    • Hi   Sorry I probably wasn't clear enough. He had lived in the flat until December 2022 with Dementia by this time it was unsafe for him to have capacity to live on his own and he had to move into a nursing home. We had left it too late to apply for power of attorney so approached a solicitor in March last year for Deputyship. We were still in the process of dealing with it by May 2024. He passed away a few weeks ago and the solicitor was contacted to halt the application and we will just pay the fees of what work he has done up until now. My wife was the named person on her dads bank account but we didn't have the ability to alter any direct debits hence the reasons for applying for Deputyship as we were having problems trying to stop some payments coming out of his account Eon being another difficult company. We kept his flat on from December 2022 - August 2023. it was at this point I contacted Sancutary housing to inform them he was no longer living in the flat, it had been cleared out and was ready for a new tenant and that he had Dementia and had moved into a nursing home December 2022 and explained the reasons why we kept it on. As the named person to speak on his behalf I asked them what proof they needed in order to give notice on the flat e.g proof of dementia and proof that he was living in a nursing home and anything else they wanted. The lady in the upstairs flat and some of the other residence in the street had asked about him and we had told them he had moved into a nursing home. The lady in the upstairs flat wanted his flat for medical reasons so asked us once we had given notice could be let her know and she'll ask them if she can have it. We explained the difficulties and it was left at that but I did tell her I would let her know once notice was given. I contacted the company by email a number of times and also telephone conversations and nobody followed it up and it wasn't till the end of February this year that the housing manager for the area wrote to our home address to ask about him that he had been to the flat a couple of times and nobody answered and he had asked some of the residence in the street and they hadn't seen him for sometime. There was an email address on the letter so I contacted him and copied in the last 2 emails I sent Sanctuary regarding me wanting to give notice on the flat for at least 9 months explaining that it went ignored as well as telephone calls. I also stated I wanted to have his rent payments returned from the date I wanted to give notice which was from August 2023 as the bank wouldn't let us stop the DD without POT or deputyship explaining we were in the process of Deputyship. He gave some excuse about not having POT to cancel on his behalf and spoke to someone in HR and said he would contact the nursing home to confirm he was there with Dementia and if it all checks out we can give notice on the flat which came to an end on the 22 March 2024. There was not mention of back payments for the rent already paid or the fact I had asked to give notice in August 2023. Despite someone living in the flat from 1st April they continue to take DD payments for the flat and have taken another 2 payments of £501. another concerning thing despite Eon not allowing us to cancel the DD to his account the lady upstairs informed Eon that she was moving into the flat February 2024 and Eon refunding the account to his bank and said in an email sorry you are leaving us and canceled his account. Something they wouldn't let us do but a stranger. She also changed her bank account to his address despite the fact notice hadn't been given on the flat yet. So we need to find out how much information Sanctuary actually had for her to tell her power company she was moving into the flat in February despite the housing manager only just getting in contact to find out where he was. So a complaint is going into Eon and Sanctuary and we are going to take advice and ask the bank to charge back the rent. My wife hasn't taken the death certificate to the bank yet to inform them of his passing.

    • Dave, You're probably thinking along the same lines as me. The NTK says "The reason for issuing the charge notice is: Parking longer than allowed" From memory, I think one of their stupid rules is that if 'Bucks is closed, you're not allowed to park at all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Though come to think of it, Ebay does actually offer a credit account for your fees if you register a credit card for payment of those fees.

 

(Ebay will take your account fees (listing and Final Value Fees) on a monthly basis direct from your credit card.

 

Ebay's User Agreement also restricts membership to over 18s.

 

NCO are pursuing this alleged debt on behalf of Ebay, who have either not told NCO to desist or because NCO's left hand doesnt know what the right hand has been told, and will continue to pursue until they again are told not to by Ebay.

 

It is Ebay that you need to contact, as they are the data controller.

 

NCO will not take a blind bit of notice of any template letter from here that that you send, claiming they are merely doing their lawful job on behalf of a client.

 

I went through something similar last year with Paypoo.

jesus NCO are a bloody nightmare.:evil: right as earlier in my posts i paid paypal, emailed them every flipping dept i could find.:rolleyes: sent cheque 20th march gone through my account today (my current account) but takes another 5 days before it reaches my paypal account!!! :evil: told paypal to call off NCO!!! did they NO!!! three calls today!!! have already sent harrassment letter. im getting well angry with nco and bllody paypal!!! NCO can sod off wont receive a penny from me! see you in court :evil:

Kimmy01 did they speak to you that's the question? I would love them to speak to me so that I can put the phone down on them. I guy phoned up twice in 45 minutes and asked for Heartlands Hospital. My daughter answered the first time and I answered the next time and when he said is that "Heartlands Hospital", I replied are you Heartlands, he laughed and put the phone down. I've just come to the conclusion that they haven't got a brain cell between them at NCO.

As bed32 has said, citing Trading Standards as a kniggit in shining armour with regards to NCO's breaches of the OFT's guidelines is simply holding out false hope.

 

Been there, done that. Had to carry out an unrelenting campaign of my own against Paypal and NCO myself to finally get Paypal to see that there was no debt to be collected and to get NCO off my back.

 

Was very, very hard work, with automated phone calls coming two or three times every day.

 

Even two months after Paypal finally realised they had been paid, the phone calls from NCO, demanding payment, stated again and I had to make the problem public by telling the World about it on Ebay's Postage and Payment forum.

 

Tell you what though- Paypal's liason rep reacted very rapidly when she saw Paypal's "Safe and Secure way to send and recieve payments online" nonsense exposed for the nonsense it is.

 

That would be my advice for you- go on to Ebay's P&P forum and slag Paypal, NCO and Ebay off to the roof tops. You will get a more helpful response that wat than from Trading Standards.

They rang again, and I asked them EXACTLY what the debt is for - and they said paypal-related ebay charges - a chargeback from a buyer to an account with your telephone number attached to it.. but not my address. Wtf?!

I asked them 'can you please give me more details about who the person you are trying to find?' and they just said sorry we cant give you any more information as you are not the 'account holder'. Agh bastards. I'll sleep on it and if they call tomorrow again I'll request information in writing and see what they say.

Then I advise you to call Consumer Direct (the point of contact for Trading Standards) and request that they contact NCO Europe with a demand to cease and desist, and to conduct any business in writing.

 

Cease and desist letters just encourage NCO.

 

Trading Standards? Dont make me laugh.

thanks guys for comments. sod paypal dont even want it anymore all this grief for £20.00.

 

will go on ebay p and p! and totally rubbish them :D

 

hubby spoke to them said i was seriously ill in hospital :p:cool: but fell on deaf ears! :o

 

sod them take me to court. but hubby getting annoyed about it now.

 

good thing. this site has made me a tigerrrr! last year would have been quaking in my boots re debt collectors.

 

gonna email every dept i can find with paypal and tell them to call off bloody NCO! :p

Wait just a (*(*&%(* minute.

 

My advice to contact Consumer Direct was given in the light of the following FACTS.

 

(a) lai1 said that he/she did not want NCO finding out the address and therefore a letter was out of the question. A letter giving no address is useless as they will (rightly) ignore it.

 

(b) I have been party to MANY threads on this site where Consumer Direct/Trading Standards have direclty helped by writing to organisations and getting them to back the hell off. When TS write to Wescot, for instance, Wescot sit up and take bloody notice. I see no reason why NCO would be any different.

 

© I stand by my comments regarding PayPal and EBay. Neither offer credit. They charge their fees directly to the funds source for the account at the end of each month in which fees occur. The fees are paid in full at the end of each month. The fees could not be charged anything other than in arrears as they cannot be quantified in advance. This is not credit, and you do not sign a credit agreement regulated by The Act - therefore they do not provide credit.

 

Now - if anyone would like to publicly challenge my knowledge on these subjects then let's have a good old fashioned argument in another thread for the purpose. BUT let's not confuse the very people we're trying to help by having a row about what is the best advice to give them. It's downright unhelpful to ANYONE reading this thread who will no doubt now be thoroughly confused about what the best course of action IS.

oh ive always been calm with PAYPAL AND NCO. it is rather annoying when its only £20 and its been paid NOW! omg another life :rolleyes:

 

i can never get through by phone so have to email paypal.

 

NCO shocking outfit. :evil:

Also , just noticed that they have added an online facility (free) to the 1571 answerphone service

 

It lists the number that called, date, time and duration and even gives you the option to save sound files of the messages to desktop

 

Particularly handy for me as I've had loads of messages left from one CCP that has completely failed to provide a copy of the executed agreement (not even an app form)

 

So as they in very hot water for attempting to chase this debt and I now have proof of each and every unlawful attempt that I can easily show to the court, I am rather chuffed with BT! (and trust me, I never thought I'd write those words)

Hello, I want to know if you have any jobs on the go. I am arrogant, loud, ignorant, abusive and love putting the phone down on my customers. Additionally, I am able to harrass, send pointless letters and intimidate members of my clients family. I understand that your policy is to call people and not say who is speaking...and when asked, to put the phone down on them and abuse innocent people upto as late as 9pm even though children are in bed.

 

I feel that I am most suited to this position because, like your other staff, I am a complete waste of space, have very little communication skills or qualifications and am desperate to earn pathetic wages for long boring hours being bossed around by gormless team leaders.

 

I hope you will consider me for the position of "Mr Telephone Caller" at your Preston office in the UK. I love Preston, it is such a fabulous bustling city with lots of fast food joints and loose women. I will fit in perfectly there.
