  1. Well i did it read all the pages. I have to say Max i think have been wasted van driving ! The way you have battled this far has been IMO remarkable Mind you i spent 35years doing heavy factory work, only to find after being finished due to ill health, i now find im a people person helping people when and where i can. From what i have read i like you had trouble at the Job Centre, with front of house staff. My way of dealing with this was direct to the Manager, first by letter then and now by e-mail. From my volunteering at a work club the JC Advisors are all different some nice and happy with job searches and some not, IMO thier bosses know this so make the ones signing on change who they see when signing on.
  2. Hi, This may be a new thing or who is front of house at the time as i took a letter in last year and it was opened just one sheet of paper. Three weeks ago i took another letter in eight A4 sheets didnt open it.
  3. Hi, if your argreement is changed then make sure it changed to help you and not so its harded for you. As for the job searching iv been told its tailored to each client, in your case IMO your DEA should also take in account you illness/disability with mine i saw her every month to start with and 30/40 minute appointment spent up dating my health details . Then spoke about training, courses etc , then volunteering

  5. Hi, sorry cant help with your dismissal, but as for the Fire Marshall being on the 4th floor and not the 1st, to me its makes sense as a fire would surely spread upwards ? Less trouble foe people to get out if lower down in a building ? Would need more help, control and guidance higher in a building thus need a Fire Marshall ? I know not every fire starts downstairs. all just my opinion
  6. Hi, i really argree with every thing you have said about diagosis , it took me nearly 2 years to be told i have no cartridges in my knees. Its started with just rested for a week or so, then cream, then physio, acupuncture, tramadol, more pills, pain clinic until a consultant examined me sent me down for a x-ray and theres your trouble
  7. Hi, well done Miss A, just wanted to add to your point Baz B, about firms recording calls. The last 3 so callled recorded calls, 1 cant trace the call, 2 cant trace call as i used a withheld number ( i had a name, date and time.) 3 thats person has now left. So yes a very big pinch of salt !
  8. Hi, it may not be as funny as you think, as in my case with a joint claim as my ex was on benefits and i was working and had a house they came after me for the over payment. Which may be the case with you ?
  9. Hi, i think this is a new thing where all people now signin on do have to do daily visits to the Job Centre, think its parts of getting people ready for work. Also IMO they can pick people out for courses, training etc

Hi, a person i know has been told he cant claim JSA as he has a private pension, i think but im not sure its due to him having to claim UC now and not JSA, he is looking for job, iv told him to ask his advisor and see CAB. Due to all the changes taking place this makes me unsure what to tell. Just some thing for your to ask/find out about as that person felt he was being let down by the system after working most of his life
  11. Hi, just wanted to say i do feel for you as i was like you at one point in my life, have you checked to see if you are claiming all the help/benefits you can claim ? I think loads of councils now have people paying something and a lot of private tennants again have to pay something to their rent due to change in the LHA.
  12. When on ESA if asked to go in for interview with your advisor or go on cousre they can stop your money if you dont, but you dont have to look for work
  13. Hi,folks,bit of an update,spoke with someone at my (old ?) place of work,its seems they knew nothing of my health,not got any off my letters . Explained my long term health to him and he said there are no jobs i could do and he cant turn back time whats done is done,r.e dismissed After that sent letter regarding what was said in our phone call. Another appealing the dismissal,i khow out of time but they done things by the book so should i,i.e appeal. Thrid letter stating i will go to the small claim court r.e un paid holiday pay. Saw c.a.b they gave me a number of a solicitor,rang him said letters seem ok,just let him know when/if they reply Hope everyone good and enjoying the sun
  14. Hi folks,surely as it stated in his agreement then so be it . The next step would be to make another agreement with him with a different travelling time ? Less hassle all round . Mind you i spent many years catching 3/4 buses,leavind at 5am to start at 7am,had months of doing that knowing that each friday we would be told at 10am or 1pm go home no work see you monday all for 3/6 hours work.
  15. Hi,firstly i wished to thank you so much for your input,others as well but you have kept with me,so extra thank you. Spoken with 4 solicitors , 2 not worth doing it no win no fee ,as its might be only 55% in my favour,1 said its possible to do yourself with some help from a solicitor and 1 to get back to me. Have got appointment with the c.a.b on thursday. Phone old company to speak with them as solicitor said so as time is short,not sure what to say,as no suprize to me hes in a meeting this is what we were told to say to any worker wanted to see some one in management,i had a spell as a forman Up for it many many times in the last 10 years i have wanted to give up !!!!!!!!!!! them 10 years i have lost a partner,her father,my father,3 uncles,1 aunt,been mugged,been left with 20,0000 of debt,lost my home,homeless,battled with benefits,my health and lost my job,just a few things off the top of my head
  16. Hi,that may be the case and then they re-typed address in new letters and sent out with the address from my letter of last week. Yes did give new address,since then old manager has been sent down. We were told he would shut the place down if we joined a union. Pension was stopped in 1997 ish i was able to join then they stopped it due to costs. It took 18months or so for me to get d.l.a and abt 4/5 months for housing benefit
  17. Hello,yes all came in 1 envelope. The company has abt 50 plus working for them. My supervisor would faer for his job if he told me anythink. My workmates most have left or been sacked. The reason i ask for a lighter job because my health at the time,i couldnt do my normal job,which i told them at the time. There was no occpational health. It was a known condition and later found out to be worst,it took 18months to see some at hospital. Yes i agree i too think it may be discrimintion,they were informed of my disability,they knew i was ill and they sacked without estabishing that may long term illness was not due to a disability. No visit. No union was allowed. No pension the was stopped they couldnt afford it. No insurance,in a betsit,lost my house while on the sick due to not being able to claim income support.
  18. Thank you so much for that,as you can tell this is not my strong point,i was/am a highly skilled metal polisher working on spindle machines going 3000rpm. Turn your head away for a second and you may lose a finger or more !,this is heavy work at times,always standing and heavy lifting,always done at speed,in dusty and dirty areas. This has been my work life for 32 years,which in my view has helped to wear down my joints e.t.c. It was the summer of 2008 when i met with them asking for a lighter job and i was told no you are skilled at your job and thats what you will do. In oct 2008 was when i was invited to see and speak with new manager,this never happen i phoned and explained my ill health,that was the last time they contacted me. In 2009 i wrote to them short note with a copy of G.P letter with upto date health details. In 2010 i wrote to say along with my knees my hip has arthritis and i was now disabled. Since then my fingers etc have arthritis and this year i have leg ulers which they dont know abt any of this as we speak. I wrote to them june this year abt holiday pay and got 4 letters back this week, One asking when back to work dated 13/9/2010 One stating unauthorised absence is a sample of gross misconduct dated 22/10/2010 One invite to a formal hearing dated 10/12/2010. One saying my employment has been terminated,gross misconduct due to unauthorised absence dated 4/01/2011 One saying as you are aware the company dismissed on the 4/01/2011 and they would dispute that you are owned holiday pay,as legitimate claims need to be made within 3 months ot termination and you are outside that dated 16/6/2011 Hope that makes things cleared for people to help/advise me,i think it does,not sure i will ever get use to this one finger typing lol

Regarding papasmurficx questions,i did say i got the letters as thats when i found out iv been sacked,they said contact them stating when im back at work,another asking what illness,another to come to an formal disciplinary hearing,another saying it took place and im to be sacked,as for saying h.b is right and i need to say what happen in 2008 ,the post never said that but im more than happy to say,i had r.p.i,depression,stress,spasming in my arms and my tendons went too,i now have osteo-arthritis of both knees and right hip also in my fingers,wrists elbows along with the last 3months or so leg ulers,as for only just asking for holiday pay i said in 1st post theres been a change in the law,which iv only just found out,plus iv had upwards of 60plus appointments this year alone,some days im drugged up i just sleep,the other monday alone i had to took 34 tabets so this was the last thing on my mind
  21. No,stopped when i no longer needed to send regarding my beneifit claim,plus them only asked for them while paying me sick pay
  22. Tbh yes,this means i have no payment what so ever,also their gross misconduct rules state unauthorised absence from work(including consistent with alleged sickness injury or incapacity) which i wasnt i just couldnt do the job,mind and body wouldnt cope
  23. Thanks Mike,they did the same to someone else,sacked cause he phoned the 3rd day of sickness not the next day,got to tribunal and just before going in they settled,they made him so nothing abt what had happened,he been there 20 plus years

Reply to the shadow questions,yes there is a disciplinary policy,they knew my new address as the letteres i never got were adressed to my new address,not heard from them since 10 oct 2008,until the other day,in 2008 they took on new works manager, i imformed them abt my health and wldnt be fit for work when he was due to start,not long after that they sacked him
