    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just looked over my contract

 

loan for car was 5578

acceptance fee was 85

finance charge 2775

pp1 insurance 2406

total paypable over 10 thousand pounds

also they charge you evey letter they write £25.00 late fees are 15.00 and to be hones with you i have looked over some of my statments (i question this all about 2 years ago but was fobbed off)

sometimes on one day alone i was charged 120 in interest

on november 5th 2002 £5 fee

nov 6th 5 fee

nov 7th 5 fee

nov 8th 5.oo fee

nov 9th 5 fee

 

and it goes on like this

also when we could not afford to pay they bombarded us and made us rewrite the loan which i think meant we borrowed more at a slightly lower interest rate to pay back the 10 thousand odd we could not afford to pay

to be honest i have not got a clue what they did

to date i think we owe more than 7 thousand still ,take into consideration that we took out 18/04/02 it ran for 42 months and we were paying 258 a month untill last year when we wrote on the advice from ccs to offer them a token payment of 20 a month

PLEASE PLEASE ANY BODY WANTING A CAR DO NOT EVER TRUST WELCOME!

Hello everyone!...

I am stuck and i need some help..I am trying to culculate the amount i should claim from Welcome FInance for the loan i took...Can anybody give me an advise?

 

Loan amount £3000, intrest 44.5%, 36 payments of £193.30

I am claiming PPI, healthcare and intrest back which are £1146.36 plus 3% of intrest...

I am using one of the CAGs spreadsheet to culculate the amount i have to claim...Is it correct?

 

I know that i should claim £1146.36+ 3% intrest on it...

 

 

But when i add up 36 months of payments of £193.35 is £6960.60...

But when i use the contract to get the total figure i get:

loan 3000

Intrest 44.5%=1335

Acceptancy fee 75

PPI+ Healthcare+ 3% intrest( 996.36+150)=1146.33

alltogether=5556.33

Its almost a £1000 difference.

Now can i calim it back with PPI+Healthcare+ intrest????

got a reply from them today here is what they said

 

"

Just to point out you signed on trade premises and there is no cooling of period, cooling off periods only stand when you sign off trade premises but under the circumstances that you feel you were wrongly sold the Payment protection insurance I will cancel the agreement for you, we also have no choice over the interest rate you received its all done on your credit score direct from the lender.

"

I SAR'D Welcome the other day on behalf of my mum. Sent the 10 quid fee and got a signed credit agreement, nothing else. Cheeky bar stewards. Goes to show they really do not have a clue. Will do them a nice little letter later telling them time is running out......

Hello all. I have had three agreements with welcome.

1) HP for a car from a company called Approved Car Credit. Paid in full 5 years ago.

2) Personal Loan for £1000, paid back in full £1650 over 12 months.

3) HP for a car £6200, got into financial difficulty with 8months left to pay. They 'restructured' the loan

and I am now paying the remaining balance over 50 months @£197 a month. All in all I will have ended up paying around £20000 for a £6500 car !!! This includes the numerous 'penalty charges ' that they applied.

I did discover though that the 'new' restructured HP agreement was turned into a personal loan though so that allowed me to change the car :)

I pay by cash each month and I get constant phone calls asking which day I am paying my payment on ......

Any how, what exactly can I claim back from them? Has anyone claimed from them yet and won?

Couldn't find it anywhere...all the PM's, posted it on my thread....no reply....seems like everybody knows the answers for SAR and LB, but not for the most important-amount to claim ( working out PPI and rule 78 ....:)))))

I also had a loan with Welcome Finance which I topped up 4 times (shame on me) I never missed a payment and paid it all off a year and a half ago (no early payment discount)

I remember being advised to take out Health Insurance and PPI, when I said I didn't want any insurance, they took off the health one but not the PPI as they said you *have* to it to get the loan.

I have all my loan agreeement numbers, and I am not disputing charges (as there are none) but I would like to ask for the mis-sold PPI's.

can anyone supply a link to a draft letter I can send??

I would really appreciate it, and will start my own post as soon as I get more info

Can someone enlighten me on a welcome issue.

 

They transferred the debt to Hillesdon (SOLD IT AS I HAVE DOCUMENTS) Hillesdon have closed the account and removed there default,

 

Two defaults were registered for the same account. (Illegal i know)

 

Does welcome now have to close it as Hillesdon have now closed the aco****, They were unable to obtain information from the original lender?

 

Welcome failed to comply with CCA request no statement of accounts, Credit agreement was not original as this had a typing error on it!

 

They typed a new one bless um! Lots of different dates now.

I always ask for the ICO registration information - they often dont have it, shame i never discuss my personal data unless I know they comply with the DPA.

 

Finally I always record calls and state at the start of there call. Although I don't have too.

hi all glad i found this site i have a car with welcome it costs me £385 per month obviously this is killing me now i have paid it for 2 years could someone explain to me in laymans terms how i go about getting the ppi removed if possible and how to challenge them on interest etc.All so is it possible to reduce my payments i have thought about giving them back the car and asked them how much i still owed by phone they said they couldn't tell me i had to write in.How do I legally stop paying them while i sort out these problems feel like im being taken for a ride.

If I dont pay them what happens they add more charges ??

Up to now paid them just under £9000 and still have 2 years to go under pressure need help please.

All so what are CCA and S.A.R's and where do i get the paperwork and what do i send first and how to sorry for being so thick lorry driver not bank manager haha

Basically what do i do first to try to sort this out heeeellllllllpppppp please
