 of the estate agents didn't care about) and that there is damp throughout? What if I am only offered a price well below the ORs valuation? I could realistically stay in the property for the next 10 years putting potential buyers off, but I would rather get it all sorted out now. So, if anyone can tell me who does the selling in this situation I would be most grateful.
  22. Hello everyone. okay a little background information, in 2006 i was made bankrupt by one of my creditors. I only every had one letter (to my recollection). Basically stating that i was made bankrupt. Then years passed by i had no phone call or letter or visit from a offical reciever. I lost my job in 2003. then i separated from my husband in 2006. along with some other disruptive stuff my son was kidnapped all the stress i ended up on sick benefits and in and out hospital. in 2009 i then went to live with my husband at a new address. I have got myself into more debt... to the total of approx £4000. now until this week when i got tired of debt collectors etc i did not do any research into bankruptcy etc. I had a chat with a helpful guy from national debt helpline. Who suggested i go for a Debt relief order. He is sending me a information pack. So since my telephone call i scour the internet reading advice etc and then come across the insolvency website where i search my name and find that i am a undischarged bankcrupt. Now goodness help me i read that bankcrupts cannot apply for loans etc. I honestly did not know I really do not know what to do I cant sleep or think straight any longer. what can i do? Any advice is appreciated and thank you
  23. Hi All, I went bankrupt November 2008, i included all my debts and everything went fine and i was discharged in November 2009. I had a loan with Lloyds Tsb for about £6000 which was included in my bankruptcy and this was marked as satisfied/settled on my credit files. However i recently checked my credit files to do a clean up and discovered that there was a company on my credit file, TTI SPC, which i had never heard of but the account number and amount owed were the same as my Lloyds tsb loan. I contacted Lloyds who have said that their credit file was correct and that they had passed my account over to Groves who wont contact me for payments,etc. I never received any correspondance from Groves or TTI SPC. They have defaulted me from November 2008 to now. Anyone had any dealings with TTI SPC? Thanks.
  24. hi can someone help..my husband obtained his credit report last year...as could not gain a bank account..he was in a voluntary admin order with local court..and now from jan 2011 ..was debt free...still could not get bank account..the lady in bank..was saying he was a undisclosed bankrupt...this in not so..never been bankrupt..and we would have known about it...lol....where have they got this info from...any help would be great...

Hi folks, Please be patient with me as i am new to all this, firstly i managed to get myself in a pickle when i lost my job, my debts went out of control etc etc and i just ignored the letters from debt collectors. They seemed to just pass them on to different agencies and i lost track of what was what and whose was whose. A couple of weeks ago somebody knocked on my door, didnt say where he was from and handed me a pile of paper, and told me that i knew all about it. It was a firm called BW Legal debt recovery solicitors. Issuing me with a statutory demand and that i should respond within 18 days, otherwise they would seek to make me bankrupt. I left it again as it is all getting on top of me, and seriously depressing me, however i got a letter today asking me to pay £980.00 immediately, then installments of £254.00 per month and if i did not, they would again apply to have me made bankrupt. The debt is just over £3000 in total not to one creditor but different ones, the full amount i owe is for various debts. I have been paying two other debts off and almost finshed paying them, as the creditor took me to court and i agreed a payment plan and have never missed, and like i said i just couldnt keep track of who was who with the rest. Why is this BW Legal simply not taking me to court, where i "Will" agree a payment plan as i cannot afford what they are asking. Is this normal what they are doing, or trying to scare me into paying this money quicker. Please help, as i am desperate. Many thanks.
