      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Why should we have a second referendum on the EU??

I wonder if you would be calling for a second referendum if the result was reversed ie Remain 51% and Leave 48% with a turnout of 72%.

 

I don’t think so, this petition is being put together because Leave came out on top in the referendum, people should get a life, and except the decision made by the people of this country.

Just thought I would give some first hand experience

 

If anyone has read the press reports about banks refusing sterling based transactions across the globe it is true.

 

I arrived in Lithuania today and both my partner and myself have had several different cards, credit and debit declined by ATMs although there are sufficient funds and some to cover the transaction.

 

Luckily I had some euros on me so all was not lost

 

Just a bit of first hand experience

 

Mind you the petition is causing a stir isn't it

Any opinion I give is from personal experience .

For anyone who thought that the Brexit 'politicians' were not aware of what would happen: it was made quite clear.

 

The reality check from End of Feb which clearly shows that Brexit claims that a renegotiation was possible or that an out vote would have the EU come running begging us to reconsider, was either lies or stupidity. I know which I think it was.

I voted remain. Told everyone I know who asked that I voted out again tho

 

Reason was simply that my area was the 2nd highest leave vote area in the uk

We're out now so EU rules don't apply anymore.

WE ARE FREEEEEEEEEEE!!!!!!!!!

We are not out and we will not be free in or out. We are used by the bourgeoisie if we like it or not.

 

I know many won't agree but Marx had some very valid points as did Durkheim and also Weber. We are controlled by the elite.

Labrat , you should have the courage of your convictions.

 

I have told my Facebook friends who voted out to bugger off and unfriendly me.

 

I can remain friends with people iof all political persuasions but people who cannot explain why they voted out other than immigration or more money for the NHS, both of which have been exposed as lies , well at the moment I have littlle time for them.

MP's might vote the budget down and this could lead to a vote of no confidence, which could lead to an early election. The Tories might not win such an election with a majority. A new government might well be forced to hold a further referendum or simply ignore the first result.

 

Labour will probably have a new leader by October. Corbyn was really in favour of Brexit, if you go by his reaction to the result. If Labour select the right person, they could be back in government by November.

Think you are so wrong. Even the Mail on Sunday have a number of articles pointing to what is already starting to happen. City of London finance centre will lose work and HM Treasury will lose tax income. That could mean an end to triple lock on pensions and tax increases.

 

I am no big fan of the EU as an instituition, but i realise that uncertainty is never good economically. It will wreck the UK economy for at least a decade.
