    • I think final version of WS now prepared with exhibits added.  All numbered properly. Of course it can still be tweaked if necessary. Laura will not need it on 25 June as that is just a Preliminary Hearing for her to represent her son. But as DCBL messed up and thought it was WS time why not prepare things calmly in advance.     • Your case shows the idiocy of employing a solicitor to do things you could easily do yourself. Had Countryside dealt with their own case they would have entered judgement on 4 June and there would have been no way back for you. But they thought they were clever by running to Rachael and Sean of BW Legal for a more "professional" (aye, right) service.  These dodgy solicitors can only make money on private parking cases by doing everything on the ultra cheap and certainly cant check the judgement date for every single separate case. Ho!  Ho!  Ho! Anyway, glad you got the defence filed OK.     • It is already trespass, nothing further needed to make out trespass. Not sure where ‘interference with goods’ helps you / how you’d bring a claim for that that stops them parking there.
    • Thanks Dx,    For some further information, the holiday was booked as a package holiday for 2. One of the 2 had to be changed, and changing costs £700 for a new flight as "tickets had been issued and they cant do a name change". I cant quite figure out how compensation works for things when it comes to package holidays.    From what I can tell  - The plane was due to land in Turks and Caicos to drop off passengers, something happened during descent, resulting in technical fault.  - The rest of the original flight from Turks & Caicos -> Montego Bay was cancelled  - A New flight was put on today, which was then delayed by 1.5hrs aswell  - Hotel was provided for the night after much hassle.  - 1.5 days, 2 evenings of holiday lost  If I understand correctly, since the original flight (LHR -> Turks -> Montego Bay) was cancelled, they are both entitled to a refund on that full flight? I can't quite work out if they are only entitled to a refund for the equivalent of Turks -> Montego Bay, or for the full LHR->Turks->Montego Bay, since it was issued as one ticket/all Virgin, and they should have arrived yesterday..?)  I can't work out how to get the cost of that compensation, or whether its a set figure, and how the loss of days of holiday is factored in   I am aware:  If you received less than 14 days’ notice of the cancellation, you are generally due compensation, awarded in pounds or euros depending on where your flight was due to depart from, according to the following scale: £220 / €250 for all flights of 1,500km or less (e.g. Glasgow to Amsterdam); £350 / €400 for all flights between 1,500km and 3,500km (e.g. East Midlands to Marrakech); £520 / €600 for all other flights (e.g. London to New York). Compensation will be reduced by 50% if the arrival time of the replacement flight doesn’t exceed the arrival time of the original flight by: two hours for flights of 1,500km or less; three hours for flights between 1,500km and 3,500km; four hours for all other flights. So I "think" its £520pp for the flight part as compensation (7500km)... but some sites say its a full refund for the flight... is it both?  Thanks,  Ryan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How many so called celebs worked for call centres is totally irrelevant. If it's not within the scope of your JSag and you don't want to do that sort of work then don't apply. Explain patiently to the nice WP person where they are going wrong and follow Mr P's excellent advice.

Hey just seeking some advise, my Ingeus adviser is saying to me that due to pressure being put on them etc they are having to be more strict, which I get ( I live in a very small town with very few job opertunities). But then she says "we don't feel your looking hard enough for work and neither do they" And pointed to the Jobcenter. I was rather annoyed at this as I do my best.

So I spoke to the job center and they said they don't know what she's talking about as I do everything I have agreed in the job center agreement I signed.

So I bring this up the next week and she still insists the same.

My question is, are they allowed to talk about me behind my back like that? Makes me feel belittled. Either that or she is lying to threaten me. Which she has done with the dreaded S word.

 

This is almost the same talk i had with my advisor on Tuesday, he went on about registering with the Universal jobmatch as the job centre will be getting on my back soon and it would be best if i did that. He also told me i wasn't committed enough to finding work ...even though i have done everything the work programme and the job centre have asked of me. He said in time the job centre will be looking for job search evidence weekly.

 

 

On a different note i got a call on my mobile todayfrom my advisor (yes i was one of many who signed all the contact stuff when i first started there nearly 2yrs ago as i didn't know you didn't have to) he said there was soon to be some jobs going at Aldi...i said great, he said the training would be at the branch next to mine,but the job maybe somewhere else after 4weeks, then he said the hours are 5am to 10 (he never said if it was 10pm or am) now this is a advisor i have now been with twice in nearly two years he knows i am a single mother, how does he expect me to get to a job for 5am in the morning...as far as i know buses don't run at that time and i don't drive when i pointed this out to him and said i can do other times but can't work at 5am he said doesn't matter you have to be fully flexible (which i have said since i signed my JSA claim i'm not due to being a lone parent) he then hung up . This work programme is starting to get to me now.

Well sure, it's just that Joeski seemed to be suggesting that there were folks in this thread who thought they were all that and a bag of chips. I'm not seeing it.

my daughter is looking for 16hrs per week job, as she has a son of 6yrs old, the advisor she has obviously has some common sense, on her jsa agreement it states the work she needs to find has to be from 10.00am - 2.pm and within 30 minutes travel, in order to be realistic in fitting round school times. I think the idiot pushing for a 5.am start needs reminding of reality, what a plonker, I would complain.

I agree. Take your jsa agreement down to that wp drone amd staple it on his forehead then maybe he will remember the working boundries and restrictions you have.

sorry i just read something the wrong way, i thought by naming a celeb who had worked in a call centre was kinda acting in their defence :/

 

I took that to show how rare it is. One out of loads and he didn't even get famous due to call-centre stuff

Same old patter isn't it; Ingeus advisor mentioning 'what the Jobcentre want' - as though they told the JC what to do - in an attempt to intimidate people and get them to do what they want. I hope you tell him exactly what the rules are and put him in his place.

 

Nobody wants to be a perpetual 'complainer' but it's getting to the point where we now have to exercise total zero tolerance and report these WP's for every infringement - seems the only way they'll take notice.

Indeed - Written complaints to the DWP citing a distrust in the providers process. Complaints to the DWP get logged and will appear in any FoI requests (& official statistics) and to some extent help to formulate ground rules for the next programme.

If sufficient complaints are received by the DWP about a specific point (i.e. travel expenses), it could trigger an investigation in to systemic abuses and fraud.

Precisely. If the Jobcentre adviser thinks you're not doing enough to find work, they'll tell you when you go to sign on. This Ingeus adviser is simply making stuff up.

Depends on what you refuse I maybe? you need to elaborate

Try te refuse using their rules against them though, like how the service is meant to be personally tailored for example

Just seen this thread when I posted in the work programme thread about Ingeous still contacting me 18 months down the line even though I got my job myself...you will never get rid of them...they do 6 monthly and yearly checks on you regardless if you are on benefits or not....I am furious at being tracked....nearly 2 years later......be warned...change your mobile numbers or any contact numbers so they cant contact you.

Personal callers can also expect to be forcibly ejected from the premises.

Just tried to apply for that job that you pointed out, Raven1, on A4E (Angry 4 Ever:-x) website and if it's not for profit company than i'm an monkey's uncle as one of the application questions is.

 

Do you have experience of working within a target or sales driven environment?

if ingeus advisors are so clever then why haven't they all got better jobs instead of working as an employment advisor?!

 

 

 

working for ingeus is hardly top of the employment chain is it..not like they're executives of big companies or anything so they seriously need slapping down :D
