Good morning Eric. Thank you for explanation it all makes sense, I am just overthinking the situation.

 

Last night I received a letter from CCBC to say that my case have been forwarded to Clerkenwell and Shoreditch County Court and that I should await for another letter re hearing date etc.

 

Will keep you guys posted!

there is a good chance that they wont oppose the set aside and may well drop the claim if you dont go after them for costs as already said.

 

Gladdys sell their services based on a story about how brilliant they are at doing court when the truth is 85% of people dot defend a claim.

 

When people do defend they normally lose ther clients money

but that is currently offset by all the false £60 add-ons in the claims

 

If 20% of people defended then the parking co's would lose more than they could ever make because the costs couldnt be absorbed ( an extra £100 minimum per case).

 

If everyone defended it would mean that Gladstones would have to stump up another half a million quid just to get to stage 2 of the procedure and then risk losing their clients so much money they would all go bust.

Makes perfect sense to me.

 

I can see why people do not try and defend the claim.

 

It takes a chunk of time and some cash flow, along with researching (if you are clueless like me).

 

However, I really do wish more people would consider defending and beating these dodgy businesses with the right help.

 

I guess I should be expecting to hear from Gladdys when the courts serve them the papers, right?

Hey guys, hoping all is well.

 

I am little worried about my case.

 

I have called the courts last night and they advised me that they have a big back log of cases and mine should be processed within a month.

 

It has already been 3 weeks plus.

 

Is this normal procedure and I should expect to wait this long?

Good afternoon and a very Happy New Year CAG!! Wishing you all the best in 2018!

 

As stated previously I have sent an email to Gladstones around 2 months ago asking if they would set aside prior to finding this group.

 

today I have received an email from Gladstones,

looks like they have received my application from court and are little afraid of the situation! (see pdf file attached).

It is also strange to mention I have blocked all emails from Gladstones and still received this one?

 

I have called the court to find out if there is any movement on my case,

they have advised that it has been passed to judge and I should await a letter (it has been around a month now).

 

How should I proceed?

I guess best move is to to fight now instead of accepting their offer.

 

Again, many thanks for taking a look and for advice given!

read the letter properly, it isnt an offer at all, it is a trick to get you to admit you owe them something.

 

They are saying their client will accpet the set aside as long as you drop the matter.

that allows them the opportunity to restart a new claim.

 

They say they will do this if you dont chase costs but in essence it is blackmail.

they know the case will be set aside at your expense and then they have to pay to continue and whether they do this or not you have a claim against them for breach of the DPA.

 

Let the courts do their bit,

do not engage with Gladdys at this stage as they have nothing to offer.

Understood, I will not engage with Gladstones and will await papers from the court.

 

It is strange that I have received the email,

 

even though I have blocked Gladstones address.

 

Does anyone by chance know how to fully block their address on Gmail so that they can't send me last minute email before hearing date?

 

I will keep you updated on the progress once I receive the documents from courts.

they probably send stuff from [email protected] or [email protected]

so blocking one doesnt block every permutation.

 

A decent spam filter will block their IP address after the first bits

so for example any IP addy that is for example 252.252.100. whatever.

The more usual block in on the last bit of the address so 252.252.100.24 and not .25

 

Something you need to go into with your service provider's help.

 

Ideally you want a bounce back message so they know they are blocked.

 

They use email to save 61p and also to abuse the process by delivering letters late at night the day they were due

so you dont have a chance to rip them to shreds in a rebuttal.

 

Also pass it on to any dca for hire at economy fare rates

Hello guys,

I am in need of some advice please.

 

I have just put down a security deposit of £500 for a rental property, which I will lose.

 

My referencing has failed due to this CCJ even though I have described my situation.

The agent is suggesting I pay the outstanding amount of £260 and it would possibly pass it through.

 

What are my options here?

My contract is expiring 27th February and I have to move out by this date,

which is really stressful now that I do not know where me and my family will have to live.

 

If I pay the amount owed and this would mark my file as satisfactory,

I guess my court case will go out through the window and I would not be able to claim anymore?

 

I have still not heard back from the courts on the date, have tried calling them multiple times waiting in cue for hours with out any response.

 

Please, please any advise on this situation would be really grateful!

Hello. I have just received a letter from court that my hearing will take place on Wednesday 14th February at 10am. 30 minutes has been allowed for the hearing.

 

Could someone please advise how I need to prepare for this and what actions I should take?

Is there anything that I should bring with me or just the skeleton arguments that I have filled out in the N244 form?

 

Printed images of signs etc?

 

I have not done a WS, do I need this?

take what you have with you,

 

it is unlikley they will turn up at all and the liklihood of the actual claim being booted out summarilty is less than 50/50

 

but always goos to show that you do have a defence and are likely to win at a full hearing.

 

PCM are them likley to not bother filing a new claim,

they will have wasted £100 already

wont want to spend another £100 just to lose even more money

 

the most they can ever win is the original contractual charge so they end up out of pocket even if they do win

I will get all the papers printed out what I have and prepare for this case.

 

I will give an update to how the hearing goes in the mean time.

 

My friend who used to live in the place where this particular ticket was issued was in court last night.

 

There was over £800 of debt outstanding.

 

The judge dismissed the claim due to insufficient evidence.

 

Game over Gladstones!

get your neighbour to give you the claim reference and use it to show a persuasive argument.

 

Also if you can get him to come here and give us a brief commentary on his day at court

 

so others have an idea what was said by whom and the reasons the judge chucked it out.

Hi all, I am sitting at court and waiting for my 10am hearing.

 

Nobody has turned up from gladstones yet, I feel a bit intimidated.

 

Fingers crossed hoping all goes well, I will post up after I get out of here.

 

P.s can i use my iphone to record the hearing or is this illegal?
