I can empathise with you going through something similar in our family but If you were feeling really malicious! you could always ring the local housing office up and advise them that your mother had passed away and that the property was empty. If its anything like our local council once you tell them someone is deceased they give you a week to empty the property. I don't know if all councils work the same but unless your name is on the tenancy agreement then the property does not automatically come to you even if you are residing in it. Hope this works out for you I know from experience what money does to some people.
  2. Just an update. Received the letter following our conversation and they are doing nothing wrong! Replied, then received a further phone call and they stated she has 2 options, pay £10 a month to have the account controlled or go back to a cashcard. I discussed this with her and she will have a cashcard. They gave me a number to ring, telephone banking, in order to do the change but they said she needs to go into the branch they can't do it there. Its a joke. She has incurred bank charges from 9/12 Feb of £46 but they are waiving these. So if they are doing nothing wrong why would they waive them? I spoke with her CPN about the situation and she said she has a lot of patients in the same boat and she has had to tell them all to go to the FOS. The thought of dealing with the FOS again fills me with dread just knowing how dire they are.
  3. I actually forward the CEO a copy of the original authorisation for me to deal with the account dated June 2007. It did state due to mental health problems. It was just after this time when Lloyds only allowed her to draw what was in her bank. This ws also the time whem I went to the MP as Lloyds allowed her a credit card which she couldn't pay. I complained to them at the time for allowing her to have a card given that she was only receiving benefits and it was clear she was struggling financially. My complaint was upheld and they wiped the debt off plus she had all her bank charges refunded. According to the call today there is no marker on her account and they said they were unaware of any special circumstances.
  4. There is no overdraft allowed on it. I remember many years ago she asked for an overdraft and she was turned down.

Thank you oleg, I can understand what you are saying and one of the many underlying issues she has is the lack of concentration and has difficulty in taking in what is told to her this is why I manage her affairs and why TSB allowing her to overdraw is creating a problem because I don't know what she is spending until it appears on her statement. She does have a CPN and I have discussed this matter with her and she was going to try and discuss the importance of budgeting with her.
  6. Thank you for your response. She had a pyschotic breakdown in 1996 at 25,since been diagnosed with schzophrenia and depression and basically lives in her own world. She has no concept at budgeting. What is really annoying is that when Lloyds and TSB merged I had already involved MP and FOS and reclaimed charges and they did stop her overdrawing. The situation has come about because of the change back to to TSB. I'm just amazed that they won't stop the overdraft now they've been told again. I did tell them that I had every intention of continuing with complaint to the FSA and FOS as I believed she was not being treated fairly. This I have evety intention of doing. I've just checked her account now and they have repaid the latest charges. However, this really isn't the issue, I really need them to stop letting her use the card if funds aren't available. Would it be worth complaining about this to the FSA? Many thanks
  7. They did say they would put the conversation in writing so will wait for that but I really wanted clarificaation on whether they should be allowing soneone to overdraw on a basic account without an authorised overdraf.
  8. I emailed the CEO originally quoting BCOBS who passed the matter to his executive team hence the phone call this morning. I was told that BCOBS didn't apply because it was in their t&C's.
  9. My daughter, who has mental heatlth problems, recently discovered that she has been able to use her debit card and go overdrawn although she does not have any authorised overdraft. Therefore, charges are being incurred. I have today had a conversation with one of the executive team who have said that it is in their T&C's that if a Visa Card is presented for payment then they will honour the payment. I thought the whole idea of having a bsic account with no overdraft facilities was to avoid this situation arising. She only receives benefits so I was disgusted with TSB today that they are not prepared to stop the overdraft situation. Their only offer of help was a Cashcard. Before I start complaining to the FSA and FOS I would like to make sure of my facts. Would welcome advice on this situation please.
  10. May I suggest that all those having problems with any bingo site that they write a review on Which Bingo Alll sites are listed and you can write a review be it a good or a bad experience. There are other similar stories concerning this group. I have previously used Which Bingo to check on sites and I was glad I did. Good luck .

Forever, sorry I cant help you but I would start a new thread as you have resurrected an old one and it would be better for you to give more details. ie: when the card was taken out, the amount owing, when CCJ was given, did you defend, etc. probably many more questions to follow. Someone then with more experience will see this then also head it something like help required with CCJ/Charging order so that it gets the right help for you. Good luck.
  12. Absolutely agree with you after 21 years and no other criminal records you would think anyone should be able to put that behind them. Thank you for your advice, this is very much appreciated. She is going to try and get them expunged and I will advise her about obtaining a basic one.
  13. My daughter is a limited company and as such she can apply for her own CRB check but the CRB said her job didnt come under this. They had a copy of the JD at that time. I have a copy of the CRB Report that came and it clearly states on it "Standard Disclosure" and they have listed the convictions. Her job does not involve interviewing, she is an Assessor. The contract was placed with the agency to cover maternity leave. I personally believe that the CRB should not have sent this report out. I have seen on this site people questioning whether convictions would be listed on a CRB check and the advice I have seen is that shoplifting for instant over 7 years would not appear, I think peeps should be aware that this may not always be the case. Thank you for all the replies so far, and I have to say a lot of them have been similar to my own opinions. Apart from the CRB report I believe they have been over zealous.
  14. They never actually said that, they said because of the CRB check they had to let her go. Whilst I do agree with you it was never intended as a lie because she has always believed that they never existed because of the length of time.
  15. First of all this was a standard CRB check. Secondly, her Agency advised her that Housing Benefit does not warrant a CRB Check and thirdly she does not do home visits. Purely employed on an assessing basis.
  16. Apparently the one was spent after 5 years and the other for 7 years but according to WM Police they stay on your record for 100 years!
  17. Sorry in advance, but this will be long, but I will need to furnish all the information. This is on behalf of my daughter. She is a self-employed Housing Benefits Contractor and obtains work through appointed government agencies and for 15 years has had regular local authority contracts. In December 2011 she was approached by an agency on behalf of one of their clients with an eleventh month contract Jan 2012 to Nov 2012. She jumped at this as they are hard to come by. 3.1.12 started at X Authority 4.1.12 completed an CRB application. 15.2.12 copy of CRB check report arrived which noted 2 offences from 21 years ago - shoplifting suspended sentence, receiving stolen goods suspended sentence. 22.2.12 Called into the office by line manager who advised her because of the CRB Report they were having to let her go. Obviously she was mortified. Several issues seem to have arisen here as I have been researching since this time. In 2007 my daughter being self employed requested a CRB for herself and was told by the CRB that her job did not warrant it under Rehabilitation of Offenders ct 1974(exceptions) order 1975. On this basis I wrote and complained to the CRB and requested why they issued a report to X Authority when the job didn't need one. They have responded, this is a brief extract. "The role of a Benefits Officer would not appear to meet any of the aforementioned criteria; therefore would not appear to be legally entitled to be checked. A CRB check should only be requested by an employer when the role meets legal entitlement for a check. The individual and the employing organisation should be sure that a CRB check is warranted for the role". My daughter was foolish to sign the form having already been advised that the job did not require it, but she was so keen to get the contract she didn't want to make waves so as to speak. She did actually tick the box where it says no convictions, she said never thought that they would now be on her record. She has been to see her MP as she believes that as these are government departments he would help. No he will not get involved told her to go to Citizen's Advice. For me the issues emanating from all of this are a) Why did the CRB send the report knowing Housing Benefits were excluded? b) The LA have obviously lied by applying for a CRB check has they should know it doesn't warrant one c) Both convictions were over 21 years old and spent, so is she not being descriminate against, along with others that may have fallen foul over the years? d) Should Human Resources have passed such information to a line manager, should they have not dealt with this themselves? Have they broken DPA by this action? I have written to HR who advised me that they do not deal with agency staff thats why it was passed to a line manager, in which case, why did they do the CRB check and not ask the Agency to do it? My daughter understands from the Agency that when the LA terminated the contract they were told to ask her why she was terminated. Incidentally, this contract was not advertised as the team leaders at X Authority knew my daughter from previous contracts so knew her work ethic. What she is really concerned about it is because this LA share information with other LA's it may prevent her from getting contracts there in the future, two of these are already regular contracts. Any advice on how to proceed further would be greatly appreciated.
  18. yes, her new rate from 12th April is £178.00 per week. I presume they must have had her medical reports and she has been in and out of hospital since 1996.
  19. The letter says that if she wants to work voluntarily she can and go to see the disability adviser. There is no need for her to seek paid work. So presumably she must be back on what was the old income support benefit.
  20. Just an update on this. My daughter had infact telephoned to cancel her appointment. A few days later received a letter from DWP stating that her benefits wouldn't be affected but should she fail to turn up to the next appointment then benefits would be stopped. She had not heard anything further until today when she received a letter from the DWP advising her that they would be backdating payments and advising her of her new rate of pay from 12th April. So obviously have put her back on supported benefits. This is good news. Thank you for your kind comments and support.
  21. Thank you Joe. You have just jogged my memory. In actual fact my other daughter applied to be an appointee but nothing has been done about it, will follow this up now. They both went down the JobCentre prior to Xmas and because they hadn't made an appointment the letter had to be posted, I know they received it as her current medical certificate was with it.
