    • Yup, well so far they have lied to me about responding to a CCA,  are threatening me with a default notice that they don't have, produced a knocked up version of my NOA, sent me 29 pages of spew for an agreement. No wonder they pay 5 p in the pound for that crap.
    • Paragraph 2. I think there should be further down and also you should make the point that the payment to was made unilaterally and without the imposition of any conditions. Paragraph 3 – this is unnecessary because you are not claiming as an entitled third-party. This worries me because it makes me feel that you haven't fully read around because this is a paragraph which you would include where you were suing EVRi as a beneficial third party because you had actually made your contract with Packlink or some other broker. I think you need to revisit and do some more reading. I'm afraid I have a sense that you have simply copied this from somebody else's witness statement without understanding that it wasn't necessary. Please can you post the amended draft. Other than the suggestions above, it looks okay – but let's see it again for a further appraisal. In terms of the evidence, parties bundle, I think it might be an idea to start off with the correspondence with EVRi and then go onto the other evidence. You will have to amend the index page accordingly. You could shorten this bit. Take 19 is pretty well blank and you may as well miss it out also, there seems to be some repetition of emails and the email chain. I think will be worth going through and getting rid of duplicates if you can. 49 pages is a bit long and it would be a good idea to try and reduce the number. I have a feeling that 50 pages as the County Court limit anyway. The judge will be happier with you if the bundle is smaller. Maybe you could reduce the size of some of the images or messages et cetera. You have got several messages which straddle onto a second page so that things like sign off information and standard confidentiality information become orphans. A bit of manipulation and they could be joined to their parents I think. Page 31 as an example. So is page 19. You may only be up to shorten the whole thing by 56 pages – but I think it would be a good idea. 56 pages is, after all, 10%. If you can do more then so much the better

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What good does daily signing do? if you're waiting for an hour, that's an hour gone for which you could be job hunting instead.

 

It seems to be an idea to anger people into quitting being on benefits only

What good does daily signing do? if you're waiting for an hour, that's an hour gone for which you could be job hunting instead.

 

The advisor i was with yesterday said, what the claimant has been doing for the 2 years at the WP is obviously not enough, they want to do an intensive job search with everyone for 14 days see what help they need if any to help propel them that much further. Its worth the hour or so taken out of your jobsearch daily according to them. If you was to ask me its more of the same except every day quick in and out they dont really have the time.

 

How can people afford to go and sign on every day?

 

You are entitled to every penny it costs to travel to a JCP office on a non regular signing on day. Get a day rider or your equivalent to get full value out of them.

For me it would cost me £3.75 each day just to get into town on the bus!

 

So that would cost me £18.75 a week and £75 a month! :-x

it wont cost you a penny as you can claim it all back.

When I did my CV thingy there was a 'bright young thing' who suggested if you are applying for 40+ jobs a month and not getting anywhere there must be major flaws in your cv.

 

She could not find anything wrong with my cv and got annoyed with me because I actually put things covering the unemployment period which were true. She constantly tried to suggest that it was lack of qualifications that was stopping me from working and was knocked down each time when I produced said qualifications she said I lacked (Customer Services, NVQ Level 3 etc) The only qualification I didn't have was a degree.

The poor thing clearly does not appreciate the jobs market or how to analyse the profile of candidates .... did the clerk that you were assigned to look as if (s)he was on an Unpaid Internship?

 

Perhaps if you see the clerk again, you could suggest that they go on a training course to acquire the skills and experience which would be required to become a Professional Careers Adviser.

i was told today the main reason for no responses was because when they look at my cv i have no recent work done on it and some companies are looking for people who have worked in last 3 months.

If HM Gov make claimants attend every day then the rules may mean that every day becomes a regular signing on day which a claimant can't claim fares for, IDS was asked if JCP claimants could claim bus fares back under these circumstances, he remained non committal.

I would LOVE to say this to my advisor she was so bloody rude to me on wed! 'Ur not doing enough, maybe u should do some courses and bulk up ur CV abit!'.

I dread going in Jobcentre every week and I'm getting ill with the DAM WORRYING that THAT day will be my last for jobseekers? :/ :???:

i was made rdundant 6th time 21 feb 2009 and if its voluntary thats whats it means so you cant be forced. when i asked if i could work for my dole voluntary they said no as you have to be available for work and interviews.

They were pushy about work experience with me as we'll but I felt like saying the best experience is a paid full time job

I think its part of their script - so much for treating people as individuals, plus they get paid by the month that you do forced labour I think

They decided I had enough work experience not to go on an 'enforced work placement' and I sidestepped their efforts at getting some voluntary work by getting involved in a group which suited my skills, and they got me an Enhanced CRB as well.

 

The WP programme tried to claim they did this but I was able to prove otherwise... same as when they tried to claim the money for getting me into short-term work, it was nothing to do with them,, an agency I had signed up for long before I was on the WP programme got me the position.

 

As I am still on the assessment phase of ESA I am not being pestered by the Jobcentre, I am however in almost daily battle with the local council (luckily their offices are a short walk from where I live).

 

Hope to have some more news on the next stage of ESA in a couple of weeks time when I need to get a new Fit Note from my GP.

just had a call from whichever co is dealing with my mandatory workplace. aske loads of questions and said i should receive letter early next week to say where the placement will be. i just hope its something constructive . been told it must be of some benefit to the local comunity. anyone been on one of the latest mwa yet and where were you put ?

Is this from the jobcentre? Did they give you a choice? Do you know much about the company contacting you?

The jobcentre refers you to the MWA provider and then the rest is up to the provider. You are given no choice in what they put you on. The providers are pretty much the same as the WP providers and the call will have been from one of those.
