    • My Ebay account was permanently suspended for "buying activity" allegation. I literally have no idea what they are talking about.   It's literally impossible to contact them by email or phone if your account has been suspended. They owe me: 1. £400 for items sold which have been delievered to the buyer 2. £350 for a faulty computer screen I purchased , which I now can't return. It's unacceptable they should hold my monies under these circumstances.I have video evidence the computer screen is faulty. But its completely frustrating, because you cannot under ANY circumstances contact  them by email or phone if your account has been suspended. So I cannot find out what guidelines I'm supposed to have broken. I'm not prepared to accpet this. I have Ebay's physical address. I am going to go to the small claims court, and appoint bailiffs `if I win and they don't pay up. Do you think Trading Standards would be interested? Or is there an Ombudsman to go to? With literally millions of accounts, this must be happening all the time. Ebay must be retaining millions of pounds under false pretences. Is it not the law you can retrun a faulty item bought over the internet, whether from ebay, or anywhere else?

    • Hi I stupidly left my handbrake off,  and my car rolled down a hill and into a fence owned by a company. I am a part owner of the company that owns the fence. My car insurance (Prima) states they won't cover the damage to the fence, just the car as they state  "you own the land', although I don't and I did make that clear to them when reporting the accident.. I understood a company is a separate legal entity, so should be considered third party damage and car insurance should cover? The property has a £400 excess and I'm already going to be paying out the £500 excess on car insurance, so want to avoid paying both if I can.. Thanks for any advice you can give...

Remember that, sadly, the vast majority of motorists who get these tickets think they are fines, that companies like ECP have some sort of official status, and give in and pay. They are just putting barriers in your way and encouraging you to fold. How about this as a reply - Dear ECP, Re: Subject Access Request PCN no.XXXXX I refer to my Subject Access Request dated XXXXX and received by yourselves on XXXXX. Thank you for your bizarre letter of 23 April.  Your letter requests Photo ID - which I have already sent to you.  The letter also requests proof of ownership of the vehicle - this is impossible to produce as the vehicle in question was on hire. In any case requests for proof of ownership are silly given your PCNs invite registered keepers to nominate drivers who do not own vehicles. I note all this concern for correct identity was absent when you decided to send letters threatening me with all & sundry if I didn't pay you money! The SAR was received on XXXXX.  I have already sent Photo ID.  The clock is ticking.  I am well aware that I would have the right to complain to the ICO and to sue you for not respecting your statutory duty should you not respect the 30-day deadline.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

I owe service charge backpayment to my management agent for my leasehold property.

 

They took it to county court,

then fast tracked to high court without informing me.

 

I only knew when I received a demand for £2100 from the Sheriff's office.

I offered to pay in instalments but they said their client wanted full payment, which I could not do.

 

I sent them a copy of my Debt and Mental Health Evidence Form, they said their client rejected it.

 

A Baliff visited my property when I was not in.

I submitted an income and expenditure form (both mine and my wife's)to the sheriff's office, which clearly shows a minus.

 

Even so I offered to pay £50 a month.

I have now had an email saying they will forward this to their client and if it is rejected I will receive a visit from the Baliff without any prior notice.

 

The amount has risen from £2100 to £3700 in just over 6 weeks, with interest at 41p a day.

There is also a charge for a Baliff visit that never happened.

I am worried sick.

 

Please, if you can, please advise.

I feel due process was not followed regarding the secrecy in taking this to court.

I suffer from depression due to my debt issues and this is really affecting me

theres no forced entry on these so called service charges debts

so quite honestly id not sweat about the bailiffs.

just don't entertain them

nor let them in whatever you do.

 

why did you not contest nor defend the CCJ?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Looking at what you have said above then there is one question to ask before trying to suggest what route to take over this.

 

Were you in a position to be able to pay what was owing in full?

I had no notification of it until I received a demand from the Sheriff'S office. I was not given an opposite to defend

 

No. I could, at that time made an initial payment of £500, but was told by the Sheriff 'S office that their client wanted payment in full.

 

I can fill out an N244 form, but I need help with that. If not successful the charges will increase

so you did not receive the claimform or any prior letters etc that they were taking you to court?

In my view Set Aside is not really an option as if you couldn't afford to have paid it you would have received a CCJ anyway.

 

What you can do is to apply for a Stay of Execution against the Writ the HCEO holds and also apply for a Variation Order whereby you can make affordable payments laid down by the Court.

 

I assume from your comments your income is limited meaning you should be able to apply for Remission of the Court fees.

Stay is definitely only option as advised above. A Stay will do just that Stay the execution of the writ. This gives time for you ato apply for a variation order. One thing to bear in m ind is that if you are still in the property further ongoing Service Charges will also be due and can you afford to pay them?

You have mentioned that this debt relates to backdated service charge for your leasehold property. I am assuming that this is the property where you currently live. If so, then I would have expected that the address on the claim form (and eventual judgment) would have been correct so it surprising that you had not known about the claim. Have you made enquiries as to the address where correspondence about this debt has been sent to?

 

You mention the you sent a Debt & Mental Health Evidence Form to the Sheriffs Office but that this was rejected by the client.

 

Where did you source this evidence form from?

 

What evidence did you provide regarding mental health difficulties? (for example, did you provide a letter from a Mental Health Counsellor or your GP?)

 

Lastly, you have said that following a recent visit, you have submitted an Income & Expenditure to the Sheriffs Office and that you have received an email back from them confirming receipt and advising that they have referred this offer to their client. This may result in the warrant being returned to the client.....its difficult to know so fingers crossed.

 

One last question, when the enforcement officer attended your address, would he have been able to identity any motor vehicles belonging to either you or your wife and if so, would the vehicles be of a high value?
