    • Today has been hectic so  have been unable to complete the whole thing. If you now understand it and want to go ahead with a complaint to the IPC, fine. If not then I won't need to finish it. But below is my response to your request  on post 64. No you don't seem stupid, the Protection of Freedoms Act isn't easy to get one 's head around at first. The part of the above Act referring to private parking is contained within Schedule 4 which you can find online under the Protection of Freedoms Act 2012. Section 9 of SCH.4 relates to how the parking scrotes have to perform so that they can transfer their right to pursue the keeper from the driver when the PCN is still unpaid after a certain amount of time. In your case the PCN was posted to you the keeper and arrived within 14 days from when they claimed a breach occurred. That means they complied with first part of the Act. The driver at that time was still responsible to pay the charge demanded on the PCN and PCM now have to wait for 28 days to elapse before they can write and advise the keeper that as the charge has not been paid, that they now have the right to pursue the keeper. They claim they sent the first PCN on the 13th March, five days after the alleged breach and it arrived on Friday 15th March. So to comply with the Act they have to observe Section 8 subsection 2f   (f)warn the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given— (i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid. ---------------------------------------------------------------------------------------------------------------------------------------------So the first PCN was deemed to arrive on the 15th March and for 28 days to have elapsed is when the time is right for them to write and say you are now liable as keeper. So they sent the next PCN on the 12th April which is too early as you could still have paid until midnight of the 12th. So the earliest their second PCN should have gone to you was  Saturday 13th April so more likely on Monday 15th April. The IPC Code of Conduct states "Operators must be aware of their legal obligations and implement the relevant legislation and guidance when operating their businesses." So by issuing your demand a day early, they have broken the Act, the IPC Code of Conduct, the DVLA agreement  to abide by the law and the Code of Conduct not to mention a possible breach of your GDPR .   I asked the IPC  in the letter on an earlier to confirm that  CPMs Notice misrepresenting the law was a standard practice for all of PCMs Notices or just certain ones. Their distribution  may depend on when they were issued and whether they were issued in certain localities or for certain breaches. Whichever method used is a serious breach of the Law and could lead to PCM being black listed by the DVLA . One would expect that after that even if the IPC did not cancel your ticket, PCM could not risk going to Court with you nor even pursuing you any further.

    • I lived there with her up until I gave notice. She took over the tenancy in her name. I had a letter from the council and a refund of the council tax for 1 month.    She took on the bills and tenancy and only paid the rent. No utility bills or council tax were paid once she took it over. She will continue to not pay bills in her new house which I'm now having to pay or will have to. I have looked online I believe the police and solicitors are going by the partner law to make me liable.   I have always paid my bills and ensured her half was paid then see how much free money is over.   She spends all her money on payday loans and rubbish then panics about the rent. I usually end up paying it or having to get her a loan.   Stupidly in my name but at the time it was because she was my partner. I even paid to move her and clean and decorate her old house so she got the deposit back. It cost me £3000 due to the mess she always leaves behind.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Not sure when I will se my advisor next, no appointments booked so just wait for a letter saying when to see her, keep my head down and keep applying and hopefully will stay on normal fortnightly sign ons for a while

 

 

not sure if I missed the new scheme, I read that at the moment it is only for people leaving the WP after april (I left in march)

 

 

job search not bad at the moment, quiet over weekend but have applied for 7 so far this week (couple of responses back)

 

 

how did your sign on go?

where they happy with everything in your work book?

yes they leave u alone if you finished wp before April and you just carry on with post work programme support but i have just read the guidelines on the gov website and it says candidates finishing work prog before april carry on with post work program support but after week 26 of post work program support your advisor can review your case and make a decision along with the manager weather or not to place you onto the new Help to Work Scheme

Im on week 31 of post work program support so it just a matter of time for me before they mandate me to that scheme - is anybody here actualy on the Help to work scheme?

I've been on the PWP since September last year, so that makes it about 36 weeks for me. So far I've been lucky in mainly only seeing decent, sensible advisers who can see that there's no point at all in sending me on worthless schemes which won't improve my employability in the slightest.

 

If the decision to mandate to Help To Work is purely a discretionary one by the adviser hopefully I won't ever have to go on it, but I'm not holding my breath. I'll certainly argue like hell if I'm ever put on the scheme but of course if it becomes compulsory after a set period then there's nothing I can do about it.

 

Anyone who is still on PWP, my advice would be to really show them you're doing all you can to find work and it might stop them putting you on HTW..if only for a while longer.

i will be put on the help to work scheme from the 20th of june as my adviser told me last month when u see me back on the 20th of june we will then decided what is best for u either daily sign on or a voluntary work but i can be sure i will be on the voluntary work scheme plus i cant see many adviser at the jcp actually wanting to sign u on daily am sure they will be wanting u out working do u not think?

 

as they wont cope with daily sign ons so to me its a waste even putting daily sign ons.

am sure u will get a job soon just keep going keep trying like am doing i had a interview today if i get it it will be bye bye job centre and hello to 40hours work.

Finished pwps in December 2013 and was put back on jsa 25+ with normal 2 week signing

 

does anyone know if i will be put on htw or put back on wp in december 2014

 

have to see advisor next week for first time in about three months

well thats the first time ive heard of sombody going from post work programme back to normal fortnightly signing on - Lucky You !

I don't think even the DWP or JC know what's happening - or when it's happening - or if it's happening! Keep your head down and you might get left alone, at least for the foreseeable future. I'm hoping for the same.

and me i just wish there was more full time job in my area also ones that dont involve commision based wages coz there loads of them advertised each week round my area

Same here. Employers now only want people when they want them; the days of the 'normal' permanent job are fading rapidly. When they started calling us 'Human Resources' instead of 'Staff' or 'Personnel' that was the beginning of the rot.

 

For myself, I'm sick of seeing vacancies which involve 15-20 seperate 'jobs' and for which they're only paying minimum wage. Most jobs usually involve doing more than was in the agreement and we all accept that, but what they expect from you now is just ridiculous.

 

Saw an admin job a while ago in which you were basically the only one left in the office during the day and had to run the place, sort out any problems, deal with customers, etc. I've done this kind of thing before and the correct title of the job should be 'Office Manager' - you're the only one there so you're effectively managing the office, right? - yet they had it advertised as only 'Admin Assistant' and for minimum wage.

 

I had an urge to email them and ask 'Pardon me, but if I'm the only one there all day, exactly who am I 'assisting'..myself?'.

They always claim even a p/t time job is better and have started giving the impression you won't lose out and should be happy you can still sign on and get JSA or whichever benefits you get

I rarely find a job thats over 36 hours a week every week thats not commission dependant an that arnt lookin for a list of qualifications as long as your arm

Looks like The help To Work Scheme hasnt started yet its set to start in the next 4 weeks as the companies who bid for the contract wernt told they would be given a contract by dwp until may and they wanted 6 weeks notice to start it up so your lookin it at things changing around 3rd or 4th week of june or even 1st week of july so keep your eyes peeled and your ears to the ground when visiting your jobcentre over the next month G4S, Learndirect and Seetec are 3 of the 6 companies to get the Help to work contract

I say name and shame them.

Once we know who these slave masters are we can boycott and bully them. Afterall thats what they are doing to us for the crime of being unemployed.

would this come from your post work programme coach or could it just be from anyone that signs you on?

 

will be your adviser not just a sign on person.

 

see in this work booklet for last time i signed on i put down i will sign up to more sites. can i put that down again this week?

 

as i have put down i will attend a interview and then put i attended my interview.

 

plus been told for my sign on make sure i put down what i will do for my next 2 weeks after this wed sign on day.

30hours community work placement and 4hours led jobsearch a maximum of 10 hours jobsearch must be evidenced and recorded must say am not sure how i will do 10hours job search when u will be doing 30hours work basically 40hours jobsearch and working all for a £50+ a week that is the worst part its not even a lot of money we get paid

will we still have to sign on during the cwp as we will probably be on the cwp monday to thursday for eight hours with a half hour break so 7.5 X four days = 30 hours

 

the supported job search will probably be on a friday for four hours where the provider could check we have done the ten hours and applied for jobs etc,

 

so thus would give us very little time to get to sign, Also this would be very similar to the old new deal work placement scheme which was for 13 weeks but no signing during that time.
