I parked a friends car in a private car park

 

 

crossed the road to the shop to get change for the meter

 

 

was gone less than 5 mins

 

 

when i returned the warden had just put a ticket on the car,

 

 

i explained what happened

 

 

he took the ticket off and said don't worry,

 

 

my friend then received a letter asking for £140.

 

 

they contacted the company ANPR Ltd gave them my details,

 

 

I then received a letter asking me for the money but stating they got my details from the DVLA

which is not true i am not the registered keeper of any vehicle so they wont have my info

 

Do i pay up or ignore it as other forums suggest

Can you post up a redacted copy of the letter you received?

 

 

From what you have said, your letter should be a Notice to Driver as your friend has named you as the driver...

 

 

What date was the parking incident? And what date did your friend receive the NTK?

- If you have multiple scans/pictures please put these into a WORD DOC first ensuring you have removed all Personal Information before converting to PDF.

if you dont have MSOFFICE, use openoffice its free and has a PDF converter.

- IPHONE ONLY: Take a picture and Convert to PDF via an APP

2. HOW TO EDIT (Remove Personal Information)

- Do this using MSPAINT.EXE or any Photo Editing program and ensure to save the document.

PLEASE TRY AND REFRAIN FROM POSTING FILES OF +1Mb in size

a single sheet of a4 should be about 50kb.

3. HOW TO CONVERT YOUR DOCUMENT TO PDF

.

- If you have OFFICE installed this has an installable PRINT to PDF option so use this and save as PDF.

- If you have PDF as an installed driver use this program and save as PDF.

- Click 'Go Advanced' below the msg box.

We need dates for the event, dates for the first communication to or by your friend and date you fist received a letter from them. All are extremely important as the parking co has to stick to strict deadlines for issuing notices otherwise they cant claim anything from anybody so tell us all.

the day I parked in the car park was 08/11/2014

date they wrote to the vehicle owner was 02/01/2015

date they wrote to me was 23/01/2015

heading on the letter is OUTSTANDING PARKING NOTICE not notice to owner or driver

As you identifed yourself (or have been identified by the RK) as the driver they have correctly written to you. The notice to keeper was in time.

Now, to appeal. Write to them saying that You went to get change for the meter and that as the prescribed fee was paid there has no been breach of contract and no loss to the company. Also say that if they do not accept this a being a valid reason then you require a POPLA code and you will complain to Patrick Troy at the BPA as the Code of Practice that they are supposed to adhere to has been breached.

Getting change is a valid reason for leaving a vehicle without purchasing a ticket, this is a simple matter of law and the parking co will lose when it comes to POPLA and legal arguments.

If they denied your appeal then go to popla using gpeol for a guaranteed win. Ignoring it is a bad idea

Are you able to post up photos of the signage at the entrance and within the car park ?

 

It would be interesting to see if a "grace period" is mentioned.

You have a limited time to do so otherwise you cant then appeal to POPLA

 

 

so write your appeal and dont worry about the detail.

 

 

just say no breach of contract as prescribed fee paid.

You have your popla code on the letter. You now send a proper appeal to Popla.

 

Post it up before you send it off.

MMM1 did post appeal letter and response. I had to unapprove as Popla code was left on letter from PPC.

MMM1- you received the standard N. Martin ' I personally know this site and talked to the issuer ' guff...

 

No where in the letter did it address your questions or even provide you with a fake GPEOL breakdown.

 

But they did issue a POPLA code for you to appeal to them, and it will get cancelled there, as ANPR will offer no evidence when you demand a breakdown of the Genuine Pre Estimate Of Loss that the charge must represent. Among other appeal points that you should use.

But your code has 15 days left ( I checked! ), so make sure you appeal in time...
