    • Hearing held today in court. I attended in person and Evri had an advocate attend on their behalf to defend their position that my contract is with Packlink and not with them. I also provided a copy of Evri's terms and conditions which explains that a contract is entered into when a parcel is sent with Evri. The judge pointed this out to the Advocate and agreed there is a contract between me and Evri under the Ts and Cs. The judge explained that while Packlink are responsible for organising the delivery of the item, it is Evri who are responsible for handling the goods and delivering them, and therefor Evri has a responsibility to handle the goods with reasonable care and skill. So am pleased to say the judge found in my favour. Hearing lasted about 75mins. Evri has been ordered to make payment within 21 days. Also nice to meet @jk2054 in person.
    • Good morning,    I just wanted to update you on the situation.    I have visits piling up with my current employment and they need doing before I finish at the end of this month.  I am moving to Wiltshire in 3 weeks for a new job helping care homes with their Dementia patients. I tried to work it out and at a guess I will be doing about 20-25,000 miles a year. So need a vehicle that can cope with that mileage, my old car would have done it easy but 🤷‍♂️ I have taken out a loan and got a friend to find me a reliable car that can cope with the miles and hasn't been written off in the past.   I phoned Adrian flux to see if I could use the last months insurance on a new car I have bought, the girl I spoke to phoned Markerstudy and asked them but they said no, my new car doesn't have any modifications.    I had an email from someone who saw one of my appeals for information, they live near the site of the accident and know a nearby farmer who has a security camera at his entrance that catches the traffic and specifically registration plates as he has been robbed before. They said they would reach out for me and see if he still has the data. Unfortunately it wont catch the scene of the crash.   The Police phoned me and said they were closing the report I made, even if they found footage of the vehicle at the time I said the actual incident would be my word vs theirs.  My first response was I am sure google maps would show that they turned around at that location which would verify my version of events, but upon reflection I do understand, I have seen people doing make up with both hands while driving, eating from a bowl steering with their knees and veering all over the place. I am sure some of these people go off the road and claim that someone forced them off.    Markerstudy phoned me yesterday to say that my car is now at Copart, the £80 tank of Vpower diesel was emptied on entry to the site for safety reasons, which I get but it sucks.  It is awaiting being assessed and shouldn't be too long, which is a relief.  I am really glad things do not seem to be going the way of the other stories and they seem to moving quickly.   However I was informed that my car was a structural write off before I bought it - this destroyed me, I was almost sick.  and this is going to affect any offer of money - after hearing the first statement this didn't affect me.   They need to wait for the assessor to check it over but it is highly likely to be written off and the maximum they can offer is £2300.  I was desperate for a car as I was working for an agency at the time, no work no pay, and did not do a vehicle check because I didn't know about them.  The seller did not tell me that it had been structurally written off, he told me that it had the front wing damaged while parked and was repaired at an approved repairer.  Markerstudy records state that it was sold at auction, no record of repair at an approved repairer.  I bought it bank transfer with hand written receipt.    It gets worse.    It turns out my airbags should of gone off. For some reason they are not working. I think we can figure out why.  If I had hit that car head on and had no airbags.    Some good news.    I can arrange a time with Copart to go and take my stereo equipment and any personal items that are left in the car only. I cant live without music and need quality sound, my speakers and amps are Hertz and JLaudio, (no I am not a boy racer with booming subs, I am an audiophile on a budget) I was really worried I wouldn't get them back so this is a huge relief for me. It is stuff I have built up over years of saving and collecting. Everything to do with the vehicle and mods I have declared need to stay to be assessed.   The accident has gone as a fault on my record, I have to remove 2 years NCB which means I still have some to declare which is good.  So it appears at this point that it may be resolved quickly, not in the way I was hoping, but not as bad as I presumed it was going to be based upon that tow truck drivers attitude and behaviour and the horror stories I read.   I am not going to buy the car back and try to make money with all the parts on it, I don't have the time or energy.   I may need an xray on my back and neck.  The whole situation has left me feeling physically sick, drained and I need it done.   The lesson learnt from this  -  My conscience is 100% clear, my attitude to safety and strong sense of personal responsibility - A rated tyres even if on credit card, brake fluid flush every year, regular checks of pads and discs, bushes etc, made avoiding what I believed to be a certain broadside collision possible.   Get a dashcam (searching now for the best I can afford at the moment)  -  Research your insurance company before you buy  -  Pay for total car check before you go and see a car and take someone with you if you are not confident in your ability to assess a vehicle.      Thank you to everyone here who volunteers their time, energy and information, it is greatly appreciated.  You helped my sister with some advice a while ago but we weren't able to follow through, she is struggling with long term health conditions and I ended up in hospital for a while with myocarditis, when I got out and remembered it was too late.  I am going to make a donation now, it is not a lot, I wish I could give more, I will try to come back when things are on a more even keel.    Take care
    • It seems the solicitor has got your case listed for this “appeal” but not for the Stat Dec(SD). You need to ensure you can perform your SD on the day. If you are able to make your SD in court, the situation you are in now is more straightforward than if you made your SD via a solicitor. You have been convicted of two offences (and two were dropped) via proceedings of which you were not aware. The way to remedy that is to perform an SD. No appeal is necessary (nor is it available via the magistrates’ court). If you are able to make your SD this is how I see it panning out: You will make your SD to the court. The court must allow you to make it as it will have been made within 21 days of you discovering your convictions. You will then be asked to enter pleas to the four charges again. At this point you should plead not guilty to all four but make the court aware that you will plead guilty to the speeding charges on the condition that the FtP charges are dropped. The prosecutor will be asked whether or not this is agreed. In my opinion the overwhelming likelihood is that it will be. If it is you will be sentenced for the two speeding offences under the normal guidelines. In the unlikely event it is not accepted,  the speeding charges will be withdrawn (they have no evidence you were driving). You have no viable defence to the FtP charges and so should plead guilty. This will mean 12 points and a “totting up” ban (as you have already suffered). You can present an “Exceptional Hardship” argument to try to avoid this (explained below).   Because of this, I don’t see any need to make an argument to ask to have any ban suspended (pending an appeal to the Crown Court) unless and until you are banned again. The only reason I can think the solicitor suggested this is to secure a (Magistrates')  court date. I was surprised when you said you had an appointment so quickly; a date for an SD usually takes longer than that. However, if you can use it to your advantage, all well and good. I can’t comment on the argument that the two speeding offences were committed “on the same occasion” as I don’t have the details. That phrase is not defined anywhere and is a matter for the court to decide. It’s an interesting thought (and only that) that such an argument could equally be made for the two FtP offences. If the requests for driver’s details arrived at your old address at the same time, with the same deadline for reply, it could be argued that you failed to respond to hem both “on the same occasion” (i.e when the 28 days to respond expired) and so should only receive penalty points for one. Hopefully you won’t need to go there. I think you have information about avoiding a “totting up” ban. But here’s the magistrates’ latest guidance on "Exceptional Hardship" (EH) which they refer to: When considering whether there are grounds to reduce or avoid a totting up disqualification the court should have regard to the following: It is for the offender to prove to the civil standard of proof that such grounds exist. Other than very exceptionally, this will require evidence from the offender, and where such evidence is given, it must be sworn. Where it is asserted that hardship would be caused, the court must be satisfied that it is not merely inconvenience, or hardship, but exceptional hardship for which the court must have evidence; Almost every disqualification entails hardship for the person disqualified and their immediate family. This is part of the deterrent objective of the provisions combined with the preventative effect of the order not to drive. If a motorist continues to offend after becoming aware of the risk to their licence of further penalty points, the court can take this circumstance into account. Courts should be cautious before accepting assertions of exceptional hardship without evidence that alternatives (including alternative means of transport) for avoiding exceptional hardship are not viable; Loss of employment will be an inevitable consequence of a driving ban for many people. Evidence that loss of employment would follow from disqualification is not in itself sufficient to demonstrate exceptional hardship; whether or not it does will depend on the circumstances of the offender and the consequences of that loss of employment on the offender and/or others. I must say, I still do not understand what the solicitor means by “As a safeguard we have lodged the appeal and applied to suspend your ban pending appeal due to the time limit for being able to automatically appeal without getting leave of the Judge.” When they speak of “leave of the judge” I assume they mean they have lodged an appeal with the Crown Court. I don’t know what for or why they would do this. It seems to follow on from their explanation of the “totting up” ban. If so, I’m surprised that the Crown Court has accepted an appeal against something that has not yet happened. But as I said, i is no clear to me. Only you can decide whether to employ your solicitor to represent you in court. If it was me I would not because there is nothing he can say that you cannot say yourself. However, I am fairly knowledgeable of the process and confident I can deal with it. That said, I do have a feeling that the solicitor is somewhat “over egging the pudding” by introducing such things as appeals to the Crown Court which, in all honesty, you can deal with if they are required. I can only say that the process you will attempt to employ is by no means unusual and all court users will be familiar with it. I can also say that I have only ever heard of one instance where it was refused. In summary, it is my view that it is very unlikely that your offer to do the deal will be refused. If it is accepted, you may be able to persuade he court that the two speeding offences occurred "on the same occasion" and so should only receive one lot of points. Let me know the details (timings, places, etc) and I'll give you my opinion. Just in case your offer is refused, you should have your EH argument ready. Whether it's worth paying what will amount to many hundreds of pounds to pay someone to see this through is your call.  Let me know if I can help further.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I can confirm that if you have a problem with Parcel2Go then YOU HAVE A MAJOR PAINFUL PROBLEM. They are truly the most useless incompetent company I have ever dealt with.

I’m sure there are those of you who have used Parcel2Go and not had any problem with them and would say they are great. But I have learnt that you cannot judge a company until you have had a problem with them and then see how they go about resolving the problem. This is when you get to see if they really care about their customers and want to resolve things as quickly and as painlessly as possible.

I arranged a collection of a parcel from my place of work for the 18th January. It was collected. It hasn’t been seen since. As it was insured for only £20 (item worth £150) I didn’t bother putting in a claim for it as I hoped it would turn up one day and if you take the £20 you have no further claim to the item.

19/06/2012 (5 months later) I receive an email from Parcel2Go saying the parcel had been received at their depot and they want £6.50 + VAT for them to send it anywhere in the UK or they would destroy it. I phoned them on their rip off phone number 08713308066.I explained the situation to them about how I have already paid but the parcel has been missing so I should not have to pay again as you haven’t actually sent it anywhere yet. They said they would return it to me (the sender) free of charge.

25/06/2012 I receive an email from them again with a link to their website where I can pay the £6.50 + VAT for them to send it back to me. Taking slow deep breaths I phoned their rip off phone line and explained the situation again. I was told they are sorry and they sent that email by mistake and the item will be returned to me free of charge as already stated.

29/06/2012 Suspicious this company is in fact doing nothing to return this parcel to me I phoned their rip off line again to ask of the parcel status. After a long pause I am told they are waiting for the parcel to be collected and it would be collected within the next few days by Yodel.

04/07/2012 (today) Once again I phone to see what, if anything, this company has done to return this parcel to me. I was told I will have to pay £6.50 + VAT and they will send the parcel to me. With my chest about to explode and gasping for breath under the weight of the incompetence that this company dumps on my face I calmly restate everything that has already been said about my case and how I have been told 3 times now that the parcel will be returned to me free of charge. The guy on the phone tells me he will speak to the warehouse and phone me back within the hour. Obviously he doesn’t bother phoning back so I once again phone their delightfully helpful 0871 phone number and am told that a request has been put in for the parcel to be collected and returned to the sender and she can give me no further information at this time. I asked if she has a non 0871 number I could phone on in the future as I have had to phone them 5 times now and am still nowhere near getting my parcel back. Can you guess what the answer was?

 

Well I’m glad I’ve got that off my chest…..

 

So to sum up. Parcel2Go have had my parcel at their depot for 16 days now and even though they are “the biggest best most fantastic parcel company the world has ever known” they don’t seem to be able to arrange a simple transaction to have a parcel collected from their depot and sent to me. What an absolute joke they are.

 

If anyone is interested I will let you know when there is another exciting chapter to this riveting saga of mine. Basically I want to tell as many people as I can about what this company is like. They make it intentionally difficult to get in contact with then. They don’t even state their rip off 08713308066 phone number on their website. I had to find that on an online forum (full of unhappy customers). They prefer to hide behind their “Live Help” which really is an even bigger joke than speaking to them on the phone.

I would strongly recommend you look elsewhere for a parcel company. There is a reason why they are the cheapest….it is because they are the poorest quality. The cost of their insurance is incredibly expensive (more than the cost of sending the item in my case). I can recommend Parcel Monkey. I have sent about 10 parcels with them since learning about how Parcel2Go treat their customers. I haven’t had any problems with them and their insurance is far more reasonable. What they are like at resolving problems I am yet to find out.

Hi there. Another few phone calls and an email or two later and still nothing so I sent my pre action letter (edited copt below). They signed for this 01/08/2012. I'm going to give them till the 20th and then file a claim at my local court.

 

Dear Sir/Madam,

As it has not been possible to resolve this matter amicably and it is apparent that court action may be necessary, I write in compliance with the Practice Direction on Pre-Action Conduct.

17/01/2012 – I pay £7.10 to Parcel2Go.com for my parcel to be collected and sent to an address in Dorset.

18/01/2012 - My parcel was collected. It was not to be seen or heard of for 5 months.

19/06/2012 - I receive an email from Parcel2Go stating my parcel has turned up at the Parcel2Go depot and I needed to get in contact to arrange what to do with it. I am told if I don’t contact them within 3 days my parcel will be destroyed. I phoned Parcel2Go and explained the situation and it was agreed that the parcel will be returned to me free of charge.

25/06/2012 – I receive an email from Parcel2Go stating I will need to pay £6.50 + VAT to get it back. I phoned again and explained the situation again. It is again agreed that the parcel will be sent back to me free of charge and that the email I received was sent in error.

29/06/2012 – With no news I phone again to find out what is happening to my parcel and when will I get it back. I am told by Kirsty that the parcel will be collected in the next few days by Yodel and she can offer no explanation why it is taking so long.

04/07/2012 – With still no news or parcel I phone again and speak to Andy. He says I need to pay £6.50 + VAT to get it back. I explain the whole situation once again. He says he will phone the depot and see where it is. He assures me he will phone me back within the hour. He doesn’t bother. I phone back. I speak to Kirsty who says Andy has put in a request for the parcel to be collected and can offer me no further information at this time but will be in touch soon.

11/07/2012 – I phone again and Andy says he will phone the depot and see where it is and will call me back within the hour. Again he doesn’t bother phoning me back.

15/07/2012 – I email k.black(at)parcel2go.com explaining the situation and explaining that if Parcel2Go does not sort out this matter by 20/07/2012 then I will sue in the small claims court for full value and costs.

18/07/2012 – I again email k.black(at)parcel2Go.com to say that TNT has turned up at my place of work on the 16th, 17th and 18th to collect the parcel from me. I stated that Parcel2Go are the ones that are in possession of the parcel and they need to have it collected from their address and returned to me. I received a response the same day saying sorry for the confusion and that the parcel will be collected 19/07/2012 and returned to me.

 

I have received no parcel or any further communications from Parcel2Go. Either the parcel has been destroyed or Parcel2Go are just too incompetent to arrange for the parcel to be collected from their own address and sent to me. Either way I will be spending no more time or effort attempting to get this parcel returned to me.

 

I want Parcel2Go to pay me £165.00 to cover the value of the parcel content as stated when collection booked, postage fee paid and cost of phoning their premium rate “help” line 6 times. Please note that I am not claiming for lost mail, I am claiming for the fact Parcel2Go have my parcel but just will not or cannot return it to me for whatever reason.

 

I intend to rely on emails sent and received and phone records in my claim against Parcel2Go.

I can confirm that I would be agreeable to mediation and would consider any other system of Alternative Dispute Resolution in order to avoid the need for this matter to be resolved by the courts and would invite you to put forward any proposals in this regard.

In closing I would draw your attention to section II (4) of the Practice Direction which gives the courts the power to impose sanctions on the parties if they fail to comply with the direction including failing to respond to this letter before claim. I look forward to hearing from you within the next 14 days, should I not receive a response to my letter within this time frame then I anticipate that court action will be commenced with no further reference to you.

Would you believe after 7 ½ months of my parcel going missing, I finally get it back today. No comment or communication from Parcel2Go at all in regards to its return – it just showed up. Not that I am complaining because they could shower me with untold riches as a sorry for their dire lack of service and I still wouldn’t touch them with poo on a stick.

Thanks for your input. If it's OK with you I would like to copy and paste the info you have provided above to my thread on the MoneySavingExpert forum where I have posted the same story. There are a lot of people not happy with Parcel2Go there and I'm sure the info would be appreciated. I will give you credit and say you're from this site. Can you just let me know if that's OK?

 

It just goes to show that sometimes the pre action letter is all that is needed to get a company to sit up and do their jobs properly.

They are no better now.

Had a well wrapped parcel 'dropped off' - (literally ... it must have 'accidentally' fallen from a lorry tailgate height onto a concrete floor) and content was very severely damaged.

Initially the delivery company said they would deal with the claim.

Then a week later told me I had to deal with Parcel2Go.

 

Parcel2Go said sender had to claim (and I discovered their arbitrary 14 days to lodge claim were rapidly running out ... they did not tell me).

Could not contact eBay seller by phone ("THIS LINE DOES NOT RECEIVE INCOMING CALLS") but mysteriousely Parcel2Go claimed to have spoken to him on the phone ??

Parcel 2Go said claim limited to £50 - but as I was not the sender I had not seen this restrictive get-out term of course.

 

'Tough, that's all we are liable for.'

 

Took over claim from seller (just within 14 day 'limit').

Parcel2Go phone me and left a message saying they would call back.

 

THEY DID NOT BOTHER and I then went into hospital for a cancer op.

 

Now (recovered post-op.), using their near-useless website, I am finding it very hard to re-establish contact but I fully expect them to duck and dive as that is their way of working.

 

NEVER use Parcel2Go.

It seems the problems with this company are still ongoing. I wish I'd found this forum before I had anything to do with them. The fact is, I only found the forum because of the dealings I've had with this company.

 

I just don't know how they can be making any money at all when they treat their customers so poorly.

 

I was recommended to them by someone on Ebay. I purchased something off Ebay and wanted to return it as it was no good for me. The item wasn't that expensive but the Royal Mail wanted £7.50 to return it and I didn't see the point as it was 50% of the cost of the item. Parcel to go quoted £4.50 to return it so I thought I'm loosing less after I've paid for the return.

 

Trouble is I had to deliver the package to a pre-determined drop off point, a shop they say are agents. So I paid my £4.50 and took the item to the shop.

 

The man in the shop just looked at me and said NO. I said to him "No, what?" "I need to drop off this parcel" But he wouldn't even look at me, it just looked away and carried on watching the football. I said to him "excuse me, can you look at me please, I'm trying to ask you a question". He just screamed at me "I said NO now go away, get out, I'm fed up of this, I don't do the service, get out of my shop".

 

Now I might be wrong, but is it my fault that he's been incorrectly listed as an agent? Why did he feel the need to be so rude to me? I hadn't been rude to him, in fact, I'd said very little.

 

That was Monday. I then took the parcel into another shop, in North London, where I work. There I was told he couldn't take it because it had another agents no and pick up points details printed on the label. I explained to him that the information had been incorrectly supplied and the agent apparently wasn't an agent but he was adament that he couldn't take the parcel.

 

So here I am. Unable to drop a parcel off anywhere, I've paid my money to get the package delivered, but after reading everyone else's comments it doesn't look like parcels are being delivered anyway.

 

I shall be phoning the 01206 number tomorrow. Hopefully I'll get some answers.

I'd have been wary of the company just from its name.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Don't Parcel2go use various courier services (eg myhermes, tnt?) I am sure I have used them in the past and had no problems, I have however had problems with Royal Mail & City link etc, I honestly think alot of courier services are the same in most respects (useless!) and it's the luck of the draw alot of the time.

I have nothing but good things to say about this company.

 

1 - Always make pick up on time (Well the couriers)

2 - Every claim I have made has always been approved and paid out

3 - Next day upgrades when a collection has been missed.

4 - Refunds for mis-given labels (Wrong bar-code ect.)

 

I started using them two years ago when RM started ripping me off even more and never looked back since.

In ref to the above issues everyone is having with parcel2go I have had the same problems! If you are reading this thinking of using Parcel2go DONT they are one of the worst companies to deal with. they have lost my package with no explanation to what happened!. YOU can never talk to a person on the phone AS they HIDE behind live chat. The first package I sent through them got lost I spoke to them multiple times through live chat and was told they had logged a package trace through UPS I called UPS and they had no contact with Parcel2go I was told by Parcel2go to keep waiting everyday for another 24hrs they will not provide me with a shipping refund either until the package is located!! if you locate the package give it back to me and we wouldn't need to be having this conversation. the fact now looking back they don't have any contact numbers is a give away. Honestly with all the bad experiences people are having with parcel2go I would think twice before using them! as for the person above me that posted the bullet points about how good they are I wouldn't be surprised if that's a parcel2go employee trying to undo the bad press they are getting!

 

Also as for the 01204387098 number it just rings they never answer or have voicemail on the line either

 

WHAT A RIP OFF COMPANY !!! customer service is what makes a company they wont last too much longer!

Thank you for this detailed warning - I was about to use Parcel2Go, but was troubled that there were no contact details on web site - never a good sign! I will not bother to use them.

 

Hope your issue gets sorted fast, too many hassles generally these days
