    • So I am now in receipt of a second Letter of Claim this time from DCBL although their letter head now says " DCBLegal"  😱 Now I'm guessing one response to a letter of claim is sufficient and I could ignore this but having been inspired by other snotty letters I wanted to have another bash at one. How does this sound? Dear Lackeys of Company with Unconscionable Morals, Thank you ever so much for gracing me with yet another Letter Before Claim on behalf of Excel Parking Services. How many of these delightful missives do you plan on sending before you muster the courage to follow through on your threats to take me to court? Just so we're clear, here is the response (in italics by that I mean the slanted text below) I previously sent to Excel’s Letter Before Claim, in case your attention to detail is as lacking as I suspect: I am currently 2-0 up in terms of Small Claims Court proceedings and I look forward to the opportunity to claim a hat trick, this case being more straightforward than my previous two. I will be asking the court for an unreasonable costs order under CPR 27.14(2)(g) due to your conduct over this absurd claim. Despite my best efforts, you continue to assert that I have breached your terms. However, I cannot breach terms that I was not present to accept. Have you even read my initial response? I suggest you review it thoroughly and save yourself some money. Additionally, please refer to section 13 of the IPC Code of Practice, 2023 edition. I eagerly await your deafening silence. Remarkably, I haven't heard a peep from Excel since my response; instead, they've passed the baton to you to perform this tiresome routine once more. Consider this my official notice that I am sending a cease and desist letter to Excel Parking Services. Their relentless hounding has crossed the line into clear harassment. Any further demands for payment from you, as Excel's lackeys, will be regarded as nothing more than shameless acts of intimidation and harassment. I now look forward to the deafening sound of your silence. Yours sincerely,
    • Personally I'd go to it and object for the sake of it. They have to attend anyway so I can't see you being liable for any costs or anything (if they try to ask for attendance costs, just say that firstly it is their application, secondly it is from their own making, thirdly that they would have to come anyway so you shouldn't need to bear their costs.   When you turn up you should object on the basis that the witness has been in office since the time of the order, and could have done their witnes statement in advance of their AL. Their poor planning is not your fault, 7 days is too rushed for you as a LIP and there is no good reason that a company can't organise itself to sort WX in time. Also they say finalise so they already have something, its not like thye have nothing. Their amendments cannot be so important if they are being added so late.   see what @AndyOrch says but that's my thoughts

    • Hello, welcome to CAG. As you say, appealing this ticket doesn't help as these people hardly ever accept appeals. They don't care how difficult someone's life is, they just want the money. The forum guys should be along later with thoughts for you on how to deal with this. Best, HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm disappointed just as much as everyone that they got a repreive as I hate Welcome Finance, Shopacheck, the Lewis Group and Cohen et al with a passion. It certainly put a crimp in my day this morning.

 

I woke up this morning hoping for better news, however, the crumb of comfort is that they will be still around just yet for us to put in our claims.

 

They will go, it's just a matter of time, they can't sustain the huge sums they owe for ever.

I felt the same way this morning but its made me all the more determined to push on and get my claim dealt with im making an appointment with my sloicitor for next week (when he gets back off his annual leave) !! See whats extracted from Welscum and what he thinks of my sooper dooper 50% once in a lifetime offer to clear my loan !

this is not a set back

just a stay of execution, its only six months

 

the prob was there is an election comming up, a local labour authority pension fund is tied up in cattles

 

not saying any political pressure but, (are there not a couple of Right Honourables involved in this company also?????)

I think a concerted effort now to make as many of the dodgy ppi, agreements and scams public and tied up in complaints/litigation as poss - for as long as poss.

I think this will help people that are trying to get their accounts settled, as they are bound to be looking to get offers in on disputed accounts, and get them off the books, and money in the pot.

My opinion is that they will be pushing the poor souls that don't know their rights and giving them hell to get money off them, or get them signed up for re-writes.

Will the FSA/FOS be monitoring them more during this 6 month period, meaning proper responses to complaints etc? (or is that wishful thinking?)

Postggj, how about starting another thread explaining the situation now and getting as many folk as poss to submit official complaints to the OFT and the FSA....keep piling the pressure?

 

The regulators will not be able to ignore the amount and the seriousness of the issues we could get logged for long. Every single one needs to be logged and deserves to be.

I have SAR'd Welcome and Carshaft - I'm looking for the commission issues, PPI mis-selling and general crap agreement issues. Think of it as a preemptive strike before they start clamouring for more dosh...

Also only if the liquidator allows it will the book debts be sold on & as they are the primary asset the liquidator may consider that the new 'owner' such as the bank is better equipped to collect

 

However the banks who funded Cattles will have 1st call on those alleged assets floating &/or fixed

Just been told bY the lady at the Welcome LMB that i still have to pay because my arrears are at £1k, and the loan is secured on my property...i kindly brought it to her attention that i have appeared in court on several occassions with the 1st charge **** bag mortgage company, and that i am still in the said mentioned property, and i am waiting for them to take me to court as mentioned in their default notice they issued me a while ago, but in the mean time could she please explain why i have been charged the £235.00 acceptance fee 3 times,send me a full set of statements from inception to date, and when will they have the current agreement ready for me to inspect in person at their office!! In the meantime i am not paying, they should not be adding any charges to my account etc (apparently they can) whilst it is in dispute!!! Thought i would leave the PPI, fraud and creative accounting and data protection breaches out for the time being..saving that for a rainy day!!! Will have 6 weeks with time on my hands for this lot come friday!!! cant wait!!!!

Unsure, I think if they are only collecting on behalf of WF, ie not bought the debt then no, but am checking that for myself also...but WF should have informed you they were passing the account on (didn't tell me either lol)

 

If you would like their general e-mail addresses to bombard them, just leme know, judging by the sniffy responses I got they really don't like that :)

 

Have Cohens done the whole 'we are preparing court papers' malarkey?

 

Looks like my situation is exactly as yours. Nothing from Welcome about passing this on to their sister company. I have also had the 'preparing court papers' crap.

 

I've got their email addy, thanks. I've had a few replies with the usual 'you owe WFS this money.

 

I've had a successful PPI claim, believe it or not, and Cohen's are not taking this off the total. Doesn't phase me though.

They're a laugh ain't they. I asked Cohens if Lewis Group actually instructed them to prepare court papers or if they just used a template letter to threaten me and apparently they have now closed their file....tut, is that all the fight I'm gonna get lol

 

Lewis Group tell me they are closing their file also. Oh really? I ain't letting them off that easy.

There will be more news this month. It's actually a good opportunity for thos who loans are finished but were missold insurances etc to get claims in. Indeed everyone should be claiming back PPI because they will get it back.

Morning all, just to let you know the little loves have just rung me, wanted to know what i thought of their amazing offer to bring my account to a close and if im going to pay it.....soooo i first of all informed him that he really shouldnt be phoning me as it is all now in the hands of a solicitor, and isnt it funny that now im fighting back against the scumbags who have made my life a misery for the last two n bit years, you are starting to be ultra nice to me. He didnt take to nicely to the fact that even if i was dealing with it i still wouldnt cough up as im going to take them to court if required,."you'll be hearing from me soon goodbye" :D

Im on day 24 now since sending my letter demandng my refund for the PPI rubbish. Just thinking if I should ring them or not and pester them, I mean they've done it to me enough over the years....calling me a week before my payment is due, asking if they can have my card details and keep them in their safe so they can take the payment on the due day....

oh and did I mention that the cheeky beggars told me in april that my agreement had ended, but i owed them 1000 worth of charges......... and that if I didnt pay my monthly amount that would imply an attachment of earnings?

Not a surprise at all :rolleyes: - Its what we come to expect fro Welcome. Would be more surprised if they didnt say something like that !! Nice to know they are still true to form - hopefully not for much longer though !!:lol:

Just spent about 35 minutes getting passed from local branch, to customer service center(?), to another place, spoke to some woman who didnt have a clue, then spoke to the office where my complaint letter had ended up, they had no record of it, although the branch give me the dates they forwarded it etc. Just spoken to the guy in our local branch, and he's gonna fax a copy to the bloke I spoke to up north somewhere. Felt slightly guilty having a go at the people in the local branch cos they've always been okish, then thought of the grief this situation has caused me over the years!

Glad to have you back! Done the splitting up thing myself too recently....is it a full moon or something? Hope you're ok :)

 

Cagger rrfcfan is in court with them today, asked for a disclosure of full PPI docs ages ago and they still haven't supplied them (shock lol), so bets are on they don't turn up today :lol:
