    • Replying to above  this was on the day that two store detectives approached me and my friend and took us into the back room and spoke to us when they explained they have been watching
    • as my learned friend above...and.. sadly because just like DCA's and initially yourself in this case, you believed they have some magical powers ...they DON'T. 85% of people blindly pay DCA's cause they know no better and think they are BAILIFFS. only the RETAILER can ever do court and none have done this on a silly member of joe public that did something stupid since the infamous 2012 Oxford case on retail loss. BAILIFFS can only ever be involved after you've been to court and lost a CCJ, fat chance re above... and anyway, no BAILIFF has any right of forced entry anyway on consumer debts even with a judgement so......... stop panicking and thinking everything that doesn't apply.. forget about them but p'haps a confidential GP visit might be a very good move... what slightly concerns me more here is:  who are 'them' that told you they'd reviewed a week of CCTV and come up with several shoplifting instances over that time amounting to the above? have you directly contacted or had contact from Sainsbury's? and know they HAVE done this? or is this DWF willy waving and they tricked you into  admitting several previous successful thefts... this is not the norm...  dx      
    • next step then await the N157 from her local court giving the time and date of a future hearing some month in the future. now she MUST file a witness statement 14 days (typically) to both the court and kearns .  so cant allow to much of a time lag before you are aware of that and get her WS done. wack us up 2 multipage pdf files please  one of what they returned for the CRP reply . and one for everything they sent back in 2022 you've found.  we do not need statements. ideally it would be nice to see their WS before hers is finally filed. dx

    • DWF can't do anything as they act for a client. In this case, Sainsbury's. Sainsbury's could take you to court and ATTEMPT to get a CCJ but it's unlikely. They had no interest in dealing with you at the time. All DWF can do is send out pointless threatograms. They'll threaten to divert an Iranian drone to your house if you don't pay. However, they can't attempt to get a CCJ against you. IGNORE THEM. It's more important now to understand why you were allegedly shoplifting, and you should speak with your GP and try and get yourself signposted to the support that's available.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Can I get taken to court over the same debt twice?

 

Have several debts, 2 with CCJ's but 6 years old early next year, paid monthly agreed amount but still balance will remain outstanding.

 

With regard other debts, again 6 years and older, they have now dropped off my credit report and all bar one have been sold to collection agencies....can they make defaulted again or take me to court to obtain CCJ? I paid monthly a small amount but have stopped since dropping off credit report.

It might be worth checking those debts without CCJs to see when the last payment was made to the account - if they have dropped off your credit file, then they cannot be restored.

have you sent all these people you pay a CCA REquest?

 

if they are that old that they've now dropped off your CRA file

then you can safely question their legality in the first place...

 

on the CCJ's you have

 

I hope you are ONLY paying the NAMED CLAIMANT

and not some fleecing DCA they have been sold on too?

and ONLY paying the amount PCM on the judgement too?

 

and no you cant be defaulted twice or get another CCJ on the same debt either.

I would CCA Cabot. They likely won't be the admin to the ccj, just to the debt, or hold the paperwork.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

no you keep paying if cabot are the named claimant

then as long as you are only paying the sum stated PCM on the CCJ you are fine.

 

have you ever looked at if PPI etc was involved?

 

might be something to reclaim here.

If Cabot got the ccj. Did you ever defend the claim or did they get judgement by default. I know its too late now.as.the ccj has been in force for so long but it looks like you've been cashcowed.

 

As DX said though, you need to maintain payments as directed by the courts. No more no less no matter what Cabot say or do.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi

 

CCJ secured in August 2007 for £5121 debt by claimant HFC Bank, payment originally to Restons and now to Mortimer Clarke for £5 per month.  Registered to an address that I left 10 years ago and moved twice since.  Paid every month without default.

 

CCJ secured in March 2008 for £8230 debt by claimant Cabot Financial (original lender HFC Goldfish Bank), payment to Cabot for £5 per month.  Again registered to an old address.  Paid again every month without default.

 

Both no longer appear on my credit file, although I do have a backdoor CCJ which falls off my credit file in March 2022 and I am making payments with no default.

 

I am now finally on top of my finances but not in a position to pay the really old CCJs off fully but at £60 per year in payment each they will be with me another 73 years and 125 years respectively!  

Aware I probably could of challenged but at the time was not in a place to.

Should I simply stop paying, the CCJs that have fallen off credit file

 

Should I advise them of new address?

As these are live CCJ debts, if you stopped paying they would trace you to new address, as difficult to hide and they would send enforcement agents out to collect.

 

I wonder whether you could try to negotiate reduced settlement of these.  Contact them to discuss stupidity of having debts which will take years to settle.  Ask whether they would accept a reduced a amount to settle these, if you could borrow a sum from family.  Perhaps 10% of debts value might be an opening suggestion.

Should I advise them of new address?

 

Is it possible to ask the courts to reduce the current CCJ on file payments inline with other ones not shown, as currently is significantly greater and would this not be a preferential debtor?

to send any 'enforcement' agents (bailiffs) a claimant must return to court.

inform everyone of your new address 

stop all payments

see what they do.

 

i seriously doubt anyone has any paperwork for CCJ's from 2007/8. esp a fleecing DCA that probably got it by default or skulduggery in the 1st place!!

You write use 2nd class post and get free proof of posting from any po counter then you have a papertrail

 

i doubt either will ever be aware a ccj even exists.certainly not the hfc one use the dca's ref number

Letters sent.

 

Any options to reduce current back door CCJ? I have paid for 4 years so not in position of strength I’m guessing.  It would help to get payment figure reduced though and more inline with other two.

By backdoor you mean a default judgment......who set the monthly payment rate ?

 

If the creditor and not the court you could consider submitting the following.....although the fee is £50 unless your exempt.

Paperwork was sent to an old address, I had moved twice since and not lived their for 6 years.

 

Amount was set by court at I assume claimants request but not 100% as didn’t see original paperwork.

Given that it is already 5 years old....I doubt its worth doing a variation....you could try to agree a lower payment with the claimant direct.
